Abstract

Article 9 Paragraph (1) of Law No. 31 of 1997 concerning Military Justice states that the military justice system has the authority to try criminal acts committed by a person who at the time of committing the crime, firstly because the subject is indeed a soldier; secondly because the subject can be equated by law as a soldier, and thirdly can also be a civilian because the decision of the Commander in Chief with the approval of the Minister of Justice must be tried by a Court within the military justice system. Meanwhile, in Article 5 and Article 6 of Law No. 46 of 2009 concerning the Corruption Court, the Corruption Court states that the corruption court is the only court that has the authority to examine, try, and decide on corruption cases whose prosecution is submitted by the public prosecutor and is emphasized in Article 6 of the Corruption Court Law that the corruption court in its authority examines, tries, and decides on special cases in corruption cases; money laundering crimes whose original crime is a corruption crime; and/or crimes that are expressly determined in other laws as corruption crimes. Looking at the provisions of the formulation of the two articles, it is not impossible that there could be a clash of authority if a TNI member commits a criminal act of corruption, whether it is the authority of the military court because it looks at it from the subject's side or it is the authority of the corruption court because it looks at it from the side of the crime committed, considering that the two courts are both special in terms of material and formal law. This research is of a normative juridical nature which uses a statutory approach, as well as a conceptual approach, where the results of this study show that if a criminal act of corruption occurs involving the TNI, based on the principle of lex specialis systematica (the specialness of the special), the TNI who commits a criminal act of corruption will still be tried and subject to the military court, and processed in accordance with the procedures in Law No. 31 of 1997 concerning Military Justice.

Abstract

Land has a very important position in human life which can be seen because of the fact, namely it is used as a place to live, a place to be born, a place to earn a living, a place to be buried, and also as a place for ancestors. Therefore, every land must have legal certainty and certainty of rights for its owner, so that there are no disputes over land rights. Efforts towards legal certainty in terms of obtaining land ownership rights are stated in Article 19 of the Basic Agrarian Law Number 5 of 1960 concerning Basic Agrarian Principles which requires the Government to carry out land registration and land certification. The goal is that parties who wish to obtain land ownership rights can easily find out the status and area of the land they wish to own, or that has been owned for certainty of rights in order to avoid land conflicts and disputes. This study uses a descriptive analytical research method that describes facts in the form of secondary data consisting of primary legal basic materials (legislation), secondary legal materials with a normative legal approach, namely a method that uses secondary data sources, namely laws and regulations, legal theories and opinions of scholars, which are then analyzed. Based on the research results, it was found that problems often arise such as negligence by land buyers who control land plots only by holding a Deed of Sale and Purchase as proof of ownership of land rights, without going through the administration of land ownership certificates at the land office. Thus, the legal analysis carried out by the Author in this study is to review the extent of efforts to resolve land ownership.

Abstract

Emotional intelligence (EI) has an important role in improving the quality of nursing care and nurses' emotional well-being in the clinical environment. EI enables nurses to effectively manage emotions, show empathy, and make appropriate decisions in stressful situations. This article aims to explore and analyze the role of EI in nursing clinical practice using the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) method. A literature search was conducted in electronic databases such as PubMed, Scopus, and CINAHL using the keywords “emotional intelligence,” “nursing practice,” and “clinical nursing”. Inclusion criteria included articles published within the last 5 years, focusing on EI in clinical nursing practice, and using quantitative or qualitative methods. Of the 150 articles identified, 25 articles met the inclusion criteria and were analyzed in depth. The results of the review showed that EI contributes significantly to improving therapeutic communication, effective decision-making, and emotional resilience in the clinical environment. Nurses with high EI are better able to cope with work pressure and have lower levels of burnout. Nonetheless, EI training in educational and clinical settings is still limited, and the integration of EI in the nursing curriculum requires a systematic approach. Conclusion EI development among nurses is very important.

Abstract

This study explores the syntactic and pragmatic roles of particles in the Makasae language, focusing on sentence-final particles such as “di,” “ara,” “gau,” “apa,” and “tai.” Using a qualitative descriptive approach, data was collected through semi-structured interviews and elicitation tasks with native speakers. The data analysis utilized descriptive, pragmatic, and comparative methods to examine how these particles contribute to sentence meaning, particularly in terms of commanding, questioning, emphasizing, and negating actions. The findings reveal that "ara" marks imperative mood, while "di" adds emphasis or negates actions. Particles "apa" and "tai" are used to form yes/no questions, with "apa" typically indicating general questions and "tai" used to inquire about specific actions. Additionally, "gau" helps specify the object of the action in both commands and questions. The combination of "di" and "ara" intensifies the imperative, adding force to commands. These particles play a critical role in structuring communication, allowing speakers to convey nuanced meanings in various contexts. This research contributes to a deeper understanding of the functional versatility of particles in Makasae, offering valuable insights into their syntactic and pragmatic use. It also sets the stage for further research on the linguistic structures of Timor-Leste’s indigenous languages.
