Abstract

In practice, Notaries/PPATs often act as intermediaries for depositing BPHTB payments to facilitate the process of transferring land rights. The problem is that several Notary/PPAT individuals often abuse their authority in the realm of unlawful acts in carrying out their office in paying BPHTB Tax. This type of research is Normative Juridical. Based on the results of the discussion in this paper, the consequences of unlawful actions by a Notary in terms of reducing the land transaction price below the market value price by collaborating and providing compensation to other parties carries criminal and administrative sanctions. The conclusion from this discussion is that Notaries are responsible for helping clients pay BPHTB, not abusing their authority by lowering transaction prices and providing compensation to unscrupulous state administrators, thereby causing losses to the state. The legal consequences received by Notaries who abuse their authority are subject to criminal and administrative sanctions against their position. The unlawful nature of the criminal law alleged against the notary is stated expressively verbis in the formulation of the offense as having consequences as an element that must be and. Acts against the law can be used as a basis for criminal liability by fulfilling the formal and material elements that form the basis for criminal acts in BPHTB practice.

Abstract

Masalah narkoba di Bandar Lampung khususnya di kalangan remaja masih tergolong darurat. Terbukti dengan semakin banyaknya penyalahguna atau pecandu narkoba, bahkan dikalangan anak muda, seiring dengan meningkatnya pengungkapan kasus kejahatan narkoba, polanya semakin beragam dan jaringan sindikatnya semakin masif, hingga polisi yang bertugas menegakkan hukum, ada adalah individu yang menyalahgunakan jabatannya untuk menjadi pengedar narkoba. Masyarakat Lampung saat ini dihadapkan pada situasi yang sangat memprihatinkan akibat maraknya peredaran gelap narkotika. Keprihatinan ini semakin menajam akibat maraknya peredaran gelap narkotika yang telah menyebar ke seluruh lapisan masyarakat, dari kalangan bawah hingga kalangan atas, bahkan generasi muda. Hal ini akan sangat mempengaruhi kehidupan bangsa di masa depan. Perilaku sebagian remaja yang mengabaikan norma dan hukum yang berlaku serta lingkungan pertemanan atau pergaulan menjadi salah satu penyebab maraknya penggunaan narkoba di kalangan generasi muda. Dalam kehidupan sehari-hari masih banyak remaja yang masih menyalahgunakan narkoba, penelitian ini menggunakan pendekatan masalah yuridis. Adapun jenis dan sumber datanya terdiri dari data primer yang bersumber dari lapangan, berupa wawancara dengan Kepala Humas Narkotika BNNP Jateng. Berdasarkan hasil penelitian dan pembahasan yang telah dilakukan penulis, dapat disimpulkan bahwa peran Badan Narkotika Nasional dalam penanggulangan tindak pidana narkotika adalah sebagai pencegahan, pemberantasan penyalahgunaan, peredaran gelap narkotika (P4GN) dan juga berperan sebagai berperan dalam melakukan penyidikan, penuntutan, dan pemeriksaan penyalahgunaan narkotika. kelas 1 oleh anak-anak.

Abstract

Advancements in health law mirror the progress made in health science. Presently, health law holds significant weight in addressing diverse challenges and legal matters within the health domain. Conversely, amidst the evolution of increasingly sophisticated technology, traditional medicine has garnered diminished attention. Yet, within the context of Indonesia's efforts to ensure the right to health, traditional medicine ought to be a crucial alternative to be acknowledged. This proposition finds support in Indonesia's rich natural environment, which boasts abundant biodiversity, including numerous plant species with potential applications in traditional medicinal practices. Consequently, ensuring legal safeguards for traditional medicines from the perspectives of both health law and intellectual property law becomes paramount. The research methodology adopted in this study is normative research, centered on the conceptualization of legislative principles or norms serving as the foundation for human conduct. The primary objective is to scrutinize the Legal Protection of Traditional Medicines within the framework of Health Law and Intellectual Property Law in Indonesia.The study's findings revealed that while Law No. 17 of 2023 does not explicitly delineate traditional medicine, it equates the term with "Natural Medicines." Article 321, paragraph (1), classifies natural medicine into distinct categories such as herbal medicine, standardized herbal medicine, phytopharmaca, and other natural remedies. The legal coverage for traditional or natural medicines is stipulated in Articles 324-325 of Law No. 17 of 2023 on Health. Conversely, within the Intellectual Property Rights (IPR) context, protection for traditional medicines is encompassed within the patent system, as outlined in Article 26 of Law No. 13 of 2016 on Patents.Keywords: Health Law, Intellectual Property Law, Patent, Traditional Medicine.

Abstract

Beberapa tahun belakangan ini, perkawinan yang dilakukan banyak mengundang perdebatan publik, salah satu nya adalah perkawinan sejenis. Perkawinan sejenis yang juga dikenal sebagai pernikahan sesama jenis semakin populer di berbagai negara di seluruh dunia termasuk di Indonesia.Metodologi penelitian hukum normatif menjadi metode pada penelitian ini, dengan tujuan untuk menemukan dan mengembangkan argumentasi hukum melalui analisis materi dan pemeriksaan prinsip dan asas-asas hukum yang berlaku.Hasil penelitian ini adalah perkawinan sejenis sudah dipastikan tidak sah baik di mata hukum maupun agama. Jika suatu perkawinan tidak memenuhi syarat maka perkawinan tersebut harus dibatalkan, meskipun hukum progresif sejatinya mengharapkan hukum dapat berkembang sesuai zaman tetapi perkawinan sejenis tetap tidak dapat dilakukan karena tidak sesuai dengan UU Perkawinan maupun kepercayaan serta agama bangsa Indonesia. Perkawinan yang tidak diakui secara hukum sebagai Perkawinan dapat dibatalkan mengingat menurut Pasal 1 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan mengatakan Perkawinan adalah ikatan lahir batin antara seorang pria dengan seorang wanita sebagai suami-istri. Di Indonesia pendukung sesama jenis terlibat dalam perilaku menyimpang menurut nilai-nilai agama dan keyakinan bangsa.

Abstract

Informed Consent is an important thing in medical services, recently there have been cases of  problems that start from the incompatibility of Informed Consent with factual actions carried  out by the hospital. This has been explained in Jo Law No. 44 of 2009 concerning hospitals  Article 37 paragraph 1 which states that every medical action taken in the hospital must obtain  the consent of the patient and his family. The purpose of this article is to analyze the Informed  Consent Relationship between Doctors and Patients Legally in the Application of Cardiac  Surgery Techniques in Indonesia and to analyze the Application of Informed Consent in the  Application of Cardiac Surgery Techniques. The method used in this research is the normative  juridical method. The normative juridical approach is carried out by conducting a study of the  principles, regulations and legislation in force with regard to the legal issues to be discussed.  The results of this study are the existence of an informed consent relationship between doctors  and patients and the application of informed consent in heart surgery in Indonesia.

Abstract

In a nominee agreement on land ownership by foreigners in Indonesia, the objective requirement is a cause what is halal is not fulfilled, it will result in the agreement becomes null and void by law. It means from the beginning of an agreement and/or an agreement thought to have never been born/never existed. Article 1335 of the Civil Code states that a an agreement made under false pretenses or forbidden has no power. In this case, the agreement was deemed to have been void from the beginning because not all agreements made have binding force as law.

Abstract

Export and Import is one of international relations in the field of trade. Various export and import commodities have been regulated in clear regulations. However, there are still commodities that have actually been banned from being imported but are still being carried out. One of the Minister of Trade of the Republic of Indonesia Number 51/M-DAG/PER/7/2015 concerning Prohibition of importing Used Clothing. The domino effect is that the more people buy used clothes, the local fashion industry will be shaken. As one of the Government Agencies participating in the effort to eradicate the smuggling of used clothing and the public should not be easily placed by the import price of used clothing which is cheaper than local clothing, because the level of health is not necessarily guaranteed.Keywords : Impact, Import, Use clothes

Abstract

This research examines the dispute resolution model concerning cases of union busting in Indonesia and the United States. Dispute resolution is crucial in the context of global industrial relations, considering the differences in legal systems, cultures, and labor policies between the two countries. Through a comparative legal approach, this article analyzes the legal framework in Indonesia and the United States related to union busting. Dispute resolution models, including mediation, arbitration, and litigation, are explored to understand their effectiveness and challenges in each legal context. The study employs references from labor laws, government policies, and recent legal cases to provide deeper insights. The results of this research are expected to serve as a foundation for improving and harmonizing labor dispute resolution systems in Indonesia and the United States, aligning with global efforts to enhance worker protection.

Abstract

Foreign investment in Indonesia has been on the rise in recent years,  with many investors seeking to establish a Limited Liability Company (LLC) as  their preferred legal entity. This research aims to examine aspects of determining  the personal status of a legal entity, which is an LLC for foreign investment. The  personal status of an LLC in Indonesia refers to the legal recognition given to the  company as a separate entity from its shareholders or owners. The study explores  the complex legal framework and regulations governing foreign investment in  Indonesia, with a focus on the unique characteristics and considerations associated  with LLCs. Through a comprehensive analysis of relevant laws, policies, and  practical implications, this research aims to provide insights into the challenges  and opportunities faced by foreign investors seeking to establish LLCs in Indonesia.  The research findings are expected to contribute to a better understanding of the  personal status of LLCs in the Indonesian legal system and facilitate informed  decision-making for foreign entities navigating the complexities of the investment  environment in the country.Keywords: Personal Status, Limited Liability Company (LLC), Foreign Investment

Abstract

In the implementation of the General Election in Indonesia, there are several legal instruments that regulate the types of violations of the Election law. This type of violation becomes an interesting discussion to discuss because if the candidate participating in the election is proven, the sanction is disqualification. Bawaslu has the authority to handle election administration violations by structured, systematic, massive. In the handling process, the Bawaslu Commissioner acts as a panel of judges. The process of recruiting Bawaslu Commissioners is not oriented as a panel of judges in conducting trials, but as a supervisory institution in the administration of elections. So that there is a shift in the function of Bawaslu not only as a supervisory institution but into a judicial institution. Constitutionally, Bawaslu is not an institution of Judicial Power. So, in the Judicial System paradigm, this has the potential to reduce the quality in deciding alleged violations of the structured, systematic, massive election administration. The problem in this research is how is the concept of election administration violation by structured, systematic, massive in Indonesia? And how is the concept of handling election administration violations in a structured, systematic, massive manner in accordance with the framework of the judicial system in Indonesia?This research method uses a normative juridical approach, with secondary data as the main data type. The data collection method was carried out by means of a library study of relevant primary, secondary and tertiary legal materials. Furthermore, data analysis was carried out using descriptive analysis method.The conclusion of this study states that the concept of election administration violations by structured, systematic, massive in Indonesia is one type of special election administration violation with the handling authority owned by Bawaslu. The concept of handling election administrative violations by structured, systematic, massive which is in line with the framework of the judicial system in Indonesia, namely through a special election judiciary that administers justice with an ad hoc panel of judges for handling structured, systematic, massive violations of election administration in Indonesia.Keywords: Reconstruction, Election Administration, Judicial System
