Abstract

This study aims to examine the influence of budget participation on managerial performance, with the roles of organizational commitment and delegation of authority as intervening variables. Three research hypotheses were tested using SEM PLS. The population in this study consists of all officials, including directors, marketing and registration managers, learning and examination service managers, registration, examination & learning coordinators, and administrative staff within the Open University, particularly in regional offices in Indonesia. A sample of 147 was tested. The results support two hypotheses: (i) Budget participation has a significant effect on managerial performance, and (ii) Budget participation significantly affects managerial performance through organizational commitment. However, the hypothesis testing the effect of budget participation on managerial performance through delegation of authority was not supported. This study emphasizes the importance of budget participation and organizational commitment in enhancing managerial performance, as well as providing insights into factors that do not have an impact in this context.

Abstract

The deed of statement and deed of power of attorney made by a notary must be based on the principle of fairness. The principle of fairness emphasizes that every activity of the government or state administration must pay attention to the values that apply in society, whether related to religion, morals, customs, or other values. This is intended so that the making of the deed does not conflict with religion, morals, customs, or other values that apply in society. The next problem is regarding the rights of children to the joint property. This paper discussed the deed of Statement and Power of Attorney No. 33 dated July 27, 1998 made before Defendant II and its derivatives each dated July 27, 1998 canceled by the court, what is the civil liability of the Notary for the deed of statement and deed of power of attorney 0p-=that was canceled by the Court and what are the consequences of further legal actions based on the Deed of Statement and Power of Attorney that was canceled by the Court in the Supreme Court Decision Number 188 K/Pdt/2013 Jo. Number 443 PK/Pdt/2015. The method used is normative juridical legal research, namely: used to provide an overview that law is written regulations in the form of statutes. The reason why the Deed of Statement and Power of Attorney No. 33 dated July 27, 1998 made before Defendant II and its derivatives each dated July 27, 1998 was canceled by the court in connection with the evidence is because the Deed of Statement and Power of Attorney which has been proven with the theory of positive evidence exceeds the rights and interests of Defendant I, even the Plaintiff feels that Defendant II also has an interest, because the actions of Defendant II above are not in good faith.

Abstract

This study aims to analyze the effect of intrinsic work motivation, extrinsic work motivation, spiritual vision leadership, spiritual altruistic love leadership, and spiritual hope/faith leadership on teacher performance at the Yayasan Indonesia Juara Foundation after the COVID-19 pandemic. The shift from face-to-face to distance learning due to the pandemic has impacted teachers' performance and motivation, highlighting the need for an understanding of the factors that influence their work. Primary and secondary data were collected from 100 teachers at the Foundation using a structured questionnaire and analyzed with SPSS version 25. The results revealed that intrinsic work motivation (t-count = 3.074, p < 0.05) and spiritual altruistic love leadership (t-count = 9.984, p < 0.05) significantly affect teacher performance, while extrinsic work motivation did not show a significant effect (t-count = 0.750, p > 0.05). The simultaneous analysis indicated that the five independent variables together had a significant impact on teacher performance (F-count = 23.520, p < 0.05), explaining 69% of the variation in teacher performance. This study underscores the importance of both intrinsic work motivation and spiritual leadership in enhancing teacher performance, especially in the challenging post-pandemic era. Abstract

The problem of inheritance distribution is one of the issues that often causes disputes in society, especially when it is related to assets that still have burdens or ties to other parties. One form of complexity in inheritance distribution occurs when the object of inheritance still has the status of debt collateral. This research is a normative legal research supported by interview data, descriptive nature of analysis using a legislative approach and a conceptual approach. The methodology of this research relies on secondary data. Data collection is done through library research, while data analysis uses qualitative methods. This decision has a significant impact as a new jurisprudence that changes the previous paradigm from rejection of the lawsuit (NO) to the concept of inheritance distribution that can still be implemented by paying attention to the protection of the rights of heirs and creditors, thus creating a new standard in religious court practice for handling similar cases in the future.

Abstract

Money lending agreements can be made either in writing or verbally, with or without collateral as a form of trust between the parties. Although Indonesian law recognizes the validity of oral agreements based on the principles of freedom of contract and consensualism, in practice it often raises legal problems, especially regarding the legal certainty of the collateral provided. The purpose of this study is to determine the validity of money lending agreements made verbally in the Indonesian legal system, what are the forms of unlawful acts in money lending agreements made verbally with movable and immovable objects as collateral according to civil law, how is the legal certainty of the position and legal protection of the recipient and provider of movable and immovable objects in oral money lending agreements reviewed from. The method used in this writing is the normative legal research method, namely a method that refers to legal norms carried out by means of literature studies, this research is descriptive in nature, and the data is analyzed qualitatively. The results of the study found that oral money lending agreements are still recognized as valid in the Indonesian legal system as long as they meet the requirements in Article 1320 of the Civil Code, even though they have weaknesses in terms of proof. In its implementation, unlawful acts can occur as regulated in Article 1365 of the Civil Code when one party commits a violation such as misuse of collateral or withholding collateral even though the debt has been paid off. However, based on Supreme Court Decision Number 198K/Pdt/2019, legal certainty is still given to the parties through the protection of their rights, as evidenced by a court decision ordering the return of collateral and excess payments to the entitled party, thus showing that even though the agreement was made verbally, the principles of justice and legal certainty are still upheld by the court.
