Abstract

The problems in this research consist of: What are the forms of violations that occur at the voting counting stages in the 2019 simultaneous general election in West Halmahera Regency What is the role of Bawaslu Halbar in resolving violations that occur during the holding of general elections simultaneously year 2019 in the West Halmahera Regency area.The location of field research was carried out in West Halmahera district. The type of normative-empirical research uses a statute approach and a conceptual approach. Types and sources of data are primary legal data and secondary legal data. Data collection techniques are carried out. by interviewing and documenting the data for further qualitative analysis.The purpose of this research is to conduct a study and analysis to find out what forms of violations that occur at the voting and counting stages in the 2019 simultaneous general elections in the West Halmahera Regency area. To find out how to resolve violations that occur during the holding of general elections simultaneously in 2019 in the West Halmahera Regency area.Whereas the forms of violations handled by Bawaslu Halbar in dealing with founding violations totaled 11 (eleven) election violations, and in handling only 3 (three) election violations recommended by the Integrated Law Enforcement Center. Besides that, 1 (one) finding that has been decided has permanent legal force. Meanwhile, other findings were not continued because the elements of election violations were not fulfilled based on the results of the study of alleged violations. The forms of violations are as follows: (1) Election Crime, there are 10 (ten) cases of criminal violations handled by Bawaslu Halbar. However, the handling process can be forwarded to the Police for only 3 (three) cases based on the results of the Bawaslu Halbar study; and (2) Violation of Liannya's Law, namely the findings of Muhammadun Hi's alleged violation of ASN neutrality. Adam on April 6, 2019 and has been registered with number 03 / TM / PL / KAB / 32.03 / IV / 2019. Based on the results of Bawaslu Halbar's study, the findings of the alleged violation of ASN Neutrality were given a recommendation to be sanctioned by the State Civil Apparatus Commission (KASN). As for the form of Election administration violations, Bawaslu Halbar did not receive reports or findings during the 2019 simultaneous elections. In addition, in terms of violations of the code of ethics, Bawaslu Halbar did not find any violations of the code of ethics committed by Election Administrators in the West Halmahera Regency either by election organizers. still namely the Election Commission of West Halmahera Regency and the organizer of the Ad Hoc Election.That Bawaslu Halbar has carried out its role as a supervisory agency for the implementation of the 2019 simultaneous elections very well. This can be seen from the actions of Bawaslu Halbar in handling violations both in the form of findings and reports of general election violations. Bawaslu Halbar handles findings of alleged violations according to working days or from the day the public finds out about and / or reports the alleged violation. Then the results are reported or stated in form B-1 and .discussed in the Plenary Meeting of the Follow-up of Initial Information on Alleged Violations to determine whether or not there are allegations of election violations, and if the election supervisor states that there is a violation of the general election, the election supervisor determines to be registered or recorded in Election register book. Bawaslu Halbar handles reporting violations totaling 8 (eight) election violations, and in handling only 1 (one) election violation that fulfills the formal and material elements. Meanwhile 2 (two) Election Violation Reports will be withdrawn by the Reporting Party. Other reports cannot be followed up because the violation elements and / or material elements are not fulfilled based on the results of the plenary meeting to follow up the initial information on the alleged violation. During the process, the election stages took place starting from the data updating stage and the recapitulation plenary session at each level, 8 (eight) reports of alleged violations from the public were received and 2 (two) of them were withdrawn by the reporter. reports that have been registered cannot meet sufficient evidence so that they are terminated, while 1 (one) other report has been reviewed and recommended to the Integrated Law Enforcement Center (Gakumdu) or related agencies because it fulfills the elements of an election criminal offense.

Abstract

Judge decision NO. 350 K/Pdt.Sus-BPSK/2016 and Judge decision NO.10/Pdt.Sus-BPSK/2016/PN.Plk are 2 (two) of the 127 (one hundred and twenty seven) verdicts of BPSK annulled by the Supreme Court (MA) on October 27, 2017. Where MA argued the two verdicts were not the authority of BPSK. Thus, problems arise whether the decision NO. 350 K/Pdt.Sus-BPSK/2016 and the decision NO.10/Pdt.Sus-BPSK/2016/PN.Plk are the competence of BPSK in resolving consumer disputes or not. To answer these problems, normative legal research methods are used, so that the conclusion is that the verdict NO.10/Pdt.Sus-BPSK/2016/PN.Plk is not the Palangkaraya BPSK competency in deciding because Sancho is not the final consumer protected by UUPK, so if the Supreme Court annulled the decision of the Palangkaraya BPSK is true. Meanwhile, verdict NO. 350 K/Pdt.Sus-BPSK/2016 is true Coal BPSK competency to decide consumer disputes because Dermasnyah Pane is the final consumer protected by UUPK, so if the Supreme Court annulled the decision of Coal BPSK is not true.

Abstract

Realitas kehidupan mengisyaratkan bahwa setiap orang yang bersalah wajib ditindak dan diberikan sanksi. Tak ayal seseorang yang dinyatakan bersalah dan telah menjalani hukumannya pun bisa kembali melakukan kejahatan yang sama, seseorang yang mengulangi kejahatan/Tindak Pidana disebut sebagai Residivis. Meningkatnya tindak kejahatan yang terjadi di Negara Indonesia menjadi penyebab utama meningkatnya jumlah pelaku kejahatan yang menjalani masa penahanan, baik di dalam Lembaga Pemasyarakatan (Lapas) maupun Rumah Tahanan (Rutan).Adapun tujuan umum dari penelitian ini adalah adalah mengidentifikasi serta mengetahui putusan hakim bagi terdakwa recidive.Sedangkan tujuan khusus dari penelitian ini diharapkan dapat menjadi bahan rekomendasi bagi pemangku kebijakan dalam hal ini hakim di Pengadilan Negeri Kota Ternate dalam  menjatuhkan pemberatan hukuman bagi terdakwa recidive.Metode dalam penelitian ini menggunakan tipe penelitian sosio-yuridis dengan jenis penelitian kualitatif. Penelitian dengan tipe sosio-yuridis digunakan dengan alasan untuk mengidentifikasi hukuman yang dijatuhkan oleh hakim di Pengadilan Negeri Kota Ternate terhadap Pelaku Pengulangan Tindak Pidana atau disebut dengan RECIDIVIST. Adapun sifat penelitian ini ialah bersifat deskriptif yang bertujuan menguji ada tidaknya hubungan sebab akibat antara berbagai variabel permasalahan yang diteliti.Hasil penelitian menunjukkan bahwa Pertimbangan hakim dalam penjatuhan pidana kepada seorang recidivist bergantung pada Surat Dakwaan dan Tuntutan Jaksa Penuntut Umum, dan pada kenyataannya tidak ada satu dakwaan dari JPU, dan Hukuman yang dijatuhkan oleh hakim kepada seorang recidivist belum ada yang mengikuti norma yang berlaku bagi pengulangan tindak pidana (recidive), tujuan pemidanaan dalam peraturan perundangan pidana di Indonesia belum semuanya mengatur secara rinci tentang pengulangan tindak pidana (recidive).

Abstract

The aim of this research is to determine the limits of the authority of the Corruption Eradication Committee and the National Police in handling criminal acts of corruption in Indonesia because in practice there are often clashes between the two authorized institutions, namely the Corruption Eradication Commission and the Indonesian National Police, in handling criminal acts of corruption.This research is normative legal research that uses a statutory approach and a legal concept analysis approach. The data sources used in this research come from primary data sourced from statutory regulations and secondary data sourced from literature.From the results of this research, it can be concluded that the authority of the Corruption Eradication Commission as an institution for eradicating corruption is delegated authority, while the authority of the National Police in eradicating corruption is attribution authority. However, the Corruption Eradication Commission (KPK) is a super body institution in handling criminal acts of corruption, especially in the investigation process. In relation to coordination, the Corruption Eradication Commission has special authority that is not owned by the National Police, however, the Corruption Eradication Committee still coordinates with the National Police in carrying out its duties and authority.

Abstract

Efforts to develop cities that care about human rights are a growing response from the movement to restore city sovereignty to its citizens. The state, including the government, supported by the National Human Rights Commission, is trying to apply this idea in Indonesia. The role of local government is very important in supporting efforts to develop cities that care about human rights. Of these problems, the focus of the research is whether the fulfillment of the rights of women and children in Ternate City meets the criteria of a city that cares about human rights and what is the role of the Government of Ternate City in fulfilling the rights of women and children in Ternate City. The human rights movement in Indonesia has begun to launch a new discourse, cities concerned with human rights (human rights cities). One of the interests in studying this issue is to widen the scope of state obligations that are not solely borne by the central government, but also local or regional governments. It is in this context that the role and position of regional leaders is very important. They have the discretion to organize and manage the city government as well as mobilize and invite city residents to be involved in human resource development programs through cities that care about human rights.

Abstract

Illegal levies on Ternate High School 2 occur because of the active role of the Ternate High School 2 schools and the length of the process of disbursing School Operational Assistance (BOS) funds from the central government to regions for unexpected expenditure needs and funds that are not unexpected included in the BOS funds budget. This illegal levies case has been followed up at the investigation stage after a closed case process was carried out by the North Maluku Regional Police Special Criminal Investigation Investigator and from the results of the title it was concluded that the criminal element had been fulfilled by allegedly violating Article 12 letter (e) of the Law Number 20 of 2001 jo. Law Number 31 of 1999 concerning Eradication of Corruption. In addition, illegal levies have become individual behavior and have become a system of providing services to the community, as if these illegal levies have become prevalent.

Abstract

This study aims to examine the factors that affect different sentences or criminal disparities and the reasons underlying the judge's decision in adjudicating criminal cases during trial. The methodology of this study uses doctrinal legal research using legal and conceptual approaches. The results of the study show that criminal disparity has an underlying cause, which can be analyzed from theoretical, legal, and empirical perspectives. Legal theory argues that the autonomy and freedom granted to judges is based on the Constitution of the Republic of Indonesia of 1945 and Law No. 48 of 2009, which regulates the current judicial power. Then the deciden ratio theory, along with disagreement, equilibrium theory, intuition art theory, experience theory, and science theory, explains criminal disparity. Indonesian courts now use a punishment system that is exclusively based on trial exams. This leads to discrepancies in judicial decisions by judges, known as criminal disparita. At the very least, consider criteria related to exterior activities and subjective elements such as motives and objectives. Next, evaluate the impact of the action, the gravity of the violation, the approach used, the internal disposition (wrong), and relevance to the core of consideration. Judges cannot rely solely on procedural factors

Abstract

The issue of Human Rights (HAM) is becoming an increasingly important agenda, the international community continues to urge all member states of the United Nations to take various steps and actions, including making laws to eliminate discrimination and violence against women. Indonesia's policy to ratify the global law mentioned above, is suspected by the rampant problems of violence faced by almost every nation and country on this earth.  The research methodology used is library research which is carried out by searching, taking an inventory and studying laws and regulations, doctrines, and other secondary data, which are related to the focus of the problem. in the legal framework Indonesia has provided guarantees for human rights (both women and men) as stated in the second amendment of the 1945 Constitution of Article 28 A-J and Law No. 39 of 1999 on Human Rights. UU no. 7 of 1984 concerning the Elimination of Discrimination Against Women or the Ratification of the Women's Convention, which states that the state will make maximum efforts to eliminate all forms of discrimination against women, including violence against women, in particular sexual violence is regulated in the Child Protection Law and the Criminal Code, while other forms of protection for victims of sexual crimes.

Abstract

A cooperative is a business entity that requires capital. Cooperative capital consists of own capital and loan capital, but to develop its business, cooperatives can also conduct equity investment activities. This capital investment activity attracts the attention of the community because of its nature that bears the risk of loss but the investor is not given the authority to participate in managing the capital opening opportunities for misuse of capital investment management in cooperatives that can lead to defaults by cooperatives due to default on investors, as well as with investors. Panca Prima Cooperative which defaults on the venture capital cooperation agreement (investment capital). Thus, a problem arises whether the Panca Prima Cooperative can be held accountable for default on the venture capital cooperation agreement (equity participation) that is carried out and whether the management of the Panca Prima Cooperative is also responsible for the default carried out by the cooperative. To answer these problems normative research methods are used. Thus, it was concluded that the Panca Prima Cooperative could be held accountable for the default of the cooperative working agreement (capital participation) because the status of the Panca Prima Cooperative was a legal entity and that the Panca Prima Cooperative Management could not be held liable for defaults made by the cooperative Koperasi Panca Prima is a legal entity

Abstract

Untuk menjamin perlindungan maksimal terhadap hak konstitusional, maka lembaga peradilan konstitusi harus diperkuat. Upaya tersebut harus didukung dengan instrumen hukum atau sistem yang baik. Melalui peluang revisi ketiga UU MK, alih-alih mampu menjawab seluruh permasalahan yang ada, produk legislasi hasil perubahan ketiga UU MK justru merendahkan kedudukan lembaga peradilan konstitusi. Banyak sekali permasalahan dalam proses pembentukan undang-undang yang secara sadar menunjukkan betapa pola intervensi pemerintah terhadap Mahkamah Konstitusi semakin kental, hal ini terlihat dari sifat produk hukum yang dihasilkan sangat jauh dari cita-cita reformasi. Tulisan ini bertujuan untuk mengkaji karakteristik Undang-Undang Nomor 7 Tahun 2020 yang merupakan produk hukum hasil perubahan ketiga UU Mahkamah Konstitusi. Penelitian ini menggunakan metode penelitian hukum doktrinal, dengan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menemukan bahwa proses revisi undang-undang Mahkamah Konstitusi mempunyai permasalahan prosedur formal. Kondisi tersebut dengan sendirinya mempengaruhi materi muatan Undang-undang tersebut. Berdasarkan indikator karakteristik produk hukum yaitu proses terbentuknya, muatan materiil dan peluang penafsiran undang-undang menunjukkan bahwa produk hukum tersebut merupakan hasil perubahan terhadap ketiga undang-undang tersebut. Konstitusi Mahkamah Konstitusi bersifat elitis konservatif. .
