Abstract

This article evaluates the effectiveness of legal protection for auction winners in executing Mortgage Rights and the practical enforceability of the Mortgage Rights Certificate. While the Mortgage Law provides creditors with privileged authority for parate execution under Articles 6 and 14, execution is often hindered when the debtor or possessor files an objection (derden verzet). The research uses a normative legal method, examining the Mortgage Law, Indonesian Civil Procedure Code, Ministry of Finance Regulation 122/2023, and relevant court decisions. The findings suggest that legal protection for auction winners is inadequate due to insufficient preventive measures, such as execution seizure before the auction. This allows objections to delay execution for years. Additionally, Article 195 of the Civil Procedure Code lacks clear time or scope limitations for resistance, enabling its misuse. The research recommends mandatory execution seizure before auction and stricter court standards for accepting execution delay requests, enhancing parate execution effectiveness and auction winner protection.

Abstract

The phenomenon of gender reassignment (transgender) presents complex legal issues, particularly concerning marital status from an Islamic legal perspective. This research examines the Islamic view on gender reassignment, the validity of marriage post-reassignment, and the implications on marital status according to scholars in Medan City. Using a qualitative method with a normative-sociological approach, data was gathered through a literature review and interviews with scholars from the Indonesian Ulema Council (MUI), Muhammadiyah, and Al-Washliyah. The findings show that Islamic law views intentional sex reassignment, without medical reasons, as contrary to human nature and impermissible. While the marriage contract remains valid, gender reassignment disrupts the marital essence, rendering the marriage unsustainable. Medan scholars believe that gender reassignment does not invalidate the marriage but provides a strong basis for ending it through Islamic legal mechanisms, with fasakh being the most just solution. This research contributes to Islamic family law studies, emphasizing the Sharia-oriented approach in addressing transgender issues.

Abstract

This study aims to analyze the role of Indonesian youth living abroad as cultural agents in the practice of cultural diplomacy, especially in maintaining the sustainability of Indonesian cultural values, facing the challenge of cultural identity in the destination country, and utilizing cultural diplomacy as a strategy to strengthen sustainable international networks and cooperation. This study uses a qualitative approach with a case study method on the Indonesian Student Association (PPI) organization located in Japan, South Korea, Germany, and Austria The results of the study show that Indonesian youth living abroad actively carry out cultural diplomacy through various cultural, academic, social, and community activities that are adapted to the socio-cultural context in the destination country. Activities such as cultural festivals, art exhibitions, traditional performances, academic forums, and the use of digital media have proven to play an important role in building cultural attraction and strengthening Indonesia's positive image at the international level. In addition, this study found that cultural diplomacy carried out by diaspora youth not only functions as a means of cultural representation, but also as a strategic mechanism in building international networks based on trust, exchange of ideas, and cross-cultural interaction. These findings confirm that Indonesian diaspora youth have a strategic position as non-state actors in supporting the strengthening of Indonesian cultural diplomacy in the era of globalization, as well as contributing to strengthening international relations through a sustainable soft power approach.

Abstract

This study aimed to develop a digital flipbook media containing Pancasila values for second-grade elementary school students that is valid, practical, and effective. The study employed a development research method by adapting the Borg and Gall development model, resulting in a digital flipbook entitled “Aku Anak Pancasila; Ayo, Jadi Hebat Dengan Lima Sila!”. Media validity was assessed by experts in media, content, and language. The practicality of the media was evaluated by six elementary school teachers, three students in individual trials, and ten students in small-group trials. The effectiveness test used a one-group pretest–posttest design involving 20 second-grade students. Data were analyzed using qualitative and quantitative techniques with a Likert scale. The results showed that the overall validity score reached 96.72%, categorized as very valid. The practicality scores were 95.5% from teachers and 91.1% from students, both categorized as very practical. The effectiveness test using a paired-sample t-test yielded a significance value of 0.002, indicating that the media is effective. In conclusion, the digital flipbook media is feasible and effective for improving students’ reading literacy.

Abstract

Notarial practice in the health sector shows a new development when terminally ill patients document their medical wishes in a will before a notary. This phenomenon raises questions regarding the limits of a notary's authority and the validity of the patient's will in conditions of physical and psychological decline. This study uses a normative legal method with a statutory and conceptual approach. The results indicate that a terminally ill patient's will is most appropriately drafted in the form of a general will in accordance with Articles 875 and 938–940 of the Civil Code and Article 15 of the Notary Law. The testator's legal capacity is based on Articles 895, 1320, and 1330 of the Civil Code, while medical capacity is determined through the principle of informed consent as stipulated in the Medical Practice Law and the Health Law. If formal and material requirements are not met, the will has the potential to be invalidated or lose its authenticity, and it also creates professional responsibilities for the notary. These findings emphasize the need for specific guidelines to ensure legal certainty and protect the will of terminally ill patients.

Abstract

This study aims to analyze the influence of price and income of Muslim consumers on purchasing decisions for Berkah Barus Syrup products from an Islamic economic perspective. The study used a quantitative approach with an associative design. Data were collected through a Likert scale questionnaire (1–5) distributed to 80 Muslim consumer respondents in Barus District, Central Tapanuli Regency, who were selected using a random sampling technique. Data analysis was performed using multiple linear regression using SPSS version 29, supported by validity and reliability tests, and classical assumption tests. The results showed that price had a positive and significant effect on purchasing decisions, as did consumer income, which had a positive and significant partial effect. Simultaneously, price and income were proven to have a significant effect on purchasing decisions for Berkah Barus Syrup products. These findings indicate that price suitability with Muslim consumers' income levels is an important factor in forming purchasing decisions. This study provides an empirical contribution to the development of Muslim consumer behavior studies by integrating the concept of purchasing decisions with Islamic economic principles, particularly in the context of price fairness and consumer welfare. The practical implications of this study can serve as a reference for business actors in formulating pricing strategies that are in accordance with sharia values and consumers' economic conditions.

Abstract

Insolvency is a state of the debtor's inability to fulfill its debt payment obligations which is normatively the basis of the bankruptcy mechanism in Indonesia. In the midst of the dominance of settlement through bankruptcy and Suspension of Debt Payment Obligations (PKPU), Indonesian civil law actually provides another alternative through the novation mechanism as stipulated in Article 1413 of the Civil Code. This study aims to analyze the position of novation as a mechanism for settling debts of debtors who experience insolvency and identify juridical obstacles in its application according to positive Indonesian law. This research is normative legal research with a legal and conceptual approach. The results of the study show that novation has legitimacy as a legitimate debt settlement mechanism outside of bankruptcy and PKPU, and can function preventively by removing old debts and replacing them with new engagements so as to prevent debtors from fulfilling the element of "due and collectible debts" as referred to in Article 2 of the UUKPKPU. However, the implementation of novation faces internal obstacles in the form of the legal terms of the agreement, the risk of loss of collateral, the ability of the debtor, and the potential for the cancellation of the novation due to defects in the old agreement. External barriers were also found in the form of the risk of cancellation through actio pauliana, as well as the absence of explicit provisions regarding novation in the UUKPKPU. Thus, although juridically novation has a legitimate position as a debt settlement mechanism, the effectiveness of its application to insolvent debtors is still limited by Indonesia's bankruptcy legal structure.

Abstract

Facing a decline in farmers and limited agricultural land, the Semarang City Development Planning Agency (Bappeda Kota Semarang) launched "Kita Tani Muda," a business incubation program to attract young generation’s participation to agriculture. Although Bappeda Kota Semarang promoted the program through various channels, it failed to meet its target number of participant. The main objective of this study is to understand the persuasive communication carried out by Bappeda Kota Semarang in promoting the Kita Tani Muda program by analyzing the communication elements contained within it. This study also identifies factors that hinder the community from participating in Kita Tani Muda. This study used a qualitative method with a case study approach. The results show that Bappeda Kota Semarang has carried out persuasive communication in promoting Kita Tani Muda by establishing source credibility, designing attractive messages, and selecting relevant channels. However, participants were hesitant to join due to their unfamiliarity with the concept of business incubation and its benefits. The study concludes that Bappeda Kota Semarang needs to enhance public awareness of business incubation and create more effective promotional strategies to boost participation in similar programs in the future.

Abstract

Improving the competency of students who do not continue their education after graduation is a crucial need to prepare them to enter the workforce or become entrepreneurs. School data shows that 34% of graduates of SMA Negeri 1 Sangatta Selatan do not continue their education. This study aims to describe the principal's management in planning, organizing, implementing, and supervising the dual-track curriculum. The study used a qualitative approach with a case study method. Data were collected through observation, interviews, and documentation, then analyzed using the Miles and Huberman interactive model. The results showed that program planning was carried out collaboratively and based on student needs with a flexible schedule, organization through a clear team structure according to competencies, implementation through theoretical and practical learning using the 3P method in the fields of fashion design, culinary design, make-up, and multimedia, as well as continuous supervision and monitoring. The implementation of the dual-track curriculum has proven effective in improving student competency as a provision for work and entrepreneurship and has the potential to be developed in schools with similar characteristics.

Abstract

Informed Consent (IC) plays an important role in determining the fate of pediatric patients, especially children who require medical treatment in the form of surgery. Children are considered legally incapable of giving legal consent to medical procedures because they have not reached adulthood, so the responsibility is given to a parent or legal guardian. Without the consent of the parents, medical procedures cannot be performed on pediatric patients. The purpose of this article is to find out how the regulation and role of IC in the practice of Paediatric Surgery in Indonesia is based on applicable regulations. The research method used is a normative juridical method. The findings obtained are that IC in the practice of Paediatric Surgery in Indonesia is regulated in Law No. 29 of 2004 concerning Medical Practice and Permenkes No. 290/Menkes/Per/III/2008 concerning the Approval of Medical Measures. In pediatric surgical procedures, IC is given by parents as the closest family based on the consideration of the best efforts for the benefit of the child, as well as protection for medical personnel in carrying out their duties. However, existing regulations do not yet regulate the protection of children's rights against parents who reject IC. In the future, it is hoped that IC pediatric surgical practice will be carried out with full understanding and wise decisions from all parties involved, in accordance with legal principles and medical ethics.
