Abstract

With Law Number 7 of 1984 (Law No.7/1984), the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) was ratified. According to the rules of international law known as pacta sunt servanda, international agreements that have been ratified must be implemented. Countries in the world may not be exempted from this obligation based on the provisions of their national laws. However, if national law reduces the implementation of an international agreement, the national law must be changed. This obligation is added to the CEDAW article which states that CEDAW Parties are required to change national laws to eliminate discrimination against women and protect women's rights. However, in Indonesia, the elimination of discrimination against women and the protection of women's rights as well as changes to the law are more complicated than the words of the rules of international law. The implementation of CEDAW contains problems in the political field, especially after the replacement of the New Order government with the Reformation Era government. Political problems are added to social problems, namely developments and differences of opinion in society regarding culture and religion. In the state legal system, the examination of these issues shows that the recognition of the principle of eliminating discrimination against women and equal rights for women is good. This recognition is contained in the 1945 Constitution and Pancasila which can be improved along with the Decree (TAP) of the People's Consultative Assembly (MPR) Number XVII/MPR/1998 concerning Human Rights (HAM) and Law No. 39/1999 concerning Human Rights which are complete. In Indonesia, the enforcement of these laws and regulations needs to be improved. This enforcement includes, among other things, the authority to test in the general court environment and the state administrative court (TUN). The scope of the existing authority to test means that the majority of laws and regulations (including TUN Decisions) cannot be tested against the principle of discrimination or women's rights. So, the majority of laws and regulations may be issued and apply whether they are discriminatory and violate women's rights or not. With this examination, this paper concludes that the position of women in Indonesia as outlined by CEDAW needs to be realized through legal changes both in the state legal system and the Islamic legal system. However, this paper acknowledges the differences between the Islamic legal perspective and the CEDAW perspective. The ambiguity of the relationship between Islamic law and CEDAW is a product of the difficulty of harmonizing these angles.

Abstract

The growth of the sharia capital market in Indonesia reflects increasing investment interest based on sharia principles that emphasize justice, transparency, and ethical investment. The sharia capital market presents a unique appeal amid global economic uncertainty, offering greater stability compared to conventional markets. This study aims to analyze the role of sharia as a catalyst for the growth of market capitalization in sharia indices on the Indonesia Stock Exchange (IDX). The research methodology uses a literature review method by analyzing secondary data and relevant theories from publications by the Financial Services Authority (OJK) and previous research. The findings show that Indonesia’s sharia capital market has experienced significant capitalization growth despite challenges such as economic crises and the pandemic. Several sharia indices, such as the Jakarta Islamic Index (JII) and the Indonesia Sharia Stocks Index (ISSI), have recorded long-term upward trends, supported by restrictions on speculation and the prohibition of riba practices. Regulatory support from OJK, particularly through policies that expand the scope of the Sharia Securities List (DES), further strengthens this growth. The year-to-year increase in the number of sharia stocks indicates market resilience and growing public awareness of sharia-based investments. With promising prospects, the sharia capital market in Indonesia is expected to continue to develop as a catalyst in market capitalization, positively contributing to the national economy through productive capital flows aligned with sharia values.

Abstract

This study aims to identify and analyze the factors that affect the obligation of equality of destiny in Sharifah marriage in East Jakarta. Equality of destiny is considered important in the Shari'ah marriage tradition, with several key factors influencing this view. The research method uses a qualitative approach with in-depth interviews with seven Habaib informants. Data were collected to explore their views on the obligation of equality of destiny and its implications in Sharifah marriage. The results of the study show that there are three main factors that underlie the equality of nasab: heredity, social factors, and madzhab teachings. First, descent is considered a mandatory tradition established by ancestors. Second, social factors reflect the negative consequences of marrying a child to an individual who is not equal to fate, such as insults and the absence of habaib. Third, the teachings of madzhab, especially from the Shafi'iyyah and Hanabilah groups, set strict standards regarding equality of descent. The discussion revealed that these factors play an important role in maintaining tradition, social status, and harmony in the Shariah community. This research provides in-depth insights into how equality of nasab affects the social structure and marriage traditions among the Habaibs.

Abstract

The Sidoarjo-Surabaya Electric Railway (KRL) project is aimed at improving connectivity and stimulating local economic growth. This study examines the economic perception of the project from an Islamic perspective and its alignment with the principles of Maqashid Sharia. The project is expected to create fair and sustainable economic benefits for the communities involved. The research finds that community support for the project is influenced by their involvement in decision-making processes, their perception of economic advantages, and the project's adherence to principles of social justice and environmental sustainability. In conclusion, the study emphasizes the importance of inclusive policies that prioritize economic justice. The project should not be solely considered a transportation solution, but also a catalyst for community prosperity in a sustainable manner.

Abstract

Marriages conducted abroad must be based on the laws of the country where the marriage takes place, which have regulations in foreign countries. This is used as a loophole for Indonesian citizens who want to get married without having to wait for the Iddah period or waiting period. This research is a qualitative method with a statutory approach and data through library research. Data analysis uses content analysis and draws a conclusion. Based on research and discussion, the implementation of Indonesian citizens' marriages during the iddah period abroad, based on Article 56 and the principles of Indonesian International Civil Law, adheres to the principle of Lex Loci Celebrationis, where the marriage is conducted according to the law of the place where the marriage takes place. This formally indicates that the marriage is declared valid. However, as long as the cumulative requirements for international marriage as regulated in Article 56 have not been fulfilled, the marriage can still be considered invalid, and the legal status of Indonesian citizens' marriages during the iddah period abroad when returning to Indonesia does not yet have clear legal certainty from the applicable regulations.

Abstract

Indonesian people's understanding of murabahah products in Islamic banks is still uneven. In January 2020, the Murabahah contract had the largest portion in Indonesian Islamic banking, which was around 58%, while the musyarakah contract was 39.5% and the mudharabah contract was 2.5%. The main problem in this study is how high the level of understanding of Bank Syariah Mandiri and BTN Syariah Serang customers on murabahah buying and selling, and whether the level of customer understanding can affect investment in Bank Syariah Mandiri and BTN Syariah bank Serang Banten. The author collected primary data with field research with a quantitative descriptive approach, with a questionnaire to 100 customers of Bank Syariah Mandiri and Bank BTN Syariah Serang Banten. The results of this study show: First, customers of Bank Syariah Mandiri Serang have an understanding level of 97.4%, while customers of BTN Syariah Bank Serang have an understanding level of 95.2%. Second, the opinion of customers who think that the level of understanding can affect the interest in investing in Islamic banks is 93.8% for Mandiri Syariah Bank customers, and BTN Syariah Bank customers are 95.3%.

Abstract

This study analyzes the readiness level of Muslim-friendly tourism in the inhabited islands of the Thousand Islands using the Analytic Network Process (ANP) method. The focus of the research is on 11 inhabited islands with tourism potential, considering various halal tourism criteria according to the Global Muslim Travel Index (GMTI) standards. The analysis was conducted through field surveys, stakeholder interviews, and documentary studies during the period of January-June 2024. The results show that the priority development sequence based on the ANP supermatrix is as follows: worship facilities, services, access, environment, and communication. Evaluations of key islands such as Tidung, Pramuka, Panggang, Kelapa, and Harapan reveal variations in the readiness of Muslim-friendly facilities and services. A SWOT analysis identifies key strengths, including the Muslim-majority population and the availability of mosques, while major weaknesses include limited infrastructure and a lack of halal certification. Development opportunities are supported by the global halal tourism trend and government support, but face threats from competition with other destinations and the impact of climate change. The study recommends a three-stage development strategy: short-term (facility mapping and basic training), medium-term (infrastructure development and halal certification), and long-term (integration with national halal tourism destinations and branding enhancement). Research limitations include access to secondary data, seasonal variations in visits, and dynamic policy changes.

Abstract

The evolution of Islamic management practices has significantly transformed from the classical to contemporary eras, demonstrating adaptability to social, economic, and global changes while adhering to Islamic principles such as faith, charity, and musawarah. This study aims to analyze the evolution of Islamic management practices and how Islam can be integrated into modern management practices. The research methodology uses qualitative research with literature and relevant sources to analyze the development and contributions of Islamic management practices over time. The findings show that Islamic management not only has relevance in Islamic business but also contributes to conventional management through ethics, value-based leadership, transparency, and accountability. Despite challenges in implementation, such as lack of standard standards and compliance with conventional business, this evolution highlights the importance of Islamic management in addressing global dynamics and creating an organization that supports and guides the Islamic community.

Abstract

Restorative justice telah menjadi pendekatan inovatif dalam sistem peradilan pidana anak, menawarkan solusi berbasis pemulihan bagi anak sebagai pelaku tindak pidana. Penelitian ini bertujuan untuk mengeksplorasi efektivitas penerapan restorative justice di Indonesia, khususnya dalam mendukung tujuan perlindungan anak sebagaimana diatur dalam Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA). Pendekatan penelitian yang digunakan adalah yuridis normatif dan empiris, dengan analisis terhadap regulasi, studi kasus, dan wawancara mendalam. Temuan menunjukkan bahwa restorative justice dapat menurunkan residivisme, meminimalkan stigma sosial, serta memfasilitasi reintegrasi anak dalam masyarakat. Namun, hambatan utama meliputi keterbatasan pemahaman aparat penegak hukum, kurangnya mediator terlatih, dan minimnya fasilitas rehabilitasi. Penelitian ini merekomendasikan penguatan kapasitas aparat, pengembangan infrastruktur pendukung, dan peningkatan kesadaran publik melalui sosialisasi. Dengan memperkuat kerangka implementasi, restorative justice berpotensi menjadi pendekatan unggul dalam menciptakan sistem peradilan pidana anak yang inklusif dan berorientasi pada keadilan sosial.

Abstract

Tulisan ini membahas hak atas tanah dalam konteks hukum agraria di Indonesia serta mengkaji perlindungannya dari perspektif hukum Islam. Dalam hukum agraria, fokus utama adalah implementasi Undang-Undang Pokok Agraria (UUPA) Tahun 1960 sebagai dasar pengaturan pemilikan, penguasaan, dan pemanfaatan tanah. Tanah, sebagai sumber daya strategis, memiliki dimensi hukum, sosial, ekonomi, dan budaya yang kompleks, sehingga membutuhkan pendekatan yang komprehensif dalam pengelolaannya. Dari perspektif hukum Islam, tanah dipandang sebagai amanah yang harus dikelola untuk kemaslahatan bersama dengan prinsip keadilan, kepemilikan yang sah, dan perlindungan terhadap hak-hak individu maupun komunitas. Studi ini mengidentifikasi tantangan utama dalam perlindungan hak atas tanah, terutama bagi masyarakat adat dan kelompok rentan lainnya, seperti kesenjangan hukum, konflik agraria, dan distribusi tanah yang tidak merata. Tulisan ini juga mengevaluasi kebijakan agraria yang ada serta membandingkannya dengan prinsip-prinsip dalam hukum Islam. Dengan pendekatan yuridis normatif dan analisis kasus, penelitian ini menyoroti pentingnya reformasi kebijakan agraria yang selaras dengan nilai-nilai Islam, pemberdayaan masyarakat adat, serta dialog inklusif antara pemangku kepentingan. Kesimpulannya, pendekatan integratif antara hukum agraria dan hukum Islam dapat memperkuat perlindungan hak atas tanah untuk mewujudkan keadilan sosial dan keberlanjutan dalam pengelolaan tanah.
