Abstract

The process of acquiring loans from traditional financial institutions is arduous for SMEs during economic pressure due to time-consuming procedures accompanied by stringent application criteria. Consequently, SMEs would have a low survival rate while awaiting loan approval from traditional financial institutions. To understand the intention to use Islamic P2P microfinance, this study extended the Technology Acceptance Model (TAM) with Perceived Risks and Perceived Benefits. The current study used a quantitative research design and non-probability snowball sampling to collect data from 248 micro-entrepreneurs across Malaysia. SPSS Version 28.0 software was used to analyse the collected data. The findings indicated that this study partially supports the TAM in predicting the intention to use Islamic P2P microfinancing in Malaysia. In the case of Islamic P2P financing, perceived benefits are also found to be an important predictor. In this paper, the authors open a new avenue for Islamic contributions to the literature on entrepreneurship development. The proposed model will benefit the government as the primary policymaker, entrepreneurs, Islamic scholars and academicians.

Abstract

The ideals of economic law are in line with the ideals of Islamic law contained in the maqᾱṣid asy-shari'ah with the focus on building and creating the benefit of the world and the hereafter for mankind. The ideals of Islamic law in the economic field can be seen in its concept of economic activity seen as a vehicle for society to lead to, at least, the implementation of the two teachings of the Qur'an. The development of Islamic economic law is basically parallel to other conventional economic law. With regard to an economy based on Islam, it is obligatory for Muslims in particular and is an alternative solution for non-Muslims. The existence of Islamic economics in general in Indonesian society is conceptually in accordance with the demands of the times. The Islamic finance industry in Indonesia has been recognized and implemented by the public. The existence of the Islamic economy is marked by the proliferation of Islamic-based financial institutions, one of which is sharia fintech.

Abstract

Regarding criminal acts in elections act. Systematically, the criminal provisions in the electoral law are regulated in Book V under the title of Election Crime Book II from Article 488 to Article 554. So that the criminal act of election is regulated in 66 articles. Violations of electoral acts, especially money politics, must then be carried out by law enforcement. Regarding this matter, it can be found in the Fifth Book of Chapter I on Handling Election Crimes – the first part of Article 476 to Article 487 of the Election Law. The essence of the law enforcement process is to refer to Law No. 8 of 1981 concerning the Criminal Procedure Code (KUHAP), unless expressly specified in the Election Law, for example regarding the establishment of an Integrated Law Enforcement Center regulated in Article 486 and Article 487. In other words, in certain cases the Electoral Law is placed as a specificity (lex specialis) of the Criminal Procedure Code as its general provision (lex generalis). As has been stated before that the purpose of the passing down of Shari'a is to achieve benefit and avoid omnipresence on two different dimensions of time, the world and the Hereafter. This means that all aspects of Islamic teachings, must lead to the achievement of these goals, including the economic aspect. Therefore, Islamic Economics must be able to become a pan-acea and a solution to the acute problems of the current economy. The logical consequence is, that to construct an Islamic Economic building it cannot be separated from the Maqashid theory as previously explained. Even Shaikh Muhammad Thahir ibn 'Assyria once said that "Forgetting the importance of the maqasid side in Islamic sharia is the main factor causing stagnation in fiqh.
