Abstract

Baganyi adalah proses awal dari perpisahan untuk memberi jeda bagi pasangan yang berkonflik. Proses baganyi diawali dengan usaha untuk menghindari konflik pasangan dalam rumah tangga dengan kepergian suami dari rumah secara resmi saat terjadi perselisihan. Praktik ini memungkinkan pasangan untuk menenangkan diri dan menghindari tindakan gegabah, yang dapat berpotensi memicu kekerasan dalam rumah tangga (KDRT). Tujuan penelitian ini adalah untuk mengkaji bagaimana praktik baganyi berfungsi sebagai mekanisme proaktif dalam menjaga ketahanan rumah tangga di masyarakat Minangkabau dengan perspektif hifz an-nasl. Penelitian ini menggunakan pendekatan kualitatif dengan jenis field research yang bersifat deskriptif-analisis. Sumber data primer berasal dari hasil wawancara mendalam di Kecamatan Palembayan, Kabupaten Agam terhadap informan yang dipilih dengan teknik purposive sampling. Analisis data dilakukan secara kualitatif dengan pendekatan teori ketahanan keluarga dari Froma Walsh dan teori hifz an-nasl. Hasil penelitian ini menyimbulkan bahwa tradisi baganyi yang dilakukan dalam masyarakat Palembayan mencerminkan sistem ketahanan keluarga yang kuat menurut kerangka Froma Walsh. Tindakan ini memungkinkan keluarga untuk menstabilkan sistem di tengah krisis dan memperoleh kembali kekuatan melalui intervensi adat, sehingga tujuan hifz an-nasl tercapai melalui pemulihan fungsi keluarga yang lebih kokoh. Implikasi dari penelitian ini akan memberikan contoh bahwa kearifan lokal mampu menjadi sumber daya sosial yang efektif dalam menjaga keutuhan keluarga.

Abstract

This study aims to examine the influence of father involvement in parenting on children's psychological development, focusing on the socio-cultural context of Jayapura City. In a society still influenced by patriarchal values, a father's role is often limited to economic functions, while emotional and affective involvement is still considered the mother's domain. This research used a qualitative approach with a case study method, involving in-depth interviews and participant observation with several families living in Jayapura City. The results indicate that a father's active involvement, whether in learning activities, emotional communication, or spiritual support, has a significant positive impact on children's self-confidence, emotional regulation, and stability of daily behavior. Conversely, low involvement tends to trigger emotional distance and psychological tension in children. Social, cultural, and communication style factors also influence the form and level of a father's involvement. These findings emphasize the importance of educating children about the role of fathers in parenting, as well as the need for a contextual and adaptive family counseling approach that aligns with local values ​​in Jayapura City.

Abstract

This study evaluates the implementation of Medan Mayor Regulation Number 27 of 2018 concerning drainage management in Medan Tembung District from the perspective of siyasah industrial and maqāṣid al-syarīʿah. A normative-empirical approach was used: primary data were obtained through interviews with officials and field observations conducted in 2025; secondary data were in the form of Perwal 27/2018, technical documents, and fiqh siyasah literature. Qualitative analysis compared norms and practices and assessed the extent to which the implementation of the Perwal met the objectives of maqāṣid, particularly ḥifẓ al-nafs (protection of life/health) and ḥifẓ al-māl (protection of property). The results showed that the implementation of the Perwal has not been optimal: maintenance is more reactive than scheduled, sediment cleaning and dredging are inconsistent, there are limitations in human resources and technical equipment, and handling is not evenly distributed throughout Medan Tembung District. This condition reflects the gap between normative provisions and field reality; from a maqāṣid perspective, the fulfilment of ḥifẓ al-nafs and ḥifẓ al-māl has not been adequately achieved. The contribution of this research is to present a study of industrial siyasah that links the norms of the Mayor's Regulation with field evidence as well as normative-fiqhiyah policy recommendations to strengthen drainage maintenance based on public welfare.

Abstract

Marriage registration constitutes a fundamental instrument within Indonesia’s family law system to ensure legal certainty, protection of civil rights, and administrative order. However, Article 2 paragraph (2) of Law Number 1 of 1974 on Marriage continues to give rise to normative and practical problems due to its ambiguous relationship with paragraph (1), which emphasizes the validity of marriage based on religious law. This ambiguity has produced a dualistic interpretation of marriage registration, which is often perceived merely as an administrative obligation lacking strong legal binding force. Consequently, the practice of unregistered marriages (nikah siri) persists and systematically weakens legal protection, particularly for women and children. This study employs a normative legal approach supported by empirical data in the form of statistical records of itsbat nikah applications submitted to the Religious Courts, sourced from the Directorate General of the Religious Courts of the Supreme Court of the Republic of Indonesia. The analysis is conducted using the perspectives of legal positivism, structural functionalism, law as a tool of social engineering, and maqasid al-shari‘ah (maslahah). The findings indicate that the high number of itsbat nikah applications reflects the inability of marriage registration norms to function effectively as instruments of legal protection.

Abstract

Child custody (hadhanah) constitutes a fundamental aspect of Islamic law, designed to safeguard the welfare, education, and protection of children following divorce. The principle of justice in Islam emphasizes that the rights of the child must take precedence over parental interests, with due consideration given to compassion, capability, and the suitability of the custodian. This study aims to analyze the concept of child custody from an Islamic perspective, identify the underlying causes of custody disputes, and examine their legal implications within the framework of Indonesia’s religious courts. The research employs a normative approach by reviewing primary sources of Islamic law (fiqh madhhab). The findings indicate that custody disputes arise not only from divergent interpretations of legal provisions but also from practical challenges. These include: (1) the absence of parental affection, which often triggers disputes; (2) financial capacity in relation to child support; (3) the influence of the living environment on parental conflict; and (4) parental customs or traditions that shape approaches to child-rearing.

Abstract

This article examines whether ridha in fiqh munakahat can remain legally meaningful when a child's apparent assent is produced through grooming. The study departs from a doctrinal gap: classical fiqh generally discusses ridha in relation to coercion (ikrah), whereas child grooming operates through gradual psychological manipulation and unequal power relations. Using normative legal research with a conceptual and maqasid-based approach, this article analyzes classical discussions of ridha together with Jasser Auda's maqasid al-shariah, especially hifz al-nafs, hifz al-'aql, and hifz al-nasl. The article argues that a child's compliance in a grooming situation cannot be treated as valid ridha because it lacks psychological maturity, freedom from manipulation, and awareness of consequences. Its contribution lies in proposing a substantive formulation of ridha that moves beyond formal consent and functions as a doctrinal test for assessing exploitative relationships involving children. This reformulation strengthens the child-protective orientation of Islamic family law and clarifies the normative incompatibility between grooming and the objectives of sharia.

Abstract

This research analyzes the integration of moral, legal, and social justice dimensions in rulings on marital property and inheritance cases in Indonesian Religious Courts. The study is motivated by the juridical dilemma faced by judges when reconciling normative legal certainty with dynamic substantive justice demands in contemporary Islamic society. This research explores the synergy between Western philosophy (Plato, Aristotle, Rawls) and Islamic philosophy (Al-Farabi, Al-Ghazali) to analyze harmony, proportionality, and social benefit. Using a layered theoretical framework ranging from legal protection to social engineering, this study employs a normative juridical method to examine judicial reasoning. The findings argue that the ijtihad performed by judges is essentially a method of legal discovery (rechtsvinding). This pattern of rechtsvinding demands interpretative flexibility, enabling judges to move beyond rigid statutory boundaries. By prioritizing substantive justice over formalistic norms, judges may employ contra legem decisions, ensuring that legal discovery functions as a responsive tool for social engineering and equity.The research concludes that judges function as both moral agents and social engineers responsible for harmonizing legal certainty with moral and social values. This harmonization is the essence of judicial ijtihad to realize a comprehensive and contextual Islamic legal justice in Indonesia

Abstract

The phenomenon of children being used as content on social media solely to pursue viewers has generated serious problems, as it neglects their fundamental rights. Based on this concern, this study aims to explain why children should not be exploited as content merely for social media viewers and to analyse it through the perspective of maqasid al-Syariah. The research employs a qualitative approach using the library study method. Data sources were obtained from books, journal articles, proceedings, research reports, and credible official websites, which were then analysed within the framework of maqasid al-Syariah. With its descriptive, analytical, and explorative character, this study does not only describe the practice of child exploitation on social media but also interprets its impact on the five fundamental principles of maqasid al-Syariah, namely religion, life, intellect, lineage, and property. The findings reveal that turning children into digital content clearly harms their best interests. Such practices violate the right to protection, cause psychological trauma, erode privacy, and shift the meaning of the parent–child emotional bond into that of a producer–actor relationship. The analysis of maqasid al-Syariah confirms that this phenomenon contradicts hifz al-nafs as it endangers life, hifz al-‘aql as it disrupts intellectual development, hifz al-nasl as it weakens the foundation of lineage, and hifz al-mal as financial motives cannot justify sacrificing a child’s dignity. Therefore, the exploitation of children in digital media has neither moral nor religious legitimacy. This research contributes to strengthening the conceptual basis for parents, policymakers, and industry actors to be more sensitive in protecting children in the digital sphere, while also enriching academic literature with a robust and applicable normative-religious framework.

Abstract

Government Regulation Number 87 of 2014 establishes key family functions as the foundation for developing resilient and high-quality families in Indonesia. However, existing studies tend to describe these functions normatively, with limited analysis of their alignment with Islamic legal objectives, particularly within the framework of Maqasid al-Shariah. This study addresses that gap by examining the extent to which the regulation reflects the core principles of Maqasid al-Sharah, namely the protection of religion, life, intellect, lineage, and property. This research employs a normative legal method using statutory and conceptual approaches, with Maqasid al-Shariah as the primary analytical framework. The findings indicate that the family functions outlined in Government Regulation Number 87 of 2014 religious, affectionate, protective, reproductive, educational, and economic are substantively aligned with the objectives of Maqasid al-Shariah . The study contributes by offering a more critical and integrative interpretation, demonstrating that the regulation not only serves administrative purposes but also embodies fundamental values of protection and welfare. Thus, it confirms the normative coherence between state law and Islamic legal principles in promoting prosperous, harmonious, and sustainable families
