Abstract

The Ministry of Religion of Malang City in September 2023 launched a religious moderation village. From this village, there are families who have multiple religions, whether from the father, mother, or child. In this case, the head of the Ministry of Religion hopes that there will be an emphasis on the urgency of togetherness and moderation in religion to realize harmony in the Indonesian state, because religious diversity in Indonesia has great potential that must be protected and fostered, especially through a religious moderation program that must be pursued from the smallest sector of the State, namely a multi-religious family. In this study, field research was used to obtain objective, actual, and strong data. The data source was taken directly from the research location, which was done by visiting the informants through interviews. The researcher conducted interviews with multi-religious families in the religious moderation village in Malang City. Multifaith families often face challenges both within and outside the family. The most common challenge is social pressure, meaning that in societies where interfaith marriages and families are accepted or extended families are accepted, although not common, family members may put pressure on spouses and children to choose a religion.

Abstract

Divorce is a social phenomenon that has existed for a long time and remains a complex issue in contemporary society. Although marriage is considered a sacred bond that must be maintained in Islam, divorce can be a last resort to maintain the well-being of both parties in certain situations. The Prophet Muhammad provided an example of how to resolve divorce in a fair and humane manner so as not to cause ongoing conflict in society. It is important to understand how the Prophet handled divorce and how it is applied in the Islamic legal system and modern household life. This research is a literature review with a non-interactive qualitative approach or research that leads to exploration, excavation and deepening of related data to answer questions in the formulation of the problem with the object of the study of the hadith on divorce. This study resulted in the first, divorce is recognized in the history of human religion. Among Jews, divorce is not permitted without an excuse. Meanwhile, in responding to divorce, Christians are divided into three groups. First, Catholics prohibit divorce for any reason. Second, the Orthodox sect. And third, the Protestant sect. Both of these sects allow divorce for certain reasons. Second, the hadith on divorce from a socio-historical perspective found that the Prophet had divorced Hafsah and then referred to it again. The Prophet's efforts to refer to Hafsah show that the Prophet remained careful and tried to choose a peaceful path to maintain the marriage as much as possible. Meanwhile, from a psychological perspective, the hadith on divorce can be understood that the hadith has a universal value of benefit for couples to be careful so that they do not get divorced easily.

Abstract

Membangun rumah tangga yang harmonis tidaklah mudah. Tiap pasangan harus menyiapkan beragam bekal untuk bisa membangun ketahanan keluarga. Ini bertujuan untuk mencegah retaknya hubungan perkawinan dalam rumah tangga. Untuk menanggulangi permasalahan ini, Kementerian Agama menunjuk KUA Kecamatan Dlanggu sebagai salah satu pelaksana program Pusat Layanan Keluarga Sakinah dengan harapan dapat menekan kenaikan pengajuan perceraian di Kecamatan Dlanggu, dan menjaga ketahanan rumah tangga masyarakat Kecamatan Dlanggu. Tujuan penelitian untuk menganalisis pelaksanaan layanan Program Pusat Layanan Keluarga Sakinah dan dampak serta manfaat analisis SWOT dari program Pusat Layanan keluarga Sakinah di KUA Kecamatan Dlanggu. Jenis penelitian ini adalah studi kasus yang bersifat deskriptif dengan metode pengumpulan data Observasi, wawancara dan Dokumentasi. Hasil penelitian ini menunjukkan terdapat strength KUA Kecamatan Dlanggu dalam program Pusaka Sakinah, yaitu layanan berbasis IT, koordinasi yang baik dengan lembaga lain, sarana dan prasarana yang memadahi. Weakneeses yaitu, keterbatasan dana, tidak ada sistem evaluasi yang kuat, minimnya kesadaran masyarakat. Oppurtunities yaitu terdapat dukungan lintas sektoral, pembinaan SDM KUA Dlanggu. Threats yaitu belum ada regulasi yang mewajibkan catin untuk mengikuti program ini, keterbatasan anggaran, kurangnya evaluasi.

Abstract

Perkembangan teknologi digital telah menimbulkan perubahan yang signifikan dalam berbagai aspek kehidupan. Dalam konteks ini, ayah sebagai pemimpin dalam keluarga memegang peranan yang sangat penting dalam membimbing dan mendidik anak-anaknya sesuai dengan ajaran Islam. Namun, di era digital ini, peran ayah dalam pendidikan anak usia dini mengalami tantangan besar akibat meningkatnya ketergantungan anak pada teknologi serta berkurangnya interaksi langsung antara ayah dan anak. Selain itu, paparan terhadap konten yang kurang sesuai dengan nilai-nilai Islam semakin sulit dihindari, sehingga ayah memiliki tanggung jawab lebih dalam mengawasi dan membimbing anak dalam penggunaan teknologi secara bijak. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi pustaka dan teknik analisis yang digunakan meliputi reduksi data, kategorisasi, interpretasi, dan deskripsi untuk menyusun hasil penelitian secara sistematis. Hasil penelitian menunjukkan bahwa dalam Islam, ayah memiliki tanggung jawab besar dalam mendidik anak secara spiritual, moral, dan intelektual. Selain itu, era digital memberikan tantangan baru bagi ayah dalam mengawasi dan membimbing anak dalam penggunaan teknologi. Oleh karena itu, diperlukan strategi pengasuhan yang mengedepankan keseimbangan antara pemanfaatan teknologi dan pendidikan berbasis nilai-nilai Islam, sehingga anak dapat tumbuh dengan karakter yang kuat, bertanggung jawab, dan tetap menjunjung tinggi ajaran Islam di tengah perkembangan zaman.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi faktor-faktor yang mendorong istri menjalankan peran ganda dalam membantu pemenuhan nafkah keluarga di Dusun Ngrancang serta menganalisis keputusan mereka dalam bingkai maqāṣid al-syarī’ah. Dengan menggunakan jenis penelitian kualitatif dan metode studi lapangan, data dikumpulkan melalui wawancara mendalam terhadap sembilan narasumber yang dipilih secara purposif, terdiri dari lima istri pekerja, dua suami, satu kepala dusun dan satu pengusaha lokal yang kemudian diolah secara deskriptif-analitik-eksplanatif. Hasil penelitian menunjukkan bahwa dorongan utama para istri untuk terlibat dalam pekerjaan publik berasal dari ketidakstabilan ekonomi rumah tangga, tingginya kebutuhan hidup, fleksibilitas pekerjaan informal serta adanya dukungan dari suami. Meskipun mereka menjalani beban ganda, para istri tetap menjaga peran domestiknya dengan strategi manajemen waktu dan kerja sama dalam keluarga. Dalam perspektif maqāṣid al-syarī’ah, keterlibatan mereka dipahami sebagai bentuk perlindungan terhadap jiwa (ḥifẓ al-nafs), harta (ḥifẓ al-māl) dan keturunan (ḥifẓ al-nasl) serta sebagai wujud tanggung jawab moral terhadap kemaslahatan keluarga. Hasil temuan penelitian ini memiliki kontribusi ilmiah yang terletak pada penggabungan antara analisis sosial dan pendekatan normatif Islam yang kontekstual, menunjukkan bahwa praktik peran ganda tidak selalu bertentangan dengan norma agama melainkan justru dapat dimaknai sebagai bentuk aktualisasi maqāṣid dalam kehidupan keluarga modern, khususnya di wilayah pedesaan.

Abstract

Komunikasi dan keterbukaan dalam keluarga merupakan fondasi penting bagi tumbuhnya kelekatan emosional dan kepercayaan antarpersonal. Namun tidak sedikit anak justru merasa lebih nyaman berbicara kepada orang lain daripada kepada orang tuanya sendiri. Penelitian ini bertujuan untuk mengungkap alasan-alasan mengapa komunikasi dan keterbukaan anak terputus dari orang tua serta menganalisis fenomena tersebut dalam perspektif Sadd adz-dzarī’ah, yaitu prinsip dalam fikih Islam yang bertujuan menutup jalan menuju kerusakan. Metode yang digunakan adalah studi kepustakaan dengan pendekatan kualitatif yang bersifat deskriptif-analitik-eksploratif, di mana data dikumpulkan melalui pencarian literatur kredibel dari jurnal, buku dan sumber daring melalui teknik boolean search. Hasil penelitian menunjukkan bahwa keterputusan komunikasi dan keterbukaan bukan semata disebabkan oleh niat buruk melainkan akibat akumulasi pola interaksi yang keliru, seperti tekanan komunikasi, respon menghakimi, absennya dialog emosional dan kelelahan psikologis orang tua. Di sisi lain, anak pun kerap mengalami kesulitan dalam mengungkapkan perasaan akibat minimnya tradisi komunikasi terbuka dalam keluarga. Analisis dengan teori Sadd adz-dzarī’ah menunjukkan bahwa bentuk-bentuk komunikasi yang tampak netral namun terus berulang secara tidak tepat dapat menjadi dzarī’ah, yakni sarana menuju keretakan relasi. Tekanan verbal, budaya diam, ketimpangan nilai antar generasi hingga keletihan emosional dibaca sebagai jalan-jalan kecil menuju mafsadah relasional yang perlu ditutup secara preventif. Temuan ini menegaskan bahwa membangun kembali komunikasi yang sehat tidak cukup hanya mengandalkan niat baik melainkan membutuhkan upaya sadar menciptakan ruang aman dan manusiawi agar keterbukaan dapat tumbuh kembali secara utuh dan bermakna.

Abstract

Settlement of inheritance disputes in Indonesia is a complex issue because it involves aspects of Islamic law, national law, and diverse customs. The rules of fiqhiyyah in Islamic law actually provide clear guidelines in the distribution of inheritance based on the Qur'an and Hadith, but in practice they often experience challenges due to differences in interpretation and local cultural influences. This study uses a normative approach by analyzing laws and regulations, Compilation of Islamic Law (KHI), and religious court decisions to examine the implementation of fiqhiyyah rules in resolving inheritance disputes. The results of the study show that although KHI has accommodated the principles of Islamic inheritance law, its implementation in the field is not always consistent with the provisions of fiqh due to the influence of customary and low public understanding of inheritance rights. In addition, differences between generations in the view of the fairness of inheritance distribution also affect the dynamics of disputes. Therefore, strategic steps are needed such as legal education, strengthening the role of religious courts, and implementing mediation involving parties who understand Islamic law and positive law. Efforts to harmonize the applicable legal system are important to realize a fair, proportionate settlement of inheritance disputes in accordance with the values of justice in society.

Abstract

The changing employment status of wives in Muslim households has become a significant social phenomenon impacting family dynamics, especially within Islamic family law. Increasing female workforce participation brings complex shifts in roles, responsibilities, and obligations of spouses, affecting household stability economically and socially. This study explores how Islamic family law responds to and regulates these changes, considering cultural and legal challenges posed by formal employment, such as Government Employees with Work Agreements (PPPK) and Civil Servants (PNS), versus informal employment. The research uses a qualitative library method, analyzing primary and secondary sources including books, journals, fatwas, and legal documents on Islamic family law. Through content and critical analysis, it synthesizes normative legal perspectives with empirical data—especially the mass divorce cases in Blitar and Cianjur—to understand the multifaceted impact of wives’ employment changes on household harmony. Findings highlight that while Islamic law keeps the husband as primary provider, it allows flexibility in recognizing productive roles of working wives, provided family harmony is preserved. The study underscores supportive spousal communication, psychosocial adaptation, and contextual legal interpretation to reduce conflicts from role changes. It concludes an integrative approach involving adaptive legal frameworks, family education based on Islamic values, and responsive social policies is essential to maintain Muslim family stability amid modern socio-economic transitions. This research offers valuable insights for academics, legal practitioners, and policymakers balancing tradition and modernity in Muslim family life.

Abstract

The principles of al-tawābi’, al-aṣhl wa al-fara’ and al-aṣhl wa al-badal in the book al-asybah wa al-nadhair are non-fundamental universal principles that are not limited to partial forms. These principles are closely related to one another, but differ in their main points in context. This study aims to describe and apply the principles of al-tawābi', al-aṣhl wa al-fara', and al-aṣhl wa al-badal and their branches to issues of Islamic family law. This study is normative or library research with a qualitative approach using descriptive analysis methods. The results of the study conclude that the application of the al-tawābi' principle includes the validity of the dowry following the validity of the marriage contract, the rights of children such as lineage, inheritance, and maintenance from their father following the validity of their parents' marriage, and the prohibition of marrying the wife's relatives such as brothers, mothers, daughters, aunts, and grandmothers. Meanwhile, the application of the principle of al-aṣhl wa al-fara’ is that the validity of the marriage guardian determines the validity of the marriage contract, murder and non-Muslims become obstacles for heirs to obtain inheritance, and the existence/absence of rights and obligations attached to husband and wife is determined by the status of the marriage bond. The application of the principle of al-aṣhl wa al-badal is that a wife's request for divorce from her husband through khulu' must be replaced with the payment of 'iwadh (ransom/compensation), the guardian judge becomes a substitute for the absence/excuse of the blood guardian in the marriage contract, and the person entitled to bear the responsibility of providing for the family if the husband is unable to provide for his children and wife due to serious illness, then the responsibility shifts to the husband's family.

Abstract

In the practice of wasiat distribution property in Prambonwetan, wasiat are commonplace for people to manage their property after death. Because wasiat is said to be the last mandate of a person which is carried out after the owner dies. Everyone has full rights to the property they own. But in Prambonwetan village there are conflicts between families caused by unfair wasiat because they are not in accordance with Islamic law or the provisions in the KHI. The formulation of the problem in this study is twofold, namely: (1) How is the practice of implementi wasiat in Prambonwetan village? (2) How is the review of the Compilation of Islamic Law on the implementation of wasiat in Prambonwetan village? The objectives of this study are as follows (1) To examine how wasiat are practiced in Prambonwetan village. (2) To find out how the review of the Compilation of Islamic Law This research method uses a qualitative approach, namely a research method that produces analytical descriptive data. With the type of empirical legal research. The data collected and the findings of this study use technical triangulation, namely combining two data collection techniques, namely interviews and documentation. The results of field research on the implementation of wasiat in Prambonwetan village do not use the guidelines of the Compilation of Islamic Law, wasiat are carried out informally without following the official procedures regulated in the Compilation of Islamic Law. Wasiat are made verbally without notary approval. In practice, there is a distribution of assets exceeding one-third of the assets owned so that it is not in accordance with Article 195 KHI paragraph 2 and Article 201 KHI because the heirs do not agree to the existence of a will exceeding one-third of the assets left behind.
