Abstract

The TRIPS waiver is a proposal by India with South Africa submitted to the WTO. The Proposal contains certain exceptions to the applicable TRIPS Agreement. This Waiver Proposal was submitted because of the inequity conditions between rich and poor countries accessing health products in eradicating the COVID-19 pandemic. This study aims to analyze the success of the TRIPS Waiver in fighting for equity distribution of global health facilities in the context of the COVID-19 pandemic from the start of the pandemic to the end of 2022 by examining the challenges and dynamics of the proposal submission process at the WTO. This study uses a qualitative descriptive method by reviewing literature or secondary data. In analyzing the challenges and dynamics of the TRIPS Waiver Proposal process at the WTO, the authors use the norm life cycle concept and find results that the internalization of norms has not been fully formed because the domination of big countries of WTO members have not agreed on all aspects of the TRIPS Waiver proposal, or it can be said that the TRIPS Waiver Proposal has not been fully agreed upon as a new norm in overcoming global health inequity. Even though the supporting tipping point has exceeded 1/3, full support is needed for the success of the TRIPS Waiver Proposal, as voting in the WTO is based on consensus. The novelty of this research is the use of the norm life cycle concept in the implementation process.

NSP Plus is a reform carried out by South Korea to perfect the NSP. NSP Plus brings new initiatives to address the challenges faced by South Korea and NSP Plus partner countries. This study aims to describe the Covid-19 behind the reform of NSP to NSP Plus. You could say that the NSP has had a pretty good career since the NSP was founded in 2017. The question is what is the connection between Covid-19 and the reforms carried out by South Korea towards the NSP? To solve these questions using a qualitative method with a case study design on the main subject, namely NSP Plus. This research is also supported by data obtained by studying literature and the data obtained are secondary data. With research instruments from previous researchers' experiments. From this it was obtained that Covid-19 was the main factor in the NSP reform. As we know that Covid-19 has had a negative impact on various aspects of life such as health, economy, education, and technology which also has an impact on the welfare of NSP partner countries which also has an impact on trust in South Korea. As a country that is quite capable in all three matters, South Korea feels it has a responsibility to be able to restore trust and also embrace to be able to rise together through reform of the NSP with the launch of 7 new initiatives. It can be concluded that Covid-19 is an urgency for reforms in order to restore the effectiveness of South Korea's cooperation with NSP partner countries which has faded due to the waning of NSP partner countries' trust in South Korea. So that NSP Plus comes with 7 new initiatives that are certainly more effective to be able to embrace NSP partner countries to rise together from adversity due to Covid-19.

Abstract

The minimum age of marriage for a man and woman according to Article 7 paragraph (1) of Law No. 16 of 2019 is 19 years. This paper will discuss how Islamic law reviews the minimum age of marriage according to Law No. 16 of 2019 concerning Marriage. The type of research is normative juridical law research using primary, secondary, and tertiary legal materials. The processing of research materials is carried out by examining the approach of theories, concepts, reviewing the relevant laws and regulations or with a statutory approach. The research material was analyzed in a qualitative descriptive manner. The result of his research is that the minimum age limit for marriage in Law No. 16 of 2019, which is 19 years for men and women, is considered mature to meet the age of maturity in accordance with Islamic religious teachings. However, Islamic law provides for marriage requirements when puberty is complete. Maturity does not depend on age but on the ability and ability to carry out marriage. In addition, the comparative analysis of the minimum age limit for marriage according to Islamic law and Law No. 16 of 2019 concerning Marriage is not much different. Because the Marriage Law is based on the Qur'an, further in Islamic law it is regulated in the Compilation of Islamic Law as a complement to the Marriage Law. Thus, the rules in the Marriage Law are acceptable to the community because there are no provisions that violate Islamic law.
