Abstract

The implementation of the Marriage Law in Indonesia has led to a notable surge in Marriage Dispensation requests, particularly observed at the Bondowoso Religious Court. This study aims to investigate the efficacy of the Marriage Dispensation Integration System (SIDIKA) application at the Bondowoso Religious Court through empirical juridical research methods. Analyzing data from 2019 to 2022, a significant reduction in Marriage Dispensation requests post-SIDIKA implementation is evident, with cases dropping from 299 in 2019 to 718 in 2022. This suggests a successful utilization of SIDIKA in streamlining dispensation processes. The implications underscore the potential for digitalization to enhance efficiency and accessibility in legal procedures concerning marriage dispensation, offering insights for broader adoption in similar contexts globally. Highlights: The surge in Marriage Dispensation requests post-Marriage Law enactment. Drastic reduction in Dispensation requests following SIDIKA implementation. Implications of digitalization for legal procedures and court efficiency. Keywords: SIDIKA, Religious Court, Marriage Law

Abstract

This study investigates the optimal foundation design for multi-story residential buildings through a comparative analysis of two foundation variants under specific geological conditions. Employing the finite element method via SCAD software, we assessed the structural integrity and load-bearing capacities of the foundation options. Material consumption was quantified for each variant, and the consistency of settling calculations for the slab foundation was evaluated. The results indicated that the slab foundation not only minimizes material usage but also simplifies design complexity according to normative standards. Based on technical and economic assessments, the slab foundation is recommended as the most cost-effective and structurally efficient option for such construction projects. This research provides a pivotal foundation design perspective that could influence future architectural and engineering practices in residential building construction. Highlights: SCAD software validates foundation integrity via finite element analysis. Slab foundations offer superior cost and material efficiency. Simplifies design, enhancing construction process efficiency. Keywords: Structural Integrity, Slab Foundation, Reinforcement, Monolith, Building

Abstract

This study explores the development of resource-saving expanded clay technology utilizing underutilized clay raw materials and oil extraction waste. Traditional expanded clay production is energy-intensive and often employs high-quality clay; however, our research identifies technological modes and parameters for producing expanded clay through plastic molding, incorporating substandard raw materials and oil sludge. This method eliminates the need for costly energy-releasing additives and reduces energy costs associated with drying and firing by 25-30%. The research aims to demonstrate the feasibility of this novel production technique in the Republic of Kazakhstan, considering the local availability of raw materials, energy resources, and regional demand for thermal insulation materials in industrial and civil construction. Our findings suggest that integrating 'Desert Sand-Oil Sludge' into the batch composition can effectively produce granulated porous thermal insulation material, aligning with the region's development strategy and offering significant economic and environmental benefits. Highlights: Resource Utilization: Uses oil waste and substandard clay to produce expanded clay, reducing reliance on high-quality materials. Energy Savings: Cuts energy costs for production by 25-30% through innovative processing. Regional Benefit: Aligns with Kazakhstan's strategy by utilizing local resources and supporting construction needs. Keywords: Expanded Clay, Oil Sludge, Desert Sand

Abstract

This study examines the role of administrative remedies in resolving state administrative disputes in Indonesia, particularly in light of Supreme Court Regulation No. 6 of 2018. It investigates the legal obligations and procedural mechanisms governing the utilization of administrative remedies, with a focus on disputes involving Civil Servants (ASN). Utilizing a juridical-normative approach, the research underscores the importance of exhausting administrative remedies before resorting to judicial measures, highlighting the potential consequences of failing to do so. Findings indicate that administrative remedies play a crucial role in safeguarding citizens' legal rights, while judicial authorities retain discretion to dismiss cases lacking administrative recourse. The study underscores the need for adherence to procedural requirements and administrative lawfulness, offering insights for legal practitioners, policymakers, and judicial authorities to enhance the administrative justice system in Indonesia. Highlights: Exhausting administrative remedies crucial for procedural fairness in state disputes. Judicial discretion vital; dismissal possible without exhausting administrative remedies. Legal practice and policy must prioritize procedural compliance and enhancement. Keywords: Administrative Remedies, State Administrative Disputes, Legal Obligations, Procedural Mechanisms

Abstract

This study explores the principle of utmost good faith (itikad baik) in insurance contracts, which mandates full and honest disclosure by all parties to prevent agreement nullification. Despite its critical importance, the enforcement and consequences of breaches are poorly documented, particularly regarding legal outcomes and claims processes. Through normative legal research utilizing primary and secondary sources, this research examines the implications of such breaches and suggests regulatory enhancements. Key findings indicate breaches can lead to contract cancellation, claim denial, or legal actions. The study highlights the necessity of regulatory improvements and increased notarial involvement to ensure equitable and transparent insurance practices. Highlights: Critical Role of Disclosure: Utmost good faith requires complete honesty from all parties in insurance contracts. Consequences of Breach: Violations can lead to severe outcomes like contract termination and denied claims. Need for Regulation: Suggests stronger legal frameworks and notarial oversight to ensure fairness and transparency. Keywords: Utmost Good Faith, Insurance Contracts, Legal Implications, Regulatory Enhancements, Notarial Involvement

Abstract

In the context of global sustainability challenges, the transition from fossil fuel dependency to greener alternatives in transportation is vital. The Greater Madura region of Indonesia, with its substantial natural resources and escalating mobility needs, presents a unique opportunity for implementing electric vehicles (EVs) as a sustainable solution. This study explores the barriers to and facilitators of EV adoption in this region through qualitative methods including interviews and expert judgements with stakeholders across government, industry, academia, and the consumer base. The findings reveal that while there is significant potential for EVs to contribute to green economic growth, challenges such as inadequate charging infrastructure and limited public awareness persist. However, strategic investments in infrastructure, comprehensive policy support, and enhanced public engagement are identified as critical drivers for successful EV integration. The study underscores the importance of multi-stakeholder collaboration in achieving sustainable mobility and economic development in Greater Madura.Highlights: The study identifies critical infrastructural and regulatory barriers to electric vehicle adoption in Greater Madura. It highlights the role of multi-sectoral collaboration in fostering a supportive environment for electric vehicles.
