Abstract

Based on Law Number 12 of 2011, the meaning of statutory regulations is a written regulation that contains legally binding norms. Legislations which are formed and stipulated by state institutions or officials whose sequence is regulated in statutory regulations. Legislation in the form of written decisions, statutory regulations in the form of authorized officials, and statutory regulations that are binding in general, are not always binding but only show that these laws and regulations do not apply concretely or individually. Legislation theory is oriented towards seeking clarity and clarity of meaning and / or understandings and is cognitive in nature, legislation is a process and technique for the preparation of a set of legal regulations. Legislative powers correspond to a hierarchy of regulations. In the Elucidation of Article 7 paragraph 2 of Law Number 12 Year 2011, what is meant by hierarchy is the separation of each type of legislation. The ranking is based on the principle that lower regulations must not conflict with higher regulations. This principle is in accordance with the Stufen Theory or Ladder Theory of the jurist Hans Kelsen in General Theory of Law and State (1945). Legislation is a process of forming state regulations, both at the central and regional levels; and legislation as well as all state regulations is the result of the formation of regulations, both at the central level as well as at the regional level.

Abstract

Bantuan hukum adalah jasa hukum yang diberikan oleh pemberi bantuan hukum, baik oleh Lembaga Bantuun Hukum maupun Advokat secara perseorangan secara cuma-cuma kepada penerima bantuan hukum. Penerima bantuan hukum adalah orang atau kelompok orang miskin. Dalam pembahasan ini merujuk pada Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum. Sebagimana, negara bertanggung jawab terhadap pemberian bantuan hukum bagi orang miskin. Sebagai perwujudan akses terhadap keadilan. Pengaturan mengenai bantuan hukum yang diselenggarakan oleh negara. Harus berorientasi pada terwujudnya perubahan sosial yang berkeadilan. Bantuan hukum merupakan instrument penting dari perlindungan hak asasi manusia. Dengan metode kualitatif dengan berfokus pada fenomena sosial yang berkembang di masyarakat. Penelitian ini diterapkan dengan menggunakan penelitian hukum normatif empiris. Melihat sejauh mana lembaga bantuan hukum berperan serta dalam tercapainya fungsi bantuan hukum, pemerataan siapa saja yang berhak mendapatkan bantuan serta peranya dalam mewujudkan lembaga hukum sebagai access to justice.

Abstract

The crime of theft with violence, theft of motorcycles, and robbery have spread terror massively. It becomes a very frighteningly specter for people in Lampung. To resolve it, it is necessary to build a "Criminal Law Enforcement Policy" (CLE) through effective policy. The question of this paper are about the condition of the existing model of CLE against the crimes in Lampung; and the application of integral and quality of the CLE model of in dealing with crime and robbery on the investigation in the future. The research approach used is legal study (jurisprudence) approach, which is based on ideas and the recent approach. The first step of this research begins with doctrinal legal research by using statute approach, an analytical approach (analytical approach), and the conceptual approach. As a complement, it also uses the approach of socio-legal studies, which examine the law as a social phenomenon related to the enforcement of criminal law. The research location in the jurisdiction of the Lampung Police. The final results are expected to be obtained through legal research are building a model of the integral and qualified CLE applications in dealing with the crime of vehicle theft on the stage of investigation. Model application of CLE will be able to provide guidance in combating this crime, effective, non-transactional, and based on the science of law. The most relevant application model was applied in accordance with the typology and characteristics of the Lampung Police jurisdiction.

Abstract

Setiap negara memili sistem politik yang sama namun dalam pelaksanaan berbeda. Hal ini berdasarkan sistem politik yang di anut oleh masing-masing negara dunia, seperti halnya di Negara Swedia dan Negara Finlandia. Kedua negara tersebut memili kesamaan yaitu parlementer. Permaslaahan dalam penelitian ini adalah bagaiamna perbandingan sistem kengaraan Swedia dan Finlandia berdasarkan sistem politiknya. Metode yang di gunkaan dalam penelitian ini adalah yuridis normatif yaitu berdasarkan ketentuan dokumen, undang-undang. Hasil penelitian ini menunjukan bahwa Sistem politik yang berjalan di Swedia dan juga di Finandia, sebenarnya yang menjadi perbedaan hanya terletak di siapa yang menduduki badan legislatif, eksekutif, dan yudikatif. Mengenai yang menjadi input, antara kedua negara juga sama-sama memiliki kelompok kepentingan. Bisa dari kelompok anomi, kelompok nonasosiasional, kelompok institusional, maupun kelompok asosiasional.

Abstract

Bentuk Hukum Perjanjian Dalam Pelaku Usaha Kecil dengan Penjual adalah Melihat apa saja ketentuan dalam pemenuhan perjanjian yaitu isi dari perjanjian dalam kesepakatan antara kedua belah pihak, Ibu Santi menyepakati untuk menjual 100 gorengan dalam satu hari, namun akibat kelalaian Ibu Santi tidak menjual seratus dalam satu hari yaitu hanya menjual 50 dalam satu hari menyebabkan kerugian bagi Ibu Ratih Berdasarkan Pasal 1234 KUH Perdata bentuk dari prestasi berupa : 1) Memberikan sesuatu 2) Berbuat sesuatu 3) Tidak berbuat sesuatu dan Akibat Hukum Wanprestasi terhadap Perjanjian Dalam Pelaku Usaha Kecil dengan Penjual adalah Dari kerugian tersebut, Ibu Santi seharusnyalah mengganti kerugian terhadap kerugian yang diderita IBu Ratih terhadap 50 Gorengan yang tidak terjual, bentuk kerugian dapat dilihat berdasarkan Pasal 1244, Pasal 1245 dan Pasal 1246 KUH Perdata ganti rugi terdiri dari biaya, rugi dan bunga, maka kerugia tersebut diganti dengan modal awal terhadap 50 gorengan kepada Ibu Ratih, atas kelalaian yang dilakukan oleh Ibu Santi.

Abstract

Tindakan mengedarkan benih lobster keluar wilayah Negara Republik Indonesia masuk dalam kategori penyelundupan. Permasalahan dalam penelitian ini adalah Apakah faktor terjadinya tindak pidana mengedarkan hasil pengelolaan benih lobster ke luar wilayah Republik Indonesia berdasarkan putusan Nomor 731/Pid.B/LH/2019/PN.Tjk, Bagaimana pertanggungjawaban terhadap tindak pidana mengedarkan hasil pengelolaan benih lobster ke luar wilayah Republik Indonesia berdasarkan putusan Nomor 731/Pid.B/LH/2019/PN.Tjk. Metode Penelitian yang digunakan adalah,pendekatan Yuridis Normatif dan pendekatan Empiris. Prosedur pengumpulan data terdiri dari studi kepustakaan (Library Research) dan studi lapangan (Field Research). Sedangkan pengolahan data dilakukan dengan metode editing, sistematisasi, dan klasifikasi data. Analisis yang digunakan adalah kualitatif. Berdasarkan hasil penelitian faktor terjadinya tindak pidana mengedarkan hasil pengelolaan benih lobster didasari pada faktor internal pelaku tidak mengetahui larangan mengedarkan benih lobster dan faktor eksternal didasari atas ekonomi. Kemudian pertanggungjawaban terhadap pelaku tindak pidana mengedarkan hasil pengelolaan pelaku divonis berdasarkan Pasal 88 juncto Pasal 16 ayat (1) Undang-Undang Nomor 31 tahun 2004 sebagaimana yang telah diubah dengan Undang-Undang Nomor 45 tahun 2009 tentang Perikanan dengan pidana penjara selama 10 (sepuluh) bulan dan hukuman denda sebesar Rp.25.000.000,- (Dua puluh lima juta rupiah). Saran dalam penelitian ini adalah, Pemerintah harus menyediakan lapangan pekerjaan untuk menggantikan sumber mata pencaharian masyarakat. Kemudian direkomendasikan kepada penegak hukum untuk melakukan upaya prefentif atau pencegahan.

Abstract

Marriage is a bond between a man and a woman committed to becoming a family. Marriage is a legal social form that describes the smallest social accountability and its legal certainty. Register marriage is a form of welfare in Islamic law family. Islamic Compilations Law (KHI) also regulates itsbat marriage or the institution of marriage that is done by competent authorities on her marriage was not recorded.The aim of this research was to determine the influence of Islamic perspective in an itsbat marriage petition at the Religious Court in Metro city as one of the agencies, legal guarantee to the community of Moslems. The author conducted the research used empiric jurisdictional approach. The analytical method used was descriptive qualitative data. The result of this research is Islam perception becomes the most important thing to regulates itsbat marriage with the divorce as the main factors.

Abstract

The purpose of this research is to look at the shift of the village community in terms of democracy, which was originally from a consensus in determining the village head to be a practical political practice for the village community, without thinking about the consequences that will be felt in the future. The revolving of village funds for development and community empowerment is one factor shifting democratic values. The method in this research is normative juridical. This research shows that developing democratic life in the village is an obligation for the village as a consequence of autonomy, where in the concept of autonomy the given authority is interpreted as a responsibility to accelerate the welfare of the community through improving the democratic system. However, the principles of democracy applied in villages must be developed in accordance with the principles of recognition and subsidiarity based on the socio-cultural village. So that the implementation and development of democratic life in the village is not only done for the sake of democracy itself, but is oriented towards the collective progress of the village community.

Abstract

Copyright Law No. 28 of 2014 concerning Copyright in Indonesia has been ratified since 2014, and came into force and can be implemented or operationalized after two years later in 2016. The main problems that arise with the application of the Copyright Act Cipta in Indonesia there are other issues related to juridical issues regarding the formulation of criminal provisions and related to the problem of unclear issues regarding the formulation of criminal offense qualifications or unclear violations, determination of the subject of corporate law is not regulated, corporate criminal sanctions are not regulated, formulation of sanctions for sanctions that are not clear, against criminal offenses in the Copyright Act. Juridical problems in the Copyright Act in Indonesia will have an impact on the implementation and operation of the current and future Copyright Laws. Furthermore, a discussion on the comparative policy formulation of criminal provisions against corporate legal entities in Indonesia with the Copyright Act in other countries. Copyright Regulations, except for the Indonesian state, do not regulate criminal sanctions against corporations, while Malaysia, Singgapura, Malaysia, Hong Kong and Thailand all regulate criminal sanctions against corporations and include them as strict legal subjects in their material and formal laws. That, proving that, copyright infringement in the eyes of foreign countries is considered important and crucial, so it needs to be regulated in the policy formulation of criminal provisions in that country in order to protect copyright holders, related rights and performers of copyright. Unlike the Copyright Act in Indonesia, only regulates the legal subject of individuals, while corporate legal entities are only referred to in the juridical definition in general provisions of the Copyright Act only, but the provisions in the formulation policy of criminal provisions are not clearly and clearly regulated. Though it is clear that criminal liability sanctions between individuals with criminal sanctions corporate legal entities differ in the imposition of sanctions. Corporations are legal entities created by law. The body that it creates consists of a "corpus" that is, its physical structure and into it the law of entering "animus" which makes the body have a personality. Because the legal entity is a legal creation, except for its creator, its death is also determined by law. To identify how the forms of legal entity are called corporations in general. The corporation has an important characteristic namely; is an artificial legal subject that has a special legal position, has a limited life span, obtains power from the state to carry out certain business activities, owned by shareholders. Shareholder responsibility for corporate losses is usually limited to the shares he owns. Furthermore, to support the objectives of this study, the paradigm used in this study is the post-positivism paradigm. Post-positivism paradigm wants to prove everything is based on reality that can be built based on experience, observation, researchers are neutral towards the object of research, even though researchers holding this paradigm remain neutral towards the object of research, but he wants to examine what actually happens from things that actually as if for sure. The post-positivism paradigm ontologically conceptualizes reality as it really is, but it is realized that there are actually many factors that influence that reality. Consequently, ontologically the post-positivism paradigm conceptualizes the law as a set of rules that apply in society whose behavior will be influenced by economic, political, cultural, and other factors. Epistemologically, researchers sit themselves impersonal, separate from the object of research. The researcher's position on the object of research is neutral and impartial.

Abstract

Pencurian terdiri dari dua unsur yaitu unsur objektif dan unsur subjektif. Unsur objektif tindak pidana pencurian terdiri dari perbuatan mengambil, objeknya suatu benda, dan unsur keadaan yang menyertai atau melekat pada benda, yaitu benda tersebut sebagian atau seluruhnya milik orang lain. Kasus pencurian yang banyak terjadi pada akhir-akhir ini semakin membuat resah masyarakat karena cara yang dilakukan juga terus mengalami perkembangan. Sebagiamana peristiwa hukum yang terjadi di daerah hukum Pengadilan Negeri Liwa dalam Putusan Pengadilan Negeri Liwa Nomor 119/Pid/2019/PN Liwa. Permasalahan yang akan di uriakan dalam penelitian ini adalah mengenai implementasi penegakan hukum terhadap tindak pidana pencurian alat petukangan berdasarkan Pasal 363 Ayat (1) Ke-5 KUHP yang memberikan keadilan kepada masyarakat. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan peraturan perundang-undangan dan bahan lainnya terkait dengan permasalahan penelitian. Hasil penelitian ini menunjukan bahwa hakim mempunyai kebebasan mandiri dalam mempertimbangkan berat ringannya sanksi pidana penjara terhadap putusan yang ditanganinya. Kebebasan hakim mutlak dan tidak dicampuri oleh pihak lain. Hal ini di sebabkan untuk menjamin agar putusan pengadilan benar-benar obyektif. Kebebasan hakim untuk menentukan berat ringannya sanksi pidana penjara juga harus berpedoman pada batasan maksimum dan juga minimum serta kebebasan yang dimiliki harus berdasarkan rasa keadilan baik terhadap terdakwa maupun masyarakat dan bertanggung jawab terhadap Tuhan Yang Maha Esa.
