Abstract

Palm oil companies generate significant profits, making them susceptible to crimes, including fraud. The aim of this research is to understand the regulations regarding fraud in private companies (palm oil companies) and to examine the use of supervisory systems within the Indonesian legal system. This study is conducted using a normative juridical approach. The research findings indicate that there are legal provisions for addressing fraudulent activities in both the public and private sectors (such as palm oil companies). The surveillance system also needs to be implemented by conducting covert observations, unbeknownst to the employees, in order to obtain genuine information. This is done as one of the efforts to control fraud

Abstract

The overcriminalization of petty offences in Nigeria disproportionately affects individuals from poor or vulnerable backgrounds, exacerbating socio-economic inequalities and overburdening the criminal justice system. This issue of global concern contradicts critical human rights agreements such as the International Covenant on Social, Economic and Cultural Rights, the principles of decriminalization of petty offences adopted by the African Commission in 2017 and the Ouagadougou Declaration and Plan of Action on Accelerating Prisons and Penal Reforms in Africa. These petty offences, often remnants of colonial laws, undermine the dignity of African people by criminalizing behaviours linked to economic hardship such as street vending, loitering, begging, sex work, nuisance, breach of peace, etc. This study aims to examine the impact of decriminalizing, reclassifying, and depenalizing petty offences in Nigeria’s criminal justice system, highlighting how these legal reforms can address socio-economic issues without stigmatizing poverty. Utilizing a doctrinal research methodology that incorporates historical and comparative sources, and supported by case studies, this research exposes the exploitative role of law enforcement agents and how this obstruct and over-burden the current system. Findings also reveal how vague and overly broad terms of petty offences lead to indiscriminate arrests, exploitation, and manipulation of charges. The paper recommends that a more efficient criminal justice system would be realized through penal reform, either by decriminalization, depenalization or reclassification, depending on the nature of the offence. Such reforms are projected to reduce the criminal justice system's burden, decrease the criminalization of poverty and promote more equitable outcomes for vulnerable individuals in Nigeria

Abstract

This journal article explores the role of law in achieving social justice within society. The primary objective of this study is to analyze how legal frameworks and institutions contribute to the realization of social justice, particularly for marginalized communities. Utilizing a doctrinal legal research methodology, the research collects secondary data through literature review and legal documents. The findings indicate that law serves as a crucial instrument for balancing individual freedoms and societal interests, thereby fostering an environment where justice can thrive. However, the study also highlights the challenges faced in the implementation of legal provisions, as many judicial decisions are often perceived as unjust by segments of society. This perception underscores the necessity for a more equitable legal system that genuinely reflects the principles of justice and fairness. In conclusion, the synergy between law and power is essential for promoting social justice. The article advocates for reforms that enhance the legal system's responsiveness to the needs of the community, ensuring that justice is not merely an abstract concept but a tangible reality for all members of society

Abstract

This research explores the role of trade unions in enhancing the quality and development of human resources (HR) in the context of globalization and digitalization challenges. Facing the dynamics of labor market changes and rapid technological advancements, the role of trade unions becomes increasingly important in maintaining employee welfare and competitiveness. Using a qualitative approach, this study analyzes how trade unions can influence company policies related to training and skill development, wage negotiations, and the creation of a harmonious work environment. The findings of the study indicate that trade unions serve as the primary advocates for employee rights, ensuring that employees have fair access to skill development programs and training relevant to current market needs. Moreover, trade unions play a crucial role in facilitating dialogue between management and employees, contributing to the creation of more inclusive and responsive work policies in the face of global challenges. Trade unions also face challenges in adjusting their strategies to the trends of digitalization, which require the enhancement of digital skills and adaptation to technological changes

Abstract

Flooding is the submergence of land by water due to heavy rainfall that increases water volume. This situation has also occurred in Bandar Lampung City, which has recently experienced flooding. The disaster affects not only Bandar Lampung but also nearby areas, such as the Bataranila Housing in Hajimena Village, Natar district, South Lampung Regency, which directly borders Bandar Lampung City. This study aims to examine the implementation of flood disaster management policies in Bataranila Housing, Hajimena Village, Natar district, South Lampung Regency. The study employs the policy implementation theory of Van Meter and Van Horn, which includes six indicators: Policy Goals and Objectives, Resources, Inter-Organizational Communication, Characteristics of Implementing Organizations, Implementer Disposition, and Social, Economic, and Political Conditions. This research is a descriptive qualitative study. The findings show that the Village Government has implemented policies according to its capacity and capability, as evidenced by the coordination between agencies, allowing for swift action in emergencies. Furthermore, the implementer disposition indicator reveals that the Village Government shows strong concern for flood issues by advising the community against littering and encouraging environmental conservation. However, limitations in authority and resources allocated for flood management persist, as disaster management is not yet prioritized in the village's programs, resulting in no specific funding allocation
