Abstract

The inconsistency in judicial reasoning regarding trademark disputes in Indonesia, particularly in determining similarity and bad faith, raises concerns about legal certainty and protection. This study aims to critically analyze the ratio decidendi of the Supreme Court Cassation Decision Number 161 K/Pdt.Sus-HKI/2023 and examine its implications for trademark law enforcement. The research employs a normative juridical method using statute, conceptual, and case approaches, with qualitative analysis of legal materials and judicial considerations. The findings indicate that the judges primarily relied on formal parameters, such as similarity in essence and indications of bad faith, while insufficiently addressing substantive aspects, including consumer protection and the broader objectives of trademark law. Furthermore, the interpretation of well-known trademark criteria and evidentiary standards appears inconsistent, potentially leading to divergent applications in future cases. This decision strengthens legal protection for trademark owners but also highlights the need for more coherent and comprehensive judicial reasoning. Therefore, improving interpretative guidelines and strengthening analytical approaches in judicial decision-making are essential to ensure greater legal certainty, fairness, and effectiveness in trademark law enforcement in Indonesia.

Abstract

The illegal trade of protected wildlife in Indonesia continues to occur, including through digital platforms such as social media and instant messaging applications. This condition raises legal issues, particularly regarding the validity of sale and purchase agreements when the object being traded is prohibited by law. This study aims to examine the validity of agreements involving protected birds from the perspective of Indonesian civil law and to analyze the legal consequences arising from such transactions. The research applies a normative legal method using statutory, conceptual, and case approaches. The findings indicate that although agreements between parties may fulfill elements of consent and capacity, they fail to meet the requirement of a lawful cause as stipulated under Article 1320 of the Indonesian Civil Code. The object of the agreement contradicts Law Number 5 of 1990 concerning the Conservation of Natural Resources and Ecosystems. Consequently, such agreements are considered null and void by law and do not produce binding legal effects. Therefore, civil law does not provide legal protection for transactions involving prohibited objects.

Abstract

This study addresses the growing challenges of social conflict, intolerance, moral decline, and weak legal awareness that threaten national security and social order. It aims to examine the theological foundations of security and order from a biblical perspective and to analyze the role of believers as citizens in maintaining social stability within a pluralistic society. The research employs a qualitative descriptive method using a biblical-theological and hermeneutical approach. Data are collected through a literature review of biblical texts, theological writings, and relevant scholarly works, and analyzed using content analysis with contextual interpretation. The findings show that security and order in the Christian perspective are grounded in justice and shalom as expressions of God’s will. The state is understood as an instrument to uphold justice, while believers are called to demonstrate responsible citizenship through obedience to law, active participation in society, and commitment to peace and moral integrity. This study highlights the importance of integrating faith and social responsibility to contribute constructively to national harmony.

Abstract

This study addresses the inconsistency between legal norms and practice in the use of music for commercial purposes without proper licensing and royalty payments. Despite clear regulations under Indonesian Copyright Law, violations remain frequent, as reflected in the dispute between the Collective Management Organization and a Mie Gacoan outlet in Denpasar. This research aims to examine the legal framework governing commercial music use and to analyze the dispute resolution mechanism applied in the case. The study employs a normative legal research method using statutory and conceptual approaches, supported by secondary legal materials such as legislation, legal doctrines, and relevant literature. The findings indicate that the commercial use of music without authorization constitutes a violation of the economic rights of creators. The dispute was resolved through mediation as a form of alternative dispute resolution, resulting in an agreement on royalty payment as compensation. This outcome highlights the effectiveness of non-litigation mechanisms while also revealing a gap between regulatory provisions and their implementation in practice. Strengthening legal awareness and enforcement is therefore essential to ensure optimal copyright protection.

Abstract

The performance of agricultural extension workers plays a strategic role in improving farmers’ capacity and agricultural productivity, yet it is influenced by multiple organizational and individual factors. This study aims to examine the effect of transformational leadership, competence, and work motivation on the performance of agricultural extension workers at the Agency for Agricultural Extension and Human Resource Development, Ministry of Agriculture. A quantitative explanatory approach was employed using multiple linear regression analysis. Data were collected through questionnaires distributed to 62 respondents selected using simple random sampling. The analysis included t-tests, F-tests, and the coefficient of determination to evaluate both partial and simultaneous effects. The findings indicate that competence and work motivation have a positive and significant effect on performance, while transformational leadership shows a positive but statistically insignificant effect. Simultaneously, all independent variables significantly influence performance, with a coefficient of determination (R²) of 71.9%, indicating that the model explains a substantial proportion of performance variation. These results highlight the importance of strengthening employee competence and motivation to improve organizational outcomes in agricultural extension services.

Abstract

This study examines the normative inconsistency in regulating business actors’ liability under Law No. 8 of 1999 on Consumer Protection, particularly in relation to the application of strict liability. The main problem arises from the coexistence of different liability regimes, namely strict liability, fault-based liability, and presumption of liability, without clear conceptual boundaries. This situation creates legal uncertainty and weakens the position of consumers. The research aims to analyze this inconsistency and propose a conceptual reconstruction to achieve legal coherence. This study applies a normative juridical method with statutory, conceptual, and analytical approaches, focusing on Articles 19(1), 19(5), and 28 of the law. The findings show that the overlap of liability models leads to ambiguity in interpretation and inconsistent law enforcement, which enables business actors to avoid responsibility. This condition is not in line with the principles of legal certainty and justice within the welfare state framework. Therefore, clearer differentiation of liability regimes is required through legislative clarification or judicial guidelines so that strict liability can function effectively in protecting consumers and ensuring fair business practices.

Abstract

This study is motivated by the increasing global concern over environmental sustainability and its implications for corporate performance, particularly in carbon-intensive sectors such as energy. As stakeholders demand greater transparency and accountability, companies are expected to manage carbon emissions and adopt green innovation to enhance their value. This research aims to examine the effect of carbon emissions and green innovation on firm value, with additional consideration of carbon emission disclosure and media exposure. The study employs an associative quantitative approach using secondary data from 83 energy sector companies listed on the Indonesia Stock Exchange during the 2019–2023 period. The sampling method used is purposive sampling. Data were analyzed using panel data regression, along with model selection tests, t-tests, F-tests, and the coefficient of determination, supported by EViews 12 software. The empirical results show that carbon emission disclosure does not have a significant effect on firm value. Similarly, green innovation is found to have no significant effect on firm value. Furthermore, the results of the F-test indicate that carbon emission disclosure and green innovation simultaneously do not have a significant effect on firm value. In addition, the coefficient of determination shows a very low explanatory power of the independent variables on firm value. These findings suggest that firm value in the energy sector is more strongly influenced by other factors outside the model, highlighting the need for further research to include additional variables that may better explain firm value dynamics.

Abstract

This study examines the issue of procedural legal defects in auction minutes deeds prepared by notaries acting as Class II Auction Officials, which often lead to legal uncertainty and potential losses for the parties involved. The objective of this research is to analyze preventive measures against such procedural defects and to assess the extent of legal certainty of the resulting deeds. This research employs a normative juridical method based on secondary data, utilizing statutory, case, conceptual, and analytical approaches. The study is grounded in Jan Michiel Otto’s theory of legal certainty and Paul Klemperer’s auction theory. The findings indicate that preventing procedural defects requires a comprehensive four-layer model consisting of regulatory harmonization, professional capacity building of notaries, the implementation of technology-based auction systems, and consistent supervisory mechanisms. Furthermore, the level of legal certainty of auction minutes deeds depends on the severity of the procedural defects, which can be classified into three categories: severe defects rendering the deed null and void, moderate defects making it voidable, and minor defects that do not affect its validity. Regulatory inconsistencies and weak supervision are identified as the main factors contributing to legal uncertainty.

Abstract

In the competitive culinary industry, purchasing decisions are influenced by various factors including location convenience and promotional activities. Mie Jaya Bintaro, South Tangerang, faces intense competition, making it important to understand determinants of consumer purchasing decisions. This study aims to determine the effect of location and promotion on purchasing decisions at Mie Jaya Bintaro, both partially and simultaneously. The research employed a quantitative approach. The population consisted of 28,780 consumers, with a sample of 100 respondents selected using the Slovin formula and simple random sampling technique. Primary data were collected through questionnaires using a Likert scale. The data were analyzed using SPSS version 27 and multiple linear regression analysis. The results indicate that both location and promotion have a significant positive effect on purchasing decisions, either partially or simultaneously. This implies that strategic location accessibility and effective promotional activities play an important role in attracting consumers and increasing purchasing decisions at Mie Jaya Bintaro. Therefore, improving these aspects can enhance customer engagement and business performance. These findings suggest that business managers should prioritize both location strategy and promotional effectiveness to increase consumer purchase intention and sustain competitiveness in the local food market for sustainable growth in competitive culinary industry context specifically.

Abstract

The background of this research is based on the importance of financial performance indicators in influencing investor decisions and stock market movements. ROE and EPS are commonly used to assess a company’s profitability and its attractiveness in the capital market, yet their effects on stock prices may vary depending on market conditions and investor perceptions. This study examines the effect of Return on Equity (ROE) and Earnings per Share (EPS) on the stock price of PT. Bank Rakyat Indonesia Tbk during the period 2015–2024. This study employs a quantitative associative approach using secondary data obtained from official financial reports and the company’s website. The data were analyzed using descriptive statistical analysis, classical assumption tests, multiple linear regression analysis, the coefficient of determination (R²), and hypothesis testing (t-test and F-test) with the assistance of SPSS version 26. The results indicate that ROE has a negative and insignificant effect on stock prices, while EPS has a positive and significant effect. Simultaneously, ROE and EPS significantly influence stock prices, with an R² value of 0.959, meaning that 95.9% of stock price variation is explained by these variables.
