Abstract

This study examines the legal protection of children born from unregistered marriages conducted in polygamous relationships without court permission, as reflected in the Decision of the Kudus Religious Court Number 94/Pdt.P/2022/PA.Kds. The issue arises because unregistered marriages often create legal uncertainty regarding the civil status and rights of children, particularly when the father remains legally married to another woman. This research aims to analyze the legal consequences faced by such children and to evaluate the judges’ legal considerations in determining the child’s legal origin. The study employs a normative juridical method using statutory, case, and conceptual approaches through the analysis of legislation, court decisions, and legal doctrines related to marriage and child protection. The findings indicate that children born from unregistered marriages remain biologically connected to both parents, although administrative barriers may hinder the recognition of their civil relationship with the father. The court determination of child origin serves as an important legal instrument to guarantee the child’s rights to identity, maintenance, education, and inheritance. The judges adopted a progressive legal approach by prioritizing the best interests of the child over the formal absence of marriage registration.

Abstract

This study examines the implementation of Securities Crowdfunding (SCF) in Indonesia, particularly Sharia-based SCF conducted through the LBS Urun Dana platform under OJK Regulation No. 57/POJK.04/2020 and DSN-MUI Fatwa No. 140/DSN-MUI/VIII/2021. The research addresses the limited regulatory and operational studies concerning Sharia SCF practices in Indonesia’s digital capital market. This study aims to analyze the legal framework governing SCF and evaluate the implementation of Sharia-compliant SCF mechanisms in practice. The research employs a normative-empirical method using statutory, conceptual, and case approaches. Data were collected through literature studies and in-depth interviews with parties involved in SCF implementation. The findings indicate that POJK No. 57/POJK.04/2020 has provided a broader legal basis for fundraising through equity, debt securities, and sukuk-based crowdfunding. Meanwhile, DSN-MUI Fatwa No. 140/2021 strengthens Sharia compliance in SCF activities. The study also finds that the implementation of Sukuk Musyarakah by PT Sinergi Nusantara Sentosa through LBS Urun Dana reflects the practical application of Sharia principles in financing real-sector projects transparently and efficiently.

Abstract

This study examines the criminogenic factors that influence theft offenses leading to murder and analyzes the criminal liability of the offender based on Decision of the Denpasar District Court Number 619/Pid.B/2025/PN Dps. The research focuses on the escalation of theft into violent crime resulting in loss of life, which reflects the complex interaction between individual and environmental factors in criminal behavior. This research aims to identify the criminogenic factors underlying the crime and to evaluate their relation to criminal responsibility under Indonesian criminal law. The study employs normative legal research using statutory, case, conceptual, and analytical approaches. Legal materials were collected through library research and analyzed descriptively and qualitatively. The findings show that economic pressure, unstable psychological conditions, and situational circumstances significantly contributed to the offender’s actions. Although the offender initially intended to commit theft, the situation developed into fatal violence during the commission of the crime. Nevertheless, the offender remains criminally liable because the element of fault is fulfilled under criminal law. Criminogenic factors may be considered by judges in sentencing, but they do not eliminate criminal responsibility.

Abstract

Employee performance is a crucial factor in supporting organizational effectiveness, particularly in public institutions responsible for human resource development. Competence and career development are considered important determinants that can improve employees’ work quality, productivity, and organizational contribution. This study aims to analyze the influence of competence and career development on the performance of employees at the Secretariat of the Human Resources Development Agency of Transportation (BPSDM Perhubungan Jakarta). The research employed a quantitative approach with an associative research method. The population consisted of employees of the Secretariat of BPSDM Transportation Jakarta, with 104 respondents selected using a simple random sampling technique. Research data were collected through the distribution of Likert-scale questionnaires. The collected data were processed using SPSS version 25 and analyzed through multiple linear regression analysis. The findings imply that improving employees’ abilities and providing clear career opportunities can encourage greater motivation, professionalism, and responsibility at work. Organizations that consistently invest in competency enhancement and structured career advancement are more likely to create productive employees, strengthen institutional effectiveness, and support the achievement of long-term organizational goals sustainably.

Abstract

Marriage is a legal institution that establishes civil relationships between spouses and their children. In Indonesia, a marriage is legally recognized when it complies with religious law and is officially registered. However, unregistered marriages (nikah siri) remain common and often create legal uncertainty, particularly regarding the civil status of children. This issue becomes more complex when the unregistered marriage is conducted by a man who is still legally married to another woman without obtaining court approval for polygamy. This study aims to analyze the legal consequences for children born from such marriages and to examine the legal reasoning of the judges in the Decision of the Kudus Religious Court Number 94/Pdt.P/2022/PA.Kds. This research employs a normative juridical method using statutory, case, and conceptual approaches. The findings show that children born from unregistered marriages remain biologically related to both parents but may face administrative obstacles in proving their civil relationship with the father. Nevertheless, Constitutional Court Decision Number 46/PUU-VIII/2010 allows such children to establish civil relations with their biological father through valid legal evidence. The determination of a child’s origin by the court provides legal certainty and ensures the fulfillment of rights to identity, maintenance, education, and inheritance. The judges in Decision Number 94/Pdt.P/2022/PA.Kds adopted a progressive approach by prioritizing the best interests of the child over the formal absence of marriage registration.
