Abstract

The position of the Riau Islands Province border area with Singapore is very strategic. Even though it has great potential to contribute to economic improvement, this position has not been utilized optimally, even though border areas are an attractive entry point for investors who intend to invest their capital. The aim of the research is to examine the Riau Islands Province Border Management Model based on Integrated Border Management (IBM) which refers to IBM parameters and competitiveness parameters as an effort to increase competitiveness in the investment sector. This research uses a qualitative analysis approach. The research results show that there are obstacles in the management of the Riau Islands-Singapore Province border area in the form of geographical, legal, management and security obstacles. Meanwhile, investment mechanisms and procedures in the border area of ​​Riau Islands Province with Singapore are not complicated and are regulated using a server. The Integrated Border Management (IBM) implementation model in managing the border between Riau Islands Province and Singapore to increase investment competitiveness uses the Single Window Model which is an integrated public service system.

Abstract

The crime of corruption in Indonesia is regulated by Law Number 31 Year 1999 on the Eradication of Corruption, which was later updated by Law Number 20 Year 2001. This research aims to legally discuss the application of death penalty and asset forfeiture in corruption cases, by considering the principle of justice. The research uses a normative juridical method, in which data is collected from various applicable legal regulations, and the results are presented descriptively-analytically. Although the death penalty is regulated in Indonesian positive law, until now its implementation in corruption cases has never been realized. As a result, the applicable law has not fully provided an adequate sense of justice for the state and the people harmed by acts of corruption. On the other hand, the Asset Forfeiture Bill (RUU) as an effort to recover state losses has been proposed. Asset forfeiture as an additional criminal offense is already regulated in Article 10 letter (b) of the Criminal Code. While the death penalty is the main punishment, both have different implementation procedures, but both aim to realize justice. Both the death penalty and asset forfeiture are expected to have a deterrent effect on perpetrators of corruption and reduce the number of corruption crimes in Indonesia.

Abstract

Murder is an act that is done intentionally to seize or eliminate the life of another person for which anyone who does it will be held accountable. However, in the Law there is a regulation that a person cannot be held accountable, namely in Article 44 paragraph (1) of the Criminal Code.This research is descriptive with a normative legal writing approach taken from secondary data by processing primary legal materials, secondary legal materials and tertiary legal materials obtained from documentation studies or literature searches or collecting library research data (library research) both offline and online which are then analyzed qualitatively. Based on the research results, it was found that the criteria for perpetrators who experience severe mental disorders in the crime of murder are strange delusions or delusions (the content is clearly unreasonable) and not based on reality, somatic (physical) grandeur, religious, jealousy, hallucinations in any form, then the panel of judges decided that the defendant was guilty of committing the crime of murder, but the defendant could not be punished for the reason of forgiveness in Article 44 paragraph (1) and (2) of the Criminal Code. The criteria for severe mental disorders should be known by the relevant police agency where the defendant works, so that something like this, namely the crime of murder, will never happen so that things like this can be anticipated.

Abstract

This study is a legal analysis of victims of defamation crimes through social media, viewed from the perspective of ITE Law No 19 of 2016. In Decision Number 108/Pid.B/2023/PN Mdl, the victim experienced defamation through social media platforms.This case illustrates how the perpetrator used social media to spread information that damaged the victim's reputation. However, this study highlights that the decision did not fully consider the rights of the victim in accordance with the provisions of  ITE Law No 19 of 2016, which regulates the protection of defamation victims in the digital era.This research is conducted with a descriptive approach using qualitative methods with normative juridical research types based on secondary data sources taken from court decision case studies and laws with analysis using relevant legal materials. The results of this study show that the final court decision did not fully comply with the prevailing laws in Indonesia in upholding the rights of defamation victims through social media. Judges should further consider the psychological and social impacts experienced by the victims, as well as provide more just and adequate compensation in accordance with  ITE Law No 19 of 2016. Therefore, this study suggests that future legal decisions should be more favorable to victims and comprehensively consider the impacts of defamation crimes through social media.

Abstract

This research explores the importance of the task of supporting and assisting Palestine in the field of economic defense for Muslims. This research aims to highlight the importance of helping our brothers and sisters in Palestine and fulfilling our obligations to Allah. Through descriptive analysis depicting obligations and responsibilities towards Palestine, this research seeks to provide insight into the moral and ethical dimensions of supporting a just cause. By examining the principles of cooperation in goodness and benevolence as outlined in Islamic teachings, this research underlines the importance of solidarity with those in need. The findings of this research underscore the important role that individuals and society play in upholding justice and compassion in the face of adversity. Ultimately, this study serves as a call to action for all believers to actively engage in efforts to support and assist Palestine in their economic defense.

Abstract

The author focuses on the problem of tropical cyclone Seroja which is known to have hit Rote Ndao Regency for the first time and how to deal with it if the disaster occurs again, so good management is needed. The purpose of this research is to find out how BPBD manages activities in dealing with the Seroja tropical cyclone disaster if it occurs again. This research uses qualitative methods with data collection techniques used through observation, interviews and documentation. In accordance with the type of research above, the authors used an interactive model from Miles, Huberman and Saldana (2019) to analyze the research data with 3 steps, namely data reduction, data presentation and conclusion drawing/verification.The findings obtained by the author in this study are that the management by BPBD in the Seroja tropical cyclone disaster is quite good, however, it still has constraints on funding and manpower which are still lacking. Disaster management in dealing with the Seroja tropical cyclone in Rote Ndao Regency is classified as good, this is because there is good coordination between BPBD and related regional apparatus in overcoming disasters in pre-disaster activities. in order to improve disaster resilient areas, it is advisable to optimize the use of local communities to be ready and alert in the face of disasters.

Abstract

Managing diversity based on local democracy is a preventive step to prevent prolonged conflicts toward social reintegration. Religious segmentation is used as a way to unravel the political conflicts that previously echoed in this area. Efforts to carry out the representation of religious identity (Islamic-Christian) in each Regional Election event are used as a new political format to minimize the tension of identity politics that can erode the spirit of community togetherness. Representation politics is then manifested in the form of pairs of candidates to occupy the position of regional head until the last twenty years have been institutions that have the ability to maintain unity and unity. This research uses a qualitative approach. For data collection techniques, researchers conduct interviews, observation, and documentation procedures. The theories and concepts used in this study include strategy theory, peace theory, conflict theory, conflict prevention concept, Conflict early Warning and Early Response System (CEWERS) concept, and state defense concept. Based on the results of the study, it can be understood that overall, conflict management carried out by the government, both the central government and local governments, is very poor. Efforts to resolve conflicts only occur at the elite level and do not include people who suffer more and lose more due to conflict. An elitist resolution will only meet the interests and demands of the elite. The demands of the masses that should also be accommodated are ignored.  As a form of strategic steps of the local government of Mamasa Regency in preventing conflicts in the administration of government and its relationship with the roots of religious conflicts in Mamasa Regency, some of the descriptions of the steps taken include the Education and Socialization Approach, Increasing the Role of the Religious Harmony Forum (FKUB), Strengthening the Economy and Social Welfare, Fair and Transparent Law Enforcement, and Inclusive Infrastructure and Public Facilities Development.

Abstract

This research is aimed at analyzing the Ratio Decidendi of District Court Decision No. 873/Pdt.G/2013/PN.Sby against notaries who do not read their deeds. The purpose of this research is to determine and analyze the Decidendi Ratio of District Court Decision No. 873/Pdt.G/2013/PN.Sby regarding deeds that were not read by a notary. Then to analyze the responsibilities of notary officials based on article 16 paragraph 1 letter (m) of the Law on Notary Positions. This type of research uses normative juridical research using a statutory approach and a conceptual approach using literature study legal material search techniques. The analysis technique used in this research is the interpretation technique used is systematic interpretation. Based on this, the problem formulation is (1) What is the judge's consideration (Ratio Decidendi) regarding Decision No. 873/Pdt.G/2013/PN.Sby regarding deeds that were not read by a notary? and problem formulation (2) What are the responsibilities of notary officials for deeds that are not read out based on article 16 paragraph 1 letter m based on the Law on Notary Positions? (1) Ratio Decidendi, namely the implementation of a decision with a ruling that the lawsuit cannot be accepted (Niet Ontvankelijk verklaard) in District Court Case No. 873/Pdt.G/2013/PN.Sby, even though in principle the lawsuit is not accepted, the notary still has responsibility for deed that he has made. Even though in principle the lawsuit is not accepted, the judge should consider not carrying out the obligation to read the deed by a notary(2) The Notary's responsibility for a deed that is not read, in this case the Notary can be sued because the authentic deed is downgraded to a private deed and then be sued civilly, namely regarding compensation based on 1365 of the Civil Code, as well as administrative sanctions based on the Code of Ethics. Notary. The advice that can be given is that during the examination of the case, if the lawsuit contains formal defects, it is better to stop it so that the decision is not rejected. Then the parties in the lawsuit must make a detailed lawsuit so that the lawsuit can be granted. Then there are administrative sanctions for the notary who does not carry out the obligation to read the deed. less severe and less of a deterrent effect, then the supervisory board should ensure that the deed made by the notary is truly authentic or not during its inspection and there should be a clear place for complaints for the public to the regional supervisory board.

Abstract

Terror acts carried out by the Al-Qaeda group and its network continue to occur in various countries, including Indonesia. The addition of group members to the network also shows existence over time. This condition is supported by the massive spread of radical ideology by the Al-Qaeda network, especially targeting educational environments and women. In this research, we want to outline the process of spreading radical ideology and the steps that need to be considered from a national security perspective. This research uses a qualitative descriptive method to explain the main discussion. The method used in data collection is secondary data obtained through literature study. The research results obtained are that emotional approaches, cultural factors, and the doctrine of wrong religious views, play an important role in the expansion of radical ideology, where groups of young people and women become victims as well as part of the perpetrators of the spread of radical ideology. Thus, the researcher provides suggestions and input for the Indonesian government in taking a gentle and persuasive approach as a step to minimize the spread of radical ideology in educational environments and among women. This step also aims to change the perspective of groups that have been exposed to radicalism.

Abstract

The adoption of data analytics by Micro, Small, and Medium Enterprises (MSMEs) has become critical for enhancing decision-making processes, improving operational efficiency, and remaining competitive in the digital economy. This study explores the impact of data analytics adoption on job roles and skill requirements within MSMEs. Specifically, it examines how traditional roles like marketing, finance, and operations are transforming to include data-driven decision-making responsibilities. The study highlights emerging roles such as data analysts and business intelligence specialists, as well as the increasing demand for technical skills like data literacy, programming, and machine learning. However, MSMEs face challenges in adopting data analytics, including resource constraints, skill gaps, and cultural resistance. To address these issues, this study employs a qualitative method approach, primarily explorative study. The research develops a conceptual model that outlines the interplay between data analytics adoption, job role transformation, skill development, and organizational adaptation. This model provides insights into how MSMEs can strategically manage the transition to a data-driven culture, overcoming key barriers to successfully integrating analytics into their operations
