Abstract

This research aims to determine the classification of legal relationships between platform service providers and online transportation drivers as gig workers (platform workers). The choice of theme is motivated by the fact that so far the legal relationship that occurs between platform service providers and online transportation drivers is a partnership relationship, but the partnership relationship that occurs does not implement the principles of partnership in its implementation in the business world. This partnership cooperation relationship is not regulated in the Law Number 20 of 2008 regarding Micro, Small, and Medium Enterprises or the Indonesian labour law because the Indonesian labour law only recognizes working relationships, while in the Law Number 20 of 2008 regarding Micro, Small, and Medium Enterprises because the original intent of the partnership in Law No.20/2008 is very different from the partnership relationship that is currently happening between platform service providers and online transportation drivers. Then the writing of this paper uses a normative juridical method with a statutory approach and an analytical approach. The legal material obtained by the author will be analyzed using descriptive analytical analysis techniques, namely a method of analyzing legal material by determining the content or meaning of legal rules in terms of partnership cooperation relationships, as well as the Civil Code. From the results of research with the above methods, the classification of legal relationships between platform service providers and online transportation drivers as gig workers (platform workers) is classified as a partnership relationship based on the Subordinate union of partnership, namely a partnership based on the merger of two or more parties that are subordinately related

Abstract

The obligation of Land Deed Official (PPAT) to provide services without charging a fee to someone who cannot afford it, as regulated in the Republic of Indonesia Government Regulation No.24 of 2016 concerning amendment Government Regulation No. 37 of 1998 concerning Land Deed Official (PPAT) Position Regulation, lacks restrictions in the regulation results in the blurring of norms. The need for definite regulation is necessary considering that the legal basis for providing free services is only stipulated in one article, and if interpreted, it might not be strong enough to become the basis for the implementation of the Land Deed official’s obligation. In addition to the non-regulation of standardization for the person unable to pay, another factor is that the current regulations are no longer relevant when observed from the phenomena occurring in society today. Thus, the issue in this research is the urgency of legal arrangements regarding the obligations of Land Deed Officials in providing services without charging a fee to someone who cannot afford it. The aims of this research are directed to analyze and formulate the urgency of regulation implementation as well as the legal protection provided by the government towards less privileged people. It was to determine whether the regulation remains relevant in its implementation. This research used normative legal research as a method with the Legislative Approach and Conceptual Approach.

Abstract

The development of crabs in Cirebon Regency is one of the important indicators in increasing fisheries production, the increase is based on the high market demand for crab commodities, especially kroyo crabs, causing an impact on the crab population. This research was carried out from February 2022 to March 2023 in 3 sub-districts, namely Suranenggala, Mundu and Gebang. This study aims to determine the stock of kroyo crabs which include carapace width and weight, growth, condition factors, mortality, and exploitation rate. The method used is direct observation of special fishermen catching kroyo crabs. The key crabs measured during the study amounted to 360 individuals with a carapace width range of male crabs of 27-44 mm and female crabs of 28-51 mm, with a frequency distribution of 8 class intervals from December 2022 to February 2023. Tools used to analyze stock conditions using the help of FISAT II and Microsoft Excel software. The first size results were caught in males (L50%=34,18mm) with more than half the asymptotic length (½L∞=23,75mm), while in females (L50%=41,08mm) greater than half the asymptotic length (½L∞=25,75mm). The carapace-weight width relationship of the male crab is W = 1,227L0,510 and the female crab W = 0,371L0,896. Conditions factors in male crabs (1,007) and females (1,008) have the same level of mon-decency. Growth equation of Von Bertalanffy male crab Lt=47,25[1- e(-0,79(t+0,179))] and female crabs Lt=51,45[1- e(-0,99(t+0,138))], So it can be stated that the growth of female crabs is faster than that of male crabs. In male crabs, the Total Mortality Rate (Z) was obtained at 2.99 per year, natural mortality (M) of 1.39 per year, and arrest mortality (F) of 1.60 per year. While in female crabs Z = 2.44 per year, M = 1.57 per year, F = 1.60 per year. The exploitation rate (E) of male crabs was obtained at 0.54 per year and females at 0.35 which means that the capture of Charybdis anisodon waters is still a tendency of underfishing. The pattern of adding new male crabs in Cirebon waters has two peaks, namely in April and August, with female crabs in July. Based on the results of this study, it can be concluded that the stock condition in Cirebon waters is still in the category of suitable for fishing for fishermen.

Abstract

The resolution of Cross-Border Insolvency disputes in bankruptcy practice in Indonesia, with a focus on court decision Number 26/PAILIT/2010/PN.Niaga.JKT.PST. This highlights the lack of specific regulations in Indonesian law regarding cross-border bankruptcy, which causes legal uncertainty in resolving such disputes. This research uses a normative juridical approach to examine the application of rules and norms in positive law. The case analysis includes a bankruptcy petition against Manwani Santosh Tekchand filed by OCBC Securities Private Limited, which raises issues regarding the evidentiary strength of the special power of attorney granted to the Attorney. This article emphasizes the importance of clear rules and legal certainty to protect creditor rights and facilitate the execution of debtor assets. The court decisions discussed in this article highlight the legal implications of cross-border bankruptcy resolution, stating that foreign court decisions can be valid and convincing evidence regarding debts and the relationship between debtors and creditors if they meet formal requirements as authentic deeds. However, foreign court decisions cannot be recognized and implemented by Indonesian courts unless there is a ratified convention or the principle of reciprocity. The article concludes that the resolution of cross-border bankruptcy disputes in bankruptcy practice in Indonesia is limited by existing regulations and suggests the possibility of litigation or filing new bankruptcy applications based on debt instruments.
