Abstract

 Artikel ini bertujuan untuk merekonstruksi pemahaman tersebut dalam kerangka etika biomedik dan filsafat hukum. Dengan menggunakan pendekatan normatif-filosofis, artikel ini menganalisis konsep tanggung jawab, relasi antara legalitas dan moralitas, serta problem keadilan dalam konteks kegagalan tindakan medis. Kasus-kasus medis di Indonesia digunakan sebagai titik refleksi untuk menunjukkan bahwa kegagalan tidak selalu mencerminkan pelanggaran hukum atau etika. Artikel ini berargumen bahwa reduksi kegagalan menjadi malpraktik mencerminkan dominasi cara berpikir positivistik yang mengabaikan kompleksitas moral dalam praktik medis. Oleh karena itu, diperlukan pendekatan filsafat hukum yang lebih integratif untuk memahami tanggung jawab dalam etika biomedik.

Abstract

Penelitian ini mengkaji tindak pidana penipuan dalam transaksi jual beli tanah yang belum bersertifikat dari perspektif yuridis dan sosiologis. Secara yuridis, perbuatan penipuan dalam jual beli tanah termasuk tindak pidana yang diatur dalam Kitab Undang-Undang Hukum Pidana (KUHP) karena mengandung unsur perbuatan melawan hukum dengan maksud untuk menguntungkan diri sendiri maupun orang lain. Ketiadaan sertifikat sebagai alat bukti hak atas tanah sering dimanfaatkan pihak-pihak tertentu untuk melakukan penipuan, sehingga menimbulkan kerugian bagi korban. Dari sisi sosiologis, kasus ini merupakan lemahnya kesadaran hukum masyarakat serta terbatasnya pemahaman terhadap pentingnya legalitas hak atas tanah. Kondisi tersebut akan menimbulkan potensi konflik sosial dan menurunkan rasa kepercayaan dalam hubungan hukum perdata di masyarakat. Penelitian ini bertujuan untuk menganalisis bentuk pertanggungjawaban hukum pelaku penipuan dan dampak sosial yang ditimbulkan terhadap korban dan lingkungan masyarakat. Dengan menggunakan pendekatan hukum normatif, penelitian ini diharapkan dapat memberikan kontribusi dalam mendorong kesadaran hukum masyarakat serta memperkuat upaya pencegahan tindak pidana penipuan dalam jual beli tanah yang belum bersertifikat.

Abstract

Legal protection for medical personnel in health centers is a very important issue considering the strategic role they play in providing health services to the community. Medical personnel at health centers, both doctors, nurses, and other health workers, often face legal risks in carrying out their duties, whether related to negligence, malpractice, or demands from patients or third parties. Based on this, legal protection for medical personnel needs to be clearly regulated to ensure the sustainability of safe and guaranteed health services. Law No. 17 of 2023 is here to provide a guarantee of better legal protection for medical personnel, especially in the first level of health facilities of Puskesmas. Law No. 17 of 2023 provides a stronger legal basis for medical personnel by affirming their rights in carrying out their profession. One of the important aspects of this law is the existence of rules that ensure that medical personnel will not be punished criminally or civilly as long as the medical actions carried out are in accordance with applicable professional standards and medical ethics. The law also provides for a fairer dispute resolution mechanism, providing opportunities for medical personnel to defend themselves in cases that could potentially harm them, as well as ensuring adequate legal assistance. The importance of this legal protection not only provides a sense of security for medical personnel, but also ensures the quality of health services provided to the community. With clear regulations, medical personnel at Puskesmas can focus more on carrying out their duties without worrying about legal repercussions that can arise due to accidental mistakes. Through Law No. 17 of 2023, it is hoped that a better, fair, and professional health service system will be created, which in turn can increase public trust in health services at Puskesmas.

Abstract

The digitalization of healthcare services through the implementation of Electronic Medical Records (EMR) has important legal implications for proving medical malpractice cases. This study aims to analyze the construction of criminal liability for healthcare workers in malpractice cases using EMR-based digital evidence, as well as assess the strength of the evidence and its legal implications in the Indonesian criminal justice system. The method used is normative juridical research with a statutory, conceptual, and analytical approach to related doctrines and decisions. The results show that the criminal liability of healthcare workers remains based on the principles of actus reus and mens rea, with an emphasis on proving the element of fault in the form of intent or negligence. EMR as an electronic document is recognized as valid evidence under the Health Law No. 17 of 2023, Law No. 1 of 2024 as the Second Amendment to Law No. 11 of 2008 concerning Electronic Information and Transactions, and derivative regulations, but its evidentiary strength is highly dependent on the fulfillment of the principles of data authentication, integrity, and validity. The findings also indicate that the use of EMR-based digital evidence has the potential to strengthen the proof of fault through digital forensic support, while also raising challenges related to personal data protection and the risk of criminalization of healthcare workers. This study concludes that harmonization of regulations and technical guidelines for digital evidence is necessary so that EMR can function optimally as evidence that ensures legal certainty, substantive justice, and balanced legal protection for patients and healthcare professionals.

Abstract

The rights of patients with mental disorders are an integral part of efforts to provide fair and equitable health services. In this context, hospitals as health institutions have a responsibility to ensure that patients with mental disorders get their rights, including access to quality health services. This research focuses on the implementation of the rights of patients with mental disorders in obtaining access to health services at Prof. Dr. Muhammad Ildrem Hospital, North Sumatra. The main focus of this study is to evaluate the extent to which the rights of patients with mental disorders are guaranteed and fulfilled in the hospital service system. This study uses a qualitative approach with a descriptive type of research. Data was collected through in-depth interviews with relevant parties, such as medical personnel, patients with mental disorders, and hospital managers. In addition, direct observation of health service practices in hospitals is also carried out to get a more complete picture of the implementation of patient rights. This study aims to analyze the extent of the implementation of the rights of patients with mental disorders at Prof. Dr. Muhammad Ildrem Hospital. and to find out the factors that affect patients' access to health services, as well as to identify obstacles and challenges faced in the implementation of patients' rights. The results of the study show that although there are policies that support the protection of the rights of patients with mental disorders, their implementation in the field still faces various challenges. Some of the factors that affect access to health services for patients with mental disorders include social stigma against mental disorders, limited facilities and trained human resources, and lack of adequate understanding from some medical workers regarding the rights of patients with mental disorders. Conclusion of this study The implementation of the rights of patients with mental disorders at Prof. Dr. Muhammad Ildrem Hospital still needs to be improved, especially in terms of fulfilling access to health services in accordance with their rights. Social stigma and limited resources are the main obstacles that need to be overcome.

Abstract

This study aims to examine the legal consequences of notarial negligence in the preparation of credit deeds and banking security deeds, as well as to identify the forms of inaccuracies that arise in notarial practice at the office of Notary Khairuddin Rasyid in Batam City. The research employs a normative juridical method combined with an empirical approach, involving the analysis of statutory regulations, legal doctrines, and practical implementation of deed drafting. The findings indicate that notarial negligence, both in formal and substantive aspects of deeds, may result in diminished evidentiary value, the potential nullification or voidability of deeds, and legal liability risks for notaries. This study underscores the necessity of applying the prudential principle, professionalism, and strict legal compliance to ensure legal certainty and protection for parties involved in banking transactions.

Abstract

This study aims to analyze the role of Law Number 17 of 2023 in improving the quality of children’s dental health services in Indonesia, particularly in efforts to prevent dental caries. This law was introduced as part of healthcare policy reform to enhance children’s dental health services by emphasizing the importance of early prevention of dental diseases. The main focus of this study is to identify how the implementation of this policy can strengthen the dental healthcare service system in Indonesia in 2025. This research employs a qualitative approach by analyzing the policies stipulated in Law Number 17 of 2023 and examining their effectiveness in practical implementation. Improvements in the quality of children’s dental health services, especially in preventing dental caries, are expected to be achieved through enhanced healthcare facilities and infrastructure, public education, and training for healthcare personnel. With the enactment of this law, the government expects improvements in the management of dental healthcare services to become more effective and efficient. The study focuses on evaluating whether the policy can have a direct impact on reducing the prevalence of dental caries among children in 2025, as well as examining the role of healthcare workers in its implementation across various regions. The results of this study are expected to provide a clear overview of the effectiveness of Law Number 17 of 2023 in achieving the goal of preventing dental caries in children. This research is also expected to serve as a reference for policymakers in formulating more comprehensive and targeted follow-up policies to address children’s dental health issues in Indonesia in 2025.

Abstract

This study aims to examine legal protection for National Health Insurance (JKN) participants in dealing with cases of default in health facility services, with reference to Health Law Number 17 of 2023. The main focus of the research is to understand the extent to which this law provides legal protection for the rights of JKN participants, especially when the health services received are not in accordance with the applicable provisions. Through a normative approach, this study analyzes the provisions contained in the law related to the obligations of health facilities and the rights of JKN participants, as well as the legal impact in the event of a default in health services. This study also identifies forms of default that may occur in the context of implementing JKN, both from the health facility and the JKN program organizer itself. By using an analytical legal approach, it is hoped that solutions can be found to improve the protection mechanism for participants, including legal remedies that can be taken by JKN participants if their rights are not fulfilled. In this study, it is also discussed about the role of supervision and sanctions given to parties who commit defaults, as well as the government's obligation to ensure that health services provided to JKN participants are in accordance with the set standards. Through the results of the analysis, this study concluded that although Health Law Number 17 of 2023 provides a strong legal basis to protect the rights of JKN participants, there are still gaps in its implementation that can harm participants. Therefore, it is recommended that there be increased supervision, a better understanding of the rights of JKN participants, and stricter law enforcement against health facilities that commit defaults. This research makes an important contribution to the development of the health legal system in Indonesia.

Abstract

This study aims to examine the role of the National Narcotics Agency (BNN) in outpatient rehabilitation programs for drug users based on Law Number 17 of 2023 concerning Health. This law provides a clear legal framework regarding medical and social rehabilitation for drug abusers, including access to outpatient rehabilitation services. This research employs a qualitative approach using in-depth interviews and literature review techniques to explore the role of BNN in implementing rehabilitation programs, the challenges encountered, and the effectiveness of the program in reducing the negative impacts of drug abuse. The results of the study indicate that BNN plays an important role in providing outpatient rehabilitation services aimed at helping drug users regain normal functioning within society. This program involves medical and psychosocial services focused on recovery without requiring inpatient treatment. The implementation of outpatient rehabilitation programs by BNN emphasizes education, assistance, and medical as well as psychological treatment for individuals involved in drug abuse.However, the implementation faces several challenges, including limited rehabilitation facilities, a lack of trained human resources, and persistent social stigma attached to drug users. In addition, although Law Number 17 of 2023 provides a strong legal foundation, challenges remain in terms of inter-agency coordination and the availability of rehabilitation services that are affordable and accessible to the wider community. This study highlights the importance of BNN’s role in improving access to rehabilitation for drug abusers and provides recommendations to strengthen collaboration among the government, non-governmental organizations, and communities in supporting the success of rehabilitation programs. The study concludes that the National Narcotics Agency has a crucial role in outpatient rehabilitation for drug users in accordance with the mandate provided by Law Number 17 of 2023.

Abstract

Penelitian ini bertujuan untuk menganalisis faktor-faktor penyebab Pekerja Migran Indonesia (PMI) bekerja secara non-prosedural serta akibat hukum yang ditimbulkan ditinjau dari Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia. Penelitian dilakukan di Desa Lombu, Kecamatan Wewewa Tengah, Kabupaten Sumba Barat Daya dengan menggunakan metode penelitian empiris. Data penelitian diperoleh melalui wawancara langsung dengan responden yang terdiri dari Kepala BP2MI, Kepala Desa, tokoh agama, Lembaga Swadaya Masyarakat (LSM), dan mantan PMI non-prosedural, serta didukung oleh studi pustaka. Hasil penelitian menunjukkan bahwa faktor ekonomi menjadi penyebab utama masyarakat memilih bekerja ke luar negeri melalui jalur non-prosedural. Rendahnya pendapatan, keterbatasan lapangan pekerjaan, tingginya kebutuhan hidup, serta rendahnya tingkat pendidikan mendorong masyarakat memilih jalur cepat untuk bekerja di luar negeri. Selain itu, kurangnya akses informasi mengenai prosedur resmi, pengaruh lingkungan sosial, dan keberadaan agen ilegal turut memperkuat praktik migrasi non-prosedural. Penelitian ini juga menemukan bahwa PMI non-prosedural menghadapi berbagai akibat hukum, seperti hilangnya perlindungan hukum, tidak memperoleh akses bantuan negara, rentan mengalami eksploitasi, deportasi, dan pelanggaran hak asasi manusia di negara tujuan. Di sisi lain, perekrut atau calo yang memberangkatkan PMI secara ilegal dapat dikenakan sanksi pidana sesuai ketentuan Undang-Undang Nomor 18 Tahun 2017. Oleh karena itu, diperlukan peningkatan sosialisasi hukum, pengawasan pemerintah, dan edukasi migrasi aman untuk mencegah praktik keberangkatan PMI secara non-prosedural.
