Abstract

The challenges in translation, interpretation, and extrapolation can result in a gap between students' theoretical knowledge of Sharia contract products and their ability to understand and apply them in practice, particularly in the context of Islamic finance. This research aims to assess the level of understanding of sharia contract products, focusing on three key aspects: translation, interpretation, and extrapolation. Using a survey approach, the study investigates how Sharia economic law students at Universitas Muhammadiyah Makassar comprehend Sharia contract products. The findings reveal that most students possess a satisfactory understanding of the subject matter, demonstrating a reasonably good ability to translate, interpret, and extrapolate the principles of sharia contracts. However, some students face challenges in fully grasping and applying these concepts, particularly in practical scenarios. A number of respondents exhibit a general understanding of Islamic financial institutions but lack the deeper capacity to translate and implement these concepts in real-world contexts.

Abstract

The uncertainty of the wage payment (ujrah) of nylon plastic rope between entrepreneurs and labour prompted this research. The purpose of this study is to determine the practice of giving wages given by , nylon plastic rope entrepreneurs to workers and understand the review of Islamic law regarding the practice of giving work wages between nylon plastic rope entrepreneurs and workers. This research is descriptive qualitative. Data collection techniques are carried out by means of observation, interviews and documentation. The results of this study indicate that the practice of giving work wages is permissible (mubah). The practice of ujrah applied by the Rajawali Rafia Rope entrepreneurs to workers who roll nylon plastic rope is that initially there is an agreement that if the worker has reached the predetermined roll target of approximately 1000 rolls, then the work wage will be given. But in practice, the wage paid depends on how fast the nylon plastic rope is sold. If the sales of nylon plastic rope in the Tali Rafia Rajawali business are sold quickly, the work wages will be given quickly. Although there is no clarity on the time of payment of wages, they still work as labourers.

Abstract

The Indonesian government offers various assistance programs aimed at supporting underprivileged families, including Program Keluarga Harapan (PKH) and Bantuan Pangan Non Tunai (BPNT). In Islamic context, the concept of poverty is categorized into eight asnaf (groups), one of which is the poor. Within this category, two specific terms used are fakir and miskin, both of which describe individuals experiencing poverty but differ in their degree of need. This study aims to analyse the distribution of fakir and miskin individuals, based on data from the Keluarga Penerima Manfaat (KPM) recipients of the PKH and BPNT programs across five sub districts in Boyolali Regency. Utilizing a survey methodology, the study employs the SAGIS application to conduct an interpretative analysis and identify the beneficiaries in these areas. A total of 785 KPMs, who receive aid from the PKH and BPNT programs, were surveyed across the five sub districts. Of these, 209 KPMs (26.7%) were categorized as fakir, 294 KPMs (37.4%) were classified as miskin, and the remaining 282 KPMs (35.9%) did not fall into either category.

Abstract

The sense of help and trust between each other is very high because of the practice of cooperation agreement of fishponds in Ading Village and this practice has long been done. The purpose of the research is to analyse the implementation of fish pond business cooperation and its review according to Islamic law. The object of this research is Ading Village, Wajo Regency. This research is qualitative with an empirical normative approach to solve the problems raised and reviewed with data collection techniques namely observation, interviews, and documentation. The results of this study show that the implementation of cooperation is carried out using a muḍārabah contract where the capital comes from the landowner. However, the implementation is in the form of oral statements without witnesses and the profit-sharing system depends on the initial agreement. This is potentially an element of fraud committed by the investor by taking large quantities of fish and even selling them himself. As for the coverage of losses, it is contrary to Islamic law, because all forms of events in the concept of muḍārabah must be borne by one party, namely the investor, while the manager does not bear losses except for his efforts and work.

Abstract

Maritime development in the Indonesian archipelago faces structural challenges, particularly in obtaining inclusive, sustainable, and locally suitable funding in Maluku. To address these issues, Islamic financing system is considered as a potential alternative to conventional system, using instruments based on Maqasid al-sharia principles. This study aims to evaluate five Islamic financial instruments focusing on productive Waqf, Mudharabah, Ijarah, Musyarakah, and Sukuk, in supporting the development of maritime regions in Maluku. We used MCDA with AHP and TOPSIS methods to evaluate these instruments. The evaluation criteria were economic feasibility, Sharia compliance, risk management, social support, and environmental impact. The results rank instruments, with productive Waqf being the most effective, followed by Mudharabah, Ijarah, and then Musyarakah and Sukuk being less suitable. The study reveals that productive Waqf is at the top due to its non-commercial nature, community participation, and reaching marginalised groups. Mudharabah is considered good for micro and small businesses with profit-sharing. Ijarah is for financing assets without ownership transfer. Musyarakah and Sukuk are less flexible for coastal communities. The findings of this study highlight that Islamic financing systems have an essential role in guiding decision-making in the maritime development.

Abstract

Gold that is traded can be a usurious item, so it is important for bank service providers to ensure that the process is in accordance with the principles of muamalat. This research discusses the gold product financing system provided by Islamic banks in installments and ensures that the transaction is in accordance with Islamic economic law. The type of research used is qualitative by utilizing a sociological approach in aspect of sharia economic law. Data collection using observation, interview and documentation methods. The research was conducted at BSI KCP Majene. The data that has been collected is analyzed by the method of data reduction, data presentation and conclusion drawing. The results of this study indicate that the gold installment system at BSI KCP Majene is carried out through 3 stages, namely the submission, the payment and the contract signing stages. In these stages, the use of murabahah contracts in the gold installment transactions under the BSI Cicil Emas product refers to Fatwa DSN-MUI Number 04/DSN-MUI/IV/2000. However, there is a problem in this stage where the practice resembles debt with the margin gained by BSI and it is classified as qard riba.

Abstract

This study aims to examine the effects of perceived ease of use, perceived usefulness, attitude towards behavior, subjective norms, and behavioral control—on students' behavioral intention to use mobile banking. A quantitative research approach was employed to validate the data collected. This research was conducted in one of Islamic Higher Education in Indonesia, namely IAIN Kendari. The sample consisted of 100 students from IAIN Kendari who actively use mobile banking, selected using a purposive sampling technique. Data was gathered through questionnaires and the analysis was conducted using path analysis regression. The results indicate that students' behavioral intention to use mobile banking is positively influenced by their perceptions of ease of use, usefulness, attitude towards the behavior, subjective norms, and behavioral control. The more favorable individuals' perceptions of convenience, utility, and control over mobile banking usage, the stronger their intention to use the technology. These factors interact with each other, shaping users' behavioral intention to adopt mobile banking.

Abstract

With the growing significance of halal product assurance in ASEAN, the demand for regulatory harmonisation is alarming with the phenomenon of globalization. This study attempts to analyse and compare the regulatory frameworks of halal product assurance from countries in ASEAN to find similarities and differences and aspects that require development. In this study, a comparative method was used to compare the legal and policies of the halal product assurance in Indonesia, Malaysia and Singapore. This study demonstrates that mandatory certification under Indonesian JPH law does ensure comprehensive regulation but impedes several industry sizes as well as intricacies during implementation. In Malaysia, JAKIM has established a known voluntary scheme all over the globe. Its governance system is excellent and has enabled Malaysia to lead the halal market globally. On the other hand, Singapore's model is highly regulated and overseen by MUIS. It serves the global economy while ensuring strict halal standards. The differences in regulations should be harmonised as they could otherwise translate into trade barriers besides affecting consumer confidence. A more integrated, competitive, and visible halal industry in the ASEAN global market can be achieved by harmonising such differences through policy alignments, coordination among agencies, and technological utilisation

Abstract

The banking sector plays a strategic role in advancing sustainable business practices through green banking initiatives, which reduce environmental risks and enhance banks’ reputations amid growing global concerns about climate change. This study examines corporate governance and sustainability performance in Islamic banks, with green banking as a mediator. The data were collected from 158 middle and upper management employees in Islamic banking institutions in South Sumatra, Indonesia. This study used mediation path analysis to assess the effect of corporate governance on sustainability performance directly and through green banking practices indirectly. The results confirm a positive relationship between corporate governance framework and sustainability performance in Islamic banks, suggesting that strengthening governance structures directly improves sustainability outcomes. Moreover, green banking practices partially mediate the nexus between corporate governance and sustainability performance, indicating that corporate governance indirectly improves sustainability performance by promoting green banking initiatives. These findings show the necessity of aligning corporate governance frameworks with green banking initiatives to achieve long-term sustainability goals in Islamic banking.

Abstract

The practice of Yelim as a form of interfaith philanthropy has yet to be scrutinised in the intersecting fields of legal sociology and Islamic economic law. The purpose of this study is to reveal the practice of Yelim in encouraging legal consciousness and social cohesion in the Kei Community and to show the harmony of its practice under the principles of Sharia economic law. This study is qualitative research under the phenomenological approach to deeply interpret the practice of Yelim with a focus on philanthropy, and fund management. Data were obtained through interviews, observation and documentation. The results disclose that Yelim is undertaken accountably by traditional figures and community members. The funds have been used for social purposes, including weddings, funerals, religious buildings, and education support. The philanthropy of both Muslims and Christians in the collection and utilisation exemplifies social solidarity and the principle of distributive justice. According to Islamic economic law, the philanthropy management has been in line with maqāṣid al-sharī'a in the principles of Hifzh al-Nafs and Hifzh al-Māl, linking to maslahah, trust, humanity and justice. The tradition undertaken has shown the legal awareness rooted in social norms and ancestral values, not merely formal legal texts. Yelim serves as a model for integrating customary law and Sharia economic principles in multicultural communities.
