Abstract

Legal drafting is an essential element in legal practice. Legal drafting relates to legal drafting made by legal subjects, both individuals and legal entities (authorized institutions), namely in the form of MoUs, cooperation agreements, and agreements/contracts. A complete understanding of legal drafting is essential for practitioners in various fields and agencies. Legal practitioners must often prepare legal drafts for their interests, clients, or institutions. Likewise, government agencies, state institutions, institutions, bodies, and commissions other than state institutions are interested in preparing legal drafting. Preparing legal drafting must consider the theories, principles, and rules regulated by statutory regulations and universal legal norms, standards, and practices. In this way, the validity of the agreed legal drafting product and the legal interests of the parties who drafted the legal drafting can be legally protected. However, many still need to understand how to prepare legal drafting correctly and legally. This training aims to help and provide students with understanding regarding making agreements. The output of this activity is 1) increasing students' legal awareness; 2) students can agree.

Abstract

This study delves into the procedures and regulatory frameworks governing PKWT, alongside scrutinizing the oversight mechanisms in place to ensure adherence to labor laws, safeguard worker rights, and maintain a balance between employer interests and employee protections. Through empirical legal research, involving interviews, document analysis, and a thorough review of legal statutes, the study unveils the intricacies of PKWT registration at the Makassar City Labor Office and assesses the effectiveness of labor oversight practices. Findings reveal that the registration process for PKWT, whether conducted online within three days or offline within seven days post-signing, necessitates the submission of specific documents to ensure legal and administrative compliance. This mechanism not only provides clarity and accountability but also serves as a foundational aspect of labor law enforcement. However, the research identifies a gap in the legal framework concerning sanctions for non-registration of PKWTs, underscoring a potential area for legislative enhancement to reinforce worker protections. The study further examines the role of labor oversight, conducted by the Makassar City Employment Office and other relevant bodies, in maintaining a fair, transparent, and regulated employment landscape. It categorizes oversight into preventive and repressive measures, each playing a critical role in promoting compliance with labor regulations and safeguarding worker rights. Despite the proactive efforts in education and socialization to foster compliance, limitations in authority at the city level underscore the necessity for coordinated efforts with provincial labor authorities to bolster oversight efficacy.

Abstract

Perkembangan media pembelajaran saat ini sedang menghadapi revolusi industri, secara khusus media pembelajaran kini harus terintegrasi dengan model e-learning, dan terputus dengan komputasi yang mengharuskan sekolah melakukan revitalisasi sistem pembelajaran. Tujuan yang ditetapkan dalam penelitian ini adalah untuk mengetahui bagaimana penerapan learning management system bagi guru sebagai media pembelajaran, untuk mengetahui bagaimana penerapan learning management system bagi peserta didik sebagai media pembelajaran dan untuk mengetahui faktor pemimpin dalam penerapan learning management system sebagai media pembelajaran di SMK Al Azhar . Banyumas. Metode penelitian ini menggunakan deskriptif kualitatif, pengumpulan data melalui wawancara dan observasi, dan analisis data menggunakan analisis reduksi. Hasil penelitian ini menunjukkan implementasi sistem manajemen pembelajaran sebagai media pembelajaran tidak berjalan sebagaimana mestinya. Sebagian guru dan peserta didik masih kesulitan dalam penggunaan LMS sendiri, sehingga proses pembelajaran tidak sesuai dengan tujuan awal. Faktor penghambatnya ialah kurangnya kemampuan teknologi dan literasi digital pada guru yang usianya di atas 40 tahun, budaya wajib pemakaian LMS pada kelas XII bukan pada seluruh kelas disekolah, serta sarana dan prasarana yang belum memadai. Perlu adanya pengembangan dan kesadaran pada guru yang belum cukup menguasai dunia digital, pemerataan penggunaan LMS sebagai media pembelajaran seluruh kelas dan peningkatan penyediaan saran dan prasarana oleh sekolah.

This research explores the crucial role of collaboration in addressing the multifaceted challenge of poverty. Drawing on case studies from diverse contexts, the study examines how partnerships between governments, non-governmental organizations, private sector actors, and communities themselves can contribute to more effective and sustainable poverty alleviation efforts. The analysis highlights the synergistic effects of collaborative approaches, demonstrating how pooling resources, sharing expertise, and coordinating efforts can amplify impact and overcome the limitations of siloed interventions. The study delves into the key elements of successful collaborations, including shared vision and goals, clear roles and responsibilities, effective communication channels, and mechanisms for mutual accountability. Furthermore, it examines the specific contributions of different stakeholders, emphasizing the importance of community ownership and leadership in driving sustainable change. By showcasing successful collaborative models and distilling key lessons learned, this research aims to provide valuable insights for policymakers, development practitioners, and community leaders seeking to forge effective partnerships and weave together a stronger safety net for those experiencing poverty.

Abstract

Restorative justice is an alternative approach to the criminal justice system that focuses on restoring relationships between offenders, victims and society rather than simply punishment. This research aims to explore the application of restorative justice in murder cases, assessing the extent to which the concept can be applied and its effectiveness in the Indonesian criminal law context. In this discussion, possible opportunities for the application of restorative justice are examined, such as the potential for victim recovery and offender reintegration into society. However, major challenges are also identified, including normative barriers in the law, resistance from law enforcement officials, and social and cultural constraints. This study uses a qualitative approach with juridical analysis of murder cases in Indonesia that consider aspects of restorative justice. The results showed that although restorative justice offers much potential to improve the justice system, its application in homicide cases requires significant legal reform, education and training of law enforcement officers, and a paradigm shift in society. In conclusion, while restorative justice has opportunities to be applied in homicide cases, the challenges present require a holistic approach to ensure effective implementation.

Abstract

Land disputes are one of the most common types of conflict in Indonesia, given that land has a very high economic, social and cultural value. As development and land use changes increase, disputes over ownership, boundaries, and land use rights are increasingly common. Mediation as an alternative to out-of-court dispute resolution has been recognised as a faster, cheaper and more efficient method of resolving often complex and sensitive land conflicts. This study analyses the various factors that influence the success of mediation in land dispute cases, including the role of the mediator, legal support, as well as the readiness of the parties involved. The results show that mediation can be an effective tool for resolving land disputes, especially when supported by competent mediators and a strong desire from the parties to reach an agreement. However, the research also identified a number of challenges, such as the power imbalance between the parties, the lack of understanding of the mediation process, as well as limitations in the implementation of mediation outcomes. Thus, while mediation offers great potential in land dispute resolution, further efforts are needed to overcome these obstacles in order for mediation to function optimally in the context of agrarian law in Indonesia.

Abstract

This study aims to understand the psychological dynamics experienced by victims of domestic violence through a qualitative approach. By focusing on the subjective experiences of victims, this study explores how domestic violence affects the mental and emotional state of victims, as well as the coping strategies they use to survive. Data were obtained through in-depth interviews with a number of victims of domestic violence, which were then thematically analysed to identify common psychological patterns. The results showed that victims of domestic violence experience various forms of psychological trauma, including fear, depression, anxiety, and a sense of worthlessness. In addition, many victims also experience internal conflict between the desire to leave a harmful relationship and a sense of emotional or economic dependence on the perpetrator. The coping strategies used by victims vary, ranging from seeking social support to using defensive mechanisms such as denial and avoidance. This study highlights the complexity of the psychological experiences of victims of domestic violence and the need for intervention approaches that are more holistic and sensitive to the psychological needs of victims. The results of this study are expected to contribute to the development of more effective policies and services in supporting the recovery of victims of domestic violence.

Abstract

This study evaluates the impact of decentralisation policies on regional development, focusing on the redistribution of administrative powers from central to local governments. Decentralisation is often implemented with the aim of improving governance, promoting local autonomy, and enhancing public service delivery. This research explores how these policies have influenced economic growth, infrastructure development, and social welfare at the regional level. Using a mixed-methods approach, including quantitative analysis of regional development indicators and qualitative case studies, the findings reveal a complex relationship between decentralisation and regional outcomes. While some regions have experienced significant improvements in governance efficiency and socio-economic conditions, others continue to face challenges such as uneven resource distribution and capacity constraints. The study concludes with policy recommendations aimed at optimizing decentralisation frameworks to ensure balanced and sustainable regional development.

Abstract

Kementerian Pekerjaan Umum dan Perumahan Rakyat (PUPR) RI menetapkan 12 kecamatan yang rawan terjadi banjir di Kabupaten Konawe, salah satunya adalah Kecamatan Lambuya, dimana Desa Waworaha sebagai daerah yang memiliki risiko/kerawanan tinggi. Tujuan dari penelitian ini adalah merumuskan rencana kebijakan penggurangan risiko terdampak banjir di Kecamatan Lambuya, Kabupaten Konawe. Penelitian ini menggunakan pendekatan deskriptif kuantitatif, untuk menjelaskan perencanaan pengutrangan risiko terdampak banjir dengan menggunakan data-data bersifat kuantitatif. Penelitian dilaksanakan di Kecamatan Lambuya, Kabupaten Konawe, Menggunakan data primer dan sekunder. Diperoleh dengan observasi, dan wawancara. Data dianalisis secara deskriptif. Hasil analisis ditemukan bahwa untuk pengurangan risiko banjir perlu ada upaya struktur dan non- struktur. Upaya struktur dengan memeprbaiki fungsi drainase, pembangunan tanggul setiap Sungai, normalisasi Sungai (sedimentasi); dan embung sebagai penampungan air hujan. Upaya non struktur seperti sosialisasi, pembersihan lingkungan.

Abstract

Pembangunan sarana air minum dan sanitasi akan mulai memberikan manfaat untuk memenuhi kebutuhan masyarakat bilamana telah selesai pembangunannya, berfungsi, dan dioperasikan. Namun untuk dapat memberikan manfaat yang berkelanjutan maka sarana dan prasarana air minum dan sanitasi harus dipelihara dan dikelola bahkan dikembangkan. Pengoperasian, pemeliharaan dan pengembangan membutuhkan pengelolaan dan pembiayaan yang realistis agar dapat menjamin efektifitas pelayanannya. Pengelolaan dan pembiayaan dimaksud hanyalah bisa terjadi bilamana tersedia kelembagaan yang dipercaya oleh masyarakat, memiliki kapasitas yang memadai dalam pengelolaan sarana air minum dan sanitasi, dengan ditunjang komitmen untuk bekerja secara jujur dan transparan Pengabdian kepada masyarakat ini difokuskan pada pendampingan dan pelatihan peningkatan keterampilan Pengelolaan Air Minum dan Sanitasi. Penentuan pelatihan ini dilatar belakangi oleh kurangnya kemampuan masyarakat dalam pengelolaan air dan sanitasi. Selain itu Prilaku Hidp Bersih masyarakat di Desa Padalere Utama masih rendah. Bentuk pengembangan sumber daya manusia dilakukan dengan target: 1) membantu untuk meningkatkan kemampuan pengelolaan air minum, 2) memberikan pemahaman bagaimana cara pengelolaan sanitasi, 3) memberikan pemahaman tentang Prilaku Hidup Bersih dan Sehat, 4) membina kerjasama dengan berbagai pihak terkait, dalam hal pengeloaan air minum dan sanitasi. Metode yang digunakan untuk mencapai tujuan adalah melalui ceramah dan pelatihan. Materi-materi terkait pelatihan disampaikan melalui ceramah dan diskusi. Kemudian selanjutnya pelatihan langsung dilaksanakan dengan praktik secara langsung. Kegiatan PKM ini secara keseluruan mendapakan hasil yang baik dan memuaskan. Beberapa komponen yang berhasil dicapai dalam pelaksanaan kegiatan ini diantaranya; ketecapaian tujuan kegiatan, dan tecapainya target materi yang telah direncanakan.
