Abstract

This study aims to analyze the practice of adoptive siblings acting as marriage guardians for adopted children in Akeguraci Village from the perspective of fiqh munakahat. A marriage guardian (wali) is one of the essential pillars of marriage; without a guardian, a marriage is deemed invalid, especially for individuals who have not yet reached the age of accountability (mukallaf). There are two types of marriage guardians: guardians by lineage (wali nasab) and judicial guardians (wali hakim). In Akeguraci Village, there is a case where the marriage guardian did not fulfill the essential requirements for guardianship. The guardian in this marriage was the biological son of the adoptive father. The mistake in the guardianship of the adopted child's marriage, performed by the adoptive sibling, occurred because the biological father refused to act as the guardian. This qualitative research collects field data through observation and interviews to uncover the practice of adoptive siblings acting as marriage guardians in Akeguraci Village. The findings reveal two main points: first, the practice of having the biological son of the adoptive father serve as the marriage guardian occurred because the biological father was unwilling to officiate the marriage, citing the child’s adoption at a young age as the reason. Second, from the perspective of fiqh munakahat, the marriage of an adopted child officiated by an adoptive sibling is invalid, as there is no lineage (nasab) relationship between the adopted child and the adoptive sibling.Al-Jaziri, A. Abstract

This study explores the influence of hedonistic lifestyles on marital infidelity and relationship stability. Using a qualitative approach, data was gathered through in-depth interviews with two couples who have experienced the adverse impacts of such lifestyles on their marriages. The research findings highlight that a hedonistic orientation typically undermines both commitment and satisfaction within relationships, potentially leading to infidelity. Analysis suggests that hedonism distracts individuals from long-term relationship goals, fostering a culture of immediate gratification detrimental to marital cohesion. The study recommends integrating cognitive-behavioral therapy (CBT) techniques in couple counseling sessions to counter these effects. This intervention is aimed at helping couples develop healthier communication patterns and more effective impulse control, which are crucial for maintaining relationship stability. The implications of this research emphasize the importance of proactive therapeutic strategies that focus on enhancing interpersonal connections and managing detrimental lifestyle influences. These findings contribute to understanding how lifestyle choices affect marital dynamics and offer practical approaches for therapists working with couples facing similar challenges.

Abstract

This study evaluates the effectiveness of implementing the Prodeo and Sidang Keliling at the Boroko Religious Court in PERMA No. 1 of 2014. The research method used is qualitative with a juridical-empirical approach, including data collection through in-depth interviews, observations, and document analysis. The results showed that implementing the two programs significantly increased access to justice for the underprivileged. However, fluctuations were found in the realization of annual cases, highlighting the need for budget adjustments and more effective socialization strategies. The discussion emphasized the importance of adapting legal services to the needs of local communities and integrating the provider approach into the broader justice system. The conclusion of this study suggests that with improved management and socialization, the Prodeo and Sidang keliling can continue to effectively support the principles of social justice and broader access to legal services. The implications of this study lead to policy recommendations to optimize resource allocation and socialization strategies in the Indonesian judicial system, especially in the Boroko Religious Court.

Abstract

This study aims to examine the enforcement of underage marriage laws in Luwu Regency. This descriptive qualitative study uses a normative-empirical approach to interview, observation, and documentation methods. The results show that the reality of underage marriages in Luwu Regency is influenced by weak public awareness, lack of serious government supervision or education, and factors such as free association, tradition, family economic background, and patriarchal views. Underage marriage practices based on cultural reasons are subject to a criminal penalty of up to 9 years as outlined in Law No. 12 of 2022 on Sexual Violence Crimes, Article 10, Paragraph (1) and (2). The enforcement of underage marriage follows the legal framework of Law No. 16 of 2019, considering the minimum marriage age, and the Supreme Court Regulation No. 5 of 2019 regarding guidelines for adjudicating marriage dispensation requests. Substantively, underage marriage, from a traditional perspective, aims to preserve lineage rather than prioritize material concerns.

Abstract

This study analyzes the implementation of penal mediation in cases involving children in conflict with the law in Manado. It examines the obstacles encountered during the penal mediation process in these cases from an Islamic legal perspective. The handling of children in legal matters cannot be equated with the treatment of adults who commit crimes. Penal mediation is an appropriate dispute resolution method for cases involving children, using a restorative justice approach by Islamic law. The research method employed is a normative-empirical approach involving direct interviews with investigators in cases of children in conflict with the law and a literature review examining Islamic law related to the application of juvenile justice. The study reveals that the implementation of penal mediation through diversion has not been fully optimized, as not all juvenile cases are mediated during the processes at the police, prosecutor's office, and court levels. Furthermore, the application of penal mediation in Islamic law aligns with the principles of Islah and Suhl, emphasizing the principle of reconciliation (Islah).

Abstract

This research examines the integration of artificial intelligence (AI) in collective ijtihad in Islamic family law, looking for innovative ways to integrate modern technology with Sharia principles. Using a qualitative approach, data was collected through in-depth interviews and focused group discussions with Islamic law experts and AI practitioners and through analysis of relevant legal documents and literature. The study's findings show that AI can speed up the ijtihad process and increase efficiency and accuracy in analyzing and resolving complex family law cases. This research reveals that although AI brings many benefits, its use must still consider compliance with sharia values, with strict ethical supervision. The discussion in this study emphasizes the importance of a balance between technological innovation and adherence to Islamic principles. The conclusions of this study suggest that the use of AI in collective ijtihad not only opens up new possibilities in the practice of Islamic law but also challenges scholars to evaluate and possibly adapt traditional principles to ensure that they remain relevant in a rapidly changing social and technological context.
