Abstract

The results of this study show that the right of liability is the object of guarantee that is most in demand by creditors (banks) as debt collateral. The value of the rights contained in thecertificate of rights of dependents has an important influence in determining the position of creditors as creditors who have preferential rights or only limited to as a concurrent creditor. If the value of the dependent rights has a greater value than the debtor's debt, then the creditor's position as the holder of the liability right is the preferred creditor, which takes precedence repayment of it than other creditors. However, the determination ofthe creditor's position as a preferred creditor or not can also be viewed from the proceeds of the sale of the object of liability from the results of auction execution. If the selling price of theobject of liability is greater than the debtor's debt, the creditor has the right to take precedence over full repayment by taking the proceeds Net sales are only limited to debtors. Meanwhile, if the proceeds from the sale of the object of liability are smaller than the debtor's debt, then the remaining debt of the debtor positions the creditor as a concurrent creditor meaning that the repayment of the remaining debtor is divided equally with other creditors

Abstract

Education is not only the main pillar of nation-building, but through education, a nation moves towards progress. In a country, with different races of people, both men and women became uplifted towards development when illuminated by education. By the united force of men and women, especially women, a country leads its way to the path of success. Women’s empowerment is a necessity for this success. Again, education is the most powerful instrument of empowerment as it generates consciousness that leads to empowerment. Hence, to pave the way for women’s emancipation and empowerment, education plays a pivotal and inevitable role. According to Pandit Jawaharlal Nehru –"If you teach a male, you educate an individual If you educate a lady, you educate an entire family.” Women who are educated and empowered succeed in society, business, and family life. So, Women empowerment refers to increasing women's social, economic, and educational power. It refers to an environment where there is no gender bias and equal rights in the community, society, and workplaces. Today, according to the GOI report, the male literacy rate is currently at 84%, while the female literacy rate is less than 70%. Again, the most recent labor force surveys conducted by the NSSO (National Sample Survey Office) published the female worker population ratio (%) on a status basis in the country during 2013-14 and 2015-16 are 29.6% and 25.8% respectively. Education helps women become aware of their rights, dignity, and opportunities. It gives them the chance to make a more meaningful decision in terms of political engagement and decision-making choices about life. Thus, education can benefit from building self-confidence, self-efficiency, and decision-making power and increasing gender parity in an organization or institution

Abstract

A Notary is a public official who is authorized to perform certain legal formalities, especially to draw up or certify contracts, deeds, and other documents for use in other jurisdictions. The Land Deed Making Officer or PPAT is a public official who is authorized to make certain deeds related to land belonging to Flats Units. The Notary/PPAT is responsible for upholding integrity and morals. Legal protection and guarantees for the Notary/PPAT are needed for the implementation of the legal service function. Protection is needed to protect Notaries/PPATs who have carried out deed-making activities carefully and professionally in accordance with legal provisions and statutory regulations. Notaries/PPATs often receive false information or documents from parties, so Notaries/PPATs are suspected of being involved in criminal or civil cases. The purpose of this study is to examine the legal provisions for the protection of the position of Notary/PPAT in making Deeds based on False Statements (Case Study of Decision Number 73/PDT.G/2012/PN.PL). The research method uses a normative legal approach with qualitative descriptive data analysis. The results of the study show that Notaries/PPATs have the right to obtain legal protection in order to create legal certainty as public officials whose function is to provide services to the public. Notary/PPAT is not responsible in terms of fraud and mistakes made by the parties. The Notary/PPAT is only in charge of recording what is conveyed by the parties to be further stated in the deed or party. The legal protection provided by the state with regulations or legal rules is considered optimal in protecting Notaries/PPATs.

Abstract

This research examines who is prioritized and whether they are prioritized by lawful heirs or heirs according to a will. The research method used is descriptive analysis, a normative-juridical approach, namely library research conducted on secondary data. The results of the study concluded in the Civil Code that the arrangement of heirs with a will must be prioritized with exceptions as long as the contents and distribution in the will do not conflict with the law. The legal considerations are that the will is the final will of the heir but still does not violate the absolute portion of the legitimacy of the heirs. If the will of the heir violates the absolute portion of the legitimacy of the heirs, they may request cancellation, correction, or reduction of the testament.
