Abstract

ASEAN as an international organisation and economoc regional integration has wider meaning than just an economic integration, its also hold social and integration between its members. Consequences are, ecah members have to realize to solve problems together to reach the AEC and ASEAN goals itself. This research use normative method with conceptual approach and teortical approach to find out why the principle and goals in ASEAN didn’t run corectly. Author find outs that there are several obstacles in ASEAN which are: there is still lack of commitment in ASEAN members, ASEAN ideologist which greatly adore the non-intervention principle, and ASEAN weakness in settling conflicts.

Abstract

Inescapable fact in direct localelections in stages capitalization is emerging localelections that were far more expensive than the modelof local elections by Parliament representatives as wellas the nuances of the most notable is the rise of localelection dispute is submitted to the ConstitutionalCourt. Policy of the government and Parliamentthrough Law No. 32 of 2004 which further amendedby Act No. 12 of 2008 specifies that local elections areconducted in direct elections should be viewed as apolitical fact local election law.

Abstract

Insurance plays an important role, because in addition to providing protection against the possibilities of losses that will happen, insurance gives a huge boost to the development of other economies. Unfortunately in practice guarantees legal protection of insurance policyholders are less protected. The problems experienced by the policyholder is always the difficulty of obtaining payment of compensation when evenement happen. The reason why the policy is not paid by insurance companies is due to a lack of knowledge of the community itself, but also because of the insurance agent.

Abstract

Based on Article 18B paragraph (2) of the 1945 Constitution, it states that the state recognizes and respects indigenous peoples and their traditional rights as long as they are still alive and in accordance with community development and the principles of the Unitary State of the Republic of Indonesia, which are regulated in the Law. -Invit. Talking about the village cannot be separated from the original autonomy of the village and based on historical values, in which the village was formed based on the initiative of the local community with due regard to the rights of recognition or the origin of the village and the rights of subsidiarity. This study aims to determine the reconceptualization of village head elections that are directly related to the position of the village as genuine autonomy, which according to the authors that the concept of direct village head elections as regulated in Law Number 16 of 2014 concerning Villages is not properly related to the position of the village as autonomy. original. Therefore, a new concept or ideal concept is needed in the village head election system in Indonesia that takes into account the values that live in the local community and does not run away from the characteristics of the village as genuine autonomy. This research is a type of normative research, which is research conducted by examining library materials. The approach method used in this research is qualitative juridical data analysis, which is a description of the legal materials collected and because the data is not in the form of numbers that will be arranged logically and systematically and without using statistical formulas. . Abstract

AbstractMoney laundering criminal acts are referred to as follow-up crimes and follow-up actions, money laundering is a follow-up action that is continued or an original crime (predicate crime) while the follow-up perpetrator of the findings of a large fund that appears to be clean or lawful, using sophisticated, creative and complex methods The purpose of deciding on this Test is, namely; First, the Current Criminal Law Policy Can Overcome Money Laundering in Indonesia, Secondly, Constraints that back down in the Criminal Law Policy in overcoming Money Laundering in Indonesia. This type of research can be classified in the type of Normative Law research. Data collection in this study uses library research methods (library research) or documentary studies. From the results of the study there are two main things that can be concluded. First, criminal law policy in the renewal of criminal law in the field of money laundering crimes that focuses on the policy formulation of criminal acts, criminal liability, and criminal sanctions In other words, renewal of criminal law requires the existence of research and thinking on a central problem and very fundamental and strategic in formulated in a statutory regulation. Second, Constraints in dealing with money laundering crimes in addition to the Constraints of the Financial Transaction Analysis Center (PPATK), Banking constraints, Police Investigator Constraints and lack of coordination between other law enforcement officers in carrying out money laundering and government efforts to overcome obstacles - these obstacles. In carrying out their respective roles synergies between these institutions are needed to prevent and eradicate money laundering crimes that apply effectively, Suggestion the author, first, It is expected that in money laundering regulations, the government is expected to be more assertive in formulating criminal acts, criminal liability, sanctions or penalties so that money laundering criminals feel more afraid, this is to reduce future money laundering crimes, Secondly, It is hoped that banks will implement a single Idenity number system so that banks can obtain the identity of service users and avoid fake identity users to use with the aim of conducting money laundering. Keywords: Legal Policy, Eradication, Crime, Money Laundering AbstrakTindak pidana pencucian uang disebut sebagai tindak lanjut kejahatan dan tindak lanjut, pencucian uang adalah tindak lanjut yang dilanjutkan atau merupakan kejahatan asal (predicate crime) sedangkan pelaku tindak lanjut atas temuan dana besar yang tampaknya bersih atau halal, menggunakan metode canggih, kreatif, dan kompleks. Tujuan penentuan Tes ini adalah, yaitu; Pertama, Kebijakan Hukum Pidana Saat Ini Dapat Mengatasi Pencucian Uang di Indonesia, Kedua, Kendala yang mundur dalam Kebijakan Hukum Pidana dalam mengatasi Pencucian Uang di Indonesia. Jenis penelitian ini dapat diklasifikasikan dalam jenis penelitian Hukum Normatif. Pengumpulan data dalam penelitian ini menggunakan metode penelitian kepustakaan (library research) atau studi dokumenter. Dari hasil penelitian ada dua hal utama yang dapat disimpulkan. Pertama, kebijakan hukum pidana dalam pembaharuan hukum pidana di bidang kejahatan pencucian uang yang berfokus pada perumusan kebijakan tindak pidana, pertanggungjawaban pidana, dan sanksi pidana. Dengan kata lain, pembaruan hukum pidana mensyaratkan adanya penelitian dan pemikiran tentang masalah sentral dan sangat mendasar dan strategis dalam dirumuskan dalam peraturan perundang-undangan. Kebijakan hukum pidana dalam rangka mengatasi kejahatan pencucian uang dapat dirumuskan sebagai upaya untuk membuat dan membentuk peraturan tentang hukum pidana di masa depan secara efektif dan efisien. Kedua, Kendala dalam menangani kejahatan pencucian uang di samping Kendala Pusat Analisis Transaksi Keuangan (PPATK), kendala Perbankan, Kendala Penyidik Polisi dan kurangnya koordinasi antara petugas penegak hukum lainnya dalam melakukan pencucian uang dan upaya pemerintah untuk mengatasi hambatan. - Hambatan ini. Dalam menjalankan perannya masing-masing diperlukan sinergi antara lembaga-lembaga ini untuk mencegah dan memberantas kejahatan pencucian uang yang berlaku efektif, Saran penulis, pertama, Diharapkan dalam peraturan pencucian uang, pemerintah diharapkan lebih tegas dalam merumuskan tindak pidana , pertanggungjawaban pidana, sanksi atau hukuman sehingga penjahat pencucian uang merasa lebih takut, ini untuk mengurangi kejahatan pencucian uang di masa depan. Kedua, Diharapkan bank akan menerapkan sistem nomor identitas tunggal sehingga bank dapat memperoleh identitas pengguna jasa dan menghindari pengguna identitas palsu untuk digunakan dengan tujuan melakukan pencucian uang. Kata Kunci: Kebijakan Hukum, Pemberantasan, Kejahatan, Pencucian Uang

Abstract

Gratifikasi dinyatakan sebagai tindak pidana korupsi sejak adanya pengaturan di dalam Undang-Undang Pemberantasan Tindak Pidana Korupsi. Gratifikasi sendiri dalam formulasinya masih belum jelas, karena dalam Pasal Gratifikasi tersebut tidak disebutkan batasan minimal nominal seseorang dapat dikenakan Pasal Gratifikasi tersebut. Syarat-syarat pemidanaan baik actus reus dan mens rea, asas-asas pemerintahan yang baik maupun pertanggungjawaban pidana, maka yang dapat dikenakan pidana adalah pejabat yang menerima gratifikasi dan berimplikasi pada suatu kebijakan yang mengandung unsur penyalahgunaan wewenang. Salah satu cara yang dianggap efektif dalam mengungkap kasus gratifikasi adalah dengan memberikan hak kepada terdakwa untuk menjelaskan asal-usul harta kekayaan terdakwa di persidangan.

Abstract

Historically village represent will form of political society and the governance in Indonesia far before this nation and state is formed. Social structure of a kind the village, socialize custom and others have come to social institution having very important position. In order to to realize autonomy and democratize at the village governance, hence need there is clear arrangement and this specially to existence BPD in each regency in Indonesia. In three governance period in Indonesia that is from Orde Lama period, period of Orde Baru and  Reform Order  have acknowledged legislative body and village governance system of village although own difference in the form of it implemented.

Abstract

In the futuristic era, transportation is one of the essential necessities for society. The dynamism of urban and rural life makes all groups of people need adequate and usable accommodation in general. However, land transportation infrastructure in Indonesia is not maximally available so it requires a lot of development. The construction of transportation infrastructure requires enormous costs, so the solution that can be used is to use a financing scheme. One of the simpler financing schemes is direct lending. The purpose of this research are to explain two main topics. First, is to analyze the legal relation of the parties in providing direct lending to finance transportation infrastructure. Second, is to determine the legal remedies that the government can take when the borrowers default on lending to finance transportation infrastructure. The type of research used is doctrinal legal research so as to produce a clear and detailed legal analysis regarding direct lending to finance land transportation infrastructure. When a borrower, who has been bound in an agreement with a lender, breach of contract, the borrower can be subject to two options of legal remedies.

Abstract

AbstractTrade secret is information that is not known to the public in the field of technology and / or business, has economic value because it is useful in business activities, and is kept confidential by the owner of a trade secret. The problem is how is the legal protection of regional food products in the Pekanbaru City based on Law Number 30 of 2000 about Trade Secrets? What are the obstacles in legal protection for regional food products in Pekanbaru City? The method used in this research is socio-legal research. The results of this research indicate that the typical regional food products and their variations in Pekanbaru City are protected as a trade secret based on Law Number 30 of 2000 about Trade Secrets because they are confidential, have economic value, and are kept confidential. If there is a violation of the trade secret, then there are strict criminal sanctions in Law Number 30 of 2000 about Trade Secrets. Constraints in legal protection against trade secrets in the Pekanbaru City, namely there are no regional regulations specifically made to regulate and protect regional specialties, businesses do not know and understand the law regarding trade secrets, and regional specialties are the cultural heritage of the people taught hereditary and inherited from generation to generation without registered rights. Keywords: Typical Foods, Trade Secrets, Legal Protection AbstrakRahasia dagang adalah informasi yang tidak diketahui oleh umum di bidang teknologi dan/atau bisnis, mempunyai nilai ekonomi karena berguna dalam kegiatan usaha, dan dijaga kerahasiaannya oleh pemilik rahasia dagang. Permasalahannya yaitu bagaimana perlindungan hukum terhadap produk makanan khas daerah di Kota Pekanbaru berdasarkan Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang? Bagaimana hambatan-hambatan dalam perlindungan hukum terhadap produk makanan khas daerah di Kota Pekanbaru? Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis. Hasil dari penelitian ini menunjukkan bahwa produk-produk makanan khas daerah maupun variasinya yang ada di Kota Pekanbaru dilindungi sebagai sebuah rahasia dagang berdasarkan Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang karena bersifat rahasia, mempunyai nilai ekonomi, dan dijaga kerahasiaannya. Apabila terjadi pelanggaran terhadap rahasia dagang tersebut, maka ada sanksi pidana yang tegas dalam Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang. Hambatan-hambatan dalam perlindungan hukum terhadap rahasia dagang di Kota Pekanbaru yaitu tidak ada peraturan daerah yang dibuat secara khusus untuk mengatur dan melindungi makanan khas daerah, pelaku usaha tidak mengetahui dan memahami hukum mengenai rahasia dagang, serta makanan khas daerah merupakan warisan kebudayaan masyarakat yang diajarkan secara turun-temurun dan diwariskan dari generasi ke generasi tanpa didaftarkan haknya. Kata Kunci: Makanan Khas Daerah, Rahasia Dagang, Perlindungan Hukum
