Abstract

AbstractKantong plastik menjadi permasalahan yang ada dimasyarakat, karena sering digunakan dengan faktor ringan, transparan, murah, praktis, dan tahan air. Indonesia juga menjadi negara penghasil limbah kantong plastik terbanyak. Permasalahan yang terjadi tersebut, pemerintah membuat kebijakan yaitu kebijakan kantong plastik berbayar sesuai dengan surat pemberitahuan No. S.1230/PSLB3-PS/2016. Kebijakan kantong plastik berbayar juga diterapkan di Kota Kediri. Untuk menganalisis kebijakan plastik berbayar yang dikeluarkan oleh pemerintah maka dalam penelitian ini difokuskan untuk menganalisis kebijakan kantong plastik berbayar dalam prespektif Al-qur’an dan Hadits yang terjadi di masyarakat Kota Kediri. Plastik merupakan bahan yang dapat mengendap dan dapat menyebabkan kerusakan pada lingkungan, seperti banjir. Kantong plastik juga dapat mengakibatkan penyakit karena dalam plastik mengandung Pemlastis Dioktilfalat (DOP) yang diketahui dari sifat toksisitas plastik berdasarkan pada uji karsinogenik. Bagi lingkungan, plastik juga memiliki dampak yaitu pada pencemaran lingkungan. selama ini konsumen secara gratis mendapatkan kantong plastik, maka sekarang konsumen harus membayar Rp 200,-. Penggabungan argumen agama sangat penting dalam membentuk keputusan kebijakan. Ajaran Allah SWT dan Hadist Nabi menekankan pentingnya mempraktikkan moderasi dalam berbagai aspek kehidupan. Sebagai pemeluk agama Islam, sudah menjadi kewajiban bagi kita untuk menahan diri dari perilaku yang berlebihan, karena hal ini dianggap merugikan dan bertentangan dengan prinsip-prinsip memaksimalkan kemaslahatan dan meminimalkan kemudharatan..

Abstract

This research aims to provide an in-depth understanding of the effectiveness of cash waqf implementation at Nu-Care LazisNU Yogyakarta in alleviating poverty, according to the legal effectiveness theory proposed by Soerjono Soekanto. Conducted as field research with a sociological legal approach, the study reveals that, overall, the implementation of cash waqf at Nu-Care LazisNU Yogyakarta is ineffective in alleviating poverty. This ineffectiveness is attributed to various factors, including legal, law enforcement, infrastructure, societal, and cultural factors. Although Nu-Care LazisNU Yogyakarta has not fully optimized poverty alleviation, at least some of the mauqūf alaih who received capital loans from NU-Care LazisNU D.I.Y have managed to surpass the absolute poverty threshold, earning above 1.25 dollars per day or above the national and regional poverty lines. Penelitian ini bertujuan untuk memahami secara mendalam tentang efektivitas pelaksanaan wakaf tunai di Nu-Care LazisNU Yogyakarta dalam mengentaskan kemiskinan menurut teori efektivitas hukum yang dikemukakan oleh Soerjono Soekanto. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan hukum sosiologis. Hasil penelitian ini menunjukkan bahwa secara umum pelaksanaan wakaf tunai di Nu-Care LazisNU Yogyakarta tidak efektif dalam mengentaskan kemiskinan. Hal ini diakibatkan oleh beberapa faktor yaitu faktor hukum, faktor penegak hukum, faktor sarana, faktor masyarakat, dan faktor budaya. Meskipun Nu-Care Lazisnu Yogyakarta belum sepenuhnya dapat mengoptimalkan pengentasan kemiskinan, setidaknya dari sebagian mauqūf alaih yang mendapat pinjaman modal dari NU-Care LazisNU D.I.Y telah mampu melampaui target ambang batas kemiskinan absolut dengan mendapatkan penghasilan di atas 1,25 dolar perhari atau di atas garis kemiskinan nasional dan daerah.

Abstract

Technological developments provide easier access to marketing and buying and selling to the public. This opportunity is also used as widely as possible to market products with various online marketing strategies, one of which is flash sales. Flash sales became popular and became a buying and selling mechanism that was widely applied by online merchants. However, this leaves a question mark about the law of the flash running mechanism both in terms of Indonesia's positive law and sharia economic law in particular. The research method used in this study is qualitative research with a cross-site study approach. Primary data sources are obtained from direct searches on e-commerce platforms, while secondary data is obtained from journals and other published research results. The results of this study show that the flash sale mechanism that has been running so far in Indonesia has been in accordance with Indonesia's positive law and sharia economic law, both from normative, social, and sharia aspects itself.

Abstract

Teknologi digital sudah menjadi bagian dari kehidupan manusia. Manusia lebih memilih teknologi digital karena lebih efisien dan mudah digunakan. Namun, beberapa orang masih menganggap Pondok Pesantren tidak mengikuti perkembangan teknologi digital. tujuan penelitian ini adalah untuk mengetahui penerapan inklusi keuangan digital syariah di Pondok Pesantren Bumi Damai al-Muhibbin Tambakberas Jombang, Untuk mengetahui peran inklusi keuangan digital syariah perspektif maqa>s}id shari>‘ah Jasser Auda. Metode penelitian yang digunakan dengan menggunakan pendekatan studi kasus dan jenis penelitian deskriptif kualitatif. Teknik pengumpulan data menggunakan observasi, wawancara, dokumentasi. Teknik analisis datanya menggunakan analisis deskriptif dengan tahapan reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa Pertama, Penerapan inklusi keuangan digital syariah di Pondok Pesantren Bumi Damai al-Muhibbin Tambakberas Jombang telah mengadopsi inklusi keuangan digital syariah. Melalui penggunaan uang digital dan kartu belanja santri (Wadi>’ah Card), transaksi santri dapat dipantau oleh wali santri dan pengurus pondok. Pondok Pesantren al-Muhibbin juga menerapkan produk tabungan digital berdasarkan prinsip wadi>'ah yad al-d}ama>nah. Dengan prinsip wadi>'ah, Pondok Pesantren al-Muhibbin bertanggung jawab sebagai penerima titipan dana dari santri. Kedua, peran inklusi keuangan digital Syariah perspektif maqa>s}id shari>‘ah Jasser Auda di Pondok Pesantren al-Muhibbin mengikuti beberapa fitur pendekatan sistem yang dikemukakan oleh Jasser Auda, seperti observasi, uji coba, sosialisasi, dan evaluasi. Selain itu, penerapan inklusi keuangan digital harus memperhatikan aspek internal dan eksternal, keterbukaan, hubungan saling berhubungan, dan multidimensi. Tujuan penerapan inklusi keuangan digital antara lain sebagai inovasi peningkatan pelayanan pondok terhadap santri, antisipasi kehilangan uang tunai, dan mendisiplinkan santri dalam pembayaran uang bulanan.

Abstract

Tulisan ini membahas tentang bentuk penerapan dan pengelolaan asuransi yang tidak resmi, dimana asuransi yang non-resmi tersebut dikenal dengan nama serikat kematian. Dalam hal ini serikat kematian ini merupakan salah satu persatuan masyarakat yang dibentuk guna untuk mengantisipasi terhadap terjadinya musibah seperti ada yang meninggal dunia dikalangan masyarakat. Maka, persatuan ini yang berperan penting sebagai garda terdepan bagi masyarakat untuk mengurusi orang yang meninggal dunia (jenazah). Metode penelitian yang dilakukan yaitu menggunakan jenis penelitian Field Research (lapangan), dengan perolehan data primer yang langsung didapatkan melalui observasi dan interview (wawancara). Tulisan ini menguraikan tentang serikat kematian yang dianalisa bagian dari asuransi syariah. Poin yang dilihat yaitu pengelolaan dan output dari dana serikat kematian. Adapun objek yang ditinjau adalah rumah ibadah berupa masjid dan musholla yang ada di daerah Kelapapati, Bengkalis, dimana disana terdapat masing – masing serikat kematian. Hasil penelitian ini memaparkan bahwa tercakup persamaan konsep antara serikat kematian dengan asuransi syariah. Posisi kesamaan tersebut terletak pada adanya iuran dan klaim. Maka, dua poin itu membuat serikat kematian menjadi topik pembahasan yang dilihat pada dimensi asuransi syariah. Akan tetapi, ada berbagai poin penting yang sebenarnya dievaluasi pada serikat kematian ini, hal tersebut adalah pengelolaan pendanaan dan manajemen pengorganisasian.

Abstract

Islamic fintech lending has emerged in response to the need for financial products that comply with Islamic law. In the context of Muslim communities, fintech lending is assessed not only in terms of efficiency and convenience but also for its adherence to Sharia principles. This research is of a normative-empirical type with a content analysis approach. The results of this study indicate that Islamic fintech is a financial innovation that combines technology with Islamic Sharia principles. Parties involved need to understand the contracts used according to their needs, such as sales (al-al-bayʿ), muḍārabah, mushārakah, wakālah bil ujrah, and qardh, the permissibility of which is explained in the Qur'an and rational evidence. In Indonesia, Islamic fintech activities refer to DSN-MUI Fatwa Number 117/DSN-MUI/II/2018. With Islamic values and strict government regulations, economic operations can be conducted in a beneficial, just manner, avoiding riba (usury), maysir (gambling), and gharar (uncertainty).

Abstract

Penelitian ini mengkaji penyelesaian sengketa hukum ekonomi Syariah di Indonesia. Tujuan dari penelitian ini adalah untuk membandingkan model penyelesaian sengketa hukum ekonomi Syariah yang dilakukan sejak masa Rasulullah dan Hukum Positif di Indonesia. Penelitian ini merupakan penelitian normative yang menggunakan sumber data kepustakaan dimana peneliti mengumpulkan data-data secara sistematis dan dianalisis secara obyektif. Hasil penelitian yang diperoleh adalah berdasarkan Hukum Islam Klasik di zaman Rasulullah, penyelesaian sengketa diselesaikan dengan 2 jalur: melalui kekuasaan kehakiman dan di luar kekuasaan kehakiman. Sedangkan berdasarkan Hukum Positif Indonesia, penyelesaian sengketa hukum diselesaikan melalui jalur litigasi dan non-litigasi. Pada Hukum Islam Klasik dan Hukum Positif memiliki kesamaan yaitu sama-sama dapat diselesaikan melalui jalur pengadilan dan di luar pengadilan. Metode tersebut juga dipakai dan diakomodir dalam Hukum Positif di Indonesia berupa mediasi dan arbitrasi, bahkan ada metode lainnya yang dapat dipilih, yaitu: negosiasi, konsiliasi, konsultasi dan penilaian ahli. Sehingga, semakin pesatnya perkembangan ekonomi Syariah diimbangi dengan model penyelesaian sengketa hukum yang dapat menjadi pilihan. This research examines the resolution of Sharia economic law disputes in Indonesia. The aim of this research is to compare the Sharia economic law dispute resolution models that have been implemented since the time of the Prophet and those accommodated by Positive Law in Indonesia. This research is normative research that uses library data sources where researchers collect data systematically and analyze it objectively. The research results obtained are based on Classical Islamic Law at the time of the Prophet, dispute resolution was resolved in 2 ways: through judicial power and outside judicial power. Meanwhile, based on Indonesian Positive Law, legal disputes are resolved through litigation and non-litigation. Classical Islamic Law and Positive Law have similarities, namely that they can both be resolved through the courts and outside the courts. In the time of the Prophet, the court route was known as al qadha. This method is also used and accommodated in Positive Law in Indonesia in the form of mediation and arbitration, there are even other methods that can be chosen, namely: negotiation, conciliation, consultation and expert assessment. Thus, the increasingly rapid development of Sharia economics is balanced with legal dispute resolution models that can be an option.

Abstract

Brokerage services have experienced growth and development in the business world in society. Business actors, especially large chili farmers, are increasingly relying on intermediary services to facilitate the sale of their crops so that their income can be disbursed more quickly. The aim of this research is to explain the review of Islamic business ethics and muamalah fiqh on the practice of delivery services in buying and selling large chilies in Tegalan Village, Kandat District, Kediri Regency. This research uses a descriptive qualitative approach. Obtaining data through observation, interviews, and documentation is finally analyzed using data reduction, data presentation, and conclusions. Checking the validity of the data uses extended participation techniques, persistence or regularity of observations, and data triangulation. Research findings show that the review of Islamic business ethics which includes unity (tauḫid), equilibrium/balance (al-'adl), free will (free will), and responsibility (responsibility) has not been fully fulfilled in this practice. Furthermore, this practice is partly by the pillars and requirements of muamalah fiqh, namely aqid and ma'qud alaih, but what is not appropriate is related to maudhu' al-aqid and sighat of the contract. The practice of intermediary services in buying and selling large chilies in Tegalan Village, Kandat District, Kediri Regency, involves two transaction schemes. The basic difference between these schemes: there is an additional transaction in the second scheme, namely that the service provider provides capital loans to farmers. This practice uses a samsarah contract, where the intermediary who sells the farmer's chili does not bear the risk but instead charges operational costs to the farmer. These operational costs are not explained in detail to farmers and the prices agreed between intermediaries and market traders are not communicated to farmers.

Abstract

This research is motivated by the emergence of a zakat management model with the launch of the zakat village initiated by the Ministry of Religion with the National Amil Zakat Agency which is intended to reduce poverty and seek the welfare of mustahik zakat recipients. These efforts are made to encourage the economy of the people which aims to alleviate poverty in underdeveloped outer areas including in the village of Besole Tulungagung. This research aims to describe and analyze the various programs contained in the zakat village through the perspective of empowerment and utilization of zakat so as to obtain comprehensive information and explanations related to the successful implementation of the zakat village program in Tulungagung.  This research is a qualitative type with a case study approach in the field. Data sources were obtained through direct observation in Besole village, interviews with related parties and documentation. The result of the research shows that kampung zakat is a zakat management development program, which is not only consumptive but also productive. Some programs in the zakat village as an effort to empower the community are well implemented and have a very positive impact on the economy of mustahik in Besole village even though it has not run optimally. The program that can be said to be successful according to the author's opinion is the goat livestock assistance program, as evidenced by the growing number of recipients and the number of goats.

Abstract

This research examines the productive zakat development model in Indonesia and Brunei Darussalam through a comparative approach. Productive zakat is an effort to utilize zakat funds to improve the economic welfare of mustahik in a sustainable manner. In Indonesia, zakat is regulated by Law no. 23 of 2011 and managed by the National Amil Zakat Agency (BAZNAS) and various Amil Zakat Institutions (LAZ). Meanwhile, in Brunei Darussalam, zakat is managed by the Brunei Islamic Religious Council (MUIB) based on sharia law. This study found that the two countries have different approaches but both focus on empowering the mustahik economy through programs such as providing business capital, skills training and assistance with production equipment. Indonesia shows diversity in program implementation with extensive collaboration between various institutions, while Brunei Darussalam utilizes full government support for more focused and effective program implementation. Challenges facing Indonesia include unequal distribution and weak supervision, while Brunei faces challenges in economic diversification. However, both countries have great opportunities to increase the effectiveness of productive zakat programs through technological innovation and closer collaboration between the public and private sectors. This study provides insight into best practices and lessons that can be drawn from each country to improve the welfare of mustahik in a sustainable manner. The conclusion of this research emphasizes the importance of strengthening the legal and institutional framework, as well as increasing transparency and accountability in the management of productive zakat.
