Abstract

This study uses an Islamic approach with a fiqh perspective based on Qawāid Fiqhiyyah to address corruption. This means they combine subjective (based on Islamic views), primordialist (rooted in Islamic religious and cultural identity) and dogmatic (based on strictly applied Qawāid Fiqhiyyah principles) approaches to deal with the complex and dilemmatic problem of corruption. This approach allows them to treat corruption not just as a legal crime, as well as a moral and social problem that needs to be resolved by taking into account religious values ​​​​and the principles of justice and public benefit regulated in Qawāid Fiqhiyyah. In the context of Qawāid Fiqhiyyah, this approach reflects the main principles that focus on justice, community welfare and prevention of damage. Qawāid Fiqhiyyah emphasizes the importance of fair and efficient law enforcement (الضرر يزال - "damage must be eliminated"), maintaining the public benefit (المصلحة العامة - "public interest"), and maintaining moral and religious values ​​(الأمور بمقاصدها - "everything is based on goals"). Confirming the law, improving the economic conditions of officials, and overcoming the culture of hedonism and consumerism are in line with these principles, which ultimately aim to create a just and prosperous society.

Abstract

The environmental crisis is characterized by climate change with an increase in the earth's average temperature of 1.50 - 2.00 Celsius. Climate change can increase the risk of hydrometeorological disasters by 80% of the total disasters that occur in Indonesia. Overcoming the impacts of climate change requires a lot of money. One form of funding instrument to overcome the impact of climate change is green sukuk. Research Objective to critically analyze the trend of green sukuk research in Indonesia. This type of research is a literature review using PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analysis) through four (4) stages, namely identification, screening, eligibility and included. The results showed that the green sukuk trend has dominated in the development of SDGs over the past 3 years. The issuance of green sukuk has contributed to the achievement of the Sustainable Development Goals (SDGs) Framework. From the maqāṣid al-sharī`ah framework through the interrelated hierarchy of the system of Islamic law approach, green sukuk used for eligible green projects fall into the urgency of al-ḍarūrīyah, al-ḥājīyah and al-taḥsīnīyah. The benefit created is maqāṣid al-khāṣṣah which is in line with QS. From these two (2) verses, there is a basic objective of sharia, namely hifẓ al-bi`ah. It is necessary to expand uṣūl al-khamsah by adding one component of hifẓ al-bi`ah (becoming uṣūl al-sittah). So that maqāṣid al-sharī`ah can accommodate universal benefits in response to increasingly severe environmental damage. Green sukuk has the scope of hifẓ al-bi`ah within the framework of maqāṣid al-sharī`ah including mitigation (al-ḍarūrīyah), adaptation (al-ḍarūrīyah), environment (SDGs) (al-ḥājīyah), social - economic (SDGs) (al-taḥsīnīyah), and governance (al-taḥsīnīyah).

Abstract

The role of the Banda Aceh City government in increasing Halal Tourism Destination Development which is seen based on the number of visitors as the main benchmark in improving the economy of the community in this sector. There were 9 (nine) informants interviewed including the Banda Aceh City Tourism Office. This research was made to see from afar what are the shortcomings of the provision of halal tourism in Banda Aceh City. The research method used is qualitative by conducting interviews, as well as data reduction as the acquisition of research data. The results of the research obtained based on interviews with the Banda Aceh City Tourism Office, visitors, and traders are that the number of tourists coming to tourist destinations is increasing every year, except in 2020 due to Covid-19, most foreign visitors come from Malaysia, this is the application of regulations by the Banda Aceh City Tourism Office has improved, and the application of halal certification by business actors as one of the supporting indicators of Banda Aceh City Tourism.

Abstract

Nowadays, Islam is often considered as a radical teaching and embraced by extreme people, especially because of the teaching of jihad. So to straighten out this view, an in-depth study is needed that discusses the correct concept of jihad in Islam, and among the scholars who always try to do this is Al-Buthy. For this reason, the question of this research will answer how the concept of jihad according to Al-Buthy and how it is actualized in modern times. This research is qualitative research and uses normative juridical methods with a conceptual approach. The results of this study indicate that in the book al Jihad fi al Islam; Kaifa Nafhamuhu wa Kaifa Numarisuhu, Al-Buthy understands the meaning and nature of jihad as an oral da'wah to spread and uphold the sentence of Allah. The explanation is that every method or method carried out orally using any media is included in the act of jihad. This is the essence of jihad that was always carried out by the Prophet from the beginning of his mission as a Messenger until his death. Then regarding jihad in the sense of war, Al-Buthy interpreted the concept of Dar al-Islam. According to him, Dar al-Islam is an Islamic State, both those that were once under the Islamic caliphate and those that have now become fragmentary states. The concept of Dar al-Islam Al-Buthy is considered more realistic and contemporary. In contrast to the concept of Dar al-Islam promoted by some Muslim groups today, where they make the implementation of Islamic sharia in a kaffah as an absolute requirement of a country called Dar al-Islam. If not then the country is legitimately fought, the leader may be forcibly deposed, and even more extreme the country is considered a field of jihad war. So that the consequences of this concept are chaos and bloodshed as is happening now. For this reason, Al-Buthy emphasized the need to understand Islam by referring to the Islamic sciences inherited from the scholars, not from Islamic thought that developed following the times. Al-Buthy's method is considered moderate and more realistic to be actualized in modern times.

Abstract

Many interests of students of the Faculty of Economics and Business Islamic UIN IB Padang who need and use Online Transportation. To know the influence of prices, services, comfort in choosing online transportation services. This type of research uses quantitative research, which is to analyze data in numbers and process it using statistical techniques. The assumption of quantitative research is that the facts of the object of research have objective reality and that the variables can be identified and their relationships measured. The results obtained from the study can be concluded that of the Adjusted R Square value of 0.221 (41.2%). It can be interpreted that the independent variable (price, service, convenience) is 0.221 (22.1%), while the rest is influenced by other factors not included in this study variable is 0.87.8 (87.8%). From the above t test it can be concluded that the price (X1) has a sig. value (0.039) < (0.05), then partially significant influence on interest in using online transportation services. Services (X2) has a sig value (0.000) < (0.05), then partly has a significant impact on the interest to use online transportation services. Comfort (X3) has sig. (0.619) > (0.05), so partially has a significant effect on the interest in using online transit services. From the F test above it can be inferred that the Price (X1), Service (X2), Comfort simultaneously have an important influence on the value of income sig (0.001) < (0.05).

Abstract

This study aims to describe how effective the productive zakat management program implemented by the National Zakat Agency (BAZNAS) of Mataram City is in strengthening the economic independence of mustahik. The main focus of this study is to explore the impact of the program on increasing the income and economic independence of mustahik in Mataram City. The main question to be answered in this study is how effective the productive zakat program is in encouraging the economic independence of mustahik and its influence on increasing the income of mustahik. Using a descriptive qualitative approach, this study collected data through interviews, observations, and documentation. The results of the study revealed that the productive zakat management program managed by BAZNAS Mataram City has proven to be effective in increasing the income and economic independence of mustahik, as seen from the increase in mustahik's income after receiving productive zakat assistance,which also contributes to empowering the local economy and reducing poverty in Mataram City. This program has proven to have a positive impact on mustahik, helping mustahik towards a more prosperous and independent life.

Abstract

The practice of waqf in Indonesia has undergone modernization, including the management of waqf assets, which is often carried out through exchanges or swaps to maximize their benefits. Although the legality of such exchanges is clearly regulated under Law Number 41 of 2004, cases in the field still reveal violations of these regulations. This condition is driven by a lack of awareness regarding the importance of preserving waqf assets for community welfare and insufficient understanding of the applicable legal provisions. This research aims to investigate the practice of land exchange (ruislag) involving mosque waqf land conducted without considering public interest, focusing on the legal framework outlined in Law Number 41 of 2004 concerning Waqf. The study employs a qualitative approach, using the village of Wringinputih, Muncar subdistrict, Banyuwangi regency, as a case study. The research methods include observation, in-depth interviews with relevant parties, and analysis of related legal documents. The findings reveal that the practice of exchanging mosque waqf land in Wringinputih Village, Banyuwangi Regency, unrelated to public interest, occurred due to an offer from a particular party to exchange land. However, the land's status had not been officially transferred to the mosque. A prior agreement had been made between the heirs and the party involved in the land exchange. Following the handover, the mosque accepted and received the waqf. An examination of Law Number 41 of 2004 indicates that the land exchange practice involving the waqf land of Bustanul Arifin Mosque in Wringinputih Village, Banyuwangi, did not fully comply with the regulations. The discrepancies include the exchange being motivated by personal interest, the uncertified status of the land, and the lower value of the replacement land compared to the original.

Abstract

This research aims to describe the position of the wife's income from the perspective of the law in Indonesia, Malaysia, Turkey, and Brunei Darussalam. The research method uses normative legal studies by comparing the four countries' legal views. The results showed that the wife's income assets in Indonesia and Turkey became joint assets and were divided equally upon separation. Meanwhile, in Malaysia and Brunei, the size of the wife's share when there is separation is determined by the amount of the wife's income.

Abstract

This research highlights how tourism management based on religious values or known as Muslim-friendly tourism can invite global tourists, while maintaining a balance between modernity and local wisdom but able to contribute in reducing social inequality, especially poverty fluctuations. This research not only explores the landscape of Aceh as a Muslim-friendly tourist destination, but also identifies alternative strategies in creating a halal tourism ecosystem that supports the image of inclusive economic transformation of the people in Aceh. This research includes descriptive qualitative field research, using the Systematic Literature Review Analytical approach. The data sources used to achieve the research objectives refer to the utilization of primary and secondary data sources. Primary data was obtained through observation, while secondary data was obtained through documentation techniques from various valid relevant sources. The data analysis procedure starts from data reduction, followed by data presentation, conclusion drawing and data verification. The research findings show that Muslim-friendly tourism offers significant opportunities to reduce poverty through the creation of new jobs, empowering MSMEs, encouraging better infrastructure development, increasing sources of diversification of community income, and elevating Aceh's image as a global Muslim-friendly tourist destination. Therefore, the tourism sector can be a locomotive that brings significant changes to the economic landscape of Aceh. With strong collaboration between the government, the community, and the private sector, Aceh has the potential to become one of the leading tourist destinations that is not only economically beneficial, but can also provide spiritual benefits for Muslims around the world. Transforming the ummah's economy through the Muslim-friendly tourism sector is not only about creating economic opportunities, but also about building a better future for future generations. It is a step that, with proper planning and implementation, can lead Aceh to a more prosperous, sustainable, and dignified economy in the eyes of the world.
