Abstract

This study seeks to examine the application of the actio pauliana lawsuit concerning the transfer of assets by bankrupt debtors, with a particular focus on Supreme Court Decision Number 26 PK/Pdt.SusBankruptcy/2020. This decision serves as a representation of the legal protection mechanism for creditors within the bankruptcy process. The research employs a normative juridical method, concentrating on the analysis of written legal norms pertinent to the annulment of the debtor's legal actions. The approach includes a statutory analysis to assess the alignment of the decision with Article 1341 of the Civil Code and Article 41 of Law Number 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations. Data sources comprise primary data, including laws and regulations, court decisions, and bankruptcy legal documents, while secondary data is derived from literature, scientific journals, academic articles, and expert legal opinions. The findings indicate that in Supreme Court Decision Number 26 PK/Pdt.Sus-Bankruptcy/2020, the debtor's asset transfer was declared null and void as it satisfied all elements of actio pauliana. These elements include the execution of legal actions during the debtor's insolvency, resulting in creditor losses, absence of legal obligations, and lack of good faith by both the debtor and the asset recipient. Consequently, the transferred assets are reinstated to the bankruptcy estate as a means of restoring creditor rights in the debt settlement process. This research affirms that actio pauliana is a crucial instrument in ensuring legal protection for creditors and plays a strategic role in upholding proportional justice, legal certainty, and the integrity of the bankruptcy process in Indonesia.

Abstract

The aim of this research is to explore the legal safeguards against theunauthorized use of culinary account videos on Instagram. Asdigitalization and social media content distribution trends grow, theunauthorized reuse of culinary videos without the original owner'sconsent is becoming more prevalent, raising concerns aboutcopyright and the legal standing of content creators. This studyemploys a doctrinal research approach, utilizing normative legalresearch methods through statutory and conceptual frameworks. The research draws on primary legal materials, including LawNumber 28 of 2014 on Copyright, Law Number 1 of 2024 amendingLaw Number 11 of 2008 on Electronic Information and Transactions, and Law Number 24 of 2019 on Creative Economy. Additionally, secondary legal materials were sourced from legal journals, books, and Instagram's internal policy documents related to intellectualproperty rights and digital content usage. The findings indicate thatvideos created and posted by culinary accounts are classified asvideographic works, thus receiving legal protection under LawNumber 28 of 2014 on Copyright. Provisions in Law Number 1 of2024 and Instagram's internal policies further reinforce the legalprotection for culinary content creators against unauthorized use. However, in practice, violations frequently occur due to low userawareness, commercial interests in culinary content, and ineffectivereporting mechanisms on the platform. Consequently, the existinglegal protection is not fully optimal and requires enhancement inboth regulatory and implementation aspects.

Abstract

Pancasila Education and Civic Education are national compulsory courses mandated by Permendikbudristek Number 7 of 2023 to be taken by all students in higher education, without exception non-educational study programs. However, the reality in the field shows that there is a gap between policies and student awareness of these obligations. This study aims to examine the level of awareness of non-educational students towards the mandatory status of the two courses, as well as their perception of their relevance to the study program taken. The research uses a descriptive qualitative approach with open questionnaire and interview techniques. The subjects of the study were 88 students from two non-educational study programs, namely Elementary School Teacher Education (PGSD) as many as 38 students and Visual Communication Design (DKV) as many as 50 students. The results of the study show that most students do not know that Pancasila Education and Civic Education are courses required by national regulations. Furthermore, when faced with a hypothetical scenario if the course is not compulsory, the majority of students stated that they would not take it on the grounds that it has no direct relevance to their field of study. These findings indicate a fundamental problem in the socialization of curriculum policies at the institutional level, as well as a gap in students' perception of the importance of national value education in the context of higher education.

Abstract

This study examines the implementation of Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) No. 14 of 2024, which strengthens the legal status of ulayat land through land registration and the issuance of Management Rights Certificates. The legal issue arises from the concerns of Indigenous communities in Sungai Penuh City regarding the potential disharmony between state land administration and the communal land tenure system of Indigenous communities (ajun arah), as well as the possibility of rights misuse. This study analyzes the certification mechanism of Management Rights, examines the legal certainty provided by the policy, and explores the perceptions of customary leaders toward its implementation. Using an empirical juridical approach through observation, interviews, and documentation, this study finds that Management Rights Certificates in Sungai Penuh City provide three dimensions of legal certainty. First, they provide certainty of status by serving as formal state recognition of ulayat land. Second, they provide certainty of control by affirming the role of customary institutions, namely Depati and Ninik Mamak, as holders of authority. Third, they provide administrative certainty through the digitalization of land data as an effort to mitigate potential disputes. The findings indicate that Management Rights have significant potential to strengthen the legality of ulayat land, provided that their implementation is based on customary consent, particularly the principle of free, prior, and informed consent, so that the existence of communal rights is not diminished. The contribution of this study lies in strengthening a model of legal protection that synergizes state law and customary law in order to preserve the socio-cultural identity of the Indigenous communities of Sungai Penuh.

Abstract

This study aims to examine the relationship between social comparison and body dissatisfaction and analyze its implications on the formation of character values in early adult female students at Bina Mandiri Gorontalo University. The method used is quantitative with a correlational design. The research population amounted to 306 active female students of the Department of Pharmacy, with a sample of 75 respondents taken using stratified random sampling techniques. Data were collected through a closed questionnaire of the Likert scale that had been validated and tested for reliability (Cronbach's Alpha 0.90), then analyzed using the Spearman correlation test  through SPSS 20. The results showed that  the level of social comparison of female students was in the medium category (64.0%) and the body dissatisfaction level  was also dominant in the medium category (73.3%). The bivariate test revealed a significant positive relationship between social comparison and body dissatisfaction with a correlation coefficient value of 0.496 and a significance level of 0.001 (p 0.05). These findings indicate that the higher the tendency of female students to make physical comparisons digitally and socially, the higher the level of dissatisfaction with their bodies. The systematic implication of this phenomenon is the degradation of character values, which is characterized by the erosion of gratitude, integrity crises due to dependence on external validation, and a decrease in mental resilience and authentic self-acceptance. The recommendation of this study is the need for higher education institutions to integrate media literacy and virtue-based character education into the curriculum. Strengthening local wisdom values such as mohuyula (mutual respect) and dila lo o'opu (living modestly) is suggested as a counter-narrative to build the moral resilience of female students in facing the pressure of beauty standards in the digital era, so that they can refocus on developing their own identity and more meaningful academic achievements.

Abstract

Globalization has transformed the actors in international relations, which are no longer dominated by states as the sole primary actors. Local actors such as village governments and community groups now play a strategic role in building global interactions through social, cultural, and lifestyle practices. This article aims to analyze the Sunday Morning activity in Pengarasan Village as a form of local diplomacy within the perspective of globalization. The study employs a qualitative method using a case study approach through participatory observation and community interviews. The findings show that the Sunday Morning activity is not merely a community sports activity but also functions as an instrument of paradiplomacy, strengthening local identity while adopting global healthy lifestyle trends. These findings affirm that villages can act as non-state actors in international relations through community-based social practices.

Abstract

This study explores digital citizenship practices among Slovak university students in their use of social media, with particular attention to communication ethics, privacy, and social responsibility. Using a qualitative descriptive case study design, data were collected through semi-structured interviews, in-depth observation, and documentation involving three Slovak university students who actively used Instagram, YouTube, and TikTok. The data were analysed thematically through transcription, repeated reading, initial coding, theme development, and interpretive synthesis. The findings show that social media functions as an everyday space for communication, information seeking, social connection, entertainment, and learning. Participants’ digital citizenship practices were reflected in communication ethics centred on the principle of not harming others, including avoiding insults, harsh language, cyberbullying, and personal attacks. Privacy awareness was also evident through the use of private accounts, close-friends features, selective sharing of personal information, and reluctance to post images of others without consent. However, students’ social responsibility remained largely personal and protective, as they tended to ignore or block problematic accounts rather than engage in collective or corrective action. The study concludes that digital citizenship among the participants has developed at the level of interpersonal ethics, privacy protection, and self-control, but requires further strengthening in terms of active participation and collective social responsibility in digital spaces.
