Abstract

Abstrak. Pelecehan seksual pada anak adalah suatu bentuk kejahatan terhadap anak di mana orang dewasa atau remaja yang lebih tua menggunakan anak untuk rangsangan seksual.Pelecehann seksual ini dapat berupa melakukan hubungan seksual terhadap anak-anak.Hukum Islam belum mengatur mengenai sanksi untuk menghukum pelaku pemerkosaan,sedangkan Al Qur’an dan Hadist tidak menjelaskan secara jelas mengenai hukuman bagi pelaku pelecehan seksual. Karena Al-Qur’an dan Hadist belum mengatur sanksi perbuatan pelecehan seksual, maka penerpana sanksi bagi pelaku ditentukan dengan hukuman ta’zir, ta’zir sanksi yang diberlakukan kepada pelaku jarimah yang melakukan pelanggaran baik berkaitan dengan hak Allah maupun hak manusia dan tidak termasuk ke dalam kategori hudud atau kafarat. Tujuan dibuatnya tulisan ini untuk mengkaji bagaimana bentuk pemidanaan dan penetapan pidana khususnya pidana mati terhadap pelaku kekerasan seksual terhadap anak,Kemudian penjatuhan pidana mati terhadap pelaku kekerasan seksual terhadap anak masih kedepannya masih dapat diberlakukan. Hal tersebut disebabkan sanksi pidana mati hanya diterapkan pada ketentuan-ketentuan tertentu saja.Kemudian kekerasan seksual pada anak merupakan kejahatan yang luar biasa yang menyangkut kemanusiaan, serta adanya pembatasan mengenai kebebasan hak asasi seseorang dan pidana mati tidak lagi menjadi bentuk pidana pokok, melainkan pidana alternatif. ABSTRACT. Sexual despising is some kind of crime that happened to a child in which adult or older childreen use a child as a sexual stimulating.one example of sexual despising is a sexual intercourse with under age child. Islam's law has not regulate what kind of punishment to assailant, meanwhile Al Quran n hadist didn't explain explicitly about what kind of punishment to suspect of sexual despising. Because it hasn't been in Al Quran or hadist yet, so the punishment given to the suspect is based on what we called ta'zir law, ta'zir punishment are related to Allah rights or humans rights and its not include in hudud or kafarat category, The purpose of this paper is to examine how the forms of punishment and criminal penalties, especially the death penalty against perpetrators of sexual violence against children, Thenthe imposition of the death penalty on perpetrators of sexual violence against children can still be enforced in the future.This is because the death penalty is only applied to certain provisions. Then sexual violence against children is an extraordinary crime that involves humanity, and there are restrictions on the freedom of a person's human rights and the death penalty is no longer a form of basic crime, but an alternative punishment.

Abstract

Abstract. This study aims to analyze the implementation and enforcement of criminal law against online gambling perpetrators in Indonesia based on Law Number 19 of 2016 concerning Electronic Information and Transactions. The research method used is normative legal research. Data collected includes regulations related to online gambling, court decisions, and relevant literature. The analysis is conducted by identifying legal provisions governing online gambling, examining the implementation of criminal law enforcement, and evaluating its effectiveness. The research results show that Law Number 19 of 2016 concerning Electronic Information and Transactions has strengthened the legal basis for taking action against online gambling perpetrators, as stipulated in Article 27 Paragraph (2) of the law, which prohibits "Any person who intentionally and without authority distributes and/or transmits and/or makes accessible electronic information and/or electronic documents containing gambling content." However, law enforcement against online gambling still faces several challenges, such as difficulties in identifying perpetrators, tracking financial transactions, and taking enforcement actions in the virtual realm. The conclusion of this study is that criminal law enforcement against online gambling perpetrators based on Law Number 19 of 2016 concerning Electronic Information and Transactions has provided a strong legal basis. Therefore, in enforcing the law against online gambling in Indonesia, it is more appropriate to use Law Number 19 of 2016 concerning Electronic Information and Transactions as the legal basis for criminalizing online gambling actions since in this case, perpetrators who have been proven to commit gambling crimes specifically conduct their illegal activities using internet media. Abstrak. Fenomena judi online semakin berkembang pesat dengan adanya teknologi internet, yang menyebabkan adanya perubahan dalam praktik perjudian dan menimbulkan berbagai tantangan dalam penegakan hukum. Penelitian ini bertujuan untuk menganalisis implementasi dan penegakan hukum pidana terhadap pelaku judi online di Indonesia berdasarkan Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik. Metode penelitian yang digunakan adalah penelitian hukum normatif. Data yang dikumpulkan berupa data sekunder yang terdiri dari, peraturan perundang-undangan yang terkait dengan judi online, putusan pengadilan, dan literatur terkait. Analisis dilakukan dengan mengidentifikasi ketentuan hukum yang mengatur judi online, melihat implementasi hukum dalam penegakan pidana, dan mengevaluasi efektivitasnya. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik merupakan dasar hukum untuk menindak pelaku judi online, sebagaimana diatur dalam Pasal 27 Ayat (2) dari undang-undang tersebut yang melarang adanya perjudian online. Namun, ketentuan-ketentuan yang telah diatur tersebut belum dapat diimplementasikan pada tataran praktik karena masih menghadapi beberapa tantangan, seperti kesulitan dalam mengidentifikasi pelaku, melacak transaksi keuangan, dan melakukan tindakan penindakan di ranah virtual. yaitu merupakan upaya yang dilakukan melalui usaha yang ditunjukan untuk meningkatkan kesadaran masyarakat seperti, sosialisasi atau penyuluhan”.

Abstract

Abstract. Child abuse is a deprivation of human rights. In essence, every child has the right to survive, grow, and develop and is entitled to protection from violence and discrimination. Decision number 262/Pid.B/2021/PN.Bdg. due to differences in perception that occur in the judicial process so that judges pay more attention to things that relieve the perpetrator rather than the suffering experienced by the victim. There are several things that need to be studied comprehensively in the crime of child abuse, which results in death, especially in the realization of substantive justice that must be obtained by the victim based on the decision of the panel of judges. The purpose of this research is to find out and understand the analysis of the judge's considerations and the fulfillment of substantive justice for perpetrators of violent crimes committed jointly that resulted in death. Normative juridical approach method, data collection techniques using library research, and qualitative descriptive data analysis methods. The results of this research show that the judge has carried out juridical considerations in the form of in-depth considerations in Article 80, Paragraph 3, of Law Number 35 of 2014; in non-juridical considerations, the panel of judges has carried out several considerations from the defendant's side in the form of mitigating circumstances, but it should be possible. The weight was given because Defendant II is an adult and legally competent, knows the consequences of the actions he committed, and also as a preventive measure so that in the future a similar case does not occur. Then, because there is no jurisprudence, doctrine, or theoretical basis and no legal values that exist in society in making decisions, the decision does not reflect the standard of a good and comprehensive decision in terms of substantive justice, which has consequences for the considerations made by the Panel of Judges that lack solid foundations in terms of belief. judge, legal doctrine, which provides information on the truth, and the sociological basis of living legal values to support the basic principles of the judge's considerations. Abstrak. Penganiayaan terhadap anak merupakan perampasan terhadap hak asasi manusia. Hakikatnya setiap anak berhak atas kelangsungan hidup, tumbuh dan berkembang serta berhak atas perlindungan dari kekerasan dan diskriminasi. Putusan nomor 262/Pid.B/2021/PN.Bdg. atas perbedaan persepsi yang terjadi dalam proses peradilan sehingga hakim lebih memperhatikan hal yang meringankan pelaku daripada penderitaan yang dialami korban. Ada beberapa hal yang perlu dikaji secara komprehensif dalam kejahatan penganiayaan terhadap anak yang mengakibatkan kematian terkhusus dalam perwujudan keadilan substantif yang harus didapatkan oleh korban atas putusan majelis hakim. Tujuan dari Penelitian ini adalah untuk mengetahui dan memahami analisis pertimbangan hakim dan pemenuhan keadilan substantif terhadap pelaku tindak pidana kekerasan yang dilakukan secara bersama-sama yang mengakibatkan kematian. Metode pendekatan yuridis normatif, teknik pengumpulan data menggunakan penelitian kepustakaan, dan metode analisis data deskriptif kualitatif. Hasil dari penelitian ini adalah Hakim telah melakukan pertimbangan secara yuridis berupa pertimbangan mendalam pada pasal 80 ayat (3) Undang-Undang Nomor 35 Tahun 2014, kemudian dalam pertimbangan non yuridis majelis hakim melakukan beberapa pertimbangan dari sisi terdakwa berupa keadaan yang meringankan, namun seharusnya bisa diberikan pemberatan karena terdakwa II sudah dewasa dan cakap hukum, mengetahui konsekuensi atas perbuatan yang dilakukan, juga sebagai langkah preventif agar di kemudian hari tidak terjadi perkara serupa. Kemudian, karena tidak ditemukannya yurisprudensi, doktrin, atau dasar teori, dan nilai-nilaiihukum yang ada di masyarakatidalam membuat keputusan, makaiputusan tersebut kurangimencerminkan standariputusan yang baik danikomprehensif dariisegi keadilan substantif yang memiliki konsekuensi padaipertimbangan-pertimbangan yang dibuatioleh Majelis iHakim kurang imendapatkan ilandasan kuatidari segi keyakinan hakim, Doktrinihukum yangimemberikan informasiikebenaran, dasarisosiologis tentanginilai-nilai hukum yang hidup guna mendukungidasaripertimbangan hakim.

Abstract

ABSTRACT. Access to healthcare services is a fundamental right guaranteed by the 1945 Constitution. Hospitals play a crucial role in providing healthcare services, improving and maintaining the health of every individual. The Indonesian state fully regulates health services under Law Number 17 of 2020. Despite the regulations, there have been instances of individuals providing healthcare services under fake identities, leading to various forms of crime in the health sector. This research aims to examine the legal implications for hospitals that employ individuals with fake identities to provide health services. Additionally, it intends to determine the criminal liability of individuals who provide health services with fake identities, according to Law Number 17 of 2023. The research method employed is a normative juridical approach with descriptive analysis. The data was collected through literature studies using secondary data, while the data analysis used qualitative juridical methods. The results of this research indicate that hospitals have a responsibility to compensate for losses incurred due to the negligence of their medical personnel, both administratively, civilly, and criminally. On the other hand, individuals who provide healthcare services in hospitals with fake identities will face criminal charges under the law.

Abstract

The main source of the state comes from taxes, so the government imposes tax obligations as one of the state obligations for the benefit of the state. Tax is a payable and forced payment payable under tax regulations. Income tax is a tax imposed on taxpayers on income earned in a tax year and has the economic ability received from wherever it comes from to increase wealth. The development in social media is useful for earning income, so endorsement work has emerged, namely to promote products online carried out by underage influencers. So underage influencers earn income from endorsement services, according to tax regulations are obliged to pay tax to the state on the income earned. Based on the description above, the author formulates several problems as follows: First, what is the responsibility of underage influencers to the obligation to pay taxes? Second, what are the legal consequences for underage Influencers with taxable income. The scientific effort of the research method uses normative juridical research sourced primarily from statutory, secondary, tertiary and library materials as well as research specifications with a descriptive approach of analysts to obtain answers to the problems studied. Based on the results of the study, the responsibility of underage influencers for the obligation to pay taxes under the UU PPh is the income of immature children, regardless of the source of income and whatever their work will be combined with their parents' taxes in the same tax year. Legal consequences for underage Influencers with taxable income not paying taxes tax legislation will be subject to administrative sanctions increased by 50%. Under civil law, the sanction will be transferred to the parent because it is under his supervision. For dispute resolution to taxpayers due to a tax assessment letter that is subject to administrative sanctions in the form of an increase but the taxpayer does not agree, it can resolve tax dispute resolution by submitting an objection to the Directorate General of Taxes.

Abstract

People with disabilities have different conditions, some have physical disabilities, mental disabilities, and a combination of physical and mental disabilities. The condition of people with disabilities affects their ability to participate in society, so they need support and assistance from others. People with disabilities also face greater difficulties than non-disabled people, such as barriers in accessing public services, education, health, and employment. To provide employment opportunities for people with disabilities, the government, state-owned and private companies, and civil society must ensure the elimination of various legal and social barriers in employing people with disabilities. This study aims to find out how the Implementation of the Right to Get a Job for Workers with Special Needs at PT. Sinar based on Law number 8 of 2016 concerning Persons with Disabilities which is related to Law number 13 of 2003 concerning Labor and to find out the efforts of the company in providing facilities for Persons with Disabilities.The method used in this study uses a normative juridical approach, which is research conducted by examining and comparing literature sources in the form of Labor Law and various kinds of literature and research specifications, namely descriptive analytical, which is an analysis of the applicable legal provisions and analyzed using relevant legal policy theories.Based on the research results, it is known that PT. Sinar in Majalengka Regency has not implemented what is mandated in Law Number 8 of 2016 concerning Persons with Disabilities. The right to get a job for people with disabilities has not been fulfilled and is not in accordance with what is mandated in Law Number 13 of 2003 concerning Labor. There is still discrimination against people with disabilities in the company. The company’s efforts in providing facilities for workers with disabilities have not been fulfilled, and are not in accordance with the law number 8 of 2016 concerning persons with disabilities regarding the company’s efforts in providing assistive devices to support work and accessibility for people with disabilities.

Abstract

ABSTRACT- Technological advances cause a variety of crimes, one of which is online fraud, with the development of the current fraud mode using the mode of buying and selling accounts in online games. Fraud with the mode of buying and selling accounts in online games is criminally different from fraud in general in the Criminal Code, but uses criminal rules in the ITE Law. Fraud by buying and selling accounts in online games has occurred several times in the territory of Indonesia. So that to see efforts to overcome criminal acts of fraud in buying and selling accounts in online games cannot only be based on the perspective of criminal law, but must also be seen in criminological studies. Criminological studies are useful to describe thoroughly, so that the crime of buying and selling accounts in online games can be handled effectively. This study aims to determine the factors that cause the rise of cybercrime which prioritizes the crime of fraudulent buying and selling of accounts in online games, the effectiveness of law enforcement in efforts to tackle cybercrime, and the obstacles faced by police officers in their countermeasures. Then reveal the modus operandi carried out by the perpetrator in committing fraud in buying and selling online game accounts, through this internet media making a gap and weakness where it is not known by consumers, the perpetrator will plunge the victim to follow the method planned by the perpetrator conothnya take back the game account that has been sold to the detriment of consumers Based on the results of the study, it is known that in revealing the motives of the perpetrators of criminal fraud with the mode of buying and selling accounts in online games requires a criminological point of view which finally found out that the factors causing the perpetrators to commit fraud crimes are due to low public legal awareness, the lack of adequate facilities, the lack of firmness of law enforcement officials, and a weak security system, then regarding the method carried out, among others, in the form of falsifying proof of transfer, account boosting services, hackback and phishing. The approach method used is normative juridical, the research specification in this research is descriptive analytical, the data collection technique in this research is literature study and the analysis method in this research uses qualitative analysis method. ABSTRAK- Kemajuan Teknologi menyebabkan terjadinya beraneka ragam kejahatan salah satunya penipuan secara online, dengan berkembangnya zaman modus penipuan pada saat ini menggunakan modus jual beli akun di game online. Penipuan dengan modus jual beli akun di game online ini secara kaidah pidana berbeda dengan penipuan pada umumnya dalam KUHP, namun menggunakan kaidah pidana dalam Undang-Undang ITE. Penipuan dengan jual beli akun di game online ini sudah beberapa kali terjadi di wilayah Indonesia. Sehingga untuk melihat upaya penanggulangan tindak pidana penipuan jual beli akun di game online ini tidak hanya bisa berdasarkan kacamata hukum pidana, tapi juga harus dilihat secara kajian kriminologi. Kajian kriminologi berguna untuk menjabarkan secara menyeluruh, sehingga kejahatan jual beli akun di game online dapat ditangani secara efektif. Penelitian ini bertujuan untuk mengetahui faktor yang menyebabkan maraknya cybercrime yang utamakan pada kejahatan penipuan jual beli akun di game online, efektivitas penegakan hukum dalam upaya penanggulangan tindak pidana cybercrime, serta kendala yang dihadapi oleh aparat kepolisian dalam upaya penanggulangannya. Kemudian mengungkap modus operandi yang dilakukan oleh pelaku dalam melakukan penipuan jual beli akun game online, melalui media internet ini menjadikan adanya suatu celahdan kelemahan dimana hal tersebut tidak diketahui oleh konsumen, pelaku akan menjerumuskan korban untuk mengikuti modus operandi yang telah direncanakan oleh pelaku conothnya mengambil kembali akun game yang sudah dijual sehingga merugikan konsumen Berdasarkan hasil penelitian diketahui bahwa dalam mengungkap motif pelaku tindak pidana penipuan dengan modus jual beli akun di game online membutuhkan sudut pandang kriminologi yang akhirnya diketahui faktor penyebab pelaku melakukan kejahatan penipuan ialah dikarenakan rendahnya kesadaran hukum masyarakat, kurangnya fasilitas yang memadai, kurang tegasnya aparat penegak hukum, dan sistem keamanan yang lemah, kemudian mengenai modus operandi yang dilakukan antara lain dalam bentuk pemalsuan bukti transfer, jasa boosting akun, hackback dan phising. Metode pendekatan yang digunakan adalah yuridis normatif, spesifikasi penelitian dalam penelitian ini bersifat deskriptif analitis, Teknik pengumpulan data dalam penelitian ini studi kepustakaan serta metode analisis dalam penelitian ini menggunakan metode analisis kualitatif.

Abstract

Abstract. Sexual violence is a form of crime that insults and tarnishes human dignity. The national criminal law regulates provisions regarding sexual violence in Law Number 12 of 2022 with 9 (nine) types of sexual violence. The Qanun Jinayat regulates 2 (two) types of sexual violence. The formulation of the problem in this research includes: What are the differences in the types of criminal acts of sexual violence in the national criminal law and Aceh Qanun Number 6 of 2014 concerning Jinayat Law and what forms of accountability exist for perpetrators of sexual violence crimes in terms of the national criminal law and Aceh Qanun Number 6 of 2014 concerning Jinayat Law. The goal is to find out what has been described in the formula. The research method used is a normative juridical method with a qualitative approach. The results of this research are Law no. 12 of 2022 accommodates 9 (nine) types of sexual violence with levels of punishment that depend on the consequences obtained by the victim. Meanwhile, Qanun Jinayat is only limited to regulating sexual harassment and rape, the elements of which are in harmony with those in Islamic law. Regarding the form of accountability for perpetrators of sexual violence, the national criminal law and Qanun Jinayat have differences in the objectives of the punishment. Abstrak. Kekerasan seksual merupakan suatu bentuk kejahatan yang melecehkan dan menodai harkat kemanusiaan. Hukum pidana nasional mengatur ketentuan mengenai kekerasan seksual dalam Undang – Undang Nomor 12 Tahun 2022 dengan 9 (sembilan) jenis kekerasan seksual. Adapun Qanun Jinayat mengatur 2 (dua) jenis kekerasan seksual. Rumusan masalah dalam penelitian ini meliputi: Bagaimana perbedaan jenis tindak pidana kekerasan seksual dalam hukum pidana nasional dan Qanun Aceh Nomor 6 Tahun 2014 tentang Hukum Jinayat serta Bagaimana bentuk pertanggungjawaban pelaku tindak pidana kekerasan seksual ditinjau dari hukum pidana nasional dan Qanun Aceh Nomor 6 Tahun 2014 tentang Hukum Jinayat. Tujuannya adalah untuk mengetahui apa yang telah diuraikan pada rumusan tersebut. Metode penelitian yang digunakan adalah metode yuridis normatif dengan pendekatan kualitatif. Hasil dari penelitian ini yaitu Undang – Undang No. 12 Tahun 2022 mengakomodir 9 (sembilan) jenis kekerasan seksual dengan kadar hukuman yang bergantung pada akibat yang didapat oleh korban. Sedangkan, Qanun Jinayat hanya terbatas mengatur jarimah pelecehan seksual dan pemerkosaan yang mana unsur – unsurnya memiliki keselarasan dengan yang ada dalam syari’at Islam. Adapun mengenai bentuk pertanggungjawaban pelaku kekerasan seksual dari hukum pidana nasional dan Qanun Jinayat memiliki perbedaan dalam tujuan pemidanaanya.

Abstract

Abstrak. Netralitas Aparatur Sipil Negara merupakan salah satu asas penting dalam penyelenggaraan pemerintahan yang demokratis. Hal ini ditegaskan dalam Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara bahwa penyelenggaraan kebijakan dan manajemen ASN didasarkan pada asas netralitas, “asas netralitas” adalah bahwa setiap Pegawai ASN tidak berpihak dari segala bentuk pengaruh manapun dan tidak memihak kepada kepentingan siapapun, dalam rangka penyelenggaraan Pemilihan Umum (Pemilu) 2024, netralitas ASN menjadi salah satu hal yang perlu diperhatikan. Hal ini mengingat bahwa Pemilu merupakan momen penting dalam demokrasi yang harus berjalan secara demokratis dan bebas dari intervensi pihak manapun. Namun, dalam revisi UU ASN yang disahkan pada tanggal 3 Oktober 2023, Komisi Aparatur Sipil Negara (KASN) yang sebelumnya menjadi lembaga pengawas netralitas ASN dihapuskan ditengah masa pemilihan Umum 2024. Metode penelitian ini adalah Yuridis Normatif yang bersumber utama dari data sekunder dibantu data primer sebagai tambahan dan penelitian ini berisifat deskriptif analitis yang bertujuan untuk mendapatkan jawaban atas permasalahan yang diteliti menggunakan metode deskriptif kualitatif. Adapun hasil dari penelitian ini bahwa Pengawasan Netralitas Aparatur Sipil Negara Pada Masa Pemilihan Umum 2024 dilaksanakan sesuai dengan SKB 5 K/L Nomor 2 Tahun 2022. Implikasi dari dihapuskannya Komisi Aparatur Sipil Negara (KASN) berpotensi meningkatnya pelanggaran netralitas ASN, Hal tersebut karena pemindahan tugas pengawasan ASN kepada Pejabat Pembina Kepegawaian (PPK) yang merupakan jabatan politik sehingga sangat rawan sekali potensi politisasi terhadap pegawai ASN. This is because elections are an important moment in democracy which must run democratically and free from interference from any party. This research method is Normative Juridical which is primarily sourced from secondary data assisted by primary data In addition, this research contains an analytical descriptive nature which aims to obtain answers to the problems studied using qualitative descriptive methods. The results of this research are that supervision of the neutrality of the State Civil Apparatus during the 2024 General Election is carried out in accordance with SKB 5 K/L Number 2 of 2022. The implications of the abolition of the State Civil Apparatus Commission (KASN) have the potential to increase violations of ASN neutrality, this is due to the transfer of duties ASN supervision of Civil Service Development Officers (PPK) which is a political position so that it is very vulnerable to the potential for politicization of ASN employees.

Abstract

China's territorial claim over the Spratly Islands, particularly concerning its rich natural resources and escalating military activities, has created tension in the region, notably affecting the sensitivity of the Philippines. The legal actions taken by the Philippines in the International Tribunal, based on UNCLOS, resulted in a verdict affirming the lack of legal basis for China's claims and denying China any entitlement to an Exclusive Economic Zone within the Spratly Islands. Moreover, it was found that China had damaged the ecosystem in the Spratly Islands through activities such as overfishing and the construction of artificial islands. Despite the binding nature of the ruling, China has refused to accept or respect it. This research explores the implications arising from China's rejection of the ruling on the integrity of international maritime law, which has become an integral part (jus cogens). UNCLOS, as a crucial milestone in territorial sovereignty delineation, reinforces legal principles above a nation's economic or political strength. China, as a signatory to UNCLOS, has ratified this convention, yet its post-verdict stance raises questions about its consistency in adhering to widely recognized principles.The principle of responsibility for the violation of agreements can be applied in the context of China's rejection of the court's decision, where China is one of the participating countries and has ratified UNCLOS. As a participating state in the Convention, China is formally obligated to comply with the provisions of the convention based on the principle of Pacta Sunt Servanda and good faith. The Arbitration Court, as stipulated in UNCLOS, has jurisdiction, embodied as a compromissory clause or a specific arbitration clause, in case of disputes regarding the interpretation and application of the convention among the parties. This jurisdiction empowers the court to settle disputes that arise. As a dispute resolution institution, the arbitration court has the authority to decide on the disputes brought before it. The decisions issued by the arbitration are final and binding on all parties involved. Abstrak. Klaim territorial China terhadap Pulau Spratly, terutama dalam konteks sumber daya alam yang kaya, serta aktivitas militer yang terus meningkat, telah menciptakan ketegangan di kawasan, khususnya menyentuh sensitivitas Filipina. Tindakan hukum Filipina di Mahkamah Arbitrase Internasional, berdasarkan UNCLOS, menghasilkan putusan yang menegaskan kurangnya landasan hukum dari klaim China dan tidak ada apapun di Kepulauan Spartly yang memberikan Cina hak Zona Ekonomi Ekslusif serta telah merusak ekosistem di Kepulauan Spartly dengan aktivitas seperti penangkapan ikan berlebihan dan menciptakan pulau buatan. Meski putusan tersebut mengikat, China menolak untuk menerima dan menghormatinya.Penelitian ini menggali implikasi yang muncul dari penolakan China terhadap putusan tersebut terhadap kehormatan hukum laut internasional yang telah menjadi bagian integral (jus cogens). UNCLOS, sebagai tonggak penting dalam pembagian kedaulatan teritorial, menegaskan prinsip hukum di atas kekuatan ekonomi atau politik suatu negara. China, sebagai negara peserta UNCLOS, telah meratifikasi konvensi ini, namun sikapnya pasca-putusan menimbulkan pertanyaan tentang konsistensi pelaksanaannya terhadap prinsip-prinsip yang diakui secara luas.Prinsip tanggung jawab atas pelanggaran perjanjian dapat diterapkan dalam konteks kasus Penolakan China terhadap putusan mahkamah, yang mana China merupakan salah satu negara peserta dan telah meratifikasi UNCLOS, maka sebagai negara peserta Konvensi China berkewajiban secara formal untuk mematuhi isi ketentuan konvensi didasarkan dengan Asas Pacta Sunt Servanda dan itikad baik (good faith). Mahkamah Arbitrase sebagaimana ketentuan UNCLOS memiliki yuridiksi, yang tertuang sebagai clause compromissiore atau klausula tambahan arbitrase yang bersifat khusus, apabila timbul sengketa mengenai interpretasi penerapan konvensi antara para pihak. Yuridiksi tersebut memberikan mahkamah kewenangan untuk menyelesaikan sengketa yang terjadi. Sebagai lembaga penyelesaian sengketa mahkamah arbitrase memiliki kedudukan untuk memutuskan sengketa yang diajukan kepadanya. Keputusan yang dikeluarkan arbitrase tersebut bersifat final dan mengikat bagi semua pihak yang terlibat
