Abstract

Criminal law enforcement against tax crimes in Indonesia has raised debates regarding applying the premium remedium or ultimum remedium principle. This study explores the legal issues arising from this change, including the submission of a judicial review of Article 39 paragraph (1) letters d and i by a taxpayer, which is considered to have a premium remedium nuance. This article examines the application of criminal law to tax crimes in Indonesia in the context of the self-assessment system and the amended regulations. With a normative approach, this study aims to assess whether criminal law in tax crimes tends to be more on the ultimum remedium or premium remedium principle, and to highlight the harmonization between the self-assessment system and criminal law enforcement. This study finds that the application of criminal law to tax crimes in Indonesia tends to follow the ultimum remedium principle, where criminal sanctions are used as a last resort after administrative measures are ineffective. Despite the elimination of Article 13A in the KUP Law which has raised debates regarding the application of premium remedium, law enforcement still emphasizes taxpayer compliance in the self-assessment system. In addition, the KUP Law also accommodates the termination of investigations in the interests of state revenue if taxpayers are willing to pay their tax obligations.

Abstract

Transportation is one of the contributors to CO2 pollutants that cause Greenhouse Gas (GHG) emissions, ultimately impacting global climate change. The creation of electric vehicles is concerned with clean energy and handling global climate change. This aligns with the 17 global goals of the United Nations, which are the world agenda to protect planet Earth and for everyone to live a decent life by 2030. However, creating innovations in production and transforming consumers to switch from fuel vehicles to electric vehicles, especially electric trucks, is equally difficult. In 2022, based on data from Vehicle Type Approval, electric truck sales in Indonesia have the lowest number compared to other types of electric vehicles. This study aims to discover how innovation should be carried out and how consumer desires can be fulfilled from these innovations so that the market easily accepts electric truck products with the hope that interest and sales can increase. This study uses a literature study method that provides an overview of how the customer-centricity approach is applied to support innovation during production. The results of this study provide suggestions in the development of electric trucks that companies should not only focus on technology but also focus on consumer needs to adopt electric truck technology such as cost and economic benefits, charging infrastructure available in various locations, government support and policies, social influence, economic and social factors, promotion policies and regional support.

Abstract

Currently, the railway line from Lahat to Lubuklinggau uses the R.42 rail type with a crossing power capacity of 2,106 > 5,106 tons/year. An increase in road class is needed to increase crossing capacity. This research aims to determine the feasibility and impact of upgrading the rail type from R.42 to R.54 to improve the operational efficiency and safety of the Lahat-Lubuklinggau railway line. In this study, the author uses the railway loading method using the beam on the elastic foundation (BoEF) concept to calculate rail permit voltage to ensure that the capacity of the railroad can accommodate the load of railway traffic. The study results in show that with the upgrade of the railroad class to class III with the R.54 rail type, this line can transport a load of 5,924,001.60 tons/year, an increase from 1,838,390.40 tons/year. In addition, the track with the R.54 rail type also meets the requirements for trains with the largest load, considering that the allowable voltage (1,097.18 kg/cm²) is smaller than the previous rail allowable voltage (1,738.14 kg/cm²). It is estimated that the R.54 rail type has a life resistance of 16-17 years against crossing power without the Babaranjang train and for 9-10 years against crossing power with the Babaranjang train for the coming year.
