The objective of this study is to examine the potential impact of superior’s orders on the quality of internal audits conducted inside the North Sumatra Government. The primary objective of this research is to ascertain the dynamics and determinants that exert an influence on the conduct of internal auditors when confronted with directives or coercion from higher-ranking individuals, and to examine the subsequent ramifications on the quality of audits produced. This study examines the factors that influence the behavior of internal auditors when they encounter pressure to fulfil organizational demands, and the potential consequences on the quality of the audit process and outcomes. The present study examines the impact of superior’s orders on professional standards, ethical conduct, and the overall efficacy of the internal audit function. The research methodology employed in this study involves the utilization of a survey method approach, wherein a representative sample of internal auditors within the North Sumatra Government is collected. The present study employs the Partial Least Squares (PLS) methodology to examine the association among variables. This study aims to identify the primary factors that lead to the variation in Internal Audit Quality (IAQ), with a specific focus on the issues encountered by internal auditors who work inside intricate government settings. The aforementioned discoveries not only constitute a valuable contribution to the scholarly conversation surrounding the influence of compliance demands and professional conduct, but they also provide practical knowledge for policymakers and practitioners who aim to enhance the efficiency of internal audit practices within the public sector. This study adds to the expanding corpus of literature about the behavioral dimensions of internal audit and offers empirical findings that might guide efforts to enhance the quality of audits in governmental organizations, specifically within the distinct setting of North Sumatra.

Abstract

Customary law has long been ignored by our society because we are too enthusiastic about the criminal and civil laws adopted since the Indonesian colonial era. Although so-called modern law cannot prevent the limitations of its application in various regions throughout Indonesia, customary law can actually be a considerable substitute. Theoretically, this can be formally implemented in various regions in Indonesia by fulfilling several criteria in accordance with the principles used by national law. A major change in the orientation of criminal law is a shift in the concept of justice, from justice based on retribution to justice that is restorative justice. The protection and restoration of the rights of victims and the wider community is considered as important as the punishment and/or rehabilitation of criminals. Based on the Police Regulation of the Republic of Indonesia No. 8 of 2021 concerning the Handling of Criminal Acts Based on Restorative Justice, the aim is to realize that the case resolution process is not only aimed at punishing or humiliating someone, but rather at trying to obtain the truth which is useful to help restore harmonious relationships. between perpetrators, victims and society. This is actually nothing new in the archipelago because the Indonesian people are already familiar with it in their customary law and its authority has recently been approved in statutory regulations.

Abstract

The act of money laundering is very dangerous both at the national and international levels because money laundering is a means for criminals to legalize the proceeds of crime in order to eliminate traces. In addition, the nominal amount of money laundered is usually extraordinary, so it can affect national and even global financial balance sheets. The nature of the research used is normative legal research and the data collection method used in this research is secondary data obtained through library research, namely by conducting research on various literatures such as books, laws, which aim to find conceptions, or understandings related to the problem of applying the law of money laundering against criminals obtained from corruption. The crime of corruption is one part of special criminal law in addition to having certain specifications that are different from general criminal law, such as the existence of procedural law deviations and when viewed from the material regulated, the crime of corruption is directly or indirectly intended to minimize leakage and irregularities in the state's finances and economy. The application of the law on money laundering to the eradication of corruption aims to find out how to put the results of evidence on the case being examined, by what means the evidence is used and by what means the judge must form his belief before the court. In essence, in order to apply evidence or the law of evidence, the judge then starts from the evidentiary system with the aim of knowing how to put an evidentiary result on the case being tried.
