Asas wa Tandhim: Jurnal Hukum, Pendidikan, dan Sosial Keagamaan (AwTJHPSA) is a peer-reviewed, open access scholarly journal published by Fakultas Agama Islam Universitas Cokroaminoto Yogyakarta. Focus AwTJHPSA is publishing high-quality manuscripts in forms of original research articles, and discussions to answer important and interesting questions, develop or test theory, replicate prior studies, explore interesting phenomena, review and synthesize existing research and provide new perspectives aimed at stimulating future theory development and empirical research on all aspects of social science and humanity, especially that relate to human religion, for promoting the integration of social science and humanity. Abstract

The phenomenon of hoisting the fictional One Piece flag (Jolly Roger) during Indonesia’s Independence Day sparked debates on freedom of expression and the protection of state symbols. This study examines the legal boundaries of expression within Indonesian criminal law regarding popular culture symbols. Using a normative legal method and statutory approach, the analysis refers to the 1945 Constitution, Penal Code, and Law No. 24 of 2009. Findings show that hoisting the Jolly Roger is not explicitly prohibited, unless it fulfills criminal elements such as insult or incitement. Such symbols are better viewed as peaceful social critique. The state should prioritize education and dialogue.

Abstract

Freedom of the press is one of the pillars of democracy guaranteed by the constitution and international law, but it is not absolute because it is still limited by legal norms to protect the public interest, individual reputation, and public order. This study aims to analyze criminal acts in journalistic practice by highlighting the limits of press freedom and forms of balanced legal protection. The method used is normative legal research with a statutory, conceptual, and case-based approach. The results of the study indicate that there is potential for criminalization of journalists due to the use of criminal articles in the Criminal Code and the ITE Law, which has a chilling effect on the work of the press. Therefore, the resolution of news disputes should prioritize the right of reply, the right of correction, and mediation mechanisms of the Press Council. Criminal sanctions should only be used as an ultimum remedium if there is proven malicious intent and serious harm. In conclusion, the protection of press freedom must be balanced with legal responsibility to create a free and accountable press system.

Abstract

This   study   aims   to   examine   prenuptial agreements concerning joint property from the perspective of Islamic Law. The research employs    a    normative    legal     approach, analyzing     commonly     used     prenuptial agreement documents. The findings reveal that   these   agreements   provide   detailed arrangements regarding the division of joint assets  and  personal  property.  Prenuptial agreements  play  a  significant  role  in  the Indonesian  marriage  legal   system,  both  in terms  of  positive   law   and   Islamic   legal principles.    Under    positive    law,     such agreements offer a strong legal foundation for regulating joint property  and  safeguarding the rights of each party involved. From the perspective   of   Islamic   law,   prenuptial agreements  align  with  the  principles   of justice  and  the  protection  of  individual ownership within a marital relationship.

Abstract

The purpose of this study is to determine the legal status of freelance digital workers in the Indonesian employment system and the legal protections that can be implemented to improve the welfare of freelance digital workers in the era of transformation. The results of the study indicate that the existence of freelance digital workers has not yet received clear legal recognition in the national employment system. Most of them are still categorized as informal workers or work partners, not as workers in an employment relationship as regulated in the Manpower Law Number 13 of 2003. Legal recognition of the status of freelance digital workers can be the basis for determining special worker categories such as platform workers or digital independent workers, then providing access to basic protections such as social security, employment insurance and requiring digital platforms to be responsible for the working conditions of their workers.

Abstract

This study examines the direction of Indonesia's legal politics through a critical analysis of the logic behind national law-making, referencing the perspectives of Mahfud MD and Satjipto Rahardjo's progressive legal theory. Using a normative-juridical approach and qualitative analysis, the research explores the relationship between legal politics, constitutionalism, and substantive justice in legislative practices. The findings reveal that the formation of national law often involves a tug-of-war between constitutional idealism and the pragmatic interests of power, leading to a distortion of justice values. Mahfud MD’s perspective emphasizes the importance of aligning legal politics with Pancasila and the constitution, while Satjipto Rahardjo’s progressive law advocates for a participatory, adaptive, and pro-people approach. This study recommends participatory, transparent, and accountable legislative reforms to restore the function of law as an instrument of social justice and sustainable social transformation.

Abstract

Restorative justice policies in Indonesia are still scattered across several regulations. This study aims to examine the importance of restorative justice implementation regulations in resolving criminal cases in Indonesia, as well as to determine the effectiveness of restorative justice from the perspectives of regulators and law enforcement officers (APH). The research methodology is normative juridical legal research with a qualitative approach. The results of the study explain that restorative justice has represented the implementation of the fourth principle in fulfilling the ideals of legal justice that live in society, where the basis of restorative justice must be integrated with the values ​​that coexist in Indonesian society. The concept of restorative justice used in the formation of policies issued by the Supreme Court, the Prosecutor's Office, and the Police benefits from implementing the idea of ​​restorative justice as a tool in resolving legal issues in Indonesia.

Abstract

The revision of the Corruption Eradication Commission Law explicitly places it as a government institution within the executive branch. Additionally, the establishment of a Supervisory Board with the authority to grant permits for wiretapping, searches, and seizures has sparked debate regarding the limits of the KPK's independence. The issues raised in this study relate to the KPK's position after the amendment of the KPK Law and the KPK's independence as an executive body after the amendment of the KPK Law. The method used in this study is the normative legal method. The research results show that the position of the KPK after the amendment to the law falls within the executive branch of power, while the KPK's independence as an executive institution is now limited because its institutional position is under the administrative control of the government. the KPK can be restored as an independent institution free from interference by any power. In addition, strengthening institutional aspects, proportionate supervision, employe professionalism, and public transparency are key to maintaining the KPK's credibility as the front line in eradicating corruption.

Abstract

One consequence of rapid progress in technology and information today is the need to safeguard privacy, especially regarding personal data. To support efforts to protect personal data, a party is needed to monitor and ensure compliance with data processing regulations, known as the Data Protection Officer (DPO). Regulations about DPOs are mainly outlined in Law Number 27 of 2022 concerning Personal Data Protection (PDP Law), which has been in effect since October 2024. However, these regulations remain broad and lack specific clarity about the DPO's role, creating a legal gap. Additionally, the Draft Government Regulation (RPP), which would implement the PDP Law, has yet to be ratified. Given these issues, this article will explore the current state of DPO regulation in Indonesia and compare it with practices in the European Union through the European Union General Data Protection Regulation (EU GDPR).

Abstract

This study aims to describe the legal considerations regarding the syiqaq requirement as a reason for divorce in the Supreme Court Circular Letter No. 3 of 2023 (SEMA) in the decision of the Panel of Judges of the Stabat Religious Court No. 154 / Pdt.G / 2024. juridical-normative research, which involves the analysis of primary data from judges' decision documents, SEMA Law Number 1 of 1974 concerning Marriage and KHI. The results of the study indicate that SEMA does not have the power to cancel laws and regulations because it is internal and not generally binding. However, SEMA can influence the authority of the panel of judges in making decisions. In the judge's decision, the basis used by the judge refers to Article 19 letter (f) PP No. 9 / 1975 in conjunction with Article 116 letter (f) KHI and is in accordance with muqashid asy-syariah, namely protecting the soul (hifz-al-nafs).

Abstract

The current Corruption Law still uses the element of "causing loss to state finances" as the main element of the crime, thus creating legal uncertainty and limiting the effectiveness of corruption eradication. This study uses a normative juridical method with a comparative legal approach between the Corruption Law and the United Nations Convention against Corruption (UNCAC) to analyze the direction of synchronization between the two. The results show that the UNCAC does not require state losses, but rather emphasizes the corrupt act itself, such as abuse of office, bribery, and illicit acquisition of wealth. In conclusion, the removal of this element is an important step in synchronizing the Corruption Law with the UNCAC. Therefore, the recommendation for its removal should focus on unlawful acts and asset recovery.
