Abstract

Unregistered marriage (nikah siri), while considered valid under Islamic law if the essential requirements and pillars are fulfilled, often creates various legal and social issues in Indonesia due to the absence of official documentation. This thesis aims to analyze the rights of spouses in unregistered marriages and the provisions for the division of joint property upon divorce from the perspective of Islamic jurisprudence (fiqh). The study employs a library research approach by examining classical fiqh texts, Islamic legal literature, and relevant regulations. The findings reveal that the rights of spouses in unregistered marriages under Islamic law include maintenance (nafkah), affection, and protection. However, the implementation of these rights is often hindered by the lack of state legal recognition. Regarding the division of joint property, Islamic jurisprudence provides flexibility to resolve conflicts through reconciliation (?ul?) or justice principles based on each spouse’s contribution. Nevertheless, the absence of marriage registration places women and children in vulnerable positions, particularly in accessing legal rights such as inheritance, maintenance, and protection after divorce. This study concludes that marriage registration is essential for better legal protection, especially for women and children. It also recommends raising public awareness about the importance of marriage registration and the role of the government and religious institutions in providing legal solutions for unregistered marriages.

Abstract

This research aims to explore and analyze the da'wah strategies implemented by the management of Al-Hidayah Mosque in encouraging greater participation in congregational Fajr (Subuh) prayer. The declining attendance at Fajr prayer has become a significant concern, considering the high virtue and importance of this prayer in Islam. This study employs a qualitative descriptive method with a case study approach. Data were collected through observation, in-depth interviews with mosque administrators and congregants, as well as documentation. The findings indicate that the mosque management applies several da'wah strategies, including personal engagement with the community, regular Islamic lectures after Fajr prayer, motivational sermons, and the use of social media to disseminate mosque activities. These strategies have shown effectiveness in increasing awareness and participation among worshippers, although some challenges remain, such as individual lack of awareness and busy daily routines. This research is expected to contribute to the development of more effective mosque-based da'wah efforts that directly address community needs.

Abstract

The development of digital technology has had a significant impact on various aspects of life, including the economic and trade sectors. One of the phenomena that has been highlighted is the rise of online trading platforms such as Binomo, which in practice is often categorized as gambling under the guise of investment. This study aims to analyze the legal aspects of online gambling cases involving the Binomo platform based on Law Number 19 of 2016 concerning Electronic Information and Transactions (UU ITE) and other related regulations in the legal system in Indonesia. This study uses a normative legal method with a statute approach and a case approach. The results of the study show that the Binomo platform has a transaction mechanism that resembles gambling, where users risk funds in the hope of getting big profits in a short time, but without transparent and accountable control. Based on Article 27 paragraph (2) of the ITE Law, activities that contain elements of gambling are strictly prohibited in Indonesia, and violations of this provision can be subject to criminal sanctions. In addition, from a trade law perspective, Binomo does not have an official permit from the Financial Services Authority (OJK) and the Commodity Futures Trading Supervisory Agency (BAPPEBTI), so all its activities in Indonesia are illegal. Furthermore, this study reveals challenges in enforcing the law against online gambling, including obstacles in supervision, minimal digital literacy among the public, and the complexity of taking action against foreign-based platforms. Therefore, a stricter policy is needed in regulating online trading platforms, increased international cooperation in eradicating cybercrime, and more massive education for the public regarding the risks of illegal investment.
