This article explains the legal system existing in the Pesantren, particularly in the term of takzir called perceived as non-human punishment contradictory with human rights. This research took place in Pondok Pesantren Edi Mancoro (PPEM) Salatiga with inclusive and tolerant characters, and voicing religious moderation. PPEM has had alumni becoming national figures. This study employed Lawrence Friedman’s legal system theory requiring the functioning of law in three components: legal structure, legal substance, and legal culture. This research employed qualitative method with data source obtained from field work study with depth interview technique and descriptive interpretive analysis. The result of research showed that Pesantren Edi Mancoro has legal system component as required by Friedman. In the context of takzir, there is a shift in the takzir (punishment) application method to evidently undisciplined students or those committing crime. Takzir contributes to creating personality (noble character) of santri in undertaking life post-pesantren. Takzir actually has educative values not contradictory with human rights. So, takzir in pesantren fulfills all components of legal system suggested by Friedman. Out of the three components, legal culture is the basic components of takzir functioning in pesantren, either internal or external legal culture.

This paper aims to reveal the concept of maqasid sharia-finding method according to Tahir ibn Ashur. It argues that Ibn Ashur’s approach to search for maqasid sharia revolves around three methods. The first is inductive method. This method can be done through the induction of many ‘illat (reasons) that have the same hikmah (goals) and the induction of many dalil (provisions) that have the same ‘illat (reasons). The second is al-bayan al-nashshi method. This method refers to understanding of explicit provisions (dalil) in the Qur'an as they leave no room for alternative interpretations according to Arabic language traditions. The third is sunnah mutawatirah method. This method is divided into mutawatir ma’nawi and mutawatir 'amali. Mutawatir ma'nawi is an inference resulted from testimonies of many shahaba (the Prophet's companions) concerning a Prophet's particular action. Actions that are considered mutawatir ma'nawi include those that are clear, bright and axiomatic in nature (ma'lum min al-din bi al-dharurah), or at least close to ma'lum min al-din bi al-dharurah. Meanwhile, mutawatir ‘amali is an inference resulted from a testimony of one shahaba concerning actions always repeated by the Prophet.

This article focuses on al-‘Aql al-Siyasi al-‘Arabi’s work and its relevance. It also touches the political phenomenon in Indonesia during 2016-2019 concerning ““NKRI Bersyariah (Sharia Republic of Indonesia Unitary State)†discourse supported by FPI and “khilafah†discourse supported by HTI. The research method employed was qualitative one involving library research viewed from Pierre Bourdieau’s perspective on habitus, field and distinction, and helped with interactive model of data analysis encompassing data reduction, data display, and conclusion drawing/verifying. The result shows that al-Jabiri views qabilah, ghanimah and aqidah as the habituated keywords since pre-Islam times. The temperament was manifested into the fighting for realizing the ideologies (aqidah) of “NKRI bersyariah†initiated by FPI qabilah, and “khilafah†(transnational) initiated by HTI qabilah. These ideologies basically are the capitalism movement trading Islam (ghanimah) to interest group. The incarnation of al-Jabiri’s terminology can be relevant to Indonesian political phenomenon.

This research investigated the integration of religion and science in the state of Islamic higher education. Methods of the investigation were library research of published and unpublished documents on the process and implementation of integration of science and religion at three state Islamic universities: the State Islamic University Syarif Hidayatullah Jakarta, the State Islamic University Sunan Kalijaga Yogyakarta, and the State Islamic University of Maulana Malik Ibrahim Malang. Data obtained using the following databases: Google Scholar, Sinta- Science and Technology Index, Ebsco-host, Study gate, Sage Journal, Free Scientific Electronic Library (SciELO), and others. The findings showed that there is poor integration of religion and science within the three universities. This conclusion can be seen from the analysis of the students' final report, theses and dissertations from these three universities. This study suggests a further assessment of all State Islamic Universities by the Ministry of Religious Affairs in promoting the integration of religion and science in State Islamic Higher Education.

This paper problematizes the dynamic of contemporary virtual preacher’s role in Indonesia and its religious border, cultural, social, and political impact. Indeed, the new media and social networks gave the preacher a pivotal social figure, a cultural broker, and an authoritative interpreter of religion. The current phenomenon of the rise of social media in da'wa participation has a significant impact on Indonesia's socio-political life. The production of religious knowledge through virtual preaching activism is in line with discourse battles, contestation of authority, and politics. This phenomenon also has an impact on the internal relations among Muslims and between religious communities as well. Therefore, by using ethnographical social-media analysis, this paper examines some research questions below: (1) what the social media can tell us regarding the shifting from traditional religious knowledge to electronic spiritual understanding? (2) how the new ulama develop authority in the online society era? (3) how the politic of piety deal with democracy?

This study aims to examine civic engagement through inter-communal ties that occur in one of the hamlets in Indonesia as a representation of a peaceful area. The inter-communal ties that occur in everyday life and are institutionalized show an effort to unite society in diversity. This is important to scrutinize as an applied example for other regions in Indonesia on a small scale about addressing diversity in one region to create peace starting at the grassroots level. The community and religious leaders in Thekelan Hamlet, Batur Village, Getasan District, Semarang Regency, jointly carry out anjangsana activities that can invite the community to unite in commemorating the holidays of each religion in turn. The people of Thekelan Hamlet are a heterogeneous society that adheres to Islam, Buddhism, Christian, and Catholicism. This study uses an ethnographic approach in observing, documenting, and conducting in-depth interviews with informants. The results showed that anjangsana was an institutionalized daily activity. The grassroots community together with religious leaders designed these activities to increase inter-communal ties between communities and maintain peace. The recommendation for further research is to expand the scope of civic engagement studies by analyzing inter-communal ties in regions throughout Indonesia to find appropriate ways to implement peace efforts. The COVID-19 pandemic has a multidimensional impact, including threatening family resilience. Psychological pressure, as well as an increase in the burden of household domestic work due to concentrated activities (work, school) at home, can give rise to family conflicts that lead to domestic violence and divorce. This study aims to offer a Mubadalah concept as a perspective and methodology in building family resilience. The results show that (1) Mubadalah is a perspective of reciprocity between men and women in carrying out their gender roles both in the domestic and public area so that one does not hegemonize over another but a relationship that supports, cooperates, and helps each other; (2) Mubadalah can be a method of reading texts and contexts around family issues; and (3) Mubadalah is an Islamic moderating perspective between gender and patriarchal regimes. This perspective allows for a balanced relationship and partnership between the two sexes and is not just a transformation of thoughts from patriarchy to matriarchy. Through approach a companionship and non-hierarchical relationship between family members, family resilience can be built.

This article discusses the function of fatwa, specifically the Tarjih Fatwa in the field of family law. So far, Islamic law is still considered not dynamic and is still limited to only one legal function, which is nahi munkar (social control) yet the function of amar makruf (social engineering) which emphasizes the suggestion to perform good deeds in a general and practical sense is still not optimal. This results in the impression that Islamic law seems to lose its relevance. This article aims to explain the function of Tarjih's fatwa for the community. The study in this article is a literature review using a sociological approach. The results indicated that the law (fatwa) is no longer considered as an independent variable that is separated from other elements, but is a dependent variable, as are social norms and other cultural identities. Tarjih fatwa is aimed at directing society to the desired goals, eliminating inappropriate habits, and creating new patterns of behavior. In other words, the function of Tarjih Fatwa can be used as a means of manipulating society (law as a tool of social engineering).

This research is aimed to dismantle and to reveal the religious moderation values from a local legacy of a Muslim cleric/kyai’s reflective thought written in a Javanese-Arabic poem (syiir) “Tanpo Waton†authored by KH. Muhammad Nizam As-Shofa, a local kyai and a spiritual master of the Naqsyabandiyyah Kholidiyyah sufi order. What remains interesting in this syiir is that it has been inaugurated by the national figure of pluralism as well as the fourth president of Indonesia, KH. Abdurrahman Wahid (Gus Dur) through his popular melodious chanting. This is a qualitative-descriptive research. Data collection in this study uses documentation, with a content and discourse analysis technique through the lens of religious moderation concept as the currently Indonesian grand narrative campaign for religious harmony. The analysis then entails the production of data in which there are textual and contextual meaning implied within the syiir which emphasizes how important it is to stick with the values of religious moderation for building Indonesian harmony and strengthening national unity within diversity. The religious moderation narrative within the syiir indeed embeds the values of nationalism, tolerance, non-violence and local wisdom respect. Such values are among the pivotal elements to teach and disseminate towards Indonesian generations for the sake of Indonesian harmony.
