Abstract

The growth of e-commerce following the COVID-19 pandemic has created complex legal protections in return mechanisms, with online businesses facing systematic losses due to fraudulent returns by consumers with bad intentions. This study aims to analyze disparities in legal substance, dysfunctional legal structures, limited platform liability, and problematic legal culture that influence the protection of online businesses. The research method uses a normative juridical approach utilizing Lawrence M. Friedman's Legal System Theory. The results show that consumers can return goods without adequate documentation and that businesses experience returns that differ from the original product. Many disputes result in decisions favoring consumers. An asymmetric burden of proof occurs, resulting in multiple losses for businesses. The return and appeal mechanisms filed by businesses favor consumers. The study's conclusions demonstrate a fundamental imbalance in legal protection due to incomplete regulations, a pro-consumer bias in dispute resolution structures, and a legal culture that ignores the interests of businesses. The study recommends regulatory reform specifically for return mechanisms, strengthening the function of the BPSK (Regional Consumer Protection Agency), establishing an objective platform verification system, and educational campaigns to create a balance of protection in the e-commerce ecosystem.

Abstract

This study aims to analyze the process of determining and affirming the boundary between Oenbit Village and T’eba Village based on Regent Regulation of North Central Timor Number 5 of 2018, examine its impacts on indigenous communal land rights, and formulate legal solutions for resolving the resulting dispute. This research employed an empirical legal research method with a qualitative approach. Data were collected through interviews with customary leaders, village heads, local communities, sub-district heads, and the Legal Affairs Division of the North Central Timor Regency Government, supported by document analysis of relevant legislation and official records. The findings reveal that the process of determining and affirming village boundaries was not fully in accordance with the provisions of Minister of Home Affairs Regulation Number 45 of 2016 due to the absence of mutual agreement among the parties, limited community participation, and insufficient consideration of historical and customary values recognized by local communities. Regent Regulation of North Central Timor Number 5 of 2018 has generated legal, social, economic, cultural, and spiritual impacts on the indigenous people of Oenbit Village, particularly through the reduction of customary communal land traditionally controlled by the community. The resolution of the dispute requires an integrated approach combining customary law and positive law through deliberation, participatory mapping, formal recognition of communal land rights, and evaluation of the existing boundary determination policy. Such an approach is expected to ensure legal certainty, justice, and effective protection of indigenous peoples’ rights.

Abstract

Anti-Suit Injunctions (ASIs) are defined as court orders prohibiting litigants from pursuing or initiating legal actions in the courts of other jurisdictions; they aim to manage parallel litigation and safeguard the integrity of domestic legal processes. In international trade, ASIs are crucial in disputes involving Standard-Essential Patents (SEPs) within high-tech sectors such as 5G, where the territorial nature of patents often triggers multi-forum litigation. This study employs a qualitative approach, focusing on legal interpretation and juridical argumentation regarding the provisions of the TRIPS Agreement and the WTO dispute settlement mechanism. The study finds that the practice of Anti-Suit Injunctions (ASIs) implemented by China has shifted from being merely a tool of civil procedure to a geoeconomic instrument influencing the enforcement of international patent rights. Although China justifies ASIs as a means to protect national jurisdiction, prevent forum shopping, and safeguard domestic economic interests, their implementation effectively restricts the ability of Standard-Essential Patent (SEP) holders to enforce their rights in the jurisdictions where the patents are valid, doing so through the threat of severe financial sanctions. Consequently, the legal status of ASIs in the DS611 case is best viewed as a practice potentially inconsistent with the principle of patent territoriality and the obligations regarding intellectual property rights enforcement set forth in Articles 28 and 41 of the TRIPS Agreement. This dispute demonstrates that national courts no longer function solely as forums for dispute resolution but also serve as strategic instruments to influence licensing negotiations and determine global technology valuations.

Abstract

This study examines the implementation of a Corporate Social Responsibility (CSR) program based on Entrepreneurship development by PT XL Axiata Tbk. through the Sispreneur by Sisternet program. It is motivated by the persistent gap in digital technology use and labor force participation between women and men in Indonesia, and the strategic role of CSR in narrowing that gap. Using Edwards III's policy implementation theory, CSR theory, and gender mainstreaming theory, this research applied a descriptive-narrative qualitative approach through in-depth interviews with one key informant and three main informants, supported by documentation. The findings show that the program was implemented through five stages; engagement, assessment, plan of action, action and facilitation, and evaluation and termination or reformation; centered on digitalization and gender mainstreaming. The main obstacles were participants' limited understanding of gender perspectives, their focus on daily income, technological literacy gaps, and technical platform issues. Benefits included gender-responsive Entrepreneurship education, digital literacy, business roadmap mentoring, and venture capital assistance. The program fulfilled the four variables of policy implementation while accommodating the dimensions and principles of gender mainstreaming, contributing to both corporate goals and women's economic empowerment.

Abstract

This study examines the normative conflict between the Special Region of Yogyakarta (DIY) special status regulations and the constitutional principle of equality of citizens in land ownership rights. Employing a normative-juridical research method with a statute, conceptual, and comparative approach, this study identifies a fundamental tension between the exclusive land rights system originating from the Sultanate's traditional legal order—particularly Gubernatorial Instruction No. K.898/I/A/1975—and the national land law framework as stipulated under the Basic Agrarian Law (UUPA) No. 5 of 1960 and the 1945 Constitution. The findings reveal that DIY's land ownership restrictions based on ethnic classification constitute a form of discrimination that conflicts with Articles 27, 28D, and 28I of the 1945 Constitution, the UUPA's principle of equal land access for all Indonesian citizens, and Law No. 40 of 2008 on the Elimination of Racial and Ethnic Discrimination. The existence of DIY Special Status Law No. 13 of 2012 provides a lex specialis argument but cannot supersede higher constitutional norms. The study further demonstrates that this normative conflict generates significant adverse implications, including legal uncertainty for non-indigenous WNI residents, suppression of investment climate, and threats to national legal system coherence. Resolution requires a systematic approach: revocation or revision of the 1975 Instruction, a restrictive interpretation of DIY's land authority under the Special Status Law, and the establishment of an effective dispute resolution mechanism.

Abstract

This study aims to analyze the juridical implications of the new policy of the Directorate General of General Legal Administration (Ditjen AHU) regarding the requirements for additional documents in the registration of changes in foundation data by notaries. The background of this study was triggered by an administrative renewal of the system aimed at tightening institutional verification and preventing internal disputes of the foundation, which in turn put a new burden of obligation on notaries as public officials. Using normative legal research methods through legislative approaches and conceptual approaches, this study examines secondary legal materials that include ministerial regulations and related circulars. Research results show that the obligation to upload additional documents, such as affidavits not in dispute and corporate account renewal, changes standard procedures on the online AHU system. Although this policy succeeded in increasing the validity of the data and strengthening legal certainty, this new regulation also added bureaucracy and shifted the burden of substantive verification more heavily to notaries. The implications of this study confirmed the need for the Ministry of Law to balance between the firmness of administrative supervision and the efficiency of the system, to ensure that electronic portals remain accommodating while minimizing the risk of office responsibility for notaries.

Abstract

The recognition of Traditional Villages as legal subjects in the national legal system as regulated in Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia, Law Number 5 of 1960 concerning Basic Agrarian Principles Regulations, and Bali Province Regional Regulation Number 4 of 2019 concerning Traditional Villages in Bali has consequences for the regulation of ownership rights and control of customary land in Bali.  This regulation still does not provide clarity regarding the scope of authority of Traditional Villages in carrying out land buying and selling transactions, giving rise to unclear norms and implications for legal uncertainty.  This research aims to analyze the regulation of ownership rights and land control by Traditional Villages in Bali and examine the position of Traditional Villages as legal subjects in the national land law system.  This research is normative legal research with a statutory approach, conceptual approach and historical approach.  Legal materials are analyzed qualitatively using descriptive analytical methods.  The results of the research show that the recognition of Traditional Villages as legal subjects has obtained constitutional and normative legitimacy, however, regulations regarding land ownership and control rights are not yet harmonious, so they still give rise to differences in interpretation in practice.  There is a need for harmonization of land regulations to create legal certainty, provide protection for the rights of customary law communities, and support sustainable management of customary land.

Abstract

The development of information and communication technology has transformed many aspects of social life, including the conduct of marriage. One notable change is the emergence of virtual marriage practices using electronic media such as video conferencing or online communication applications. This practice has triggered debate over whether it is valid under Islamic law and Indonesian positive law. This study aims to examine whether virtual marriage is valid under Islamic law and to investigate its legal validity based on the prevailing legislation in Indonesia. The study employs a normative legal approach by reviewing relevant legal regulations, examining key related concepts, and comparing different legal systems. The information sources cover various legal norms, comprising primary, secondary, and tertiary legal materials, analyzed through a qualitative approach. The findings show that within Islamic law, scholars hold differing opinions on the validity of a virtually conducted marriage contract (akad nikah). Some scholars permit such marriages as long as the pillars and conditions are fulfilled, while others reject them because the requirement of ittihad al-majlis (unity of assembly) has not been met. Under Indonesian law, virtual marriage is not yet explicitly regulated, but it may be considered valid if it fulfills the conditions set out in marriage regulations and can guarantee legal certainty for both parties. Therefore, clearer regulations are needed to accommodate technological developments in the marriage process while still upholding the principles of Islamic law and state law.

Abstract

This study aims to determine the relationship between peer socialization and the level of discipline among high school students. The method used in this study is a quantitative survey research method. The data analysis technique uses the Kendall’s Tau correlation statistical test. The research results show a coefficient value of 0.119 with a p-value (sig.) of 0.026 (< 0.05). This means there is a positive and significant relationship between peer socialization and students’ level of discipline. The operationalized hypothesis that there is a positive relationship between the two variables is proven. The higher the intensity of students socializing with their peers, the higher their level of discipline. Peer socialization is one of the factors influencing students’ discipline because high-intensity socialization between students and their peers can lead to behavioral imitation. When students are in a disciplined peer environment, they are likely to become disciplined themselves. Conversely, when students are in a less disciplined peer environment, they are likely to be less disciplined. So, respondents with high levels of student discipline are those who have a high intensity of socialization with peers.

Abstract

Child marriage, involving individuals under the age of 19 as defined by Law Number 16 of 2019, is a pressing social and legal issue in Bali. The increase in applications for marriage dispensations reflects the high rate of underage marriage, with consequences such as school dropout, economic vulnerability, household instability, and violence. The conflicting norms between National Law, which prioritizes child protection, and Balinese Customary Law, which recognizes the validity of marriage through the Tri Upasaksi (bhuta witness, manusa witness, and dewa witness), exacerbates this situation. This study aims to examine the basis of the Tri Upasaksi rules in Balinese customary law as a means of preventing child marriage, and to analyze how Balinese customary law adapts to the provisions of positive state law. The research method used is normative legal research with a socio-legal approach, analyzing primary and secondary legal materials to identify conflicts and harmonize norms. The findings are expected to contribute to the development of legal science and serve as a reference for the government and customary institutions in formulating policies that integrate local values ​​with child protection.
