Abstract

This comprehensive study delves into a meticulous comparative analysis, examining the metaphysical underpinnings and normative frameworks inherent in Islamic and Western philosophical paradigms. The primary focus is on their profound implications for the foundations and practical application of human rights. Through an in-depth exploration of key philosophical texts, historical contexts, and real-world applications, this research sheds light on the complex tapestry that shapes understanding human rights in these distinct traditions. The Islamic viewpoint, deeply rooted in the sacred Qur'an and Sunnah, emphasizes concepts like fitrah (innate predisposition) and stewardship. At the same time, Western traditions, evolving across classical to Enlightenment eras, prioritize individual liberties within a secular framework. By navigating these intellectual landscapes, this study contributes significantly to a nuanced and culturally sensitive discourse on human rights, surpassing simplistic dichotomies and fostering a global understanding.

Abstract

The existence of the Al-Hijrah mosque is proof of how the community members amount 120 families, suddenly, unplanned, and with a relatively low level of education and a weak economy, were able to build a mosque at a total cost of around IDR 1.7 billion within six months by relying on local wisdom called Communication Guyub (collaborative, togetherness, mutual cooperation). First, communication uses online and offline media, with offline media being dominant. The main cause is because not all residents have smart phones and internet quota, especially those aged 40 years and over. Second, the area is small and the community system is entrenched, this is the reason why residents prefer to share information directly through daily life activities. This research aims to determine the methods/models of Guyub Communication practices and strategies for residents of the Cimareng neighborhood to produce a mosque worth IDR. 1.7 billion within six months in sudden, unplanned conditions and relatively limited conditions. It is hoped that the findings of this research can inspire and become a variant of other development strategies that improve the welfare of society. The research was conducted using qualitative methods and a situational leadership theory approach

Abstract

This research examines the intricate issues of land grabbing and agrarian conflicts in Indonesia, spotlighting the socio-economic and legal challenges faced by local communities, smallholders, and indigenous peoples. Utilizing a normative legal methodology, the study delves into statutory, conceptual, and futuristic approaches to analyze the phenomenon of land grabbing, which has been exacerbated by global food demand, economic interests, and the expansion of capitalism. The enactment of Law No. 1 of 2023 on the new Criminal Code (KUHP) in Indonesia marks a pivotal development in addressing crimes against land, offering robust legal protection against land dispossession, and ensuring equitable land transactions. The research underscores the dire need for agrarian reform, rooted in the principles of the Basic Agrarian Law (UUPA) and aimed at rectifying the unequal distribution of land. It argues for a balanced approach that harmonizes the interests of society, including marginalized groups, with those of investors to foster sustainable development and social justice. The study highlights the legislative efforts to tackle land-related crimes through the new KUHP, emphasizing the significance of transparency, fairness, and the protection of legal rights in land management. Through a comprehensive analysis, this research contributes to the discourse on sustainable national development, advocating for policy reforms and legal measures to combat land grabbing. It calls for a more democratic policy-making process, involving civil society's active participation, to ensure equitable land distribution and uphold the welfare of smallholders and indigenous peoples.

Abstract

This study comprehensively explores blurred vision in the left eye, unraveling its intricate web of anatomy, physiology, and contributing factors. The left eye's complex structure, involving the cornea, iris, lens, retina, and optic nerve, is meticulously dissected to discern their roles in visual perception. Blurred vision transcends optical distortion, presenting a dynamic spectrum of symptoms and characteristics. From difficulties in focusing to haziness and distorted shapes, this visual impairment poses challenges that extend beyond the physical realm, influencing daily activities and psychological well-being. The multifactorial etiology of blurred vision is elucidated, encompassing refractive errors, corneal disorders, lens anomalies, retinal and optic nerve pathologies, and psychological influences. Diagnostic methods, ranging from traditional eye examinations to psychological assessments, are discussed, providing a comprehensive toolkit for accurate assessments. Real-world implications underscore the psychosocial impact, emphasizing the need for holistic patient care. This study's significance lies in its consolidated synthesis of existing knowledge, offering a valuable resource for clinicians, researchers, and educators in the field of ophthalmology. Including case studies enriches practical insights, bridging the gap between theory and clinical application. Visual aids, such as tables, enhance accessibility, ensuring broad dissemination of this complex information. In conclusion, this study advances our understanding of blurred vision in the left eye and sets the stage for future research endeavors, fostering continuous improvements in diagnosis and tailored interventions.

Abstract

Legal protection places an emphasis on the state or government fulfilling the obligations of the community. In the concept of legal protection, there is a demand for the right to legal protection to be fulfilled if the obligation for the law to fulfill the law is carried out, and there will be restrictions on the legal protection of a person who performs legal acts. Legal protection rests on and originates from the concept of the recognition and protection of human rights. This research is grouped in the humanities field if it is related to the RIP of Bengkulu University. It is very relevant to be examined in accordance with the development of the general principles of good governance, which together can be said to be the principles of good governance. The government must protect the interests of housing consumers who are in good faith because they have made house payments both in installments and in cash and have even obtained certificates of land rights. The final effort is a result of the Criminal Court decision, which states that the developer's unlawful actions have now reached the cassation level. If this decision is legally binding, it will result in the loss of land rights for consumers of Grand Korpri Bentiring housing because the land has become an asset of the Bengkulu city government. This research focuses on the consequences of the developer's unlawful act and his responsibility, as well as what efforts the government can make in relation to the protection of housing consumers. Similarly, the criminal acts committed by the developer should not be charged to consumers or result in the elimination of consumer land rights because the land falls to the state due to the proof of unlawful acts (PMH) from the developer. This is in accordance with the adage nemo punitur pro alieno delikto, which means that no one is punished for the actions of others. While civil law liability based on tort (onrechtmatige daad) is based on the existence of a legal relationship between housing consumers and developers through a sale and purchase agreement.
