Journal Customary Law is an international legal journal that publishes research and theoretical articles related to various legal fields. The journal aims to provide scholarly and authoritative articles that discuss legal issues of current importance to both academic research and legal practice. JCL has a national and international readership and publishes refereed contributions from authors around the world. The journal also publishes review articles, but only for selected or invited authors, containing critical notices of recently published books. JCL addresses specific issues on private law, criminal justice, constitutional law, human rights, administrative law, international law, and Islamic law. JCL publishes peer-reviewed articles to increase the efficiency of the process and ensure the quality of published articles. Abstract

Intellectual property rights violations are increasingly common in the digital age, resulting from the growth of digital content media. Low public awareness about the risks of access to illegal content is a major factor in intellectual property violations such as data theft, online trading of counterfeit goods. To solve this problem, the government and the general public must proactively increase law enforcement and educate the public on the importance of respecting intellectual property rights. The way digital technology protects intellectual property rights (IPR), has changed due to easier distribution and access to content on online platforms. Copyright infringement is on the rise, making current laws more difficult to enforce. This research aims to identify how the development of digital technology impacts copyright protection and to find the main problems faced by the Ministry of Law in enforcing the law against copyright infringement in the digital world. This research uses the normative juridical method, by analyzing legislation and conducting a literature review. The results of the analysis show that although digital technology provides people with new opportunities to build and spread work, it also poses problems for supervision and enforcement. To protect copyright in the digital age, the government and society need to take strategic actions to strengthen the legal framework and improve law enforcement capabilities to protect copyright. This is due to regulations that have not fully adjusted to the rapid changes in the digital world, as well as low public awareness of the importance of copyright protection.

Abstract

This research aims to analyse the situation and frequency of personal data breach cases in Indonesia, identify the factors causing them, and evaluate the preventive efforts that have been made in the context of the Personal Data Protection Law. This research uses a mixed methods approach that combines quantitative and qualitative methods. Quantitative data was obtained through an online survey of Indonesians to measure the level of awareness and experience related to personal data breaches. Meanwhile, qualitative data was obtained through a literature study and in-depth interviews with experts in cybersecurity and law. The results show that cases of personal data breaches in Indonesia are increasing, with the main contributing factors including weak public awareness, lack of data protection by companies, and suboptimal law enforcement. Preventive efforts that need to be improved include socialisation of the Personal Data Protection Law, improving information system security, and cross-sector cooperation. This research provides recommendations for more effective policies to prevent and address cases of personal data breaches in the future.

Abstract

Penghilangan watermark digital merupakan tantangan besar dalam perlindungan hak cipta di era digital. Watermark digunakan sebagai alat identifikasi dan perlindungan terhadap karya digital, tetapi keberadaannya dapat dengan mudah dihapus atau dimanipulasi, menimbulkan potensi pelanggaran hak cipta. Penelitian ini menggunakan pendekatan yuridis normatif untuk menganalisis aspek hukum terkait penghilangan watermark digital dalam perspektif Undang-Undang Hak Cipta (UU No. 28 Tahun 2014) dan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE No. 11 Tahun 2008 jo. UU No. 1 Tahun 2024). Hasil penelitian menunjukkan bahwa penghilangan watermark dapat dikategorikan sebagai tindak pidana, terutama jika dilakukan tanpa izin dan berdampak merugikan pemilik hak cipta. Namun, penegakan hukum masih menghadapi berbagai tantangan, termasuk lemahnya regulasi, keterbatasan forensik digital, serta kurangnya pemahaman aparat hukum terhadap kejahatan siber. Peningkatan kapasitas penegak hukum, penguatan regulasi, dan pemanfaatan teknologi enkripsi serta blockchain dapat menjadi solusi dalam meningkatkan perlindungan hak cipta. Selain itu, kesadaran masyarakat dan pembuat kebijakan perlu ditingkatkan agar perlindungan hak cipta digital semakin efektif dan berkelanjutan. Dengan langkah-langkah ini, penghilangan watermark digital dapat diminimalisir, sehingga hak cipta di dunia digital lebih terlindungi dan dihormati.

Abstract

The Supreme Court Decision No. 23P/HUM/2024 on the minimum age limit for regional head candidates has come under scrutiny due to its impact on legal principles, politics, and public trust. This research discusses the application of power theory in the decision, highlighting the role of the Supreme Court as a guardian of the rule of law and the principle of checks and balances. Using a qualitative method, this research analyses the legal process, impact, and public response to the ruling, which stipulates that a candidate's age is calculated from the time of inauguration, not determination. This decision has raised pros and cons: on the one hand, it is considered inclusive of the younger generation, but on the other hand, it has triggered accusations of political manipulation. The survey showed that the majority of the public understood the importance of the Supreme Court's involvement in maintaining justice, despite concerns about the transparency of the process. The conclusion underscores the importance of caution in the formation of regulations to reflect legal integrity and maintain public trust.

Abstract

Perumahan di Indonesia menghadapi tantangan yang signifikan selama pemerintahan Presiden Joko Widodo, terutama di kalangan masyarakat berpenghasilan rendah (MBR). Jumlah penduduk yang semakin meningkat berkolerasi terhadap kebutuhan akan perumahan layak yang semakin mendesak mengakibatkan masyarakat kesulitan memiliki rumah sehingga di bentuk progam Tabungan Perumahan Rakyat. Undang-undang Republik Indonesia Nomor 4 Tahun 2016 adalah program penyimpanan yang dilakukan oleh peserta tapera secara berkala dalam jangka waktu yang dapat digunakan untuk pembiayaan perumahan terutama bagi MBR. Pada pasal 5 ayat (3) PP No. 25 Tahun 2020 tentang Penyelenggaraan Tabungan Perumahan Rakyat mewajibkan pekerja dan pekerja mandiri sebagai peserta. Pekerja yang menerima upah atau penghasilan tetap lebih terjamin tentang keberlangsungan kepesertaan Tapera daripada pekerja mandiri yang tidak dapat memastikan penghasilan mereka namun, pernyataan ini mengakibatkan problem dalam masyarakat tentang ke adilan bagi peserta progam tapera. Tujuan penelitian ini yaitu untuk mengetahui apakah kewajiban kepesertaan pekerja mandiri mengikuti progam tapera sesuai teori keadilan John Rawls dengan menggunakan metode penelitian pendekatan perundang-undangan dan pendekatan konsep, sumber data dan analisis data. Hasil penelitian ini menunjukkan bahwa kewajiban pekerja mandiri dalam Program Tapera diatur dalam PP No. 25 Tahun 2020 yang bertentangan dengan teori keadilan John Rawls, karena membebani kelompok pekerja mandiri yang ekonominya rentan dan tidak adil sebagai kewajaran. Program ini seharusnya disusun lebih inklusif, memperhatikan prinsip kebebasan yang sama serta kebutuhan kelompok rentan, agar menjadi instrumen keadilan sosial dalam akses perumahan bagi seluruh pekerja di Indonesia.

Abstract

Penelitian ini bertujuan untuk mengkaji implikasi hukum dari integrasi metadata dan teknologi blockchain dalam sistem perikatan di Indonesia. Latar belakang penelitian ini didasarkan pada perkembangan teknologi digital yang mendorong perubahan dalam mekanisme perikatan, khususnya melalui penggunaan kontrak elektronik dan smart contract berbasis blockchain. Penelitian ini menggunakan pendekatan yuridis normatif, dengan mengandalkan bahan hukum primer, sekunder, dan tersier yang dikumpulkan melalui studi kepustakaan. Analisis dilakukan secara deskriptif-analitis untuk menilai kesesuaian prinsip hukum perikatan dengan penerapan blockchain dan metadata dalam transaksi digital. Hasil penelitian menunjukkan bahwa integrasi metadata dalam blockchain dapat meningkatkan keabsahan, keamanan, dan transparansi kontrak elektronik. Namun, masih terdapat tantangan dalam aspek regulasi, perlindungan data pribadi, serta pengakuan hukum terhadap smart contract di Indonesia. Untuk itu, diperlukan pembentukan kerangka hukum yang lebih komprehensif dan adaptif agar teknologi ini dapat diimplementasikan secara optimal dalam sistem hukum nasional
