Abstract

Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi konsumen terhadap praktik pengoplosan beras merek Stabilisasi Pasokan dan Harga Pangan (SPHP) serta mengevaluasi politik hukum yang mengaturnya dalam rangka menjamin hak konsumen dan ketahanan pangan nasional. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, yang diperkaya dengan teori Roscoe Pound mengenai hukum sebagai sarana rekayasa sosial. Bahan hukum primer meliputi Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 18 Tahun 2012 tentang Pangan, serta Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Bahan hukum sekunder diperoleh dari buku, jurnal ilmiah, skripsi, sumber daring, dan studi kasus yang relevan. Analisis data dilakukan secara deduktif dan induktif untuk menilai kesesuaian norma hukum dengan praktik di lapangan serta arah kebijakan negara. Hasil penelitian menunjukkan bahwa praktik pengoplosan beras SPHP merupakan pelanggaran terhadap ketentuan Pasal 8 Undang-Undang Perlindungan Konsumen terkait standar mutu dan kejujuran informasi produk, serta menimbulkan tanggung jawab mutlak bagi pelaku usaha sebagaimana diatur dalam Pasal 19 sampai dengan Pasal 23. Namun demikian, efektivitas perlindungan hukum masih terhambat oleh lemahnya pengawasan distribusi, rendahnya kepatuhan pelaku usaha, dan belum optimalnya penegakan sanksi, yang mencerminkan kurang kuatnya komitmen politik hukum negara dalam menjaga keamanan pangan. Penelitian ini merekomendasikan rekonstruksi politik hukum yang lebih responsif melalui penguatan sistem pengawasan, pengetatan sanksi, pemberdayaan pemerintah daerah, serta pemanfaatan teknologi pelacakan distribusi beras guna mewujudkan perlindungan konsumen yang berkeadilan dan berkelanjutan.

Abstract

Penelitian ini bertujuan menganalisis dampak perluasan Operasi Militer Selain Perang (OMSP) serta penempatan prajurit aktif Tentara Nasional Indonesia (TNI) dalam jabatan administratif sipil terhadap relasi sipil-militer dan kualitas demokrasi Indonesia pasca-Reformasi 1998, khususnya dalam konteks revisi Undang-Undang TNI tahun 2025. Fokus utama penelitian ini adalah kekhawatiran atas potensi kembalinya peran dominan militer di ranah sipil yang sebelumnya dibatasi melalui agenda reformasi sektor keamanan. Penelitian ini menggunakan metode kualitatif dengan pendekatan analisis-deskriptif melalui kajian literatur, analisis dokumen hukum dan kebijakan termasuk UU TNI No. 34 Tahun 2004 dan revisinya serta telaah literatur akademik mengenai hubungan sipil-militer dan demokratisasi. Data diperoleh dari jurnal ilmiah, laporan lembaga pemerintah dan organisasi masyarakat sipil, serta analisis kasus terkait pelanggaran batas kewenangan TNI di sektor non-pertahanan. Hasil penelitian menunjukkan bahwa perubahan UU TNI 2025 mengandung kekosongan norma dan ambiguitas interpretasi yang membuka ruang perluasan peran militer di sektor sipil, diperparah oleh lemahnya mekanisme pengawasan sipil dan tingginya legitimasi sosial terhadap TNI. Kondisi ini berpotensi mengaburkan batas kekuasaan sipil-militer, meningkatkan risiko pelanggaran HAM, serta melemahkan prinsip supremasi hukum dan akuntabilitas demokratis. Dengan merujuk pada teori kontrol sipil objektif Huntington dan konsep constabulary force Janowitz, penelitian ini menegaskan pentingnya penguatan supremasi sipil, pembatasan peran militer, dan reformulasi mekanisme pengawasan guna mendukung konsolidasi demokrasi di Indonesia.

Abstract

This study aims to analyse the effectiveness of the Criminal Hygiene Approach in preventing sexual abuse crimes against potential victims, particularly vulnerable groups such as children, women, and the elderly. The research focuses on crime prevention efforts through improving social and environmental conditions that are considered to have a significant influence on the emergence of sexual abuse crimes. The research method used is a normative juridical approach supported by an empirical juridical approach, conducted through literature studies, analysis of court decisions, and criminological studies relevant to the prevention of sexual crimes. The results of the study show that the application of the principles of Criminal Hygiene plays an important role in creating a safe and preventive social environment, including through strengthening education, increasing legal literacy, social awareness, and continuous environmental monitoring. Analysis of sexual abuse cases in the Tangerang and Kulon Progo areas revealed that these crimes were influenced by a closed social environment, low intensity of social interaction, weak informal social control, and limited access to protection mechanisms for vulnerable groups. In addition, this study found various obstacles in the implementation of the Criminal Hygiene Approach, such as the tendency of victims to remain silent due to fear and social stigma, weak coordination between authorised institutions, and low levels of public awareness and participation in prevention efforts. Therefore, this study emphasises that strengthening the Criminal Hygiene Approach requires continuous synergy between families, communities, and formal institutions so that protection for potential victims can be carried out effectively, comprehensively, and in an integrated manner.

Abstract

This study examines conditional grants (hibah bersyarat) as a preventive mechanism to prevent inheritance disputes in the Religious Courts. The high number of inheritance dispute cases submitted to the courts indicates weaknesses in the regulation and planning of family asset management. On the other hand, the practice of fully transferring assets to children during the lifetime of parents has the potential to create legal vulnerability and future conflicts, particularly when the donor loses control over assets that have already been transferred. These conditions underline the need for alternative legal arrangements that are capable of providing legal protection for donors while simultaneously ensuring legal certainty for recipients. This research aims to analyze the concept of conditional gifts from normative and juridical perspectives and to assess their effectiveness as an instrument of legal protection, as well as a means to realize justice, legal certainty, and utility in family asset management. The study employs a normative legal research method using conceptual and statutory approaches, supported by empirical data obtained through interviews with notaries as a means to strengthen the analysis and to obtain practical perspectives regarding the implementation of the examined legal concept. The findings confirm that conditional gifts are normatively legitimate and legally acceptable, allow donors to retain control, provide early certainty, and function as an effective mechanism to prevent inheritance disputes.

Abstract

Necessary defence is a criminal defence that plays an important role in Indonesian criminal law, especially amid increasing public vulnerability to the threat of crime. Although it is regulated in Article 49 of the Criminal Code and reinforced by Article 34 of Law Number 1 of 2023, its application in practice still faces various problems. The main problem lies in law enforcement officials' assessment of the elements of forced defence, such as proportionality, immediacy, inability to avoid, and the psychological condition of the perpetrator, which often leads to the criminalisation of defensive actions that should be lawful. This study uses a normative juridical approach with case studies of Donggala District Court Decision Number 32/Pid.B/2021, Sinjai District Court Decision Number 101/Pid.B/2024, and the Amaq Sinta case to examine the consistency of the application of forced defence in judicial practice. The results of the study show that the application of noodweer is highly dependent on the objectivity of investigators and the thoroughness of judges in understanding the factual context and the dynamics of the threat faced by the perpetrator. Differences in understanding among officials often create a gap between legal norms and law enforcement practices. Therefore, standardised interpretation, clear technical guidelines, and capacity building for officials are needed so that self-defence can realise substantive justice and effective protection of the right to life and safety of individuals.

Abstract

The The development of information technology in the digital age has increased the ease of access to data-based services, but it has also posed a serious threat in the form of personal data theft as a form of cybercrime. Personal data theft not only causes financial losses, but also has psychological and social impacts such as stress, anxiety, decreased trust in digital institutions, and damage to the victim's reputation. This study aims to analyze personal data theft from a criminological perspective by examining the driving factors, impacts, and weak data protection in Indonesia. The research method used is a qualitative approach through a literature study of regulations, criminological theories, and cases of data theft in digital and banking services. The results show that data theft is triggered by the perpetrators' economic motives, human error, malware attacks, social engineering, weak digital security systems, and low public literacy. In addition, the implementation of the Personal Data Protection Law (PDP Law) is considered suboptimal, thus failing to provide effective protection. This study concludes that personal data theft is a complex crime that requires regulatory strengthening, improved cybersecurity, and collaboration between the government, digital institutions, and the public to create a secure digital ecosystem.

Abstract

This study examines the regulatory construction of sexual violence crimes under Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS Law) and analyzes the urgency of effective law enforcement in Indonesia. The research applies a normative juridical method using historical and statutory approaches to explain the background, development, and legal framework of the TPKS Law. The historical approach traces the evolution of legal protection for victims of sexual violence, while the legislative approach analyzes the substance, structure, and systematic coherence of the law within the national legal system. The findings show that the TPKS Law consists of 12 chapters and 93 articles that comprehensively regulate sexual violence crimes. These provisions include general definitions, classifications of sexual violence, related criminal acts, investigation and prosecution procedures, and court examination mechanisms. The law also explicitly regulates the rights of victims, victims’ families, and witnesses, including protection, recovery, restitution, and access to justice. TPKS Law prioritizes integrated women/children protection services at national and local levels, plus prevention, coordination, oversight, and community involvement. It includes funding, global partnerships, transitional clauses, and final provisions, notably launching SPPT-PKKTP for women violence cases.  Within this system, victims are positioned as legal subjects with the right to be heard, informed of legal processes, considered in the pursuit of justice, and restored from the impacts of violence. This victim-centered orientation represents a shift toward restorative-justice.

Abstract

This research covers the Iraqi experience regarding cybercrimes, which reveal an obvious discrepancy between the present criminal laws and the widespread nature of the breaches that are common nowadays. This research particularly covers the ongoing use of the Code of Criminal Procedure and the 1980 Wireless Communications Law, despite the reality that the laws were mainly drafted for physical crimes. As such, the legislation doesn't address the wide range of other crimes that are committed using the internet, such as hacking into computer systems, the manipulation of electronic data, and international fraud. In addition, the research focuses on the problems faced by the prosecution regarding the search for electronic documentation, which, as discussed, remains uncharted despite plenty of gaps. In short, the whole criminal justice system only delivers ineffectual penalties despite the gravity of the crime. This research forms the starting point for exploring the gaps that are apparent within the existing Iraqi legal framework. It assesses the applicability of the laws and regulations and attempts to pinpoint where the laws are failing and why there are discrepancies in enforcing them. The authors believe that the criminalization process needs to shift from the imbalance of the laws to the definition of digital behaviors and an accompanying shift in the definition of the evidentiary rules. The conclusion reached highlights that Iraqi legislation and regulations lack the efficacy required to deal with the comprehensiveness of the threats that come through cyberspace.

Abstract

Penerapan bedah robotik telah meningkat secara signifikan karena presisinya, sifat invasifnya yang minimal, dan waktu pemulihan yang lebih singkat. Namun, penerapannya di fasilitas kesehatan primer menimbulkan masalah hukum yang kompleks, termasuk tanggung jawab profesional, tanggung jawab institusional, tanggung jawab produk, dan sejauh mana perlindungan pasien ketika terjadi kesalahan teknologi atau manusia. Studi ini menganalisis kerangka hukum Indonesia yang mengatur bedah robotik dan meninjau mekanisme perlindungan pasien, persyaratan informed consent, dan kompetensi operator. Dengan menggunakan metode yuridis normatif, penelitian ini menyoroti kebutuhan mendesak akan peraturan khusus yang mengatur teknologi medis canggih untuk menjamin keselamatan pasien dan kepastian hukum.
