Abstract

This study examines digital da'wah content, namely religious lectures by Islamic scholars on YouTube and Instagram, as a supplementary learning resource in Islamic Religious Education (PAI) in public senior high schools in Banten Province, Indonesia. Adolescent Muslim consumption of such content has grown substantially, yet the formal PAI curriculum has not responded to it pedagogically. The study maps students' consumption patterns, analyses their critical reception capacity, and identifies opportunities and constraints for integration within the Merdeka Curriculum. A sequential explanatory mixed-methods design was used: a survey of 324 students from six public senior high schools, followed by phenomenological interviews with 24 students. Quantitative data were analysed with Structural Equation Modeling using Partial Least Squares (PLS-SEM) in SmartPLS 4.0, and qualitative data through inductive thematic analysis grounded in Freire's critical awareness framework. Findings show that 78.4 percent of students actively consume digital da'wah content, yet only 31.2 percent demonstrate adequate source verification capacity. Such content significantly influences religious identity formation (b = 0.412; p < 0.001; R² = 0.341). Students with stronger critical reception show more internalised religious motivation, indicating that reception quality, not consumption volume, drives identity outcomes. The study proposes a three-tier integration model covering Islamic-media critical literacy, a da'wah content curation guide, and digital-literacy competency training for teachers.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis Pelaksanaan penyelesaian sengketa harta warisan di Pengadilan Agama dan Upaya Pengadilan Agama Parepare dalam mengatasi kendala penyelesaian sengketa harta warisan dengan teori kepastian hukum dan keadilan dengan para ahli waris. Penelitian ini mengunakan tipe penelitian Normatif Empiris dengan Pendekatan Perundang-undangan dan Pendekatan Sosial. Jenis sumber Data mengunakan Data Primer danData Sekunder. Analisis data akan dengan cara observatif-indrawi dan teoretis-rasinal dengan menggunakan model penalaran dengan terlebih dahulu menggunakan logika induktif yang kemudian diteruskan dengan logika deduktif. Pelaksanaan penyelesaian sengketa harta warisan di Pengadilan Agama merupakan kewenangan absolute berdasarkan pasal 49 Undang-undang No. 3 Tahun 2006 tentang perubahan Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama yang melalui tahap-tahap yaitu pedaftaran gugatan, penafsiran biaya perkara, penunjukan majelis hakim, pemanggilan para pihak, mediasi, Pemeriksaan Persidangan (Pembavaan Gugatan, Jawaban/Eksekpsi, Replik/Duplik,pemeriksaan bukti surat, saksi, ahli (jika diperlukan), pemeriksaan setempat (khusus objek tidak bergerak)), Kesimpulan para pihak, Putusan Hakim dan Pelaksanaan atau Eksekusi putusan (jika putusan sudah berkekuatan hukum tetap atau tidak adanya upaya hukum) Dan Upaya Pengadilan Agama Parepare dalam mengatasi kendala penyelesaian sengketa harta warisan dengan teori kepastian hukum dan keadilan dengan para ahli waris yaitu dengan mengoptimalkan mediasi, mengoptimalkan proses pembuktian, memberikan pertimbangan hukum yang jelas dan sistematis, menjatuhkan putusan verstek apabila persyaratan terpenuhi dan Pelaksanaan Eksekusi Putusan sesuai Prosedur.

Abstract

This study aims to analyze the provisions on life imprisonment in Law No. 1 of 2023 on the Criminal Code, particularly regarding the absence of a time limit for the review of life-sentenced prisoners. This study employs a normative legal research method using a statutory approach, a conceptual approach, and a comparative approach. Legal materials were analyzed qualitatively using a descriptive-analytical method. The results of the study indicate that although the National Criminal Code has updated the sentencing system to accommodate more humane sentencing objectives, the provisions regarding life imprisonment still leave a normative gap concerning the evaluation mechanism. Unlike the death penalty, which provides for a ten-year evaluation period, life imprisonment lacks a similar mechanism, potentially leading to legal uncertainty and contradicting the principles of rehabilitation and social reintegration. Therefore, a reformulation of the regulations governing the evaluation of life imprisonment is necessary as part of the reform of national criminal law.

Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas pelaksanaan Program Pendaftaran Tanah Sistematis Lengkap (PTSL) di Kantor Pertanahan Kota Parepare serta mengidentifikasi faktor-faktor yang memengaruhi implementasinya. Sebagai salah satu program strategis nasional, PTSL bertujuan mempercepat pendaftaran tanah dan memperkuat kepastian hukum atas hak-hak masyarakat. Namun, pelaksanaannya masih menghadapi berbagai tantangan, antara lain harmonisasi regulasi, ketepatan administrasi, koordinasi kelembagaan, dan partisipasi masyarakat. Penelitian ini menggunakan metode penelitian hukum normatif-empiris dengan pendekatan peraturan perundang-undangan dan pendekatan sosiolegal. Data diperoleh melalui observasi, wawancara, dokumentasi, studi terhadap peraturan perundang-undangan, serta kajian pustaka yang relevan. Seluruh data dianalisis secara kualitatif dengan menggunakan teknik analisis deskriptif, interpretatif, dan evaluatif. Hasil penelitian menunjukkan bahwa pelaksanaan Program PTSL pada Kantor Pertanahan Kota Parepare pada umumnya telah sesuai dengan ketentuan peraturan perundang-undangan yang berlaku serta berkontribusi dalam meningkatkan kepastian hukum, mewujudkan tertib administrasi pertanahan, dan memberikan perlindungan hukum bagi pemegang hak atas tanah. Meskipun demikian, efektivitas pelaksanaannya masih dipengaruhi oleh beberapa faktor, yaitu substansi hukum, kapasitas kelembagaan, ketersediaan sarana dan prasarana pendukung, tingkat kesadaran hukum masyarakat, serta budaya hukum. Penelitian ini merekomendasikan penguatan harmonisasi regulasi, peningkatan kapasitas kelembagaan dan infrastruktur digital, penguatan koordinasi antarinstansi, serta peningkatan edukasi hukum kepada masyarakat secara berkelanjutan guna mengoptimalkan pelaksanaan Program PTSL. Upaya tersebut diharapkan dapat mewujudkan kepastian hukum yang berkelanjutan serta tertib administrasi pertanahan yang lebih efektif.

Abstract

This study aims to examine and analyze the implementation of civil case resolution via E-Court-based small claims procedures at the District Court, the factors hindering the implementation of electronic small claims at the Sidrap District Court, and the obstacles encountered in this process. The study employs a normative-empirical research design, utilizing both statutory and socio-legal approaches. Data sources include both primary and secondary data. Data analysis is conducted through observational-sensory and theoretical-rational methods, employing a reasoning model that proceeds from inductive logic to deductive logic. The study finds that the implementation of civil case resolution via E-Court-based small claims at the District Court is governed by Supreme Court Regulation No. 4 of 2019 (amending Supreme Court Regulation No. 2 of 2015 on Small Claims Resolution Procedures) and Supreme Court Regulation No. 7 of 2022 (on Electronic Case Administration and Court Proceedings). The process comprises the following stages: registration (E-Filing), payment (E-Payment), review of claim completeness, appointment of the presiding judge and substitute clerk, summoning of parties (E-Summons), conciliation, trial proceedings (E-Litigation), and the rendering of the judgment. In the E-Court system, judges upload official copies of rulings—electronically signed using digital certificates (e-sign) from the Electronic Certification Center (BSrE)—into the SIPP and E-Court systems. Factors hindering the implementation of electronic-based small claims lawsuits at the Sidrap District Court, as well as obstacles in resolving such civil cases, include: administrative factors (errors in uploading or transmitting files/documents, identity verification issues, problems with advance court fees, administrative errors in summoning parties, and delays in sending hearing documents); public factors (legal understanding and culture, where the public lacks knowledge regarding E-Court and still views face-to-face court services as necessary); and infrastructure factors (issues with internet networks and the E-Court system/application). Additionally, regulatory obstacles exist regarding Supreme Court rules on E-Court and small claims; these regulations address procedural aspects but fail to provide mechanisms for resolving issues that arise during the actual implementation of electronic-based small claims proceedings.

Abstract

This study aims to examine and analyze the implementation of the Electronic Mortgage (HT-el) at the Pinrang Regency Land Office based on Minister of Agrarian Affairs and Spatial Planning/National Land Agency Regulation No. 5 of 2020 and to identify the challenges encountered in its implementation. This study is normative-empirical research employing both a legal and a social approach. Data sources consist of primary and secondary data obtained through observation, interviews, and documentation. Data analysis was conducted using observational-sensory and theoretical-rational methods, applying a reasoning model that first utilized inductive logic followed by deductive logic. The results of the study indicate that the implementation of the electronic mortgage registration system (HT-el) at the Pinrang Regency Land Office has been carried out in accordance with the provisions of Minister of Agrarian Affairs and Spatial Planning/National Land Agency Regulation No. 5 of 2020. The application of the electronic system has improved efficiency, transparency, and accountability, while also providing convenience and certainty in the registration services for mortgage rights. The challenges encountered include legal obstacles (regulatory adjustments), technical issues (system and internet network disruptions), administrative hurdles (incomplete or non-compliant required documents), and sociological factors (differences in users’ levels of understanding and ability to operate the HT-el system), but these did not hinder the overall implementation of HT-el, as they could be overcome through coordination among stakeholders, human resource capacity building, and system improvements.
