Abstract

Among modern women, there are those who do not agree with the implementation of female circumcision, especially those that damage the reproductive organs, because it is an act of violence against women. This does not mean that there is a contradiction between Islamic teachings and the provisions of “Positive Law” regarding female circumcision, because textually there is no explicit argument that can be referred to do make it mandatory, so that from a fiqh perspective no Ulama of fuqaha requires it. Some Ulama even state that the law on female circumcision in only permissible, it may or may not be carried out, therefore, it is up  to parents of the government. If it is considered more beneficial not carry it out, this research is a type of library research, namely research whose object of study uses library data in the form og books, journals, articles and so on as the data source. This research os carried out by reading, reviewing an analyzing various existing literature, in the form of the Qur’an, hadith, MUI fatwa, as well as research argument that requires or considers circumcision for women to be sunnah, either from al-Qur’an, sunnah, ijma’ and qiyas. Qardhawi also revealed that the ulama agrees on this abilities. So there is not a single scholar who says that circumcision is something that is forbidden or that is makruh li tanzih or li tahrim. Therefore, it is nor considered good for someone to criticize the person who did it or consider to have committed an act against the law, uncles it is done excessively to the point that one of the parties feels aggrieved.

Abstract

Legal analysis of corporate financial transparency and accountability is an important study in the context of corporate governance and financial market integrity. In an information-driven environment, transparency in financial reporting is key to ensuring stakeholder trust and market efficiency. However, the lack of transparency and accountability in financial reporting is often a disturbing issue, raising questions about the legal framework that regulates it and the legal implications of these practices. A lack of transparency in financial reporting not only creates risks for stakeholders, such as investors and creditors, but can also disrupt market efficiency by increasing asymmetric information. Therefore, law enforcement against financial reporting violations is important in ensuring company compliance with applicable transparency standards.

Abstract

Penelitian ini bertujuan untuk menganalisis penetapan imbalan yang wajar bagi inventor paten Alpanhankam yang pelaksanaannya dilakukan oleh pemerintah Indonesia, berdasarkan Undang-Undang Nomor 13 Tahun 2016 tentang Paten dan Peraturan Presiden Nomor 77 Tahun 2020 tentang Tata Cara Pelaksanaan Paten oleh Pemerintah. Fokus utama penelitian ini adalah untuk mengevaluasi apakah ketentuan yang ada sudah cukup memadai dalam memberikan perlindungan hak ekonomi bagi para inventor, terutama terkait dengan mekanisme kompensasi yang adil dan proporsional. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus implementasi paten oleh pemerintah. Hasil penelitian ini menunjukkan bahwa meskipun terdapat kerangka hukum yang mengatur imbalan, masih terdapat ketidakjelasan dalam penerapannya, khususnya dalam aspek penentuan nilai kompensasi yang dianggap wajar bagi inventor. Temuan ini diharapkan dapat memberikan kontribusi dalam perbaikan kebijakan terkait perlindungan hak ekonomi inventor di Indonesia.

Abstract

Reflecting a paradigm shift in the way people look for work as well as a profound transformation in global economic change, the Gig Economy has become a highly sought after labor market. The gig economy is a job market that relies heavily on the role of independent contractors or contract workers and freelancers to fill temporary and part-time positions. Behind the advantages of the Gig Economy phenomenon, significant challenges are often hidden, especially in terms of legal protection. Therefore, the author conducted studies and research on how Labor Law in Indonesia protects workers in the Gig Economy Era. The writing method that the author uses is qualitative with literature study. Based on the results obtained from the literature, the author can conclude that currently, there is no law in Indonesia that specifically regulates worker protection in the gig economy sector, nor has there been any significant regulatory development related to partnership relations in Indonesia. In fact, the growth of gig economy workers in Indonesia is quite rapid. Gig workers may be protected by the Employment Law, which regulates employment relations between workers and employers. Although gig workers are considered partners, they have rights as employees.

Abstract

The main aim of this research is to find out what the law is for health consumers who experience malpractice and to find out what are the obstacles to the rights of health consumers who experience malpractice. This is very important to explain so that anyone knows about legal protection from malpractice cases and can find out the causes and effects of these cases. The research method used in this article is a normative legal research method which focuses on positive law inventory, legal principles and doctrine, legal discovery in cases in concreto, legal systematics, level of synchronization, legal comparison and legal history. The conclusion of this research is that in terms of proving malpractice, consumers must be able to prove that the injuries experienced by consumers/patients are the result of violations committed by health workers.

Abstract

This research aims to determine the implementation of Garut Regency regional government policy in managing street vendors in the Pengkolan area and the factors that hinder it. Using qualitative methods with descriptive analysis. Where data collection used includes observation, interviews and documentation. Data analysis techniques using data reduction, data presentation and drawing conclusions. The results of the research concluded that the local government had communicated to street vendors both persuasively and repressively. Human resources implementing policies are ready in quality and quantity to carry out their duties and functions. Meanwhile, equipment resources are still limited and cannot accommodate a large number of street vendors. Limited budget is a problem for relocating street vendors from red zones. The policy implementers already have a strong attitude and commitment to implementing government policies in structuring street vendors in the Pengkolan area. The arrangement of street vendors in the Pengkolan area has involved various related agencies and stake holders. In the field, factors found to be obstacles were the government's lack of seriousness in enforcing criminal and civil sanctions, the lack of awareness of street vendors regarding the rules and the reluctance of street vendors to be relocated.

Abstract

In February 2024, Bea Cukai Soekarno-Hatta with Badan Pengawas Obat dan Makanan has (BPOM) destroyed one ton of imported processed food namely milk buns from Thailand. There are two problems in this research, that’s how the distribution permits for imported processed food are regulated in Indonesia and how consumer protection for imported processed food without a distribution permit based on a case study of the destruction of one ton of Milk Bun bread from Thailand. The type of research is normative juridical. The problem approaches used are the statute approach and the case approach. Data sources were obtained from secondary data. The sources of legal materials are obtained from primary and secondary legal materials. The data collection techniques were carried out using library research. The data analysis technique was carried out using qualitative analysis. Meanwhile, analyzing legal materials is done using content analysis. The research results explain that the regulations for distribution permits for imported processed food in Indonesia is Peraturan Badan Pengawas Obat dan Makanan Nomor 27 Tahun 2022 tentang Pengawasan Pemasukan Obat dan Makanan Ke Dalam Wilayah Indonesia. The consumer protection against imported processed food without a distribution permit based on a case study of the destruction of one ton of milk bun bread from Thailand is BPOM gave orders to the Ditjen Bea Cukai, specifically Bea Cukai Soekarno-Hatta to carry out the destruction.

Abstract

Human rights is a right owned by every individual on this earth that is absolute and cannot be reduced. In the international world, human rights are protected and have legal regulations, but human rights violations still often occur in individual humans, one of which in this case is Palestinian civilians. The research method used in this research is normative juridical method. The results of this study state that Israel in attacking Palestinian civilians, has ignored the 1949 Geneva convention that has been ratified by Israel. In this case, international institutions such as the UN Security Council need to take a role in mediating the conflict. However, Israel has not ratified the Rome Statute of 1998 so it is not yet the authority of the ICC to prosecute, so a referral to the UN Security Council is needed. The national law that was established because it did not ratify the 1998 Rome Statute has not achieved justice and works the other way around because it protects Israel to be tried by the ICC. In addition, in the case of wars such as the Israeli-Palestinian conflict, non-derogable rights need to be applied and should not be limited because it can be considered a violation of human rights. However, Israel ignores this right by attacking Palestinian civilians and medical personnel.

Abstract

This article attempts to analyze the fatwas in Indonesia (DSN-MUI) with the fatwas in Malaysia (MPS-BNM), the fatwas that are analyzed are more specific to the mudharbah agreement of the two fatwa institutions. from the fatwa in issuing a fatwa, in terms of definition, pillars and requirements, as well as the application of fatwa in Islamic banking in both countries. The data sources in this study were the MUI DSN fatwa and the MPS-BNM fatwa on the mudharbah agreement. Then analyzed with a comparison of the jurisprudence of the four schools of thought, books, and other articles using qualitative methods with a normative juridical approach. From the results of the analysis, it can be concluded that both the DSN-MUI and MPS-BNM fatwas use a lot of shafi'i schools of reference. Then, seen from the fatwa of the mudharbah agreement, the MUI DSN fatwa is more strict and moderate, while the MPS BNM is more flexible but moderate.

Abstract

This study discusses the impact of social media on the revelation of bullying cases at Binus Serpong High School. Social media has become a significant platform for spreading information and revealing incidents of bullying among teenagers. This study employs a normative juridical method to analyze how social media can accelerate the process of uncovering and handling bullying cases, as well as its impact on the community and the school administration. The results of the research show that social media is effective in raising awareness and facilitating quick responses to bullying cases. Additionally, social media also provides emotional support for victims through anti-bullying campaigns and online communities. However, there are risks of information misuse and the potential occurrence of cyberbullying. Schools are expected to take transparent and fair actions in following up on bullying cases by coordinating with the police and the Indonesian Child Protection Commission (KPAI). This study recommends increasing education about bullying, providing psychological support, and implementing strict anti-bullying policies within the school environment.
