Abstract

Artikel ini membahas peran pemuda sebagai agen perubahan dalam upaya pemberantasan korupsi di Indonesia. Korupsi menjadi ancaman serius yang menghambat pembangunan nasional di berbagai sektor. Metode penelitian yang digunakan adalah pendekatan yuridis normatif, dengan analisis terhadap peraturan hukum dan literatur yang relevan. Pembahasan mencakup peran strategis pemuda dalam pendidikan antikorupsi, sosialisasi nilai-nilai kejujuran, serta pemanfaatan teknologi digital untuk meningkatkan partisipasi masyarakat. Selain itu, pendekatan seni dan budaya juga dibahas sebagai alat untuk menginspirasi masyarakat dalam melawan korupsi. Kesimpulan menunjukkan bahwa kolaborasi antara pemuda, pemerintah, dan masyarakat sangat penting untuk menciptakan lingkungan yang transparan dan akuntabel, serta mewujudkan Indonesia yang bebas dari korupsi.

Abstract

Penelitian ini bertujuan untuk menganalisis kepemilikan tanah absentee dan pola penggarapannya di Kabupaten Indragiri Hilir. Berdasarkan PP Nomor 224 Tahun 1961 tentang Pelaksanaan Pembagian Tanah dan Pemberian Ganti Kerugian, Pasal 13 ayat (1), serta PP Nomor 41 Tahun 1964, terdapat larangan terhadap kepemilikan tanah secara absentee. Tanah absentee merujuk pada tanah yang lokasinya jauh dari tempat tinggal pemiliknya. Umumnya, individu yang tinggal di kawasan perkotaan memiliki tanah di wilayah pedesaan yang kemudian dikelola oleh petani penyewa melalui sistem bagi hasil. Namun, praktik kepemilikan tanah secara absentee masih banyak ditemukan, sehingga implementasi larangan ini belum dapat dilaksanakan secara efektif. Kondisi ini mencerminkan bahwa peraturan mengenai tanah absentee belum sepenuhnya diterapkan sesuai dengan ketentuan hukum yang berlaku. Penelitian ini menggunakan pendekatan studi kepustakaan dengan mengacu pada berbagai sumber, seperti buku, jurnal, dan dokumen lainnya yang relevan. Fokus penelitian ini adalah untuk mengidentifikasi permasalahan terkait kepemilikan tanah absentee serta pola penggarapannya di Kabupaten Indragiri Hilir. Hasil kajian ini diharapkan dapat memberikan pemahaman lebih mendalam mengenai dinamika pengelolaan tanah absentee dan efektivitas regulasi yang ada dalam mengatasi permasalahan tersebut.

Abstract

In an effort to improve the well-being of agricultural workers, Land reform aims to restore a sense of fair control, ownership and use of land. However, as a matter of fact, this objective was not understood on the grounds that the land object had been moved to one more party before it was effectively circulated. Accordingly, settlement endeavors are expected to stay away from the issue of adding land protests rashly. The Essential Agrarian Regulation (UUPA) is the principal land change program in Indonesia. Land change is characterized as an adjustment of the design of command over land possession, in a simply political sense as well as from a specialized perspective. The objective of the LoGA is to roll out crucial improvements to existing agrarian relations with the goal that they become all the more and satisfy the interests of the worker individuals. The reason for land change being done in Indonesia is to build the pay and way of life of the cultivators of the land, as a premise or essential for completing monetary improvement towards a fair and prosperous society in view of Pancasila. To accomplish this objective, it is completed by holding a fair dissemination of the vocations of the laborer individuals as land and a fair circulation of results, executing the rule of land for ranchers, finishing the property manager agricultural workers, and safeguarding against a powerless economy.

Abstract

Penelitian ini menganalisis efektivitas penegakan hukum terhadap tindak pidana siber di Indonesia dalam era transformasi digital. Metode penelitian melibatkan studi literatur dan analisis deskriptif terhadap regulasi yang ada serta praktik penegakan hukum. Temuan utama menunjukkan tantangan dalam penegakan hukum siber, seperti kurangnya harmonisasi regulasi dan keterbatasan kapabilitas teknis aparat penegak hukum. Meskipun pendirian Badan Siber dan Sandi Negara (BSSN) merupakan langkah konkret, penelitian ini menyoroti perlunya peningkatan kapasitas dan regulasi yang lebih adaptif untuk mengatasi dinamika kejahatan siber yang terus berkembang. Kesimpulannya, kolaborasi antara pemerintah, sektor swasta, dan masyarakat, serta pendidikan dan pelatihan keamanan siber yang intensif, sangat penting untuk meningkatkan kesadaran dan keterampilan dalam menghadapi ancaman siber.

Abstract

Fungsi utama suatu perjanjian adalah memberikan perlindungan, keadilan, dan kepastian hukum kepada para pihak serta menjadi landasan penyelesaian sengketa di kemudian hari. Apabila salah satu pihak lalai melaksanakan syarat-syarat perjanjian, maka para pihak dapat melanjutkan transmisi berdasarkan perjanjian tertulis. Penelitian ini menggunakan pendekatan normatif, yang menitikberatkan pada asas-asas hukum serta mengkaji dan menyelidiki peraturan-peraturan tertulis. Berdasarkan temuan penelitian dapat disimpulkan bahwa perjanjian tertulis mempunyai kewenangan hukum untuk menyatakan seseorang melakukan wanprestasi. Sekalipun perjanjian tertulis itu memuat keterangan palsu atau tidak didukung oleh pihak yang dituduh wanprestasi, namun tetap mempunyai kemampuan untuk menyatakan seseorang wanprestasi dengan kepastian hukum. Namun, Anda dapat mengajukan tindakan hukum ke pengadilan. pemenuhan hak dan kewajiban sesuai dengan kesepakatan para pihak dalam perjanjian atau kontrak, yang berfungsi sebagai bentuk perlindungan hukum terhadap hak-hak para pihak dan mempunyai kekuatan hukum mengikat yang harus diikuti.

Abstract

Islamic law as a source of national law is a collection of rules based on norms or rules of fiqhiyah. Fiqh as a form of Islamic law is required to always be current to become a religious solution for society. Over a long period of time, fiqh as a product of the thoughts of scholars can be found in various fiqh books with various styles of schools of thought and various methods and patterns in their explanations. This research aims to examine the relationship and differences between fiqiyah rules (principles of Islamic law) and nazhriyah fiqhiyyah (theories of Islamic law). Fiqiyah rules are general rules derived from the syar'i texts (Al-Qur'an and Hadith) and are used to explain the laws of fiqh on various issues. Meanwhile, nazhriyah fiqhiyyah are concepts or theories developed by scholars to understand, classify and formulate fiqh laws systematically. The method used in writing this article is the literature review method by examining and referring directly to primary and secondary references in studying the relationship and differences between Fiqiyah and Nazhriyah Fiqhiyyah rules.

Abstract

This study analyzes the efforts to resolve defaulting bank customers based on DSN MUI Fatwa No. 4/DSN-MUI/IV/2000. In the Islamic banking system, customers who default require approaches aligned with Sharia principles, such as negotiation, mediation, and arbitration. This study employs a qualitative method with a literature study approach to understand the provisions and implementation of the fatwa related to default resolution. The findings indicate that resolving defaulting customers in murabahah contracts involves restructuring, mediation, and Sharia arbitration in accordance with DSN MUI Fatwa provisions. Additionally, banks are obliged to provide guidance to customers in fulfilling their obligations while prioritizing justice and transparency. This study recommends optimizing the role of Islamic financial institutions in handling default cases more effectively and in compliance with Sharia principles.

Abstract

Penelitian ini mengkaji kerangka hukum dan mekanisme akad Murabahah dalam perbankan syariah, dengan menekankan kepatuhan terhadap prinsip-prinsip syariah. Penelitian ini menyoroti pentingnya transparansi harga, kepatuhan pada hukum Islam, serta potensi tantangan akibat ketidaksesuaian regulasi. Dengan pendekatan yuridis normatif, studi ini meninjau regulasi utama seperti Fatwa DSN-MUI Nomor 04/DSN-MUI/IV/2000 dan PBI Nomor 07/46/PBI/2005, serta analisis konseptual dan perbandingan praktik Murabahah di bank syariah Indonesia. Hasil penelitian memberikan wawasan tentang peningkatan efektivitas akad Murabahah, memastikan kepatuhan syariah, dan mendorong pembangunan ekonomi yang berkelanjutan sesuai dengan kerangka syariah.

Abstract

This article discusses the dilemma of customary land and the dual legal system is a complex issue that often occurs in countries with strong indigenous communities, such as Indonesia and some regions in Africa. Customary land is land owned by the collective of indigenous peoples that is managed based on customary law norms, while the dual legal system refers to the existence of two legal systems that run in parallel, namely customary law and national or positive law. The existence of these two legal systems often triggers conflict and confusion, especially in the management and settlement of disputes over customary land. In Indonesia, although customary law has a place in the national legal framework, its implementation is often hampered by weak formal recognition and overlapping agrarian regulations. As a result, many conflicts over customary lands have not been resolved fairly and completely for indigenous communities. Meanwhile, the national legal system emphasizes more on legal certainty and the protection of individual rights, but tends to override the collective values and deliberative approach that are at the core of the customary law system. The formal litigation process is often considered ineffective for indigenous peoples because of its rigid, time-consuming, and inconsistent characteristics of customary-based dispute resolution that is more flexible and restorative. The lack of synergy between customary law and national law has also muddy the situation. Many judgments produced by customary institutions are not legally recognized by state courts, and instead, court decisions often do not have the legitimacy of indigenous peoples. This inconsistency increases legal uncertainty and magnifies the potential for conflict, especially when customary lands are targeted by investment interests or national development projects. Another problem that is no less important is in the process of registration and legalization of customary land. Although there are regulations that open up opportunities to officially register customary lands, the reality on the ground shows many obstacles, both conceptually and administratively. Many customary areas do not have formal ownership documents, making them vulnerable to seizure or transfer without legal consent. As a solution, a number of studies suggest the need to develop a hybrid legal model that is able to incorporate customary law values and principles into the national legal structure. This integrative approach is expected to provide fairer protection for the rights of indigenous peoples, while creating important legal certainty in the context of national development and investment. Land registration on customary land illustrates the latent conflict between the state version of legal certainty and the indigenous version of cultural justice. The disharmony between state law and customary law has caused legal protection of customary rights to be ineffective. Therefore, it is necessary to reformulate policies that recognize the existence of customary law substantially and provide an inclusive, participatory, and sensitive land registration mechanism for local values.

Abstract

Salah satu program yang dicanangkan pemerintah adalah Bantuan Operasional Sekolah (BOS), yang bertujuan untuk meningkatkan kualitas pendidikan, termasuk pemerataan sarana dan prasarana. Hal ini sesuai dengan amanat Pancasila, "Keadilan Sosial Bagi Seluruh Rakyat Indonesia", yang merupakan Sila Kelima Landasan Ideologi Nasional. Semua program anggaran sangat rentan terhadap korupsi, jadi perlu ada pengawasan yang ketat untuk memastikan bahwa program tersebut dilaksanakan dengan benar. Menurut Undang-Undang Nomor 15 Tahun 2006 tentang BPK, pemeriksaan keuangan terhadap laporan keuangan dilakukan dengan tujuan memberikan keyakinan yang memadai atau keyakinan yang wajar bahwa penyajian laporan telah dibuat secara wajar terkait semua hal material dalam substansinya, sesuai dengan prinsip-prinsip umum keakuntansian, seperti Laporan Keuangan Pemerintah Pusat. Tiga prinsip evaluasi harus dipatuhi: prinsip kontinuitas (kontinuitas), prinsip menyeluruh (komprehensif), dan prinsip objektivitas. Situasi sebagaimana diungkapkan diatas membuat pentingnya dilakukan analisis lebih lanjut mengenai Bagaimana pengaturan mekanisme pertanggunga jawaban Dana BOS berdasarkan prinsip akuntabilitas? Dan Bagaimana mekanisme pengawasan oleh BPK sebagai pihak yang berwenang untuk setiap program pemerintah terkait anggaran?
