Abstract

Indonesia is a country that has a variety of natural preservation, especially its forests, where forests in Indonesia also have a variety of species of both flora and fauna, it is necessary to preserve nature and not damage the sustainability of the forest such as cases of illegal logging. In writing this journal, the author uses library research methods sourced from books, previous journals and newspapers. The formulation of the problem is (1) what is meant by illegal logging, (2) the causes of the difficulty of eradicating the perpetrators of illegal logging in Riau forests, (3) the punishment that can be received for the perpetrators of illegal logging and (4) the efforts of the government and local communities in overcoming the problem of illegal logging. And the conclusions of this paper are (1) illegal logging or illegal logging is an activity or action that involves the exploitation of natural resources in the form of forests without the appropriate government permits, or compliance with environmental regulations where this can cause serious ecological and social impacts, (2) The causes of the difficulty of eradicating illegal logging perpetrators are illegal logging is no longer independent but has been organized so that it has been controlled, the ineffectiveness of laws governing illegal logging, weak coordination between law enforcement officials, sentencing illegal logging perpetrators is often disproportionate or too light so as not to cause a deterrent effect. (3) Criminal law rules for perpetrators of illegal logging have been regulated in article 19 letters A and B jo article 94 paragraph 1 letter a and article 12 letter E jo article 83 paragraph 1 letter B, Law No. 18 of 2013 concerning the prevention and eradication of forest destruction with a maximum prison sentence of 15 years and a maximum fine of Rp. 100 billion. (4) Government efforts in overcoming illegal logging are revitalizing institutions in managing forests, structuring community access to land and forest resources, strengthening the capacity of communities capable of carrying out effective natural resource management and so on. In addition, the community's efforts in helping the government to overcome the problem of illegal logging are that the community must have self-awareness to care and participate in forest management and conservation, provide information if they know of any illegal logging incidents around the forest where they live, carry out reforestation, help monitor the forest, and report if they see illegal logging.

Abstract

Women's powerlessness does not only come from other people but also from themselves, where many women feel unworthy and unable to try new things. In writing this scientific work, the author uses a library research method in which the source of literature comes from books, archival documents, newspapers and journals that have been published first. The formulation of the problem is (1) What is meant by the PKK movement and its scope, (2) PKK's efforts in empowering women, especially villages in Indonesia, (3) Challenges in empowering women in Indonesia, (4) The role of village governments in empowering women. And the conclusions are (1) PKK is a movement that aims to empower women. PKK is a community development movement that originated from a household economy seminar held in Bogor in 1975 by producing 10 formulations in terms of family life, (2) PKK's efforts in empowering women, especially in villages, are by conducting (a) job skills training, (b) conducting training on financial services and microcredit, (c) providing work information focused on women's needs, (d) optimizing technology and communication information in the women's business chain, (e) collaborating with the private sector to provide work assistance and employment for women, (3) the challenges faced in empowering women are (a) lack of willingness from the women themselves, (b) lack of understanding from the women themselves (c) many women are still not literate in education and think women only sit at home taking care of family and children, (d) there is still a gender gap in the territory of Indonesia, (e) limited access to education and training, (f) lack of interest from women in developing opportunities in business from the government. (4) The role of the village government in empowering women is (a) increasing the number of women in terms of economic or employment activities, (b) increasing the number of women in making decisions in government, (c) targeting 30% representation of women in legislative elections, (d) increasing literacy rates through various programs including illiteracy or literacy education programs, (e) improving the quality of health services for mothers and children and providing education and. Socialization to pregnant women and prospective parents to use qualified birth attendants.

Abstract

Humans created by Allah SWT on this earth are basically social creatures and every human being lives side by side with one another. In writing this scientific paper, the author uses library research methods and also uses normative juridical research methods that examine various theories, concepts and legal principles and laws related to this research, where the legal material is Law Number 1 of 1974 concerning marriage. The problems in this paper are (1) What is meant by marriage, (2) What is meant by a prenuptial agreement, (3) The legal provisions of a prenuptial agreement in the view of civil law, (4) whether a prenuptial agreement can be canceled and how to cancel a prenuptial agreement according to civil law, and the conclusions are (1) marriage is one of the phases in human life that can be lived by a Muslim after determining a life partner and being mentally and financially ready and if he is capable and mature and emotionally ready then marriage can be done in order to perfect half of his religion, (2) a prenuptial agreement is an agreement made before or during marriage, and the contents of this prenuptial agreement are to discuss (a) the rights and obligations of husband and wife while being husband and wife, (b) an agreement made without coercion from any party, (c) the contents of this agreement in the form of property and debt, (d) discussing children and offspring if the husband and wife divorce. (3) according to the view of civil law, this prenuptial agreement must fulfill the conditions stated in article 139 of the Civil Code, and in the view of civil law itself an agreement can be made and may be made if it meets the conditions, does not violate decency and the law and uses a notarial deed, (4) according to civil law this prenuptial agreement can be canceled if both spouses agree to change and the change does not harm the third party, namely the notary, and the cancellation of the prenuptial agreement can be done if there is a violation of the agreement and how to cancel this prenuptial agreement can be done through the court, the plaintiff can report the defendant to the religious court if a Muslim and to the district court if non-Muslim

Abstract

Domestic violence is also known as domestic violence, which is gender-based and personal. In this research, the author uses library research methods sourced from previous books and journals. The main issues in this study are (1) What is meant by domestic violence, (2) Criminal sanctions for perpetrators of domestic violence, (3) the role of the government in preventing cases of domestic violence and (4) the negative impact on victims of domestic violence. This study concludes that domestic violence is an act committed against someone, especially women, which causes suffering and misery physically, sexually, psychologically and domestic neglect. The criminal provisions in articles 44 to 53 where sufficient sanctions include physical violence that is classified as severe, which causes someone to fall ill or seriously injured, it will be imprisoned for a maximum of ten years and if it causes the victim to die, it will be subject to a maximum imprisonment of fifteen years and also includes physical, psychological and sexual violence that causes the victim to not recover, lose memory and abort or die in the womb, it will be subject to criminal sanctions in the form of twenty years imprisonment. While the role of the government in domestic violence prevention efforts is to formulate, policy, communication, information, education and socialization and advocacy to the community, and the impact of victims of domestic violence is in the form of physical and mental where the physical impact is in the form of headaches, nausea, memory loss, loss of consciousness, bruises and mental impact is in the form of shame, depression, stress, helplessness and confusion, decreased self-confidence and self-esteem, suicide attempts and anxiety disorders.

Abstract

This research discusses the criminal sanctions against perpetrators of criminal acts of general elections in Indonesia. The main issues in this study include what is meant by elections and election violations, what are the criminal sanctions for perpetrators of violations in general elections in Indonesia, what are examples of cases of election crimes that have occurred in Indonesia, and what are the efforts made by related parties in handling cases of election violations in Indonesia. This study concludes that what is meant by general election is a democratization process used in many countries around the world to elect government leaders and represent Indonesian citizens in a government institution. Election violations are actions that are contrary to or not in accordance with laws and regulations related to general elections, as for the sanctions for perpetrators of election violations, if the perpetrator commits a violation in the form of providing false information in the campaign finance report, he will be subject to sanctions in the form of a maximum imprisonment of 1 year and a maximum fine of Rp. 12 million, if the perpetrator provides false information in the campaign report or unclear information, he will be subject to sanctions in the form of imprisonment for a maximum of 2 years and a maximum fine of Rp. 24 million and if the perpetrator provides incorrect information in filling in the voter's personal data, he will be subject to sanctions in the form of imprisonment for a maximum of 1 year and a maximum fine of Rp. 12 million, an example of a case of criminal election violations that have occurred in Indonesia is the case of money politics violations that occurred in the 2019 elections where the suspect named David H. Rahardja, who is a candidate for the DKI Jakarta DPRD from the Perindo party, was sentenced to six months in prison and a fine of Rp. 5 million, because he was caught giving cooking oil to citizens during a campaign. The efforts made by related parties regarding cases of general election violations in Indonesia are by conducting supervision in the frame of prevention, conducting socialization and also understanding to the public of potential violations that must be anticipated, mapping and identifying general election violations before conducting election supervision and coordinating, supervising, guiding and monitoring and evaluating the implementation of elections.

Abstract

Persatuan dua individu yang sebelumnya terpisah menjadi satu kesatuan yang dikenal sebagai perkawinan. Menurut QS An Nisaa: 34 , laki-laki bertanggung jawab untuk menafkahi keluarga. Setiap perkawinan melibatkan harta yang dibawa dan diperoleh oleh suami dan istri sebelum perkawinan. Selalu ada pembahasan menarik sesekali tentang harta dalam kaitannya dengan perkawinan. Gagasan tentang harta bersama, kadang-kadang dikenal sebagai harta yang dibawa atau hanya harta bersama, adalah fenomena yang tampaknya tak ada habisnya. Hukum Islam menawarkan prinsip umum yang dapat diterapkan pada gagasan tentang harta dalam perkawinan. Berdasarkan kajian pustaka dan telaah pustaka yang membahas tentang konsep harta bersama dalam perkawinan, kajian ini bersifat normatif. Sebaliknya, harta gono gini atau yang dikenal juga dengan harta bersama dalam perkawinan adalah harga bersama yang dibuat oleh suami istri yang bekerja sama, atau syirkah. Meskipun demikian, Islam tetap dapat menyikapi hukum harta bersama atau gono gini dengan melihat situasi saat ini. Harta bersama tetap diperbolehkan dalam Islam. Agar lebih mudah membagi harta bersama jika terjadi perceraian, Islam bahkan memperbolehkan ta'lik sebelum perkawinan. Kekayaan sebaiknya dimanfaatkan secara optimal sambil tetap mematuhi prinsip-prinsip dalam Islam. Dalam pernikahan, harta digunakan untuk memenuhi kebutuhan keluarga demi kebaikan semua anggotanya. Jika terdapat kelebihan harta, sebaiknya diberikan sebagai hibah atau disedekahkan kepada orang lain yang membutuhkan.

Abstract

Tujuan penetapan hukum, yang dikenal sebagai maqashid al-syari'ah, adalah salah satu konsep mendasar dalam studi hukum Islam. Karena urgensinya, para pakar teori hukum menetapkan bahwa maqashid al-syari'ah wajib dipahami oleh seorang mujtahid dalam proses ijtihad. Dalam upaya menemukan hikmah dan tujuan di balik penetapan hukum, para ulama sebelum al-Syatibi telah mengembangkan setidaknya tiga metode yang digunakan. Manusia sebagai makhluk sosial diciptakan oleh Allah SWT dengan kesempurnaan, diberi akal untuk berpikir dan bertindak demi kebaikan, bukan kemudaratan. Dalam konteks hak asasi manusia, manusia menjadi perhatian utama bagi berbagai kalangan. Beragam upaya dan teori dirumuskan untuk menjaga kesejahteraan serta menciptakan kedamaian antar sesama manusia dan antar umat beragama, agar hak-hak setiap individu tetap terjaga dan tidak dilanggar.

Abstract

The main aim of this research is to dig deeper into Maqasid Syariah as a Philosophy of Islamic Law from the Thought of Jasser Auda. The method used in this research uses the library study method, using various sources of reading material such as books, journals, scientific works and so on. Jasser Auda's thinking attempts to approach Islamic law in various dimensions, which is then called a multi-disciplinary approach. This multi-disciplinary approach includes established methodological aspects formulated by past scholars, such as ushul fiqh, tafsir science, etc. Apart from that, the field approach of philosophy and systems theory is the most significant approach in determining the dynamics of Islamic law. This multidisciplinary approach became known as the maqashid approach formulated by Jasser Auda, namely an approach to fiqh theory that is holistic (kulliyun) and does not limit itself to texts or partial laws. Jassser Auda offers methods in a systems approach as an effort to form a new framework of thinking in understanding Islamic law in the current era. Religious approaches and interpretations are expected to produce legal products that are in accordance with the purposes stated in Islamic law.

Abstract

The main objective of this study is to explain about heirs and their distribution based on the Law. The method used in this study uses the normative juridical method, namely referring to the provisions of positive legal regulations in Indonesia, especially laws and regulations on inheritance law. Talking about inheritance, it is inseparable from the death of a person. Inheritance law is the law that regulates the transfer of assets left by a deceased person and the consequences for the heirs or their heirs. Inheritance according to Islamic Law regulates the principles of inheritance, conditions and pillars of inheritance, heirs, and regulations regarding the amount of inheritance received by the heirs. Sourced from the Qur'an, hadith, ijma' and ijtihad, inheritance according to Islamic Law then developed in the lives of Indonesian society until the enactment of the Compilation of Islamic Law (KHI) as an application of Islamic law in Indonesia, including regarding inheritance. In Islamic teachings, the issue of inheritance plays a very important role. In some Muslim communities, conflicts often arise between fellow heirs regarding the distribution of inheritance. Therefore, it is very important for Muslim communities to know the issue of inheritance in Islam.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi kontribusi mazhab-mazhab filsafat hukum terhadap pengembangan teori dan praktik hukum. Fokus utama penelitian ini adalah empat mazhab utama dalam filsafat hukum, yaitu positivisme hukum, naturalisme hukum, historisme hukum, dan realisme hukum. Penelitian ini menemukan bahwa setiap mazhab memberikan kontribusi yang signifikan dalam pembentukan sistem hukum dan dalam memberikan solusi terhadap tantangan hukum kontemporer. Positivisme hukum, yang mengedepankan prinsip legalitas, memainkan peran penting dalam menciptakan sistem hukum yang terorganisir dan memberikan kepastian hukum, meskipun sering dikritik karena mengabaikan isu keadilan sosial dan moralitas. Naturalisme hukum, yang menghubungkan hukum dengan prinsip moral universal, telah memberikan kontribusi penting dalam pengembangan norma internasional, seperti hak asasi manusia dan hukum lingkungan, meskipun tantangan penerapannya di masyarakat pluralistik masih menjadi hambatan. Historisme hukum, dengan pendekatannya yang mengutamakan perkembangan hukum berdasarkan konteks sosial dan budaya, memberikan perspektif yang penting dalam memahami hukum adat dan hukum lokal, tetapi kurang responsif terhadap perkembangan hukum yang cepat, seperti di bidang teknologi. Sementara itu, realisme hukum, yang bersifat pragmatis, relevan dalam menghadapi tantangan globalisasi dan masalah hukum yang kompleks, namun dikritik karena sering mengabaikan dimensi normatif hukum. Penelitian ini menyarankan perlunya pendekatan integratif antara mazhab-mazhab ini untuk menciptakan sistem hukum yang lebih adaptif dan responsif terhadap kebutuhan zaman.
