Abstract

Fenomena jual beli akun Netflix dengan sistem sharing semakin marak seiring meningkatnya kebutuhan masyarakat terhadap layanan hiburan digital yang terjangkau. Praktik ini umumnya dilakukan oleh pihak ketiga yang tidak memiliki hubungan kontraktual dengan Netflix dan menawarkan akses dengan harga murah melalui media sosial maupun marketplace. Kondisi tersebut menimbulkan persoalan yuridis karena pembagian akun di luar satu rumah tangga bertentangan dengan ketentuan lisensi Netflix, serta berpotensi melanggar hukum perdata, ketentuan hak cipta, dan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini bertujuan menganalisis legalitas jual beli akun Netflix sharing menurut hukum positif Indonesia, kedudukan para pihak dalam perspektif perlindungan konsumen, serta kesesuaian praktik tersebut dengan prinsip-prinsip fikih muamalah. Metode yang digunakan adalah penelitian yuridis normatif melalui pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa transaksi akun sharing melanggar syarat objektif perjanjian, berpotensi merupakan pelanggaran hak cipta, serta mengabaikan hak konsumen atas informasi dan jaminan layanan. Dalam perspektif hukum Islam, transaksi ini mengandung unsur gharar, tadlis, serta pelanggaran haq al-intifā’, sehingga tergolong akad tidak sah. Dengan demikian, baik hukum Islam maupun hukum positif memandang praktik tersebut tidak layak dipertahankan secara hukum.

Abstract

Rural economic development is an important aspect of improving the welfare of rural communities. However, in many regions, including West Nusa Tenggara Province (NTB), rural economic growth still faces various limitations. Ranggagata Village in Central Lombok Regency is an agricultural village where the majority of the population depends on seasonal rice farming for their livelihood. This condition causes unstable community income and encourages the emergence of various alternative economic strategies. This study aims to analyze the economic conditions of the Ranggagata Village community and the role of the village government in community economic empowerment efforts. The research method used is a qualitative approach with data collection techniques through field observations, interviews with village officials, BUMDes managers, and the community, as well as a documentation study of the APBDes and village planning documents. Data analysis was conducted using the Miles and Huberman model through the stages of data reduction, data presentation, and conclusion drawing, accompanied by data triangulation to maintain the validity of the findings. The results of the study show that the village economy is still dependent on a single agricultural sector, while BUMDes is not yet functioning optimally. The allocation of the economic empowerment budget in the APBDes is relatively low and is not fully in line with applicable regulations. This condition has given rise to the phenomenon of kioskization as a survival strategy for the community, but has not been able to improve welfare in a sustainable manner. This study recommends strengthening village economic institutions, increasing the allocation of empowerment budgets, and developing data-based local economic potential so that village economic development is more effective and sustainable

Abstract

Illicit narcotics trafficking in Indonesia has evolved into an organized, transnational crime that threatens the social order and violates the provisions of Law Number 35 of 2009 concerning Narcotics. Ironically, this illegal activity is not only prevalent in the community but has also transformed into a complex socio-legal phenomenon within correctional institutions (prisons). This situation raises issues regarding the effectiveness of investigative processes in uncovering and combating narcotics trafficking networks controlled from inside the prison. Therefore, this study aims to analyze the implementation of the investigative process and identify the factors enabling inmates to continue controlling narcotics trafficking. An empirical research method with a field-based approach was employed at the Class II A Correctional Institution in Palu City, integrating primary data sources obtained through observation and interviews with secondary data derived from the study of legislative documents. The research findings indicate that while the investigative process is implemented in accordance with statutory regulations, it faces various practical obstacles, such as the misuse of communication devices and the involvement of certain individuals. These factors hinder efforts to effectively combat inmate-controlled narcotics trafficking networks. Consequently, there is a need for enhanced supervision, strengthened coordination among law enforcement agencies, and stricter law enforcement to dismantle narcotics trafficking networks operating from within correctional institutions.

Abstract

The rise in migration among Indonesian migrant workers (PMI) has sparked complex issues regarding the care of “left-behind children,” while conventional family law regulations have not yet been able to address the challenges of transnational child care. Therefore, a reconstruction of child care law is necessary to ensure protection that is oriented toward the best interests of the child. This normative legal study employs a legislative approach and a descriptive-qualitative analysis of the literature. The research reveals an evolution in child custody law from a parent-centered approach toward a child-centered one, although a gap still exists between regulations governing migrant labor and child protection. The results of this study indicate that legal reform can be achieved through laws that adopt several concepts or principles, such as 1) shared parenting, which involves joint child-rearing utilizing digital technology so that parenting is not constrained by time or space; 2) the application of the principles of Maqashid al-Syari’ah and Mubâdalah, so that child-rearing is fundamentally the responsibility not only of the mother but also of the father, particularly when the mother is a migrant worker; 3) strengthening Village Regulations as the closest regulatory framework for the protection and care of migrant workers’ children, 4) community-based care is effective because it stems from solidarity, commitment, and awareness, and 5) affirming the state’s responsibility, as protecting every citizen is a constitutional mandate, and the involvement of corporate social responsibility (CSR) is crucial because remittance benefits also flow to several related private sectors.

Abstract

This study aims to examine the application of the Criminal Procedure Code (KUHAP) regarding the use of coercive measures against the suspect in the Buntu Burake Drinking Water Supply System (SPAM) corruption case by the Tana Toraja District Attorney's Office, and to analyze the legal basis for these measures. This is an empirical legal study employing a socio-legal (juridical-empirical) approach, conducted at the Tana Toraja District Attorney's Office. Data were collected through interviews, observation, documentation, and literature review, and subsequently analyzed qualitatively. The results indicate that the application of the KUHAP regarding coercive measures against the suspect in the Buntu Burake SPAM corruption case was carried out through investigative stages involving the collection of project documents, witness examinations, the gathering of evidence, the formal naming of the suspect, and the seizure of documents and evidence related to the case. The naming of the suspect was based on at least two pieces of valid evidence, in accordance with Article 184 of the KUHAP and Constitutional Court Decision Number 21/PUU-XII/2014. The legal basis for implementing these coercive measures refers to Article 1 point 2, Article 1 point 14, Article 38, and Article 184 of the KUHAP, as well as Article 30 paragraph (1) letter d of Law Number 11 of 2021 concerning the Prosecution Service of the Republic of Indonesia. Thus, the application of the KUHAP regarding coercive measures against the suspect in the Buntu Burake SPAM corruption case by the Tana Toraja District Attorney's Office has been carried out in accordance with applicable criminal procedural law provisions.

Abstract

The high cost of politics in Indonesia's general elections is a critical structural issue threatening the quality of democracy and the integrity of political representation. This study analyzes the causal link between the open-list proportional representation system stipulated in Article 168 (2) of Law No. 7 of 2017 on General Elections and the escalating financial burden on candidates, while proposing a Mixed-Member Proportional (MMP) system as a constitutional law reform alternative (ius constituendum). Employing a qualitative normative legal research method combined with a comparative legal approach, this article examines legal norms, campaign finance mechanisms, and the institutional experiences of Germany and Japan. The findings demonstrate that the open-list system fuels intense intra-party competition and capital-centric candidate campaigns, leading to hyper-inflated election expenditures and endemic vote-buying practices. Conversely, while closed-list proportional representation minimizes candidate spending, it risks entrenching intra-party oligarchy and alienating voters from their representatives. Consequently, the MMP system is presented as a contextual solution that harmonizes political party institutionalization with popular sovereignty, effectively curbing candidate campaign costs through a balanced allocation of single-member district seats and proportional party-list seats.

Abstract

The nomination stage of the 2024 Simultaneous General Elections and Regional Head Elections in Indonesia faced considerable challenges, including regulatory changes, technical issues with the Candidate Nomination Information System (Sistem Informasi Pencalonan/Silon), and the need for responsive and adaptive public services. This study aims to analyze the effectiveness of helpdesk services in supporting the nomination process for Regional Representative Council (DPD) members, Provincial Regional House of Representatives (DPRD) members, and Governor and Deputy Governor candidates in West Nusa Tenggara Province, while identifying strategies to improve service effectiveness. A qualitative approach was employed through a combination of literature review and empirical research using participant observation, supported by the analysis of regulations, official correspondence, minutes of meetings, and technical guidelines. The findings indicate that the helpdesk service effectively provided information, consultation, technical assistance, coordination, and problem-solving, enabling all nomination stages to be completed on schedule despite technical disruptions in Silon, regulatory changes, limited access to Silon accounts, and varying levels of political party operators' technical competence. This achievement was supported by institutional synergy between KPU commissioners as policy makers and the KPU Secretariat as the public service implementing body. The study concludes that helpdesk services constitute a crucial governance instrument by bridging policy implementation, digital technology, and service users, thereby supporting effective, adaptive, and good governance-oriented election administration.

Abstract

Inventory constitutes a movable asset with significant economic value in commercial activities. However, its dynamic nature gives rise to legal uncertainty regarding its status as an object of proprietary rights. Although Indonesian positive law recognizes inventory as an object of proprietary rights, its legal status remains contentious in both legal practice and property law doctrine because continuous changes in the quantity, type, and existence of inventory may conflict with the principles of specificity (speciality principle) and droit de suite. This study aims to analyze the legal certainty of inventory as an object of proprietary rights from the perspective of Indonesian civil law. The research employs a normative legal research method using statutory and conceptual approaches. The findings demonstrate that, from a juridical perspective, inventory qualifies as movable property that may serve as an object of proprietary rights, including fiduciary security under the Indonesian Civil Code and Law Number 42 of 1999 on Fiduciary Security. This study proposes a legal framework based on the identification of inventory according to its type, economic value, recording system, and underlying legal relationship to strengthen legal certainty and legal protection without impeding commercial transactions.

Abstract

The enforcement of the Indonesian National Police (Polri) Code of Ethics plays a crucial role in maintaining the professionalism and integrity of the police institution, particularly in addressing violations committed by police officers. This study aims to analyze the mechanisms for handling and enforcing the Code of Ethics against police officers involved in assault cases at the Professional and Security Division (Bidpropam) of the Maluku Regional Police. This research employed an empirical legal approach using statutory and sociological perspectives. The study involved one key informant, the Head of the Internal Affairs Subdivision (Kasubbid Paminal) of Bidpropam Polda Maluku, selected through purposive sampling. Data were collected through interviews and document analysis and analyzed using a descriptive qualitative approach. The findings indicate that the enforcement process consists of report submission, preliminary investigation, and hearings before the Police Code of Ethics Commission (KKEP). Assault cases increased from 14 in 2022 to 16 in 2023 and 29 in 2024. Ethical proceedings were conducted concurrently with criminal justice processes through both internal disciplinary and general judicial mechanisms. The study concludes that, although the enforcement mechanism has been implemented procedurally, its preventive effectiveness requires strengthening through continuous supervision, guidance, and the internalization of professional ethical values.

Abstract

: Indonesia's nickel ore export ban policy, implemented as part of its downstream industrialization strategy, has led to an international trade dispute with the European Union in Indonesia—Measures Relating to Raw Materials (DS592) before the World Trade Organization (WTO). Previous studies have primarily examined the consistency of the policy with the provisions of the GATT 1994 or its implications for downstream industrialization, while limited attention has been given to the protection of state interests within the WTO legal framework. This study aims to analyze the legal protection of state interests under the WTO framework concerning Indonesia's nickel export ban policy and to examine the legal implications of the DS592 ruling for Indonesia's export policy and mineral resource management. This research employs a normative legal method using statutory, case, and conceptual approaches. The primary legal materials include the GATT 1994, the Agreement Establishing the World Trade Organization, the WTO Panel Report in DS592, and relevant Indonesian legislation, which are analyzed using a descriptive-qualitative method. The findings indicate that although the WTO recognizes policy space through the exception provisions of the GATT 1994, these exceptions are interpreted restrictively, resulting in Indonesia's nickel export ban being found inconsistent with Article XI:1 of the GATT 1994. The study finds that the protection of state interests within the WTO remains constrained by interpretations that prioritize trade liberalization over the industrialization needs of developing countries. Therefore, Indonesia's downstream industrialization policy should be formulated through legal instruments that promote value-added mineral development while remaining consistent with WTO obligations.
