Abstract

Law enforcement serves as a fundamental mechanism for establishing order, security, and peace within society. It encompasses efforts to prevent or eliminate violations of the law, addressing issues both preventively and repressively. However, challenges arise when actions taken do not align with established procedures. The appropriate course of action within a legal framework is essential, and when discussing legal protection in the context of procedural law, it is important to clarify that such protection should not be interpreted as a means to shield offenders from accountability. This study seeks to evaluate law enforcement in Indonesia through the lenses of legal certainty, justice, and societal benefit. Employing a literature review methodology, which relies on expert opinions, the findings indicate notable deficiencies in the law enforcement system in Indonesia. For an extended period, those seeking justice within society have yearned for equitable law enforcement. Nevertheless, current practices in law enforcement tend to prioritize legal certainty over the community's sense of justice. Various court decisions, for example in the case of grandmother Minah and Aal, the sandal thief, seem to illustrate that law enforcement tends towards the view that law is law and has given rise to public disappointment with law enforcement in Indonesia.

Abstract

Traditional marriage in Pulau Buaya Village is not just the union of two individuals, but also a bond between two large families that involves social, cultural, and economic aspects. The traditional marriage customs in this village have significant stages that reflect the values of collectivism and respect for ancestors. However, the majority of the community also adheres to Islam, which has its own legal rules regarding marriage. The interaction between customary law and Islamic law in marriage practices often results in adaptations or acculturation that do not always proceed smoothly. Some traditional customs sometimes conflict with the principles of Islamic law, creating challenges in balancing the preservation of traditions with adherence to religious teachings. This study uses a juridical-empirical method with a qualitative approach. Primary data is obtained through interviews and direct observation of traditional leaders, religious leaders, and couples who have undergone traditional marriages. Secondary data is gathered from literature studies on customary law and Islamic law. The findings show that the customary marriage law in Pulau Buaya Village has been adjusted to Islamic principles, but practices still exist that contradict Islamic law. The implications of this study are the need for an integrative approach in formulating marriage policies that respect cultural diversity while remaining in accordance with Islamic and national legal principles.

Abstract

Contracts and agreements are two different things. This is because a contract is basically one type of agreement. However, not all agreements reach the level of a legally binding and enforceable contract. As the problems that will be discussed in this paper are the terms of the agreement in the Indonesian civil law legal system and the terms of the contract in the English common law legal system. In Indonesia, the validity of a contract consists of four conditions, namely the agreement of those who bind themselves, the ability to make an agreement, a certain matter, and a halal or permissible cause. Meanwhile, in English there are five conditions, namely agreement (offer and acceptance, intention to create legal relations, and genuineness of consent), capacity, consideration, legal purpose, and form of contract. Based on this, the author analyzes the comparison of the validity of an agreement or contract between Indonesia and the English and its implementation. Then for the research method used is the normative legal approach method which places the law as a norm system building. The results of the research obtained are that there are significant differences in the requirements regarding the validity of an agreement or contract between Indonesian law and English law, although each of these requirements also has similarities and differences in its provisions.

Abstract

Gender equality theory, which is a branch of gender studies, offers an in-depth view of how gender inequality can occur in various aspects of life, including in the legal system. In simple terms, this theory distinguishes between formal equality and substantive equality. This research aims to analyze gender equality theory which can be used as an analytical framework for understanding injustice for female victims in the criminal law enforcement system and the impact of gender injustice in the criminal law enforcement system on female victims. This research uses a type of normative research with a conceptual approach. The data source used comes from secondary data. The data collection method is carried out through documentation studies. This research shows that gender equality theory is a very relevant analytical framework for understanding the injustices experienced by female victims in the criminal law enforcement system. Gender injustice in the criminal law enforcement system has a broad and deep impact, not only on individual female victims but also on social, cultural and institutional structures.

Abstract

AI has been widely used in various nations, especially in the economy, healthcare, and law. However, its current state is limited to weak AI, lacking full awareness and control. Some countries use AI to assist legal professionals in analyzing legal documents and in helping judges with research during court proceedings. Thus, exploring AI's role and regulation in making civil case decisions within Indonesian law is crucial. This study relies on secondary data and normative legal methods. Findings suggest weak AI is promising for crafting judgments in Indonesian civil cases due to its focus on formal truth. Implementing regulations, possibly Supreme Court Regulations (PERMA), is necessary for the possible use of AI in Indonesia's court proceedings. These rules should define, classify, and limit AI, ensuring legal reliability in its application.

Abstract

This study explores the essential role of lobbying and negotiation strategies across various sectors such as politics, social affairs, business, and non-profit organizations. Using a qualitative approach and case studies, the research highlights how these communication strategies influence decisions, build relationships, and resolve conflicts. The findings indicate that lobbying and negotiation skills are crucial for groups to achieve their goals, particularly in today’s digital era. Social media also emerges as a new platform for such practices, though it brings challenges to face-to-face interaction quality. Therefore, a deep understanding and ethical application of lobbying and negotiation are vital for creating effective and constructive communication.

Abstract

The rise of trade in protected wildlife threatens the preservation of biodiversity in Indonesia, especially in the Aceh and North Sumatra regions. This is because punishment does not provide a deterrent effect to the perpetrators and the involvement of officials in its implementation, so that law enforcement against the trade in protected wildlife has not been felt effective in the eyes of the public. In this thesis, the author wants to know the extent of the effectiveness of law enforcement carried out by Forestry Civil Servant Investigators (PPNS) against protected wildlife trade through issues related to law enforcement, obstacles in law enforcement and efforts that have been made to overcome these obstacles. This research was conducted in Section I of the Sumatra Regional Environmental and Forestry Law Enforcement Center. The research method used is a case study with a qualitative approach. Data was collected through interviews with PPNS Forestry and related parties, as well as analysis of documents related to protected wildlife trafficking cases. The results of the study show that the effectiveness of law enforcement by PPNS Forestry has been quite effective, although it is still faced with several obstacles in its implementation. Law enforcement against the trade in protected wildlife starts from preemptive, preventive, repressive and judicial actions. Light punishment, the use of undercover buy techniques, proof of evidence, involvement of officials, facilities and infrastructure, human resources and public awareness are still factors that hinder law enforcement. Therefore, efforts have been made to overcome these obstacles by revising the law, strengthening intelligence networks, adding and increasing human resources, coordinating with related agencies and socializing to the community. The author recommends that socialization be carried out to law enforcement officials regarding the equality of perception in the implementation of Law Number 32 of 2024 and establish close cooperation with the TNI and Polri intelligence networks and make strict rules against officers involved in the trade of protected wildlife.

Abstract

Intellectual Property (IP) plays a crucial role in fostering fair business competition. Trademarks as a element of IP serve as distinguishing identifiers that guarantee product quality. In addition, trademarks function as marketing tools in competitive markets and provide protection against bad faith actions by other parties. To obtain legal protection, a trademark must be registered in accordance with statutory requirements. A trademark application may be rejected if these requirements are not fulfilled. A common reason for rejection is the existence of substantial similarity to a previously registered mark or an earlier-filed application for similar goods and/or services. Therefore, clear and consistent standards for determining substantial similarity are essential to ensure legal certainty for applicants.

Abstract

Labor law in Indonesia prioritizes the protection of workers as a primary focus in industrial relations. This protection becomes highly relevant in the context of termination of employment (PHK), particularly in cases where PHK is carried out on the grounds of corporate spin offs. This study aims to analyze the company’s responsibility in fulfilling workers' rights and the legal measures that can be taken to ensure workers' welfare in accordance with Government Regulation No. 35 of 2021. The research method employs a normative juridical approach with descriptive-analytical review of primary documents, such as labor-related legislation, and secondary documents related to the PHK process. The analysis reveals that PHK conducted by a company on the basis of a spin off lacks a strong legal foundation if it contradicts the principles of legal certainty and worker protection as stipulated in applicable regulations. In the event that PHK is still carried out, the company is obligated to provide full compensation to workers, including severance pay, service appreciation pay, and rights replacement as outlined in PP 35/2021. Furthermore, workers are advised to pursue their rights through non-litigation, litigation at the Industrial Relations Court, or administrative measures in a step-by-step manner. The implication of these findings underscores the importance of enforcing labor laws to protect workers' rights during corporate restructuring.
