Abstract

Cases of murder involving minors are an important issue to be examined because they are not only related to criminal law aspects but also involve social and psychological factors of the perpetrator. This study aims to analyze the criminal act of murder in the case involving a student of SMPN 26 Bandung, which occurred in the former Kampung Gajah area, West Bandung Regency. This research uses a normative legal research method with statutory and case approaches. The data were obtained through library research sourced from legislation, journals, books, and various news reports relevant to the case under study. The results show that the perpetrator’s actions fulfill the elements of premeditated murder due to the presence of intent and planning before the act was committed. In addition, this case indicates low legal awareness and the influence of social environment factors contributing to the occurrence of the crime. Therefore, preventive efforts are needed through legal education, strengthening the roles of family and school, and strict law enforcement to prevent similar cases from occurring in the future.

Abstract

The rapid development of information technology has brought various conveniences to society, but it has also sparked new formsof crimes in the digital space, one of which is revenge porn. This act refers to the distribution of intimate photos or videos of someone without consent, aimed at embarrassing, degrading, or damaging the victim's reputation. This study aims to analyze the psychological and social impacts experienced by victims of from a victimology perspective. The research method used is normative legal research with a statutory approach and a conceptual approach. The legal materials used consist of primary legal materials in the form of legislation, secondary legal materials in the form of scientific literature, and tertiary legal materials as supporting materials. The research results show that causes serious psychological impacts on victims, such as anxiety, trauma, a sense of insecurity, and mental health disorders. In addition, victims also experience social impacts in the form of stigma, victim blaming, social isolation, as well as the risk of secondary victimization. This situation is often exacerbated by the lack of public understanding regarding electronically-based sexual violence and the potential criminalization of victims through certain legal provisions. Therefore, strengthening regulations, increasing public awareness, and providing more comprehensive protection for victims of crimes are necessary.

Abstract

This study examines the conflict of authority between customary institutions and state law enforcement agencies in resolving criminal cases, as well as the potential for human rights violations in the application of customary sanctions. This research aims to analyze such conflicts and examine the efforts for harmonization within the national legal system. This study employs a normative legal method with statutory and conceptual approaches. The results indicate that although customary law is recognized as living law under the Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 and Undang-Undang Nomor 1 Tahun 2023 tentang KUHP, there is no clear regulation governing the relationship between customary dispute resolution and the formal criminal justice system. This condition creates a dualism of legal processes, where cases resolved through customary mechanisms are still processed in formal courts, potentially resulting in double punishment. Furthermore, certain forms of customary sanctions may conflict with human rights principles when they do not meet proportionality and the protection of human dignity. This study finds that legal harmonization is necessary through the clarification of case limitations, strengthening supervision of customary sanctions, and integrating a restorative justice approach to ensure legal certainty while safeguarding human rights

Abstract

Perkembangan ekonomi digital telah mentransformasi kedudukan data pribadi dari sekadar informasi menjadi aset strategis bernilai ekonomi tinggi dalam ekosistem bisnis modern. Intensitas pemanfaatan data yang terus meningkat belum diimbangi dengan efektivitas penegakan hukum yang memadai, sehingga menciptakan celah sistemik bagi terjadinya pelanggaran dan penyalahgunaan data pribadi. Penelitian ini bertujuan menganalisis efektivitas penegakan hukum terhadap pelanggaran data pribadi dalam praktik bisnis digital di Indonesia serta mengidentifikasi faktor-faktor struktural yang mempengaruhinya. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Hasil penelitian menunjukkan bahwa meskipun Indonesia telah memiliki Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi yang mengadopsi sejumlah prinsip perlindungan data bertaraf global, implementasinya masih menghadapi hambatan serius dari tiga dimensi: keterbatasan kapasitas institusional, inkonsistensi sanksi, serta rendahnya kesadaran hukum. Dari perspektif ekonomi hukum, pelanggaran data terjadi karena kalkulasi rasional pelaku usaha menempatkan potensi keuntungan eksploitasi data lebih tinggi daripada risiko sanksi. Permasalahan utama bukan pada ketiadaan regulasi, melainkan pada defisit implementasi yang bersifat sistemik.

Abstract

The increasing prevalence of sexual violence cases in Islamic boarding schools (pesantren) over the past decade has prompted a policy response from the Ministry of Religious Affairs through Minister of Religious Affairs Regulation (PMA) Number 73 of 2022 concerning the Prevention and Handling of Sexual Violence in Educational Institutions under the Ministry of Religious Affairs. This study aims to analyze the extent to which the provisions of PMA Number 73 of 2022 contribute to the reconstruction of the Internal Control System (ICS) of pesantren as an instrument for mitigating sexual violence. The study employs a qualitative approach using document content analysis. Primary data were obtained from the text of PMA Number 73 of 2022, while secondary data consisted of academic literature, reports from government institutions, and comparative policy documents. The findings indicate that PMA Number 73 of 2022 normatively accommodates the five core components of the Internal Control System—control environment, risk assessment, control activities, information and communication, and monitoring. However, significant implementation gaps remain, particularly regarding whistleblower protection, competency standards for handling teams, and trauma-informed victim recovery mechanisms. This study contributes to the development of an institutional governance framework for protection that is contextually relevant to religious educational institutions.

Abstract

Peer to peer lending creates a digital financing relationship between lender, borrower, and platform operator. The main legal issue arises when the borrower defaults and the lender suffers financial loss, while the operator often positions itself merely as an intermediary. This article analyzes the liability of peer to peer lending operators toward lenders in the perspective of Indonesian consumer protection law. This research uses normative legal research with statutory and conceptual approaches. The result shows that lenders may be positioned as financial services consumers because they use services provided by a financial services business actor. Default caused solely by the borrower's inability to repay is essentially a funding risk borne by the lender. However, the operator may be held liable when the lender's loss is caused by the operator's fault or negligence, including inaccurate risk disclosure, weak risk mitigation, improper credit scoring, misleading information, or unfair standard clauses that eliminate the operator's responsibility.

Abstract

Tanjungpinang’s traditional Malay culinary heritage constitutes a form of traditional knowledge possessing both cultural and economic value, thereby necessitating appropriate legal protection. Due to its communally developed nature, its protection cannot rely solely on conventional Intellectual Property Rights (IPR) regimes such as copyright, trademarks, or geographical indications. This study aims to analyze the legal protection of Tanjungpinang’s traditional Malay culinary heritage from the perspective of Communal Intellectual Property (CIP) and to examine the legal rationale for why CIP serves as the most suitable form of protection for supporting the creative economy. The study employs a normative legal research method, utilizing statutory, conceptual, and comparative approaches. The findings indicate that Tanjungpinang’s traditional Malay culinary heritage meets the criteria for Traditional Knowledge classified as Communal Intellectual Property; consequently, legal protection should commence with the inventory and registration of said CIP. Such protection can subsequently be reinforced through other IPR regimes such as geographical indications or collective trademarks tailored to the specific characteristics of each product. Thus, strengthening CIP protection not only provides legal certainty regarding the Malay community's cultural heritage but also fosters the development of the creative economy by preserving culture, enhancing the competitiveness of MSMEs, and reinforcing regional identity.

Abstract

On-call doctor practice is a form of healthcare service that arises from the moral obligation of the medical profession to always be ready to provide assistance, even outside of formal working hours. On the other hand, this practice carries legal vulnerabilities for doctors due to the lack of detailed regulations regarding the scope of responsibility, while patients' rights must still be fully upheld. This study aims to analyze the position of the moral obligation of doctors in on-call practice from an ethical perspective, examine the implications of their legal responsibilities in civil, criminal, and professional disciplinary domains, and formulate a framework for ethical protection of the medical profession that is proportional while still fulfilling patients' rights. The research uses a normative juridical method with a legislative, conceptual, and case approach, through the review of laws and regulations, the Indonesian Medical Code of Ethics, court decisions, and relevant scientific literature. The findings indicate that the moral obligation of on-call doctors transforms into a legal duty (duty of care) once active contact with a patient occurs, with responsibilities that can be divided in a tiered manner between individual doctors and hospital institutions based on the theory of limited liability and the non-delegable duty doctrine. A proportional ethical protection framework for the medical profession can be formulated through three pillars: the application of the principle of ultimum remedium in criminal law, strengthening documentation obligations as an evidentiary instrument, and enhancing the role of ethical and disciplinary forums in assessing the appropriateness of medical actions in a contextual manner. This framework is expected to serve as a reference for professional organizations, healthcare facilities, and policymakers in developing fair guidelines for on-call doctor practices.

Abstract

This study analyzes the gap in protecting the civil rights of wives in secret marriages (nikah siri) by comparing Indonesian positive law and Islamic jurisprudence (fiqih). Although fiqih munakahat, particularly the Shafi'i School, recognizes the validity of secret marriages when the marriage pillars are fulfilled (parties, guardian, two witnesses, and offer-acceptance), this recognition is not accompanied by state legal protection. Law Number 1 of 1974 on Marriage adds a registration requirement as a condition for administrative recognition, creating a legal dualism: valid under fiqih but unrecognized by positive law. As a result, wives in secret marriages lose protection over their rights to maintenance (nafkah), inheritance, joint property (gono-gini), and dignity before the court. Additionally, contemporary Islamic scholars, through the maqasid al-shariah approach and the dar'ul mafasid principle, consider secret marriages prohibited because they cause significant harm (mafsadat) to women, creating a disjuncture between conservative and contemporary fiqih. This regulatory gap demonstrates the absence of effective legal enforcement mechanisms to uphold the rights of wives in secret marriages, even though fiqih has established these rights normatively.

Abstract

Law No. 1 of 2023 concerning the National Criminal Code, in Article 100 regulates the death penalty with a 10-year probationary period which has given rise to much debate and problems. In this article 100, there has been a shift in the paradigm of the death penalty from a principal punishment to a special punishment. This will open up a gap in legal uncertainty and the potential for transactional practices in assessing "good behavior" in prisons. The formulation of the problem discussed is How is the Regulation of the application of the death penalty in the National Criminal Code, and What is the Mechanism for the application of the death penalty in Law No. 1 of 2023 concerning the National Criminal Code. The research method used is normative juridical with a statute approach, a conceptual approach, and a comparative approach. The results of the study show that in the National Criminal Code, the death penalty no longer occupies a position as a principal punishment but is repositioned as a special punishment that is alternative or as a last resort (ultimum remedium). The implementation mechanism introduces innovation in the form of a 10-year probationary period which must be included in the judge's decision. If the convict demonstrates commendable behavior and conducts during the probationary period and shows remorse, the death penalty can be commuted to life imprisonment through a Presidential Decree after consideration by the Supreme Court. However, this study also highlights concerns regarding the potential for abuse of power, transactional practices, and intervention by the judicial mafia in the evaluation process at correctional institutions during the probationary period. Therefore, strict and transparent derivative regulations are needed to maintain the dignity of justice for victims and the integrity of the national legal system. This study concludes that the death penalty in Law No. 1 of 2023 remains a legitimate instrument of retributive justice to protect the rule of law and the right to life of victims of extraordinary crimes. Although Article 100 introduces a 10-year probationary period, this mechanism should be viewed as a strict filter and not a legal loophole that weakens the ultimate deterrent effect. Therefore, derivative regulations of the National Criminal Code must ensure that the evaluation process for convicts is carried out in a rigid, transparent, and objective manner to maintain the dignity of justice for society.
