Abstract

This study aims to analyze the constitutional paradox in the Islamic Republic of Iran following the 1989 Constitutional Amendment. The research focuses on the conceptual and practical tension between the doctrine of Velayat-e Faqih (Guardianship of the Islamic Jurist), which embodies the principle of divine sovereignty, and the republican principle based on popular sovereignty. This study employs a normative legal research method with a qualitative approach through conceptual, historical, and comparative analyses. The analysis examines constitutional provisions and the distribution of authority among state institutions to identify the dynamics of power within Iran's constitutional system. The findings indicate that non-elective institutions, particularly the Guardian Council and the Supreme Leader, possess constitutionally entrenched powers that significantly constrain the independence of elective institutions, including the President and the Majles (Parliament). These findings demonstrate that the conventional Western doctrine of checks and balances is insufficient to explain the hybrid and asymmetrical nature of Iran's constitutional governance. Accordingly, this study proposes the concept of Concurring Constitutionalism as an alternative constitutional paradigm aimed at fostering a more balanced distribution of state power while preserving both the Islamic identity of the state and the political rights of its citizens.

Abstract

This article examines the application of the principle of balance in the formulation of franchise agreements in Indonesia using a normative legal research method with a qualitative approach, including statutory, conceptual, and analytical perspectives. The study explores the legal framework consisting of the Indonesian Civil Code (KUH Perdata), Government Regulation No. 42 of 2007 on Franchising, and Minister of Trade Regulation No. 71 of 2019 on Franchise Implementation. It also identifies the sources of imbalance between franchisors and franchisees in contractual practices. The findings reveal that the dominance of standard-form contracts and unequal bargaining positions often result in clauses that disproportionately favor franchisors. Meanwhile, the existing regulations emphasize administrative compliance and procedural transparency rather than ensuring substantive fairness within contractual terms. This condition allows the continuation of exploitative practices, even when formal requirements are fulfilled. To address these issues, this study recommends strengthening administrative authority to review contract fairness, implementing a key fact sheet for prospective franchisees, developing balanced model clauses, and promoting accessible dispute resolution mechanisms. These measures are expected to reinforce the principles of balance and good faith, creating a fair, ethical, and sustainable franchise system in Indonesia.

Abstract

Coordination between regional government agencies plays a crucial role in the preparation of the Regional Government Work Plan (RKPD) to ensure that planned programs and activities align with regional development priorities. This study aims to analyze the implementation of coordination by the Riau Province Regional Development Planning Agency (Bappeda) in the preparation of the 2023 Regional Government Work Plan and to identify obstacles encountered during the process. This study employed a qualitative method with a descriptive approach. Data were obtained through observation, interviews, and documentation of informants directly involved in the preparation of the 2023 RKPD at the Riau Province Regional Development Planning Agency and the Riau Province Public Works and Spatial Planning Office. Data analysis was conducted through the stages of data reduction, data presentation, and conclusion drawing. The study shows that the Implementation of the Coordination of the Riau Province Regional Development Planning Agency on communication indicators has been running well through coordination meetings, discussion forums, official letters and online communication media, the implementation of coordination on the integration indicator has been running well through joint discussions, division of tasks according to functions and adjustment of activity programs with regional development priorities and the implementation of coordination on the synchronization indicator has been carried out well, synchronization is carried out through the process of verifying program proposals, adjustments to the RKPD, Renstra and Renja of regional devices. Obstacles faced in the Implementation of the Coordination of the Riau Province Regional Development Planning Agency in the Preparation of the 2023 Regional Government Work Plan include the replacement of representatives of regional apparatus organizations, suboptimal cross-sector coordination, delays in the issuance of General Guidelines for the preparation of the RKPD, delays in submitting supporting data and coordination adjustments due to the implementation of the Work From Home (WFH) system.

Abstract

The Constitutional Court Decision Number 135/PUU-XXIII/2024, which separates the implementation of National Elections and Regional Elections, has significant legal implications for the continuity of the tenure of Regional People's Representative Councils (DPRD). The separation of election schedules causes the term of office of the 2024–2029 DPRD members to expire before the regional elections are held in 2031, thereby creating the potential for a vacancy in DPRD positions during the transitional period. This study aims to analyze the legal implications of the DPRD vacancy following the Constitutional Court's decision and to examine alternative solutions from the perspective of constitutional law. The research employs a normative legal method using statutory, conceptual, and case approaches. The findings indicate that there is currently no explicit legal framework governing the mechanism for filling DPRD vacancies during the transitional period, which may lead to legal uncertainty and weaken legislative, budgeting, and supervisory functions at the regional level. Therefore, policy reform through amendments to the Election Law is necessary to ensure legal certainty, maintain the continuity of regional governance, and uphold the principles of popular sovereignty and constitutional democracy.
