Abstract

Ahmad Hassan (1887-1958), prominent figure of Persatuan Islam (Persis) who had critical views on Islamic law, offered a conceptual defiling stilth or najis in the context of ablution in Islamic law. In his view there were three kinds of najis: (i) najis as impurity that must be cleaned before praying (salat); (ii) najis as impurity that was forbidden to eat; and (iii) najis as impurity that contained in heart (qalb). These three kinds of najis, according to Hassan, were absolutely based on the rules in Qur`an and Sunnah of the Prophet. Furthermore we can see many controversial opinions of his views in detail rules in this field. In the first kind of najis, according to him, there were only five or six sorts of impurity that were all human substances, they are feces, urine, blood of menstruation, blood of childbirth, mazi, and wadi. These sorts of impurity purely based on the traditions of the Prophet and other legal reasoning. No other impurity or najis need to be cleanned before praying (salat) excepts those five sorts. So, some sorts of impurity like (spittle of) dog, pig, and animal manure, according to his view were not najis that have to be cleanned before praying. In the second kind of najis, according to Hassan forbidden foodstuffs were only forbidden foodstuffs mentioned in Qur`an. There was no forbidden foodstuff outside the Qur`an. In the third kind of najis, according to him, there was metaphor impurity that was in the hearts of unbelievers. The first and second concept of impurity or najis above are important to be studied furthermore.

Abstract

Maslahat is one of the approaches which is usually used by Indonesian moslem scholars to solve gap problems between Islam and world development. It also causes many contradictions amongst them, however, because of its flexibility. some scholars use maslahat without clear boundaries and apply it as a free method. The writer tries to give a solution about this problem, especially when maslahat faces the culture of Indonesian law system. Maslahat has universal characteristic. Therefore, it should be acceptable and applicable in universal ways. In Indonesian context, maslahat must be formalized and institutionalized in Indonesian law system if it will be applied as universal value in the middle of Indonesian society. Consequently, if there is a conflict amongst several applications from maslahat, Indonesian law system could have the right to determine the truth.

Abstract

One fresh contribution to the contemporary study of fiqh (Islamic jurisprudence) is the theory of limits (nazariyyah al-hudud) promoted by a Syirian liberal Islamic figure, Muhammad Syahrur. Syahrur’s theory of limits solves the epistemological deadlock of previous works. Syahrur asserts that the theory of limits is an approach within ijtihad (individual interpretation) to study the muhkamat verses (clear and direct verses of law) of the Qur’an. The term “limit” (hudud) used by Syahrur refers to the meaning of “the bounds or restrictions of God which should not be violated, contained in the dynamic, flexible, and elastic domain of ijtihad. By using the theory of limit, Syahrur tries to re-constructs both concept poligamy and jilbab as contribution to the contemporary study of Islamic jurisprudence.

Abstract

The provisions on marriage registration law are not explicitly stated by the texts of the Qur'an and Sunnah, albeit marriage is a legal event, creating rights and obligations of the parties. The fulfillment of these rights and obligations can be well enforced if an orderly marriage administration is in place, namely by registering the marriage to the competent institutions of marriage, evidenced by a marriage certificate (authentic evidence). Since the texts do not provide the laws, its explanation is also not found in conventional fiqh. Marriage laws in several Islamic countries also provide non-uniform provisions in terms of technical details, although the majority requires marriage registration. The legal importance of marriage registration can be strengthened by several methods of istinbath (usul fiqh), inter alia, the methods of qiyas, sadd al-z\ari'ah, and al-maslahat al-mursalah. respectively.

Abstract

Learning the history of law and establishment and also the changing of legislation regulation in pre-colonial period is an interesting thing and hoped to be able to give input for the experts of Indonesia law in the frame work of rearrangement Indonesia law system. We will get description how the type of legislation regulation which prevails in Indonesia before Dutch held invention of law when Dutch was colonizing Indonesia. This article will find various guidelines to the understanding that the literature of java is and important source for the history of development islam law in Indonesia.The writer will examine the manuscript of law which was created in Demak kingdom period, that was serat angger-angger and suryangalam and serat suryagalam. This article will discuss how the setting of sosio cultural and the politics of Demak kingdom as the place which was what forms the background of appearing the manuscript of serat angger-angger. Abstract

Policy of western countries, especially the United States against some Muslim countries in the Middle East region led to a backlash and generate assistance in various ways. One way or form of resistance which is by suicide bombing. Even this kind of action does not only happened in the region or the state which is being colonized or war zone, but also often happened in a peaceful country like Indonesia. This paper attempt to uncover the law suicide bombing in perspective of Islamic law by classifying into two, the first suicide bombing as a jihad and second, suicide bombings as terror. This article tries to answer the questions when suicide bombing can be categorized as jihad? What are the conditions or requirements? And when its categorized as terror? The answer in this paper derived from qualitative research. This research is library research toward source texts of Islam, including the fatwas and opinions of ulama, especially contemporary ulama. Author using a theory of maÅŸlahah which is the purpose of shari'a (maqashid al-syariah) as basis for reviewing the legal and categorized of suicide bombing. When a suicide bombing itself include maÅŸlahah by meeting various condition or requirements, then it is categorized as jihad. However, when its performed in peaceful area causes damage that reduces maÅŸlahah, suicide bombing is categorized as terror.

Abstract

Tujuan utama didirikannya Perguruan Tinggi Agama Islam adalah untuk menyiapkan peserta didik menjadi anggota masyarakat yang memiliki kemampuan akademik dan menciptakan ilmu pengetahuan agama Islam, serta mengembangkan dan menyebarluaskan ilmu pengetahuan agama Islam serta mengupayakan penggunaannya untuk meningkatkan taraf kehidupan masyarakat dan memperkaya kebudayaan nasional. Harapan pertama berkaitan dengan pengembangan kajian Islam secara akademis-ilmiah, kedua berkaitan dengan kontribusi nyata lembaga terhadap masyarakat sekitar. Fiqih hisab rukyat masuk dalam pembidangan ilmu agama Islam. Idealnya, lembaga PTAI yang bernaung di bawah Departemen Agama, mengembangkan fiqih hisab rukyat yang merupakan bidang ilmu yang tercantum dalam keputusan tersebut. Apalagi pembidangan ilmu ini disempurnakan dan sekaligus disetujui oleh Lembaga Ilmu Pengetahuan Indonesia. Dalam pengembangan fiqih hisab rukyat, PTAI dihadapkan pada berbagai persoalan. Pertama bahwa perkembangan fiqih hisab rukyat paska Ulugh Beg telah menurun karena menurunnya vitalitas peradaban Islam dan munculnya dikotomi antara agama dan sains yang pada gilirannya melahirkan pemisahan antara ilmu falak dan ilmu astronomi, minimnya peminat fiqih hisab rukyat di PTAI dan sedikitnya literatur fiqih hisab rukyat yang menjadi referensi perkuliahan fiqih hisab rukyat di PTAI yang berbahasa Indonesia. Mulai tahun 1983, muncul buku fiqih hisab rukyat yang digunakan di PTAI yaitu Ilmu Falak karya Abdurrahim, Ilmu Falak karya M. Sayuti Ali tahun 1997, Ilmu Falak: Teori Dan Praktek karya Susiknan Azhari tahun 2001, Ilmu Falak: Teori Dan Praktek karya Muhyiddin Khazin tahun 2004, Hisab Rukyat Dan Aplikasinya karya Encup Supriatna tahun 2007, Ilmu Falak Praktis karya Moh. Murtadho tahun 2008, Ilmu Falak (Teori Dan Aplikasi) karya A. Jamil tahun 2009 dan Ilmu Falak karya Maskufa tahun 2009. Namun dengan munculnya banyak literatur fiqih hisab rukyat tersebut juga dibarengi dengan materi yang komprehensif dan pendekatan yang empiris? Dari enam buku fiqih hisab rukyat yang diuraikan, empat buku masuk kategori komprehensif yaitu buku fiqih hisab rukyat yang digunakan di UIN Jakarta, UIN Yogyakarta, UIN Malang dan STAIN Metro lampung. Sedang dua lainnya tidak komprehensif yaitu buku fiqih hisab rukyat yang digunakan di UIN Bandung dan IAIN Banten. Pendekatan kajian yang sangat empiris digunakan dalam dua buku fiqih hisab rukyat yaitu yang ada di UIN Yogyakarta dan UIN Malang, yang cukup empiris ada pada buku fiqih hisab rukyat yang digunakan pada UIN Jakarta, UIN Bandung dan STAIN Metro Lampung. Sedang yang tidak empiris ada pada buku fiqih hisab rukyat yang digunakan pada IAIN Banten.

Abstract

Syari’at Islam diturunkan untuk memberikan kemaslahatan kepada manusia dan menghindari mereka dari kemudaratan sesuai dengan perkembangan manusia itu sendiri.Hal ini merupakan konsep dasar dari maqasid al-syari’ah sejak abad pertengahan Islam (era pemikiran klasik) yang dijelaskan Imam al-Syatibi dalam kitab al-muwafaqat. Namun kemudian konsep maqasid al-syari’ah ini mengalami perkembangan dan menjadi sebuah paradigma baru (new paradigm) dalam filsafat hukum Islam kontemporer, yaitu maqasid al-syari’ah yang dipopulerkan oleh Jasser Auda dengan pendekatan sistemnya. Perubahan paradigma dari maqasid yang lama ke maqasid yang baru ini terletak pada titik tekan keduanya. Titik tekan maqasid yang lama lebih pada protection (perlindungan) dan preservation (penjagaan/pelestarian), sedangkan maqasid baru lebih menekankan pada development (pengembangan) dan right (hak).

Abstract

Hubungan Islam sebagai agama dengan ide Hak Asasi Manusia Internasional telah menarik perhatian banyak pihak diantaranya para aktivis dan akademisi.Diantara akademisi yang menaruh perhatian terhadap isu ini adalah Fathi Osman dan Mshood Baderin.Berkaitan dengan hal tersebut, tulisan ini secara khusus didedikasikan untuk menggali gagasan, saran, dan konsepsi keduanya dalam menyoal isu yang dimaksud.Keduanya mencoba mensintesiskan antara konsep hukum Islam dengan Hak Asasi yang diadopsi oleh masyarakat internasional (melalui wadah PBB). Tulisan ini bertujuan menampilkan setrategi keduanya dalamm proses pensintesisan, yang dilakukan dengan investigasi secara penuh kehati-hatian pada konsep Hak Asasi Manusia secara Islami dan Hak Asasi Manusia secara modern dalam sejarah, selanjutnya diikuti dengan identifikasi faktor-faktor dan wacana-wacana yang melingkupi keduanya. Hal ini adalah setrategi guna memperoleh gagasan yang jelas mengenai bagaimana seharusnya komsep Hak Asasi Manusia diformulasikan.Tulisan ini juga mengkaji secara komparatif antara ide kedua figur dalam studi ini guna mengetahui mana yang lebih kompatibel untuk diaplikasikan dalam kehidupan kontemporer ini.

Abstract

Fatwa Majelis Ulama Indonesia (MUI) tentang perkawinan beda agama telah memberikan warna baru dalam hukum Islam. Pelarangan MUI terhadap perkawinan beda agama merupakan wujud pembaruan hukum karena fatwa ini bertentangan dengan nass baik dalam al-Qur’an, hadis maupun pandangan jumhur ulama. Pembaruan hukum yang tampak pada fatwa ini lebih disebabkan oleh penggunaan metodologis. MUI menggunakan metode masalih al-mursalah dalam menetapkan fatwa ini. Dengan pertimbangan kemaslahatan, MUI melarang perkawinan ini karena kerugiannya (mafsadah) lebih besar daripada keuntungannya (maslahah). Faktor yang mempengaruhi terjadinya pembaruan/perubahan hukum dalam fatwa ini lebih dominan dipengaruhi oleh faktor sosial budaya. MUI lebih memperhatikan aspek sosiologis dalam menetapkan fatwa ini sekalipun bertentangan/berlawanan dengan pandangan jumhur ulama bahkan nass al-Qur’an yang jelas-jelas membolehkan laki-laki muslim menikah dengan ahl al-kitab.
