Abstract

Abstract Adultery is increasingly becoming a trend in our society, this phenomenon can be seen from the increasing number of cases of abortion of fetuses resulting from illicit relationships. Adultery is also caused by the damage to the morality and spirituality of our young generation, the rise of promiscuity to the lack of supervision from parents. According to Islamic Sharia, adultery is sexual intercourse between a man and a woman without a valid marriage bond, with the threats of punishment for the perpetrators being: 1) if the perpetrator is married and commits adultery voluntarily, is not forced and is not raped, is by being whipped and stoned, 2) if the perpetrator is not married, then he is whipped with 100 lashes and exiled (locked up or imprisoned). While the definition of adultery according to the Criminal Code is voluntary sexual relations by someone who is married to someone who is not their husband or wife. Thus, adultery in the Criminal Code focuses on acts that injure a marriage, with a maximum penalty of nine months in prison, and new prosecutions can be made on complaints from tainted husbands or wives. Meanwhile, according to the RKUHP, the penalty for committing adultery is one year in prison and a maximum fine of ten million rupiah, with an absolute complaint offense which can only be prosecuted if there is a complaint from the husband, wife, parents or child who has been harmed.

Abstract

The role taught by parents to children regarding manners should start early. Because the process of child development is determined by the education obtained from the surrounding environment. This article discusses the differences in the interpretation of the QS. An-Nur verse 58 according to commentators. Among them according to the views of Ahmad Mustafa Al-Maraghil, Jalaluddin Al Mahalli in Tafsir Al-Jalalain, and Quraish Shihab. In the discussion of QS. An-Nur verse 58 according to the commentators there are several views regarding the interpretation of the verse. The views of each of these figures are related to the prohibition of children entering their parents and also teaching about the manners contained therein and the steps to get used to children asking permission before entering a room and using other people's things.

Abstract

Penelitian ini dilatarbelakangi, dalam Islam peradilan dan upaya penegakan keadilan telah banyak diatur mulai dalam nash al Qur’an, hingga pemikiran ‘Umar Bin Khattab pada 14 abad yang lalu dalam Risalat al Qadha yang menjadi pedoman beracara dan etika hakim di masanya. Mengingat Indonesia adalah negara dengan pemeluk agama Islam terbesar di dunia, maka sangatlah penting untuk terus mengkaji hal-hal yang berhubungan dengan islam termasuk dibidang penegakan hukum oleh ‘Umar bin Khattab seorang khalifah yang pertama kali meletakkan dasar- dasar peradilan. Sehingga penulis di sini akan menganalisis hukum acara perdata Peradilan Agama masa kini dan penguatan kapasitas hakim di Indonesia dalam perspektif Risalat al Qadha. Penelitian ini merupakan penelitian kepustakaan (library research) yang menggunakan metode penelitian kualitatif. Teknik pengumpulan data melalui dokumentasi. Sedangkan analisis datanya menggunakan metode Content Analysis. Berdasarkan analisis tersebut dapat disimpulkan bahwa: (1). Tahapan proses pemeriksaan perkara dalam peradilan agama seperti anjuran perdamaian atau mediasi, penundaan hari sidang untuk menyiapkan alat bukti, pembuktian, upaya hukum, secara umum sejalan dengan konsep beracara dalam Risalat al Qadha, yang membedakan dalam pelaksanaannya. (2). Kriteria kapasitas hakim dalam konteks sekarang lebih luas, hakim bukan hanya diamanatkan untuk senantiasa memahami hukum formil maupun hukum materiil, tetapi juga berfikir yuridik, kemahiran penerapan hukum serta komitmen profesional. Kriteria kapasitas hakim juga diamanatkan dalam Risalat al Qadha, di dalamnya memfokuskan pemahaman yang dimiliki hakim pada pokok perkara dan sumber hukum, juga terdapat ketentuan etika yang harus dimiliki hakim dalam proses persidangan. Kesimpulan dari hal tersebut kapasitas hakim di Indonesia lebih luas karena rentan waktu yang panjang antara saat ini dan Risalat al Qadha 14 abad yang lalu.

Abstract

This research focuses on the principles or mandates of judges in carrying out their work according to the Minutes of Al Qadha Umar Bin Khattab and the Procedural Law and what are the sources of law in making decisions. The method used is the literature review method. The sources of the literature reviewed in this paper are in the form of books researched by journals and other scientific articles. The results of the study show that according to the treatise of Al Qadar Umar Bin Khattab and procedural law in carrying out the implementation there are several principles, among others, understanding the subject matter and giving a decision, a fair judge, giving the parties the opportunity to bring evidence of peace issues (ishlah), correcting decisions that are wrong, False Witnesses and Prohibition to try, Stay away from angry attitudes, confused thoughts, boredom, Purity of intention as a judge. Umar's messages in all of his treatises to judges are: The importance of judges understanding the main points of contention, The firmness of a judge to carry out and convey his decision, Equality of position between disputing parties in the eyes of the law and judges, There is a burden of proof in investigating problems, Holding peace efforts, Improving decisions erroneous, Knowledge of the law and the ability of judges to apply the law through ijtihad and qiyas, Suspension of court proceedings, Honesty of witnesses, Exemption from charges for the accused, Patience of judges and the importance of cold thinking, Loyalty and purity of intention as a judge, Great motivation and reward for judges be honest. Sources of judicial law are Al-Qur'an, As-Sunnah, ijtihad, ijma', qiyas, previous court decisions, Books of statutes as written law, Customary heads and religious advisors, Sources of jurisprudence, Writings scientific law experts, and books of other science.

Abstract

This article investigates the position of international human rights law with respect to the Hijab (veil) worn by Muslim women to express their religious beliefs. In Islam, the hijab is not only an important aspect of a woman's faith, but also shows their religious affiliation as a form of submission to God. However, the regulation of headscarves in several countries has raised complex human rights issues, particularly in the context of women's rights to freedom of religion and its manifestations, equality and non-discrimination. This article examines the theological status of the hijab in Islam for the first time. In the West, the ban on wearing the headscarf has increased discrimination against Muslim women and restricted the movement of Muslim women as they are forced to withdraw from public life and remain at home. Secondly, it analyzes the selected laws, administrative acts, and cases regarding the wearing of the hijab in public places, especially in European Union (EU) countries. The article concluded that there was no justification under international human rights law for banning Muslim women from wearing the headscarf. The absence of a reasonable justification in accordance with human rights law can interfere with individual freedom to practice a religion. The general exclusion of women from work or other life activities due to the use of the headscarf will lead to further discrimination. Abstract

Adapun dari sekian banyak penemuan tersebut yang tidak kalah penting adalah perkembangan pada bidang kedokteran. Penemuan menakjubkan yang ditemukan pada bidang ini yakni mengenai praktik transplantasi organ tubuh manusia. Artikel ini bertujuan untuk mengetahui bagaimana hukum pencangkokan organ tubuh manusia perspektif hukum Islam. Metode yang digunakan dalam artikel ini menggunakan jenis penelitian metode kualiatif sedangkan sifat penelitian ini bersifat library research (penelitian kepustakaan). Teknik analisisnya menggunakan teknik analisis isi (content analysis). Selanjutnya pendekatan penelitian ini adalah menggunakan pendekatan yuridis normatif. Hasil penelitian menunjukan bahwa Dalam dunia kedokteran, pencangkokan organ tubuh ini sangat bermanfaat bagi perkembangan ilmu kedokteran baik untuk penyembuhan dan penyempurnaan organ tubuh pasien yang membutuhkan. Selain itu pencangkokan organ tubuh ini sangat bermanfaat juga bagi pasien yang membutuhkan sehingga organ yang rusak tersebut dapat kembali lagi fungsinya. Dalam pandangan hukum Islam, bahwa hukum pencangkokan organ tubuh dilakukan karena beberapa hal antara lain : pencangkokan organ tubuh yang didasari untuk perbaikan, didasari kedaruratan dan didasari sebagai kebutuhan.

Abstract

Abstrak Wakaf merupakan ibadah dengan harta benda atau yang disebut dengan ibadah maliyah dengan tujuan Taqarrub Ilallah atau mendekatkan diri kepada Allah Swt. Wakaf akan bernilai ibadah yang memiliki ganjaran pahala apabila harta benda yang telah diwakafkan itu dapat bermanfaat bagi umat manusia, bahkan wakaf akan. Jadi, kemanfaatan harta benda wakaf untuk kemaslahatan umat merupakan prinsip utama dari ibadah wakaf itu sendiri. Dari sini kemudian muncul pendapat fuqaha yang menyatakan bahwa harta benda wakaf yang sudah tidak bermanfaat atau rusak boleh ditukar atau diganti dengan harta benda lainnya yang bermanfaat atau menghasilkan berdasarkan pertimbangan kemaslahatan. Penelitian ini didasarkan pada studi kepustakaan. Tema yang diambil adalah pemikiran Ibnu Qudamah tentang pengalihan fungsi harta wakaf. Dalam penelitian ini, ada beberapa masalah, yaitu bagaimana status hukum penjualan harta wakaf menurut perundang-undangan dan bagaimana istinbath hukum yang diambil oleh Ibnu Qudamah. Abstract

The distribution of inheritance frequently gives rise to disagreements, particularly when it comes to fairness, reliability, accountability, and openness. When adopted children are involved in the inheritance process, issues arise. The goal of this study is to identify patterns and types of distribution  of inheritance in adopted children in accordance with the Islamic Sharia laws found in the Compilation of Islamic Law. Through descriptive explanation and a qualitative methodology, this study measures and analyzes data. Case studies and phenomenology are two categories of study methods. This research is categorized as both library and field research based on where it was conducted. The conclusions of this study pertain to the pattern of distribution that the heir must create while still alive in the form of a legally required will with the distribution. based on the guidelines and regulations set forth in the Compilation of Islamic Law (HKI). Regarding the structure of inheritance in accordance with the division prescribed by the Koran and reinforced by the KHI.A necessary will must specify how much of the heir's estate can be given to adopted children; ideally, all that is specified in the form of a will with the heirs' awareness. This attempts to prevent misunderstandings between family members, which will ultimately lead to the filing of a case in court. Keywords: Adopted Children, Inheritance, Compilation of Islamic Law. Abstrak Sering kali terjadi perselisihan pembagian harta waris, khususnya berkaitan dengan keadilan, amanah,transparan dan akuntabel. Permasalahan berkembang dengan adanya keberadaan anak adopsi dalam pembagian harta waris. Penelitian ini bertujuan  untuk menemukan pola dan bentuk pembagian harta waris pada anak adopsi sesuai ketentuan syariah Islam dan termaktub  dalam Kompilasi Hukum Islam. Penelitian ini mengukur dan menganalisis  data dengan pendekatan kualitiatif melalui eksplanasi deskriptif. Tipe dan strategi penelitian tergolong Studi kasus dan Fenomenologi. Dilihat berdasarkan tempat, penelitian ini tergolong Library dan  Field Research. Penelitian ini menghasilkan temuan mengenai pola pembagian harta warisan harus dirancang sedemikian rupa oleh pewaris sewaktu masih hidup dalam bentuk wasiat wajibah dengan pembagian sesuai ketentuan dan aturan yang termuat dalam Kompilasi Hukum Islam (HKI). Adapun bentuk harta waris sesuai pembagian yang diatur dalam Alquran dan diperkuat pada KHI. Pemberian harta warisan kepada anak adopsi melalui wasiat wajibah tidak boleh melebihi sepertiga dari harta peninggalan pewaris dan sebaiknya segala sesuatu yang dituangkan dalam bentuk surat wasiat sepengetahuan ahli waris. Hal ini bertujuan untuk menghindari kesalah pahaman  antar anggota keluarga yang pada akhirnya terjadi acara gugat menggugat di pengadilan.   Kata kunci: Anak Adopsi,  Harta Waris, Kompilasi Hukum Islam.
