Abstract

Rapid advancements in information and communication technology have fueled a rise in cybercrime in Indonesia. These crimes not only result in material losses but also have psychological and social impacts on victims. This study aims to analyze the psychological and social effects experienced by victims of cybercrime and to examine this phenomenon from a victimological perspective. The method used is normative legal research with a legislative and conceptual approach. Data were collected through a literature review covering legislation, books, and scientific journals related to victimology and cybercrime. The results of the study indicate that victims of cybercrime often experience psychological impacts such as anxiety, fear, stress, trauma, and a decline in self-confidence. Additionally, they face social impacts including feelings of shame, reduced social interaction, and stigma from their surroundings. From a victimology perspective, it is crucial for victims of cybercrime to receive greater attention through legal protection, social support, and psychological recovery efforts. Therefore, more comprehensive measures are needed from the government and society to provide protection and recovery for victims of cybercrime in Indonesia.

Abstract

This study aims to analyze the implementation of Standard Operating Procedures (SOP) in the secretariat and clerkship divisions in realizing public accountability at the Sukoharjo District Court and to identify the obstacles faced in its implementation. This research employed an empirical legal research method with a qualitative descriptive approach. Data were obtained through observation, interviews, and literature studies on laws and regulations, references, and documents related to judicial administrative services. The results indicate that the implementation of SOPs in the secretariat and clerkship divisions has been carried out quite effectively through the application of One-Stop Integrated Services (PTSP), electronic-based administrative services, and structured division of work responsibilities. The implementation of these SOPs supports the creation of administrative services that are more transparent, orderly, and accountable. However, several obstacles remain, including limited human resources, disruptions in information technology systems, high administrative service workloads, and the limited public understanding of digital court services. Therefore, improving the quality of human resources, optimizing information technology facilities, and strengthening public service socialization are necessary to support the effectiveness of SOP implementation and improve the quality of public services within the judicial environment.

Abstract

This study examines the normative gap concerning the strengthening of the Village Consultative Body (BPD) as a checks and balances institution following the enactment of Law Number 3 of 2024 on Villages. The research employs a normative legal approach using statutory, conceptual, and literature-based analyses of relevant legal sources. The findings reveal that the 2024 Village Law primarily emphasizes extending the village head's term of office from six to eight years without providing adequate reinforcement of the BPD's authority, supervisory functions, or institutional capacity. As a result, an imbalance of power between the village head and the BPD may emerge, potentially weakening the BPD's oversight role, reducing community representation, and limiting accountability mechanisms at the village level. Furthermore, the weakened institutional position of the BPD increases the risk of excessive concentration of local power and may undermine democratic village governance. Therefore, this study recommends strengthening the legal framework through implementing regulations that enhance the BPD's authority, improving institutional capacity through continuous training and development, and reinforcing horizontal accountability mechanisms to promote transparent, participatory, accountable, and democratic village governance.

Abstract

Islam, as a religion with a mission to provide mercy to all of nature, places welfare, justice and human protection as the main goals of sharia. Therefore, the concepts of war and peace should not be viewed only as tools of violence, but as part of siyāsah fiqh which is tied to maqāṣid al‑sharī‘ah. In Islamic constitutional law, jihad and war policies are within the authority of state leaders who are responsible for the stability and welfare of the people. However, in the context of modern Islamic countries, tensions arise between the claim of the primacy of sharia and the state's obligations to international law, especially international humanitarian law and human rights (HAM). This research discusses the issue of the law of war and peace in the context of Islamic constitutional law with the perspective of international law and human rights, and offers a reconstruction of the concept of the law of war and peace which emphasizes the principles of protection of civilians, justice, non-discrimination and compliance with war crimes within the framework of the ICC and the Rome Statute. From this analysis, it is concluded that the reconstruction of the concept of the law of war and peace in Islamic constitutional law does not conflict with Islamic teachings, but rather strengthens the integrity of sharia as a source of mercy and justice which is in line with human rights standards and international humanitarian law.

Abstract

Carbon trading in Indonesia has entered a new chapter following the enactment of the Economic Value of Carbon (EVC) regulation and the launch of the carbon exchange. However, the massive growth of this new market leaves a crucial legal gap, notably the practice of greenwashing (manipulation or false environmental claims) regarding the traded carbon units. This study aims to analyze the urgency of criminalizing greenwashing as a new economic crime and to formulate an ideal future penal policy. The research method employed is doctrinal legal research (normative juridical) with a statutory approach and a conceptual approach. The results indicate that current administrative law and consumer protection instruments are inadequate to address the complexity of fraud in carbon trading, which has a systemic dimension impacting the national economy. Therefore, criminalizing greenwashing as a new economic crime is highly urgent to maintain market integrity, legal certainty, and the achievement of Indonesia's NDC targets. Future penal policy must integrate the expansion of corporate legal liability, cumulative criminal sanctions, and the restoration of environmental economic losses (restorative justice).
