Abstract

This study discusses the legal channels and obstacles in claiming compensation for medical malpractice in Indonesia through a literature review of the stages of dispute resolution in civil law. The focus of the study is on legal mechanisms, including mediation, filing lawsuits, trials, and the execution of compensation decisions, as well as the various obstacles faced by victims in the process of enforcing their rights. Using a literature review method, this study analyses legal literature, court decisions, regulations, and related documents to provide a comprehensive overview of the procedures and obstacles that arise, whether procedural, substantive, systemic, or cultural. The results of the study show that although formal legal channels are available, complex obstacles often hinder victims of malpractice from accessing justice. Therefore, improvements to the legal system, increased understanding of patient rights, and the development of alternative dispute resolution mechanisms are needed to create effective and fair legal protection.

Abstract

This study examines the conflict between customary law and human rights standards, focusing on the practice of customary punishment and gender equality issues through a literature review method. Customary law, which is deeply rooted in community traditions, often conflicts with human rights principles that demand the protection of individual rights without discrimination, especially in the implementation of customary punishments that can violate the rights to freedom and physical integrity. In addition, the patriarchal structure of customary law creates gender inequality that hinders the rights of women and other gender groups in various aspects of life. This study presents a critical analysis of existing literature to understand the dimensions of this conflict and find common ground between local cultural norms and universal human rights principles. The results of the study indicate the need for inclusive and dialogical reform of customary law, respecting local wisdom without neglecting human rights, as an effort towards a fair, inclusive, and sustainable legal system.

Abstract

Food security is a crucial issue in ensuring sufficient, nutritious, and sustainable food availability for the community. This study systematically reviews the literature on food security approaches, focusing on three main dimensions: diversification, access, and stability in agricultural food supply. Through a systematic literature review, this study filters and analyses various reliable scientific sources to gain a comprehensive understanding of the roles and challenges of these three aspects in the context of food security. The results of the study show that food diversification contributes significantly to improving the sustainability of the food system and nutritional quality, while adequate food access and supply stability are key to ensuring food affordability and continuity for all levels of society. These findings emphasise the need for an integrated approach that combines production diversification, strengthening socio-economic access, and policies that support supply stability to effectively improve national and global food security. This study provides a strong scientific basis for the development of policy strategies and agricultural practices that are more adaptive and inclusive of environmental and socio-economic changes.

Abstract

Legal protection for medical personnel is a crucial issue in the Indonesian health system, especially since medical personnel are often vulnerable to lawsuits even though they have practised in accordance with professional standards. This study aims to analyse the forms of legal protection for medical personnel as stipulated in Law No. 17 of 2023 on Health and to examine its implementation in health service practice. The research method used is normative juridical with a legislative and conceptual approach, supported by relevant primary and secondary legal materials. The results show that the 2023 Health Law has normatively strengthened protection for medical personnel by emphasising that any medical personnel who act in accordance with professional standards, service standards, and professional codes of ethics cannot be automatically prosecuted. However, the implementation of legal protection in the field still faces serious challenges, including limited derivative regulations, low legal literacy among medical personnel, inconsistent understanding among law enforcement officials, and a lack of advocacy from professional organisations. These conditions result in the legal protection promised by the law often not being felt in practice by medical personnel in the field. Thus, this study concludes that legal protection for medical personnel is strong in terms of norms but weak in terms of implementation. To ensure its effectiveness, concrete steps are needed in the form of drafting more operational derivative regulations, increasing the legal literacy of medical personnel, strengthening the role of professional organisations, and training law enforcement officials on health law. These efforts are expected to create a more fair, balanced, and effective legal protection mechanism, enabling medical personnel to perform their professional duties safely and ensuring the public continues to receive quality healthcare services.

Abstract

Safe and quality healthcare is a human right that must be guaranteed by the state. Law No. 17 of 2023 on Health serves as a regulation that strengthens the guarantee of patients' rights and safety in the healthcare system in Indonesia. This study aims to analyse the legal protection of patients' rights and safety guarantees as regulated in the 2023 Health Law. Using a normative juridical research method through a legislative and conceptual approach, this study found that patients' rights are protected more comprehensively, including the right to medical information, consent to medical treatment, confidentiality of medical records, emergency services, safe medicines, and dispute resolution mechanisms. On the other hand, the concept of patient safety is strengthened through the obligation of health facility accreditation, the application of quality standards, incident reporting systems, drug and health technology supervision, and the obligation of health worker competence. The legal protection provided by the 2023 Health Law is both preventive and repressive, while placing patient safety as the main indicator of quality medical services. Thus, this law serves as a strategic legal foundation for building a national health system that is more equitable, safe, and oriented towards human dignity.

Abstract

This study aims to examine the impact of educational decentralisation on the implementation of democratic principles in schools, highlighting the interaction between the central government, local governments, and the community. The method used is a literature study through descriptive-critical analysis of academic literature, legislation, and previous research related to educational governance and school democratisation. The results of the study show that decentralisation provides a great opportunity to strengthen democracy in schools through increased participation of teachers, students, parents, and the community; transparency and accountability in management; and more collaborative school leadership. In this context, schools can function as laboratories of democracy that foster the values of participation, equality, tolerance, and respect for differences. However, this study also emphasises that decentralisation has the potential to create new problems, including overlapping authority between the central and regional governments, unequal capacity between regions, and community participation that is often formalistic in nature. Non-synergistic interactions between the central government, regional governments, and the community can lead to policy fragmentation and widen the gap in the practice of school democratisation. Thus, the democratisation of education in Indonesia can only be realised if decentralisation is supported by effective institutional coordination, capacity building in the regions, and the empowerment of the community as active partners in education.

Abstract

This study examines tax policies in Indonesia's financial services sector and their implications for tax compliance and industry growth. The financial services sector, which includes banking, insurance, capital markets, and fintech, plays an important role in the national economy, so effective taxation policies are needed to support the industry's sustainability and competitiveness. Through a literature review approach, this study analyses various applicable tax regulations, implementation challenges, and the impact of these policies on taxpayer compliance behaviour and business growth dynamics. The results of the study show that transparent, fair tax policies accompanied by incentives can increase tax compliance and encourage innovation and expansion in the financial services industry. Conversely, regulatory complexity and high administrative burdens can reduce compliance rates and hamper sector growth. This study recommends the continuous evaluation and refinement of tax policies with the involvement of stakeholders to create a healthy taxation ecosystem that optimally supports the development of Indonesia's financial services industry.

Abstract

Affection is the main basic component in the education process and the formation of children's character or morals. Parents who always educate their children with love and affection will make the learning atmosphere in the household very pleasant for children. Children never get bored to absorb every lesson given. Because there is no better way to captivate a child's heart and win his trust than to develop a sense of love and affection by his parents. With love and affection the atmosphere of the house will be a very pleasant place for children and all residents. So that the house becomes a place to live and gather all joy, peace and politeness. A house filled with rays of love and affection will be a place where honesty and all the qualities of goodness and happiness reside. The importance of parental love for children requires maximum effort from both parents in giving these expressions of affection to children, so the role of parents is very necessary in educating children at a young age.

Abstract

Pentavalent immunisation was carried out simultaneously in Indonesia in February 2014 in West Java, the immunisation coverage until July was above the average target. Immunisation of DPT-HB-Hib 1 from the target coverage of 57.2% turned out to be 59.3%, DPT-HB-Hib 2 from the target of 55.4% the coverage was 57.9%, DPT-HB-Hib 3 from the target of 52.5% through July coverage was more than 57.8%. This study used an analytical survey with a cross sectional approach carried out in April 2018. The sample of this study was 50 mothers who had babies aged 2-4 months. Data analysis was performed using Chi-Square. The results showed that there was a correlation between knowledge (p = 0.035), attitude (p= 0.039) and Health Officer Support (p= 0.034) with the provision of Pentavalent Immunization in Kapuas Kanan Hulu Village in the Work Area of Puskesmas Sungai Durian Sintang. The health care can focus more on providing information about Pentavalent Immunisation and fostering the desire of the community to immunise their babies by motivating people to maintain the health and development of their children.
