Abstract

Prinsip first to file dijadikan dasar pemberian hak eksklusif atas merek di Indonesia sehingga perlindungan diberikan kepada pihak yang lebih dahulu melakukan pendaftaran. Seiring berkembangnya ekonomi digital berbagai persoalan seperti trademark squatting dan pendaftaran merek beritikad tidak baik semakin banyak ditemukan sehingga keadilan substantif belum sepenuhnya dapat diwujudkan. Melalui penelitian ini penerapan prinsip first to file dianalisis serta relevansi Teori Hukum Responsif Nonet dan Selznick dikaji sebagai dasar rekonstruksi penerapannya pada era disrupsi digital.  Metode yuridis normatif digunakan dengan pendekatan perundang undangan konseptual dan studi kasus sengketa merek Arc'teryx . Hasil penelitian menunjukkan bahwa prinsip first to file masih dipertahankan sebagai instrumen kepastian hukum namun penguatan pemeriksaan itikad baik pengakuan terhadap hak pemakai pertama dan merek terkenal percepatan pembatalan pendaftaran beritikad tidak baik serta penafsiran yang lebih responsif masih perlu dilakukan.

Abstract

Law Number 17 of 2014 on the MPR, DPR, DPD, and DPRD (Law on MD3), particularly Articles 327 and 376, stipulated that the leadership of provincial and regency/municipal Regional House of Representatives (DPRD) was drawn from the political party with the highest number of seats, rather than from the individual legislative candidate who obtained the highest number of votes. This provision stood in contrast to the principle governing the determination of elected DPRD members under Article 422 of Law Number 7 of 2017 on General Elections, which based individual electability on the highest number of votes obtained within an electoral district. This article examined this normative inconsistency and its implications for legal certainty and the quality of local democracy, focusing on two problems: first, the shift of DPRD leadership legitimacy from voters' will to the decisions of political party elites; second, the disparity in institutional support, including the recess-activity budget, between members who obtained the highest votes without holding leadership positions and those who held leadership positions through the party-seat mechanism, even though both bore an equally significant burden of constituent representation. Employing normative legal research through statutory and conceptual approaches, the article concluded that norm harmonization and a reconfiguration of the criteria for electing DPRD leadership were needed to align the mechanism with the principle of voter sovereignty and the proportionality of constituent representation.

Abstract

Protected forests perform a strategic ecological function by regulating water systems, preventing erosion and floods, reducing landslide risks, and maintaining soil fertility. Their conversion into plantation areas therefore raises legal, environmental, and socio-economic concerns. This study examines the implementation of Government Regulation No. 23 of 2021 concerning Forestry Administration in the conversion of protected forests into plantation areas in Tonra District, Bone Regency. It addresses two questions: how the conversion mechanism is implemented under the regulation, and what impacts arise together with the measures undertaken by the local government. The study employed qualitative socio-legal research combining the analysis of statutory provisions with field observations, semi-structured interviews, and documentation. The fieldwork focused on Rappa Village and involved information from the village head and a forestry extension officer of the Ulubilah Forest Management Unit. The findings show that conversion is legally expected to proceed through layered administrative and technical stages, beginning with local proposals and spatial-planning review and ending with central-government approval. In practice, implementation remains suboptimal because regulatory requirements collide with community economic needs, supervision is limited, institutional authority is fragmented, and human resources are insufficient. Conversion has contributed to soil and water degradation, short-term income gains accompanied by the loss of traditional forest-based income, and declining forest-based social interaction. Government responses include law enforcement, inter-agency patrols, rehabilitation, reforestation, and community involvement, but limited funding, personnel, and public awareness constrain their effectiveness.

Abstract

Perkembangan kecerdasan buatan (Artificial Intelligence/AI) telah membawa perubahan yang signifikan terhadap sistem hukum di Indonesia sekaligus memperlihatkan keterbatasan konsep legal pluralism dalam menghadapi keberagaman sistem hukum. AI yang dikembangkan berdasarkan data dan logika algoritma cenderung mengakomodasi hukum formal, sementara hukum adat sebagai living law sering kali tidak terdokumentasi secara memadai. Artikel ini bertujuan mereformulasikan legal pluralism sebagai kerangka normatif yang lebih adaptif dalam merespons relativitas dan fragmentasi hukum akibat penerapan AI serta implikasinya terhadap eksistensi hukum adat. Penelitian menggunakan metode yuridis normatif dengan pendekatan konseptual dan komparatif melalui analisis peraturan perundang-undangan, teori hukum, dan dua studi kasus di Indonesia yaitu verifikasi klaim hutan adat di Gunung Lumut, Kalimantan Timur, dan pemetaan wilayah adat masyarakat Dayak Ngaju di Kalimantan Tengah. Hasil penelitian menunjukkan bahwa AI berpotensi memperkuat marginalisasi hukum adat apabila tidak diimbangi regulasi yang inklusif. Oleh karena itu, legal pluralism perlu direformulasikan sebagai landasan operasional yang mengintegrasikan hukum adat ke dalam tata kelola dan regulasi AI nasional guna menjamin perlindungan hak masyarakat hukum adat

Abstract

This article analyzes the intersection of criminal law policy and human rights protection in Indonesia, focusing on the rationalization of the New Criminal Code (Law No. 1 of 2023) and the urgency of reforming the Criminal Procedure Code (KUHAP). Using a normative legal method with statute, conceptual, and case approaches, the study evaluates the shift from a retributive paradigm to restorative and rehabilitative justice. Despite normative progress aimed at preventing degrading punishments and introducing sentencing alternatives, empirical realities reveal persistent anomalies. By examining concrete cases of wrongful arrest and trial by press outside the context of narcotics offenses, this paper demonstrates the enduring dominance of a repressive crime control model among law enforcement apparatuses. The research concludes that substantive human rights protection requires both the legislative institutionalization of a Preliminary Examining Judge (Hakim Pemeriksa Pendahuluan) to oversee coercive measures and a radical cultural transformation within law enforcement agencies.

Abstract

Maritime transport is central to Indonesia's logistics system, but shipboard operations expose passengers, crews, cargo, and the marine environment to substantial safety risks. This article examines the ship master's legal responsibility for navigational safety under Law Number 17 of 2008 on Shipping, as amended, and identifies the forms of liability that may arise when safety duties are breached. It applies normative legal research using statutory and conceptual approaches. Primary legal materials include the Shipping Law, the Indonesian Civil Code, and relevant international maritime instruments, particularly SOLAS and STCW, while secondary materials comprise maritime-law scholarship and earlier studies. The analysis finds that the ship master's authority is inseparable from a personal duty to verify seaworthiness, adequate crewing, navigational and communication equipment, safety appliances, cargo conditions, weather information, and operational readiness before departure and throughout the voyage. A breach may generate administrative sanctions, civil liability, or criminal responsibility, depending on the violated norm, the existence of fault, causation, and the resulting harm. These regimes may operate concurrently, although personal liability must be distinguished from the responsibilities of the shipowner or shipping company. Effective enforcement therefore requires a fact-sensitive attribution of fault rather than an automatic assignment of every maritime casualty to the ship master

Abstract

Why do countries with recorded serious interpersonal violence display markedly different shares of lethal outcomes? This study introduces the Lethal Escalation Index (LEI), calculated as intentional homicide divided by the sum of intentional homicide and police-recorded serious assault. LEI is an ecological measure of the lethal composition of recorded violence, not the probability that an individual assault becomes homicide. UNODC counts for 2016-2018 were linked to civilian firearm estimates, alcohol consumption, current health expenditure per capita, and government effectiveness. The complete-case sample comprises 88 countries. Fractional logistic regression with heteroskedasticity-robust standard errors assesses the associations, supplemented by temporal-coverage sensitivity tests. Recorded LEI ranges from 0.19% to 86.44%, with a median of 9.27%. Government effectiveness is associated with a substantially lower lethal share in the fully adjusted model; firearm prevalence, alcohol volume, and health expenditure are not independently distinguishable from zero. Health expenditure is negative before government effectiveness enters, but their strong correlation prevents clean separation. The findings support treating homicide as an outcome of lethalization while demonstrating that administrative visibility remains inseparable from cross-national comparisons of serious violence.

Abstract

This article examined the transformation of legal truth in the age of Artificial Intelligence, particularly when synthetic images, voices, texts, and digital representations increasingly blurred the distinction between factual reality and simulation. The central problem arose when legal processes continued to rely on evidence as a representation of events, while Artificial Intelligence enabled the creation of convincing representations without an underlying factual occurrence. The study employed normative legal research combined with philosophical and conceptual approaches to analyze hyperreality, legal truth, and evidentiary authenticity. The study found that the traditional orientation toward truth verification was no longer sufficient to address artificially generated realities. Legal truth therefore required an additional stage of reality authentication to determine whether the represented event, identity, object, or communication had genuinely existed before its evidentiary value was assessed. The article proposed a reconstruction of legal truth through the principle of juridical reality authentication. It concluded that contemporary law needed to distinguish between factual reality, representation, and synthetic simulation before constructing legally valid truth.

Abstract

This article examined traffic police corruption in South Africa through a multi-theoretical framework. It drew together the Theory of Reasoned Action, the Theory of Planned Behaviour, behavioural intention, control and social control perspectives, and General Systems Theory to explain why corrupt practices cannot be reduced to individual choice alone. The analysis indicated that behavioural intentions interact with workplace culture, peer solidarity, the code of silence, weak or inconsistent sanctions, managerial control, and wider organisational systems. It also showed that single-theory explanations leave important features of traffic-policing environments unexplained. The article therefore developed an integrated framework in which individual dispositions, social pressures, accountability mechanisms, feedback, and institutional conditions are treated as interconnected influences. It concluded that effective anti-corruption responses require both behavioural and systemic interventions, including credible sanctions, protected reporting channels, managerial accountability, and attention to both bribe takers and bribe givers.

Abstract

Penelitian ini menganalisis rekonstruksi tanggung jawab negara atas hak kesehatan reproduksi perempuan setelah reformasi hukum kesehatan Indonesia. Penelitian hukum normatif ini menggunakan pendekatan perundang-undangan, konseptual, dan gender-responsif dengan menelaah hukum nasional serta standar hak asasi manusia internasional. Hasil penelitian menunjukkan bahwa pembaruan melalui Undang-Undang Nomor 17 Tahun 2023, Peraturan Pemerintah Nomor 28 Tahun 2024, dan Undang-Undang Nomor 4 Tahun 2024 telah memperkuat dasar normatif kesehatan reproduksi, tetapi belum cukup apabila tanggung jawab negara hanya dibaca sebagai pengakuan hak. Penelitian ini menemukan bahwa kewajiban menghormati, melindungi, dan memenuhi perlu diuji secara silang melalui empat unsur Availability, Accessibility, Acceptability, dan Quality (AAAQ). Matriks tersebut memperjelas tanggung jawab atas otonomi perempuan, pengawasan penyedia layanan, akses tanpa diskriminasi, informasi, pemerataan, dan mutu pelayanan. Rekonstruksi yang ditawarkan menggeser fokus dari inventarisasi hak menuju akuntabilitas negara yang dapat diuji secara normatif.
