Abstract

The COVID-19 pandemic has had a significant impact on the mental health of people worldwide, including in Indonesia. This article aims to explore and examine the relationship between the COVID-19 pandemic and the legal policies governing mental health in Indonesia. Using a qualitative approach through literature review and legislation, this article highlights the main challenges in the implementation of mental health law during the pandemic, such as social stigma, limited access to mental health services, and a lack of resources. In addition, the opportunity for integrating community-based mental health services was also discussed as a reform step. Through this analysis, it is hoped that solutions can be found to strengthen the legal framework that supports mental health more effectively, including recommendations for policy improvements and implementation strategies for the future. Research findings indicate that policy reform and improved accessibility to mental health services are crucial steps for enhancing the mental well-being of the community during the pandemic.

Abstract

The death penalty for corruptors in Indonesia is a controversial topic that has sparked debates among the public. Proponents argue that it serves as a deterrent for those engaging in corrupt practices, while opponents believe that it goes against human rights and does not address the root causes of corruption. As the government continues to grapple with this issue, the effectiveness and ethical implications of implementing such a severe punishment remain under scrutiny. While some argue that the death penalty is necessary to send a strong message against corruption, others believe that it is a violation of basic human rights. Additionally, many question whether the death penalty actually addresses the systemic issues that allow corruption to thrive in the first place. As the debate continues, it is crucial for policymakers to consider all perspectives and weigh the potential consequences of implementing such a drastic measure. Ultimately, finding a balance between justice and human rights is paramount in addressing corruption in Indonesia.

Abstract

In this digital age, interactions between patients and doctors are increasingly moving to social media platforms, which can have a significant impact on the accessibility and affordability of healthcare services. However, it is important to note that when medical consultations take place online, new legal challenges arise in terms of information confidentiality, professional responsibility, and patient protection. This journal addresses the issue of legal protection for patients who communicate with doctors via social media. This study examines the legal framework governing online medical consultations, including patient privacy rights, doctors' professional ethics, and legal accountability. The emphasis is on identifying potential legal gaps and developing solutions to improve legal protection for patients in this context. This journal's approach aims to contribute to the development of appropriate and convincing regulations to address legal issues that arise as communication technology advances.

Abstract

Asset recovery from corruption in Indonesia presents a significant challenge for the legal system.(Ariawan, IGK (2008). Stolen Asset Recovery Initiative: A Hope in Returning State Assets. Kertha Patrika Journal, 33(1). Corruption not only undermines national finances but also threatens social and economic stability. In this context, the implementation of the reversal of the burden of proof and in rem asset forfeiture models is crucial for optimizing asset recovery. The reversal of the burden of proof shifts the responsibility to the perpetrators to demonstrate that the assets they hold are not derived from criminal activities. Meanwhile, in rem asset forfeiture allows the state to seize assets suspected of being the result of a crime without having to wait for a final legal ruling against the perpetrator. This approach provides an opportunity for the state to recover lost assets, even if the perpetrator cannot be conventionally punished. Through normative legal research, it is essential to explore the application of these two approaches within the Indonesian legal system. By analyzing various mechanisms and case studies, ways to accelerate the recovery of state losses can be identified. The findings indicate that the integration of the reversal of the burden of proof and in rem asset forfeiture can serve as an effective solution. This approach not only enhances the legal capacity for asset seizure but also delivers the necessary deterrent effects to reduce corrupt practices. Therefore, implementing these two models is vital to strengthening anti-corruption efforts in Indonesia.

Abstract

The research demonstrates that mediation respecting customary traditions is more effective than formal legal approaches that disregard the socio-cultural context.( Miller et al.” Supervising Minorities—Respecting Individual and Cultural Differences”, Effective Police Supervision – 2020). This highlights the significance of the multisentric law approach, where legal processes must be open to social and cultural norms to achieve more satisfactory outcomes for the community. In the context of digital humanities, technology can be leveraged to support dispute resolution through digital mapping and more detailed analysis of cultural data. The use of digital mapping to visually document customary land claims can help clarify conflicts and improve accuracy in the mediation process.( Pratiwi & Juerges, “Digital advocacy at the science-policy interface: Resolving land-use conflicts in conservation forests”, Land Use Policy – 2022). Integrating digital technology with legal and cultural approaches would result in a more comprehensive and inclusive resolution, as shown by the study's findings (with over 70% of respondents satisfied with mediation based on customary practices). The interdisciplinary approach combining digital humanities and multisentric law creates a land dispute resolution process that is more relevant to the socio-cultural context of the local community. Abstract

Kasus impor limbah bahan berbahaya dan beracun (B3) secara ilegal oleh PT Esun International Utama Indonesia di Batam menjadi contoh krusial penegakan hukum lingkungan di Indonesia. Penelitian ini bertujuan menganalisis aspek hukum larangan impor limbah B3, mengkaji tindakan penegakan hukum oleh Kementerian Lingkungan Hidup, dan mengevaluasi efektivitas regulasi yang ada. Menggunakan metode penelitian yuridis normatif dengan pendekatan studi kasus, penelitian ini mengungkapkan bahwa tindakan PT Esun melanggar UU No. 32 Tahun 2009, Perpres No. 47 Tahun 2005 tentang ratifikasi Konvensi Basel, dan prinsip hukum internasional. Temuan menunjukkan bahwa sanksi administratif yang dikombinasikan dengan penuntutan pidana diperlukan untuk memberikan efek jera. Kasus ini menekankan pentingnya penguatan pengawasan, koordinasi antar lembaga, dan komitmen terhadap konvensi internasional untuk melindungi kedaulatan lingkungan Indonesia.

Abstract

Local governments in Nigeria are often described as the closest tier to the people, yet many of them struggle to meet even basic developmental expectations. In Anambra State, this struggle is shaped largely by how revenue is raised, who controls it, and how much freedom councils actually have to make financial decisions. The study used a descriptive survey design to examine revenue generation across six local governments in Anambra State, covering Awka North, Idemili North, Aguata, Nnewi North, Anambra East, and Onitsha North. A projected population of 1,919,000 served as the study population. Using the Taro Yamane formula at a 5 percent margin of error, a sample size of 400 was determined and proportionally distributed across the LGAs. Data were collected through a validated and reliable structured questionnaire, supported by secondary sources. Analysis employed descriptive statistics and multiple regression using SPSS 20 at a 5 percent significance level to test hypotheses and identify revenue generation patterns. The gender distribution showed more female respondents [210; 58 percent] than males [153; 42 percent]. Analysis of five infrastructure indicators revealed generally low implementation levels. Palliatives on feeder roads scored low extent [33.5 percent], agro-allied implements also low [24.9 percent], and borehole water moderate [40.3 percent]. Primary healthcare outreach recorded moderate extent [28.4 percent], while environmental sanitation showed very low extent [42.5 percent]. Respondents rated infrastructure provision as low [46.16 percent], moderate [20.54 percent], and high [33.30 percent]. Hypothesis testing showed a significant negative relationship between lack of autonomy and infrastructure provision [t=1.628; p=0.002], leading to rejection of the null hypothesis. The study concludes that strengthening local government autonomy is not merely a reform proposal; it is essential for improving revenue performance and enabling more responsive, development-oriented administration at the grassroots.

Abstract

Studi ini membahas peran sektor pariwisata dalam menghadapi krisis ekonomi di Sri Lanka, dengan fokus pada konflik internal selama tiga dekade serta dampak aksi teror Minggu Paskah 2019. Penelitian menggunakan pendekatan kualitatif berbasis studi kasus dan teori soft power untuk menganalisis bagaimana pariwisata berfungsi sebagai katalis pemulihan ekonomi. Temuan menunjukkan bahwa meskipun Sri Lanka mengalami penurunan drastis akibat perang saudara, aksi teror, pandemi COVID-19, dan ketidakstabilan politik, sektor pariwisata tetap menjadi salah satu pilar utama dalam menciptakan devisa, lapangan kerja, dan menarik investasi asing. Namun, keberhasilan pemulihan pariwisata bergantung pada stabilitas politik, modernisasi infrastruktur, promosi internasional yang efektif, serta penerapan konsep pariwisata berkelanjutan. Kesimpulannya, pariwisata tidak hanya berperan dalam pemulihan ekonomi jangka pendek, tetapi juga dalam mendukung pembangunan sosial dan keberlanjutan jangka panjang di Sri Lanka.

Abstract

Etika pemerintahan dan tanggung jawab hukum dalam administrasi publik menjadi isu penting dalam mewujudkan tata kelola pemerintahan yang baik dan meningkatkan kepercayaan masyarakat. Penelitian ini bertujuan untuk menganalisis peran prinsip etika dalam penyelenggaraan pemerintahan, mengkaji bentuk tanggung jawab hukum aparatur publik, serta mengevaluasi hubungan antara pelanggaran etika dan akuntabilitas hukum dalam praktik pelayanan publik. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan konseptual dan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa etika pemerintahan merupakan landasan utama bagi tindakan administrasi yang sah secara hukum. Temuan juga mengungkapkan bahwa pelanggaran etika, meskipun tidak selalu termasuk pelanggaran hukum, sering kali memicu terjadinya maladministrasi dan berpotensi menimbulkan tanggung jawab hukum, baik administratif, perdata, maupun pidana. Oleh karena itu, penguatan standar etika, kepatuhan hukum, dan mekanisme akuntabilitas menjadi kunci dalam menciptakan administrasi publik yang transparan, berintegritas, dan profesional.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh penetrasi pasar dan aturan hukum terhadap daya saing produk legal, serta menguji peran aturan hukum sebagai variabel moderasi antara penetrasi pasar dan daya saing. Pendekatan kuantitatif digunakan dengan pengumpulan data melalui kuesioner yang disebarkan kepada konsumen, distributor, dan pelaku usaha yang terlibat dalam pasar produk legal. Analisis data dilakukan menggunakan PLS untuk menguji hubungan langsung dan moderasi antarvariabel. Hasil penelitian menunjukkan bahwa penetrasi pasar dan aturan hukum secara signifikan berpengaruh positif dan signifikan terhadap daya saing produk legal, sementara pengaruh moderasi aturan hukum terhadap hubungan penetrasi pasar dan daya saing tidak signifikan. Temuan ini menekankan pentingnya strategi penetrasi pasar dan kepatuhan terhadap regulasi hukum secara independen untuk meningkatkan daya saing produk legal di pasar yang kompetitif.
